<subsection id="H4C9F32A938D94F34872C95E2F1AEC798"><enum>(a)</enum><header>Findings</header><text>Congress finds that—</text> 
<paragraph id="HA93349B2CC5741F3A93F34A83726CEF4"><enum>(1)</enum><text>cruise vessels carry millions of passengers each year, and in 2001 carried 8,400,000 passengers in North America;</text></paragraph> 
<paragraph id="HBC80C7D834804EE2B4EAFAD1AE2151E7"><enum>(2)</enum><text>cruise vessels carry passengers to and through the most beautiful ocean areas in the United States and provide many people in the United States ample opportunities to relax and learn about oceans and marine ecosystems;</text></paragraph> 
<paragraph id="H530022055F184AD7AB05001C644205C9"><enum>(3)</enum><text>ocean pollution threatens the beautiful and inspiring oceans and marine wildlife that many cruise vessels intend to present to travelers;</text></paragraph> 
<paragraph id="HC4E0B16B6C51447B00B5D07100BFBF2F"><enum>(4)</enum><text>cruise vessels generate tremendous quantities of pollution, including—</text> 
<subparagraph id="H027AC5B8D7054B5587B37BC07E2BCD00"><enum>(A)</enum><text>sewage (including sewage sludge);</text></subparagraph> 
<subparagraph id="H801F44DCB69E46FCB2FEE3F71754ADF9"><enum>(B)</enum><text>graywater from showers, sinks, laundries, baths, and galleys;</text></subparagraph> 
<subparagraph id="HA3D671DF437E4563BC8D00DB839901D2"><enum>(C)</enum><text>oily water;</text></subparagraph> 
<subparagraph id="HEF2A262FECBA4ABABBA39F0089DAB008"><enum>(D)</enum><text>toxic chemicals from photo processing, dry cleaning, and paints;</text></subparagraph> 
<subparagraph id="HF0D101853E304BFD843C6C9C9D388262"><enum>(E)</enum><text>ballast water;</text></subparagraph> 
<subparagraph id="H8D268845279E4C43A93DDB3DC236F3C3"><enum>(F)</enum><text>solid wastes; and</text></subparagraph> 
<subparagraph id="H9419C62FFD564CED8EE00FA8F90C37F"><enum>(G)</enum><text>emissions of air pollutants;</text></subparagraph></paragraph> 
<paragraph id="H06FDE4F920E84661A618002E1FA58FBB"><enum>(5)</enum><text>some of the pollution generated by cruise ships, particularly sewage discharge, can lead to high levels of nutrients that are known to harm and kill coral reefs and which can increase the quantity of pathogens in the water and heighten the susceptibility of many coral species to scarring and disease;</text></paragraph> 
<paragraph id="HF355247E4486498B8434CCE913FCCA9E"><enum>(6)</enum><text>laws (including regulations) in effect as of the date of enactment of this Act do not provide adequate controls, monitoring, or enforcement of certain discharges from cruise vessels into the waters of the United States; and</text></paragraph> 
<paragraph id="H6DCFC40A46A64C209303A83242F6B700"><enum>(7)</enum><text>to protect coastal and ocean areas of the United States from pollution generated by cruise vessels, new Federal legislation is needed to reduce and better regulate discharges from cruise vessels, and to improve monitoring, reporting, and enforcement of discharges.</text></paragraph></subsection> 
<subsection id="H61152ED56554408A813B462D2E335976"><enum>(b)</enum><header>Purposes</header><text>The purposes of this Act are—</text> 
<paragraph id="H8072077150164DF7816997814FC62888"><enum>(1)</enum><text>to prevent the discharge of any untreated sewage or graywater from a cruise vessel entering ports of the United States into the waters of the United States;</text></paragraph> 
<paragraph id="H87D2DF3C2E154B91A8C340047F91811"><enum>(2)</enum><text>to prevent the discharge of any treated sewage, sewage sludge, graywater, or bilge water from cruise vessels entering ports of the United States into the territorial sea;</text></paragraph> 
<paragraph id="HB264E826BE9444819FA938F6CFED0EC"><enum>(3)</enum><text>to establish new national effluent limits and management standards for the discharge of treated sewage or graywater from cruise vessels entering ports of the United States into the exclusive economic zone of the United States in any case in which the discharge is not within an area in which discharges are prohibited; and</text></paragraph> 
