<official-title>To amend the Family and Medical Leave Act of 1993 and title 5, United States Code, to provide entitlement to leave to eligible employees whose spouse, son, daughter, or parent is a member of the Armed Forces who is serving on active duty in support of a contingency operation or who is notified of an impending call or order to active duty in support of a contingency operation, and for other purposes.</official-title>

<section section-type="section-one" id="H1CEEEC50E55B437F97473F4B7569954E" display-inline="no-display-inline"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Military Families Leave Act of 2005</short-title></quote>.</text></section> 
<section id="H5195A45070BD4CEFA8DA97AA8064327B"><enum>2.</enum><header>Leave for military families under the Family and Medical Leave Act of 1993</header> 
<subsection id="H64832EC3923A41EE8D4017ED0017E4E9"><enum>(a)</enum><header>Entitlement to leave</header><text>Section 102(a)(1) of the Family and Medical Leave Act of 1993 (<external-xref legal-doc="usc" parsable-cite="usc/29/2612">29 U.S.C. 2612(a)(1)</external-xref>) is amended by adding at the end the following new subparagraph:</text>

<subparagraph id="H5EC4C38F452A4F968786CBB2F0141805"><enum>(E)</enum><text>Because of any qualifying exigency (as the Secretary shall, by regulation, determine) arising out of the fact that the spouse, or a son, daughter, or parent of the employee is on active duty (or has been notified of an impending call or order to active duty) in the Armed Forces in support of a contingency operation.</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection> 
<subsection id="HE58D079484FC4D3191034DE5B00608A1"><enum>(b)</enum><header>Intermittent or reduced leave schedule</header><text>Section 102(b)(1) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/29/2612">29 U.S.C. 2612(b)(1)</external-xref>) is amended by inserting after the second sentence the following new sentence: <quote>Subject to subsection (e)(3) and section 103(f), leave under subsection (a)(1)(E) may be taken intermittently or on a reduced leave schedule.</quote>.</text></subsection> 
<subsection id="H77C59308400C475EAE9E68C225A6DBB2"><enum>(c)</enum><header>Substitution of paid leave</header><text>Section 102(d)(2)(A) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/29/2612">29 U.S.C. 2612(d)(2)(A)</external-xref>) is amended by striking <quote>or (C)</quote> and inserting <quote>(C), or (E)</quote>.</text></subsection> 
<subsection id="H32B276E467744656B057E887004B77E0"><enum>(d)</enum><header>Notice</header><text>Section 102(e) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/29/2612">29 U.S.C. 2612(e)</external-xref>) is amended by adding at the end the following new paragraph:</text>

<paragraph id="H1E4352C9436B4D94A14885FDF2008442"><enum>(3)</enum><header>Notice for leave due to active duty of family member</header><text>In any case in which the necessity for leave under subsection (a)(1)(E) is foreseeable based on notification of an impending call or order to active duty in support of a contingency operation, the employee shall provide such notice to the employer as is reasonable and practicable.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection> 
<subsection id="HD196B5C0A41D47BEB818397485AA4CE3"><enum>(e)</enum><header>Certification</header><text>Section 103 of such Act (<external-xref legal-doc="usc" parsable-cite="usc/29/2613">29 U.S.C. 2613</external-xref>) is amended by adding at the end the following new subsection:</text>

<subsection id="HD72BA273770E48B5BB36D539FF896C98"><enum>(f)</enum><header>Certification for leave due to active duty of family member</header><text>An employer may require that a request for leave under section 102(a)(1)(E) be supported by a certification issued at such time and in such manner as the Secretary may by regulation prescribe. If the Secretary issues a regulation requiring such certification, the employee shall provide, in a timely manner, a copy of such certification to the employer.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection> 
<subsection id="H39A7B181129B462BBA855D9985091448"><enum>(f)</enum><header>Definition</header><text>Section 101 of such Act (<external-xref legal-doc="usc" parsable-cite="usc/29/2611">29 U.S.C. 2611</external-xref>) is amended by adding at the end the following new paragraph:</text>

<paragraph id="H51991820FD9D4D49AF83D8A0CEEF7CFA"><enum>(14)</enum><header>Contingency operation</header><text>The term <term>contingency operation</term> has the same meaning given such term in <external-xref legal-doc="usc" parsable-cite="usc/10/101">section 101(a)(13)</external-xref> of title 10, United States Code.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection></section>

<subsection id="HAD09D1EDA63D404D9EAC1CCAA56DBE8E"><enum>(a)</enum><header>Entitlement to leave</header><text><external-xref legal-doc="usc" parsable-cite="usc/5/6382">Section 6382(a)(1)</external-xref> of title 5, United States Code, is amended by adding at the end the following new subparagraph:</text>

<subparagraph indent="up1" id="H403F7CF927E54C028BC9A734987FBB5"><enum>(E)</enum><text>Because of any qualifying exigency (as defined pursuant to section 6387) arising out of the fact that the spouse, or a son, daughter, or parent, of the employee is on active duty (or has been notified of an impending call or order to active duty) in the Armed Forces in support of a contingency operation.</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection> 
<subsection id="H0AC1DF0461F042D385CFBF0760C9F527"><enum>(b)</enum><header>Intermittent or reduced leave schedule</header><text>Section 6382(b)(1) of such title is amended by inserting after the second sentence the following new sentence: <quote>Subject to subsection (e)(3) and section 6383(f), leave under subsection (a)(1)(E) may be taken intermittently or on a reduced leave schedule.</quote>.</text></subsection> 
<subsection id="H0E8DB91FE1CE458991001D2D00DAA8BC"><enum>(c)</enum><header>Substitution of paid leave</header><text>Section 6382(d) of such title is amended by striking <quote>or (D)</quote> and inserting <quote>(D), or (E)</quote>.</text></subsection> 
<subsection id="HEF6C12E259CA44B9BD58EFE500D48C89"><enum>(d)</enum><header>Notice</header><text>Section 6382(e) of such title is amended by adding at the end the following new paragraph:</text>

<subsection id="H427BA6BDE7004EABA2E6CFC985CBACFE"><enum>(e)</enum><header>Certification</header><text>Section 6383 of such title is amended by adding at the end the following new subsection:</text>

<subsection id="H83B17CDE8DC048DA8B1F91CD6BA47FE5"><enum>(f)</enum><text>An employing agency may require that a request for leave under section 6382(a)(1)(E) be supported by a certification issued at such time and in such manner as the employing agency may require.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection>

<paragraph id="HA264C0D571934D118300CC81684BD705"><enum>(1)</enum><text>in paragraph (5)(B), by striking <quote>and</quote> at the end;</text></paragraph> 
<paragraph id="HEFEE4E0E0E8543B2873E69415FE83BD9"><enum>(2)</enum><text>in paragraph (6)(B), by striking the period at the end and inserting <quote>; and</quote>; and</text></paragraph> 
<paragraph id="H1F5C97400C554BBEAF1F898D01C8CD84"><enum>(3)</enum><text>by adding at the end the following new paragraph:</text>
