<official-title>To prohibit Federal agencies from obligating funds for appropriations earmarks included only in congressional reports, and for other purposes.</official-title>

<section id="H320B9F0FA5DB4CDEB560501286A05303" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Obligation of Funds Transparency Act of 2005</short-title></quote>. </text></section> 
<section id="H1C75F7F320A64115BB8E4461B09D00AB"><enum>2.</enum><header>Prohibition on obligation of funds for appropriations earmarks included only in congressional reports</header> 
<subsection id="H0F2E91686FDE4E21A284728426CDAA62"><enum>(a)</enum><header>In general</header><text>No Federal agency may obligate any funds made available in an appropriation Act to implement an earmark that is included in a congressional report accompanying the appropriation Act, unless the earmark is also included in the appropriation Act.</text></subsection> 
<subsection id="H2B52920EC42342C4AF491CDC996D5F71"><enum>(b)</enum><header>Definitions</header><text>For purposes of this section:</text> 
<paragraph id="HB3030A4F1CD34900B503EFEDB213BA88"><enum>(1)</enum><text display-inline="yes-display-inline">The term <quote>assistance</quote> includes a grant, loan, loan guarantee, or contract.</text></paragraph> 
<paragraph id="H026D954A7BD34560B2783436D551F0C2"><enum>(2)</enum><text display-inline="yes-display-inline">The term <quote>congressional report</quote> means a report of the Committee on Appropriations of the House of Representatives or the Senate, or a joint explanatory statement of a committee of conference.</text></paragraph> 
<paragraph id="H4E51EC4B6E0E4248A3161200AC446412"><enum>(3)</enum><text display-inline="yes-display-inline">The term <quote>earmark</quote> means a provision that specifies the identity of an entity to receive assistance and the amount of the assistance. </text></paragraph> 
<paragraph id="HFB6F6002D56E44DD89FD3C3BDE2B5F58"><enum>(4)</enum><text>The term <quote>entity</quote> includes a State or locality, but does not include any Federal agency.</text></paragraph></subsection> 
<subsection id="H64F7AFBBC56346F1A60869D484326800"><enum>(c)</enum><header>Effective date</header><text>This section shall apply to appropriation Acts enacted after December 31, 2005.</text> </subsection></section> 
<section id="H5EB133A78866455B8EF105B25D00AE08"><enum>3.</enum><header>Prohibiting waiver of germaneness requirement for conference reports</header> 
<subsection id="HCC077EEF84AF4DC59593A406AE06A65B"><enum>(a)</enum><header>Prohibiting waiver</header><text>Rule XXII of the Rules of the House of Representatives is amended by adding at the end the following new clause:</text> 
<quoted-block id="H370F5310F52E476B909B00EBF5165D5F" style="OLC"> 
<paragraph id="H9FE11D4B2963450586E081A0E8E0098" indent="up1"><enum>13.</enum> 
<subparagraph id="H1AFE59630D774F57008567A18B4FF8" display-inline="yes-display-inline"><enum>(a)</enum><text>A report by the Committee on Rules on a rule or order that would waive clause 10(a)(1)(A) may not be called up for consideration over the objection of any Member, except when so determined by a vote of three-fifths of the Members voting, a quorum being present.</text></subparagraph> 
<subparagraph id="H661C47E80A4A419C945BB855B6878FDF" indent="up1"><enum>(b)</enum><text>A question of consideration under this clause shall be debatable for 20 minutes equally divided by a proponent of the question and an opponent.</text></subparagraph> 
<subparagraph id="HB3641359E7C54E648CEC0006E6B0D913" indent="up1"><enum>(c)</enum><text>This clause is intended to admit the question of consideration not only in the case of a special rule that explicitly waives clause 10(a)(1)(A) but also in the case of a special rule that waives all (or unspecified) points of order.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection> 
<subsection id="HFAD45A3F8F934BDBA2563DA37C3BC266"><enum>(b)</enum><header>Prohibiting rule waiving restriction</header><text>Clause 6(c) of rule XIII of the Rules of the House of Representatives is amended—</text> 
<paragraph id="HD9325B3D3F5A4DDFB45DF1AD4E528E96"><enum>(1)</enum><text>by striking the period at the end of subparagraph (2) and inserting <quote>; or</quote>; and</text></paragraph> 
<paragraph id="HEF97FE31E6034BCC9DED2EFFBF3761"><enum>(2)</enum><text>by adding at the end the following new subparagraph:</text>

<paragraph id="H38A18987E0764C018F66ED0011ABB481"><enum>(3)</enum><text>a rule or order proposing a waiver of clause 13 of rule XXII.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection></section>