<paragraph id="H6137E363ED4C42A4B4DCF546454C0009"><enum>(4)</enum><text>to ensure that cruise vessels entering ports of the United States comply with all applicable environmental laws.</text></paragraph></subsection></section> 
<section id="H995EB409BA154D478B475B9C7F7FEC25"><enum>3.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text> 
<paragraph id="H04BD67C576E244718D1E189F59C4E4D2"><enum>(1)</enum><header>Commandant</header><text>The term <term>Commandant</term> means the Commandant of the Coast Guard.</text></paragraph> 
<paragraph id="H806717A52A5542CA82AA1F8607C085A0"><enum>(2)</enum><header>Administrator</header><text>The term <term>Administrator</term> means the Administrator of the Environmental Protection Agency.</text></paragraph> 
<paragraph id="HC696A2B091C945E5A06319F049A6EDC0"><enum>(3)</enum><header>Territorial sea</header> 
<subparagraph id="H938B0D1872774972B48700C9A60006FC"><enum>(A)</enum><header>In general</header><text>The term <term>territorial sea</term> means the belt of the sea measured from the baseline of the United States determined in accordance with international law, as set forth in Presidential Proclamation number 5928, dated December 27, 1988.</text></subparagraph> 
<subparagraph id="H15351E3588214DFBB3708613EC85A0F6"><enum>(B)</enum><header>Inclusion</header><text>The term <term>territorial sea</term> includes the waters lying seaward of the line of ordinary low water and extending to the baseline of the United States described in subparagraph (A).</text></subparagraph></paragraph> 
<paragraph id="H6269483949FF4BFEA4D5C306697E3453"><enum>(4)</enum><header>Exclusive economic zone</header><text>The term <term>exclusive economic zone</term> means the Exclusive Economic Zone of the United States established by Presidential Proclamation number 5030, dated March 10, 1983.</text></paragraph> 
<paragraph id="H3844359BD1E4462DA575B43D70E879A9"><enum>(5)</enum><header>Waters of the United States</header><text>The term <term>waters of the United States</term> means the waters of the territorial sea, the exclusive economic zone, and the Great Lakes.</text></paragraph> 
<paragraph id="HD928B3A93FF04342B6DF37EB58E32D92"><enum>(6)</enum><header>Great Lake</header><text>The term <term>Great Lake</term> means— </text> 
<subparagraph id="H7C65CB4ECC4A4D508455F724FE26F22E"><enum>(A)</enum><text>Lake Erie;</text></subparagraph> 
<subparagraph id="H3042EEC1A5A1440A93928F5E9D7B0075"><enum>(B)</enum><text>Lake Huron (including Lake Saint Clair);</text></subparagraph> 
<subparagraph id="HAA66A5FD1D5944A29F086358F48E8868"><enum>(C)</enum><text>Lake Michigan;</text></subparagraph> 
<subparagraph id="H0A4D3E698CFA46989965F8CA65C4AE43"><enum>(D)</enum><text>Lake Ontario; and</text></subparagraph> 
<subparagraph id="H559CAC15BA4C43E396671DFC8F3EE864"><enum>(E)</enum><text>Lake Superior.</text></subparagraph></paragraph> 
<paragraph id="HC0D1DBBE61504969AE25D46D2FD2E69D"><enum>(7)</enum><header>Cruise vessel</header> 
<subparagraph id="H181FD5B16D3340089419A9DBBE842FDA"><enum>(A)</enum><header>In general</header><text>The term <term>cruise vessel</term> means a passenger vessel (as defined in <external-xref legal-doc="usc" parsable-cite="usc/46/2101">section 2101(22)</external-xref> of title 46, United States Code), that—</text> 
<clause id="HE4B09F98F13D424CA3E1ABD218335222"><enum>(i)</enum><text>is authorized to carry at least 250 passengers; and</text></clause> 
<clause id="HE7CB81B592494837A701DB4B71510027"><enum>(ii)</enum><text>has onboard sleeping facilities for each passenger.</text></clause></subparagraph> 
<subparagraph id="HC4556D7B692C4F908D28874B00A50458"><enum>(B)</enum><header>Exclusions</header><text>The term <term>cruise vessel</term> does not include—</text> 
<clause id="HF9BCFE42D8DA4C768651C65524E1E02"><enum>(i)</enum><text>a vessel of the United States operated by the Federal Government; or</text></clause> 
<clause id="HAB2037C14B9241AFA03E52EB7C8DD0"><enum>(ii)</enum><text>a vessel owned and operated by the government of a State.</text></clause></subparagraph></paragraph> 
