<legis-type>A BILL</legis-type> 
<official-title>To shorten the term of broadcasting licenses under the Communications Act of 1934 from 8 to 3 years, to provide better public access to broadcasters’ public interest issues and programs lists and children’s programming reports, and for other purposes.</official-title>

<section section-type="section-one" id="H9D5FA21315304B16A17B5004E6CC5B31" display-inline="no-display-inline"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Localism in Broadcasting Reform Act of 2005</short-title></quote>.</text></section> 
<section id="H5542DE4344974AA2A06FBD841FE984FA"><enum>2.</enum><header>3-year term for broadcast licenses</header> 
<subsection id="HB418FDE65AAA46C9813D2D46EBA47300"><enum>(a)</enum><header>In general</header><text>Section 307(c)(1) of the <act-name parsable-cite="CA34">Communications Act of 1934</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/47/307">47 U.S.C. 307(c)(1)</external-xref>) is amended by striking <quote>8</quote> each place it appears and inserting <quote>3</quote>.</text></subsection> 
<subsection id="H8212F83D34DE4DE2B873B69DE18F914E"><enum>(b)</enum><header>Existing licenses</header><text>The amendment made by subsection (a) shall apply to licenses granted or renewed after the date of enactment of this Act.</text></subsection></section> 
<section id="H8FDAFB045A2945DD93318C6087BC6891"><enum>3.</enum><header>Full Commission review required for 5 percent of applications</header><text display-inline="no-display-inline">Section 309(a) of the <act-name parsable-cite="CA34">Communications Act of 1934</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/47/309">47 U.S.C. 309(a)</external-xref>) is amended by adding at the end the following: <quote>The determination required by this subsection shall be made by the full Commission en banc in no fewer than 5 percent of the applications filed with it in each calendar year to which section 308 applies.</quote>.</text></section> 
<section id="H430ACE709B6F4C79B36E3F80D551B44B"><enum>4.</enum><header>Issues and programs reports; children’s television reports</header> 
<subsection id="HC22C03B012374F5591E5B080099DA8B3"><enum>(a)</enum><header>In general</header> 
<paragraph id="H2E6F0D8E2633478BBFC53EDAE6BDE810"><enum>(1)</enum><header>Electronic filing</header><text>The Commission shall amend its regulations to require every broadcaster to file, electronically, a copy of its public interest issues and programs list and its children’s programming reports with the Commission, in such form as the Commission may require, within 10 days after the end of each calendar quarter.</text></paragraph> 
<paragraph id="H3DA6D30D05E94E02A26D19F26363BDC"><enum>(2)</enum><header>Waiver</header><text>The Commission may waive or defer compliance with the regulations promulgated in paragraph (1) by a broadcaster in any specific instance for good cause shown where such action would be consistent with the public interest.</text></paragraph></subsection> 
<subsection id="HCEA03670E2454329A5D01B48D8041F31"><enum>(b)</enum><header>Licensee website requirement</header><text>The Commission shall amend its regulations to require every broadcast station for which there is a publicly accessible website on the Internet—</text> 
<paragraph id="HA71F56B21D8A47148FA8CA01D310F9E9"><enum>(1)</enum><text>to make its public interest issues and programs list and its children’s programming reports available to the public on that website; or</text></paragraph> 
<paragraph id="H5B6343AD6DE54417B900AABE677F312B"><enum>(2)</enum><text>to provide a hyperlink on that website to that information on the Commission’s website.</text></paragraph></subsection> 
<subsection id="HF392B60AA4F7499086EBD69616554BE9"><enum>(c)</enum><header>Commission website requirement</header><text>The Commission shall provide access to the public to the public interest issues and programs lists and children’s programming reports filed electronically by broadcasting stations with the Commission.</text></subsection> 
<subsection id="HFE11C820996249DC8D2B3456F1CE4F5C"><enum>(d)</enum><header>Timeframe</header><text>The Commission shall amend its regulations to carry out the requirements of this section not later than 180 days after the date of enactment of this Act.</text></subsection></section> 
<section id="H2456751272A84E03A5A7E0F18384A69E"><enum>5.</enum><header>Standards for broadcast station renewal to include review of licensee’s other stations</header><text display-inline="no-display-inline">Section 309(k)(1) of the <act-name parsable-cite="CA34">Communications Act of 1934</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/47/309">47 U.S.C. 309(k)(1)</external-xref>) is amended—</text> 
<paragraph id="HCFA1610C1EE94F2592CC5C002C9D5807"><enum>(1)</enum><text>by striking <quote>with respect to that station,</quote> and inserting <quote>with respect to that station (and all stations operated by the licensee),</quote>;</text></paragraph> 
<paragraph id="HB572E2622361447798461268BE019514"><enum>(2)</enum><text>by striking <quote>its</quote> and inserting <quote>that station’s</quote>; and</text></paragraph> 
