<official-title>To amend title 10, United States Code, to provide a temporary five-year increase in the minimum end-strength levels for active-duty personnel for the Armed Forces, to increase the number of Special Operations Forces, and for other purposes.</official-title>

<section section-type="section-one" id="H835BE4E4219140A9AFE63579BDB5D6B" display-inline="no-display-inline"><enum>1.</enum><header>Temporary increase in minimum active-duty end-strength levels and Special Operations Forces strengths for the Armed Forces</header> 
<subsection id="HCBBC0E1A783949B18C1BFA27716B5241"><enum>(a)</enum><header>Minimum active-duty strength levels</header><text><external-xref legal-doc="usc" parsable-cite="usc/10/691">Section 691</external-xref> of title 10, United States Code, is amended by inserting after subsection (d) the following new subsection:</text>

<subsection id="HD182E7E7EEA44D33B61C489E765BF8BB"><enum>(e)</enum><text>For each of fiscal years 2006 through 2010, the numbers in effect for purposes of subsection (b) shall be the following, which shall be treated as the strengths specified in that subsection for purposes of subsections (c) and (d):</text> 
<paragraph id="HFE1C21C0517D44439F00EDA56808B5F7"><enum>(1)</enum><text>For the Army, 532,400.</text></paragraph> 
<paragraph id="HF1286AAA5C1A44FBA5D60491103FF413" display-inline="no-display-inline"><enum>(2)</enum><text display-inline="yes-display-inline">For the Navy, 367,900.</text></paragraph> 
<paragraph id="HA4253D04E625494DB35E1EFBD4E77EA5"><enum>(3)</enum><text>For the Marine Corps, 190,000.</text></paragraph> 
<paragraph id="H62D2732FF8EC4F8486D70077013189A6"><enum>(4)</enum><text display-inline="yes-display-inline">For the Air Force, 360,700.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection> 
<subsection id="H322B82F6195A4779B2F068F7CCB3E228"><enum>(b)</enum><header>Special Operations Forces</header><text>Such section is further amended by adding at the end the following new subsection:</text>

<subsection id="HA707FF434DC64F29B7AB3C63AEA832E1"><enum>(g)</enum> 
<paragraph id="H6C0A97B88F464BE09733AE003C805400" display-inline="yes-display-inline"><enum>(1)</enum><text display-inline="yes-display-inline">The Secretary of Defense shall manage the selection, training, and retention of Special Operations Forces personnel so that as of September 30, 2010, the total number of such personnel is not less than the number equal to the baseline number plus 10,000. The Secretary shall ensure that, of the increase in Special Operations Forces personnel required by the preceding sentence—</text> 
<subparagraph id="H6618072B8FDF43ABBF4258ACAB93604D" indent="up1"><enum>(A)</enum><text display-inline="yes-display-inline">not less than 6,000 shall be in Army Special Operations Forces personnel;</text></subparagraph> 
<subparagraph id="H2A5821ACC689447BB164BD176C51A7DF" indent="up1" display-inline="no-display-inline"><enum>(B)</enum><text>not less than 2,000 shall be in Navy Special Operations Forces personnel; and</text></subparagraph> 
<subparagraph id="HB8EBF841B65F4DCBA522BDCDF66C35B6" indent="up1"><enum>(C)</enum><text>not less than 2,000 shall be in Air Force Special Operations Forces personnel.</text></subparagraph> </paragraph> 
<paragraph id="HDB4731D3295E4D55828EAC391222EB3" indent="up1"><enum>(2)</enum><text display-inline="yes-display-inline">In order to accomplish the implementation of the increase in the total number of Special Operations Forces personnel required by paragraph (1), the Secretary shall manage Special Operations Forces personnel so that—</text> 
<subparagraph id="H5924BDBC21ED4565B511D8890046EEAC"><enum>(A)</enum><text>as of September 30, 2006, the total number of such personnel is not less than the number equal to the baseline number plus 2,000;</text></subparagraph> 
<subparagraph id="H100D58FC9A4F42ECA646209878866285"><enum>(B)</enum><text display-inline="yes-display-inline">as of September 30, 2007, the total number of such personnel is not less than the number equal to the baseline number plus 4,000; </text></subparagraph> 
<subparagraph id="H2ED0618E1D1941E0AD8E1C59A36FE446"><enum>(C)</enum><text display-inline="yes-display-inline">as of September 30, 2008, the total number of such personnel is not less than the number equal to the baseline number plus 6,000; and</text></subparagraph> 
<subparagraph id="H2F16502E5E024462A0DEE63F87B8AD30"><enum>(D)</enum><text display-inline="yes-display-inline">as of September 30, 2009, the total number of such personnel is not less than the number equal to the baseline number plus 8,000.</text></subparagraph> </paragraph> 
<paragraph id="H0677179FF9B14B2CACF0604138493B39" indent="up1"><enum>(3)</enum><text>In this subsection:</text> 
<subparagraph id="H26F0558E18F645528BEEA1B854E1306"><enum>(A)</enum><text display-inline="yes-display-inline">The term <quote>Special Operations Forces personnel</quote> means members of the Army, Navy, or Air Force who are qualified and designated as Special Operations Forces personnel.</text></subparagraph> 
<subparagraph id="HE4A25B9FF5184433BCE4C1A2002394E4"><enum>(B)</enum><text display-inline="yes-display-inline">The term <quote>baseline number</quote> means the total number of Special Operations Forces personnel as of September 30, 2004.</text></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection> </section>