<paragraph id="H9FFFD38A6B774700A77CA480588776B9"><enum>(8)</enum><header>Passenger</header> 
<subparagraph id="H667D44270B374CB6AA83C4842714CB31"><enum>(A)</enum><header>In general</header><text>The term <term>passenger</term> means any person on board a cruise vessel for the purpose of travel.</text></subparagraph> 
<subparagraph id="H7E2E51096F6A42A783125827EACA8BC0"><enum>(B)</enum><header>Inclusions</header><text>The term <term>passenger</term> includes—</text> 
<clause id="HCE1C37B4695D4342BFB4D1AB001835FA"><enum>(i)</enum><text>a paying passenger; and</text></clause> 
<clause id="H3B267820B97442B29EC95000D6E71B3E"><enum>(ii)</enum><text>a staffperson, such as a crew member, captain, or officer.</text></clause></subparagraph></paragraph> 
<paragraph id="H8FFF9D798DD941B4A028D67CD7AC14DD"><enum>(9)</enum><header>Person</header><text>The term <term>person</term> means—</text> 
<subparagraph id="HED132B670CD44CBDBFA450574D00F73F"><enum>(A)</enum><text>an individual;</text></subparagraph> 
<subparagraph id="H59DAC5A798734051B6764400C0A9614C"><enum>(B)</enum><text>a corporation;</text></subparagraph> 
<subparagraph id="HF6CA4F456AEC4C27B17DFA5556390076"><enum>(C)</enum><text>a partnership;</text></subparagraph> 
<subparagraph id="HB69BEF55081A4B0EBA10D38D549F5F76"><enum>(D)</enum><text>a limited liability company;</text></subparagraph> 
<subparagraph id="HFCE1CE75FF824571A3C6B075F14F5492"><enum>(E)</enum><text>an association;</text></subparagraph> 
<subparagraph id="HE6B5C57C693F4153AAA9F4C83B15200"><enum>(F)</enum><text>a State;</text></subparagraph> 
<subparagraph id="H34478969EEC04C46A94363004F62D93E"><enum>(G)</enum><text>a municipality;</text></subparagraph> 
<subparagraph id="H204BC67098C94D08B8657DBB74C41B00"><enum>(H)</enum><text>a commission or political subdivision of a State; and</text></subparagraph> 
<subparagraph id="H1580780F61ED48FBA6E0A3D5799CCC21"><enum>(I)</enum><text>an Indian tribe.</text></subparagraph></paragraph> 
<paragraph id="H70EFB329A3914FAFBAFFAB79BB19977"><enum>(10)</enum><header>Citizen</header><text>The term <term>citizen</term> means a person that has an interest that is or may be adversely affected by any provision of this Act.</text></paragraph> 
<paragraph id="H83B03937C1F043B182172E498B4DCECF"><enum>(11)</enum><header>Discharge</header> 
<subparagraph id="H44DFA5201B684031841D3770E5271266"><enum>(A)</enum><header>In general</header><text>The term <term>discharge</term> means a release of any substance, however caused, from a cruise vessel.</text></subparagraph> 
<subparagraph id="H3F7493AC73A44929A5EC183982169390"><enum>(B)</enum><header>Inclusions</header><text>The term <term>discharge</term> includes any escape, disposal, spilling, leaking, pumping, emitting or emptying of any substance.</text></subparagraph></paragraph> 
<paragraph id="H8DFA07D54D6C4521B3276600233400E6"><enum>(12)</enum><header>Sewage</header><text>The term <term>sewage</term> means—</text> 
<subparagraph id="H166BD304CD06493BB7E6EC85D5812F00"><enum>(A)</enum><text>human body wastes;</text></subparagraph> 
<subparagraph id="HF8E45345835C4BCC96009D683F57A3BA"><enum>(B)</enum><text>the wastes from toilets and other receptacles intended to receive or retain human body wastes; and</text></subparagraph> 
<subparagraph id="HC030E954AEB948279FB261F592BC6B7D"><enum>(C)</enum><text>sewage sludge.</text></subparagraph></paragraph> 
<paragraph id="H277896B3921843388900C942CEDDC42E"><enum>(13)</enum><header>Graywater</header><text>The term <term>graywater</term> means galley, dishwasher, bath, and laundry waste water.</text></paragraph> 
<paragraph id="H35D073A47CA54B708E3317DDC258E962"><enum>(14)</enum><header>Bilge water</header><text>The term <term>bilge water</term> means wastewater that includes lubrication oils, transmission oils, oil sludge or slops, fuel or oil sludge, used oil, used fuel or fuel filters, or oily waste.</text></paragraph> 
<paragraph id="H865D639E4BD848FCBCD0F345A8119D7E"><enum>(15)</enum><header>Sewage sludge</header> 