<paragraph id="H49379881319C4F29B949D192CAB775C3"><enum>(3)</enum><text>in subparagraph (A), by striking <quote>the station has</quote> and inserting <quote>the station has, and such other stations have,</quote>.</text></paragraph></section> 
<section id="HFD77B7B6C1B94EFC90B2A255C5A662FB"><enum>6.</enum><header>Party in interest requirement for petitions to oppose the grant or renewal of a license</header><text display-inline="no-display-inline">Section 309(d) of the <act-name parsable-cite="CA34">Communications Act of 1934</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/47/309">47 U.S.C. 309(d)(1)</external-xref>) is amended by adding at the end the following:</text> 
<quoted-block act-name="Communications Act of 1934" id="H615B1992A06C43EC919F24DDF2B770C"> 
<paragraph indent="up1" id="H10A4C3C8BF37442799FC7EEC2C677F69"><enum>(3)</enum><text>For purposes of paragraph (1), the term <term>party in interest</term> includes any individual who—</text> 
<subparagraph id="H18804670A10041B5A7BC5B6419E914D8"><enum>(A)</enum><text>is a listener or viewer of the specific station to which the application relates (determined without regard to such individual’s place of residence);</text></subparagraph> 
<subparagraph id="H280F48B7AF7248969C8E6D38C2AADD0"><enum>(B)</enum><text>asserts an interest in vindicating the general public interest; and</text></subparagraph> 
<subparagraph id="HE3B701424CBD47E7B2861FF2FD91FC30"><enum>(C)</enum><text>makes the specific allegations and showings required by this subsection.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></section> 
<section id="HBE1ED6D2E4CA4659988B4EEDA4C95991"><enum>7.</enum><header>Completion of certain pending proceedings</header> 
<subsection id="HBE20D44F3B344A9AB00000F6263D48FA"><enum>(a)</enum><header>In general</header><text>Not later than 9 months after the date of enactment of this Act, the Commission shall complete action on—</text> 
<paragraph id="H50D709421DDE4E15A3FEA61E4D9E182D"><enum>(1)</enum><text>In the Matter of Standardized and Enhanced Disclosure Requirements for Television Broadcast Licensee Public Interest Obligations, MM Docket No. 00–168; and</text></paragraph> 
<paragraph id="HB4C9184807864C5ABFE9E71E52B108C3"><enum>(2)</enum><text>In the Matter of Public Interest Obligations of Television Broadcast Licensees, MM Docket No. 99–360.</text></paragraph></subsection> 
<subsection id="H60B8A3863CC948B6A7368EEE49D6D707"><enum>(b)</enum><header>Standardized forms for electronically filed reports</header><text>As part of the proceedings described in subsection (a), the Commission shall—</text> 
<paragraph id="H4B8DEC8585D142F782FA7F10AC7D5D64"><enum>(1)</enum><text>give consideration to requiring standardized forms for broadcasters to use in preparing public interest issues and programs lists for electronic filing; and</text></paragraph> 
<paragraph id="H2E9D75DE4F2B4403A33281F5E77BDF52"><enum>(2)</enum><text>if it determines that such standardized forms would be in the public interest, develop and promulgate such forms and require their use by permittees and licensees.</text></paragraph></subsection></section> 
<section id="H1F6ED300B6FD4EE49CDD877D793295A0"><enum>8.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text> 
<paragraph id="HE6CE4DF2493D40B6A3D7A806A1A5FCF0"><enum>(1)</enum><header>Broadcaster</header><text>The term <term>broadcaster</term> means a permittee or licensee of a commercial or non-commercial television or radio broadcast station.</text></paragraph> 
<paragraph id="HC5ADF158A0054EF39259F3BFF4DB5CBE"><enum>(2)</enum><header>Children’s programming reports</header><text>The term <term>children’s programming reports</term> means the information that a broadcaster is required to provide for public inspection by paragraph (e)(11)(iii) of <external-xref legal-doc="regulation" parsable-cite="cfr/47/73.3526">section 73.3526</external-xref> of title 47, Code of Federal Regulations.</text></paragraph> 
<paragraph id="HF0734771FD7A4130913300F9A018FB9"><enum>(3)</enum><header>Commission</header><text>The term <term>Commission</term> means the Federal Communications Commission.</text></paragraph> 
<paragraph id="H6D12AC1EC57340609CDEE86961B705AF"><enum>(4)</enum><header>Public interest issues and programs list</header><text>The term <term>public interest issues and programs list</term> means the information that—</text> 
<subparagraph id="HDD60337EF3F5493FBC1F36B8DB47794B"><enum>(A)</enum><text>a commercial broadcast station is required to provide for public inspection by paragraphs (e)(11)(i) and (12) of <external-xref legal-doc="regulation" parsable-cite="cfr/47/73.3526">section 73.3526</external-xref> of title 47, Code of Federal Regulations; and</text></subparagraph> 
<subparagraph id="H3E36B6247E1E4774BF9BE200BC595E00"><enum>(B)</enum><text>a non-commercial broadcast station is required to provide for public inspection by paragraph (e)(8) of <external-xref legal-doc="regulation" parsable-cite="cfr/47/73.3527">section 73.3527</external-xref> of title 47, Code of Federal Regulations.</text></subparagraph></paragraph></section>