<subparagraph id="H7002FB4690A3486498844F97DAF63051"><enum>(A)</enum><header>In general</header><text>The term <term>sewage sludge</term> means any solid, semi-solid, or liquid residue removed during the treatment of municipal waste water or domestic sewage.</text></subparagraph> 
<subparagraph id="HD825CBA325804BFF913C8B0031514DF"><enum>(B)</enum><header>Inclusions</header><text>The term <term>sewage sludge</term> includes—</text> 
<clause id="H509E9583FF384EA280E6C68DE7A4B9B3"><enum>(i)</enum><text>solids removed during primary, secondary, or advanced waste water treatment;</text></clause> 
<clause id="HCEEE082E7E3F440CB55343CDEA86E3E4"><enum>(ii)</enum><text>scum;</text></clause> 
<clause id="H803F83AF990A47FAB66676BFBE911F1E"><enum>(iii)</enum><text>septage;</text></clause> 
<clause id="HEE72ED2B7F624D05BEAEA2846EF61F9"><enum>(iv)</enum><text>portable toilet pumpings;</text></clause> 
<clause id="H31097A2FFDBB43B8952EA30107946BC"><enum>(v)</enum><text>type III marine sanitation device pumpings (as defined in part 159 of title 33, Code of Federal Regulations); and</text></clause> 
<clause id="HAE305EA13C6D471200485E9CE6DA501B"><enum>(vi)</enum><text>sewage sludge products.</text></clause></subparagraph> 
<subparagraph id="H6BA34E7366DB4415B5E6985435E62D63"><enum>(C)</enum><header>Exclusions</header><text>The term <term>sewage sludge</term> does not include—</text> 
<clause id="HC3F4151D72B44DFFA258BCF621C5C446"><enum>(i)</enum><text>grit or screenings; or</text></clause> 
<clause id="H47C9302E5F3A40E2BE6593C6B62BD177"><enum>(ii)</enum><text>ash generated during the incineration of sewage sludge.</text></clause></subparagraph></paragraph> 
<paragraph id="H8815CBF342BB4FE19D12B56EFECFF862"><enum>(16)</enum><header>Indian tribe</header><text>The term <term>Indian tribe</term> has the meaning given in section 4 of the <act-name parsable-cite="ISDA">Indian Self-Determination and Education Assistance Act</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/25/450b">25 U.S.C. 450b</external-xref>).</text></paragraph></section> 
<section id="HE6700D31FF154B5085199C2D8DAAC5B2"><enum>4.</enum><header>Prohibitions and conditions regarding the discharge of sewage, graywater, or bilge water</header> 
<subsection id="H9F89BE1788734636B7F940D4E0BE8176"><enum>(a)</enum><header>Prohibition</header> 
<paragraph id="H04670603744F479FA5BE00DAB088DE1E"><enum>(1)</enum><header>In general</header><text>Except as provided in paragraph (2) and section 11, no cruise vessel entering a port of the United States may discharge sewage, graywater, or bilge water into the waters of the United States. </text></paragraph> 
<paragraph id="H972A0A7EC58246B193B79FE766C8C77D"><enum>(2)</enum><header>Exception</header><text>A cruise vessel described in paragraph (1) may discharge sewage, graywater, or bilge water into the exclusive economic zone but outside the territorial sea, or, in the case of the Great Lakes, beyond any point that is 12 miles from the shore, only if—</text> 
<subparagraph id="H7F00DE8CC0464C4CA26BBF7DA588E561"><enum>(A)</enum> 
<clause display-inline="yes-display-inline" id="HDFD76F362218426DA01CAD441C5C8CAD"><enum>(i)</enum><text>in the case of a discharge of sewage or graywater, the discharge meets all applicable effluent limits established under this Act and is in accordance with all other applicable laws (including regulations); or</text></clause> 
<clause id="HCECF08D558A643FF9EFBA1941ED7A7F2" indent="up1"><enum>(ii)</enum><text>in the case of a discharge of bilge water, the discharge is in accordance with all applicable laws (including regulations);</text></clause></subparagraph> 
<subparagraph id="HE8BC3642957D42E292ACB3439320B156"><enum>(B)</enum><text>the cruise vessel meets all applicable management standards established under this Act; and</text></subparagraph> 
<subparagraph id="H9DF7D6D68E9746AFA9126163374EDAF"><enum>(C)</enum><text>the cruise vessel is not discharging in an area in which the discharge is otherwise prohibited.</text></subparagraph></paragraph></subsection> 
<subsection id="H7631D016704F44FAA6469BC2A372D18"><enum>(b)</enum><header>Safety exception</header> 
<paragraph id="HD9933D213987466287C356ADEAA1D0AC"><enum>(1)</enum><header>Scope of exception</header><text>Subsection (a) shall not apply in any case in which—</text> 
<subparagraph id="H2A3C95FB2A174D2300712060A57D10FB"><enum>(A)</enum><text>a discharge is made solely for the purpose of securing the safety of the cruise vessel or saving a human life at sea; and</text></subparagraph> 
<subparagraph id="HB687DC7AB16A4E3AB43ECC00A44ED41F"><enum>(B)</enum><text>all reasonable precautions have been taken for the purpose of preventing or minimizing the discharge.</text></subparagraph></paragraph> 
<paragraph id="HA221ABC6DD0C44EB866601FF135BCC66"><enum>(2)</enum><header>Notification of Commandant</header> 
<subparagraph id="H148DF7F9A44C43800081BCF0A6EBDFC4"><enum>(A)</enum><header>In general</header><text>If the owner, operator, or master, or other individual in charge, of a cruise vessel authorizes a discharge described in paragraph (1), the individual shall notify the Commandant of the decision to authorize the discharge as soon as practicable, but not later than 24 hours, after authorizing the discharge.</text></subparagraph> 
<subparagraph id="HD2AC337F626549EE8DC5BAA75FE6591B"><enum>(B)</enum><header>Report</header><text>Not later than 7 days after the date on which an individual described in subparagraph (A) notifies the Commandant of an authorization of a discharge under the safety exception under this paragraph, the individual shall submit to the Commandant a report that includes—</text> 
<clause id="H40B3CC9A21FE4C108D564B61E406B760"><enum>(i)</enum><text>the quantity and composition of each discharge made under the safety exception;</text></clause> 
<clause id="H758B3832D8924A9BB04474C7CB513760"><enum>(ii)</enum><text>the reason for authorizing each discharge;</text></clause> 
<clause id="H74D7CA941BCF453883FF5FC880EED156"><enum>(iii)</enum><text>the location of the vessel during the course of each discharge; and</text></clause> 
<clause id="H4C4366B4B2494AD9BAF68457B0C2225B"><enum>(iv)</enum><text>such other supporting information and data as are requested by the Commandant.</text></clause></subparagraph></paragraph></subsection></section> 
<section id="HEAA9D24C13F74328835C9D585B7BC25F"><enum>5.</enum><header>Effluent limits for discharges of sewage and graywater</header> 
<subsection id="H63436370BCFC4405A1A9A2534B594D6B"><enum>(a)</enum><header>Effluent limits</header> 
<paragraph id="H197F8F9E0B3A4C7A8F9600B04EA95074"><enum>(1)</enum><header>In general</header><text>Not later than 3 years after the date of enactment of this Act, the Commandant and the Administrator shall jointly promulgate effluent limits for sewage and graywater discharges from cruise vessels entering ports of the United States.</text></paragraph> 
<paragraph id="HFC20D55786CD4115A9AE3F890068856D"><enum>(2)</enum><header>Requirements</header><text>The effluent limits shall—</text> 
<subparagraph id="HA856BD88DDF74B21840038186FF3D071"><enum>(A)</enum><text>require the application of the best available technology that will result in the greatest level of effluent reduction achievable, recognizing that the national goal is the elimination of the discharge of all pollutants in sewage and graywater by cruise vessels into the waters of the United States by 2016; and</text></subparagraph> 
<subparagraph id="H3723CE99C78C4D8F80A89F1832494F00"><enum>(B)</enum><text>require compliance with all relevant water quality criteria standards.</text></subparagraph></paragraph></subsection> 
<subsection id="H11A2BA72C6D04B4AABBAEBF4D0A127B1"><enum>(b)</enum><header>Minimum limits</header><text>The effluent limits under subsection (a) shall require, at a minimum, that treated sewage and graywater effluent discharges from cruise vessels shall, not later than 3 years after the date of enactment of this Act, meet the following standards:</text> 
<paragraph id="H731F3C04978A4B519135977DA39597B1"><enum>(1)</enum><header>In general</header><text>The discharge satisfies the minimum level of effluent quality specified in <external-xref legal-doc="usc" parsable-cite="usc/40/133">section 133.102</external-xref> of title 40, Code of Regulations (or a successor regulation).</text></paragraph> 
<paragraph id="H672EA829092E421A9DBEF3A043014112"><enum>(2)</enum><header>Fecal coliform</header><text>With respect to the samples from the discharge during any 30-day period—</text> 
<subparagraph id="H0E80606D265146B7BE31AF8EB2F1B45F"><enum>(A)</enum><text>the geometric mean of the samples shall not exceed 20 fecal coliform per 100 milliliters; and</text></subparagraph> 
<subparagraph id="H4206023D6FC541D1AA16D12B008E8175"><enum>(B)</enum><text>not more than 10 percent of the samples shall exceed 40 fecal coliform per 100 milliliters.</text></subparagraph></paragraph> 
<paragraph id="H1BA2069B06494657B4BD681F6DCECAF9"><enum>(3)</enum><header>Residual chlorine</header><text>Concentrations of total residual chlorine in samples shall not exceed 10 milligrams per liter.</text></paragraph></subsection> 
<subsection id="HE5814E0A9E3B4C92BFAA78371FDD00BF"><enum>(c)</enum><header>Review and revision of effluent limits</header><text>The Commandant and the Administrator shall jointly—</text> 
<paragraph id="H31FE885AC6D7436E9785C5A324F769A9"><enum>(1)</enum><text>review the effluent limits required by subsection (a) at least once every 3 years; and</text></paragraph> 
<paragraph id="H16E9C163BA654E348C4804B5203292EF"><enum>(2)</enum><text>revise the effluent limits as necessary to incorporate technology available at the time of the review in accordance with subsection (a)(2).</text></paragraph></subsection></section> 
<section id="H43106D9481A0457A85394F1FAC6083C"><enum>6.</enum><header>Inspection and sampling</header> 
<subsection id="HC14508253EC642CE8D9E9610E1FDCD16"><enum>(a)</enum><header>Development and implementation of inspection program</header> 
<paragraph id="H3AD32E2F05664646BE00083D497444B9"><enum>(1)</enum><header>In general</header><text>The Commandant, in consultation with the Administrator, shall promulgate regulations to implement an inspection, sampling, and testing program sufficient to verify that cruise vessels calling on ports of the United States are in compliance with—</text> 
<subparagraph id="H4698728B3B3841D7A08DA77D9511642C"><enum>(A)</enum><text>this Act (including regulations promulgated under this Act);</text></subparagraph> 
<subparagraph id="H21581A95E0B046419104BC62ED2F4915"><enum>(B)</enum><text>the <act-name parsable-cite="FWPCA">Federal Water Pollution Control Act</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/33/1251">33 U.S.C. 1251 et seq.</external-xref>) (including regulations promulgated under that Act);</text></subparagraph> 
<subparagraph id="H164904FAFEAE46F0BA46A678AE98A57F"><enum>(C)</enum><text>other applicable Federal laws and regulations; and</text></subparagraph> 
<subparagraph id="H845E8039BDC042CD8CD313D39DE1A76"><enum>(D)</enum><text>all applicable requirements of international agreements.</text></subparagraph></paragraph> 
<paragraph id="HCEAE6E7C1E7245A293E835448783A0E1"><enum>(2)</enum><header>Inspections</header><text>The program shall require that—</text> 
<subparagraph id="H424266D29FC640519DCE9DF1261208D7"><enum>(A)</enum><text>regular announced and unannounced inspections be conducted of any relevant aspect of cruise vessel operations, equipment, or discharges, including sampling and testing of cruise vessel discharges; and</text></subparagraph> 
<subparagraph id="H249E9864913F4DB8B300E2295EEC737E"><enum>(B)</enum><text>each cruise vessel that calls on a port of the United States shall be subject to an unannounced inspection at least annually.</text></subparagraph></paragraph></subsection> 
<subsection id="H2354EBC182624E8BBF19CC8CA7E41480"><enum>(b)</enum><header>Regulations</header><text>Not later than 1 year after the date of enactment of this Act, the Commandant, in consultation with the Administrator, shall promulgate regulations that, at a minimum—</text> 
<paragraph id="H68D8959313D740FBA342CDB12C25C529"><enum>(1)</enum><text>require the owner, operator, or master, or other individual in charge, of a cruise vessel to maintain and produce a logbook detailing the times, types, volumes, and flow rates, origins, and locations of any discharges from the cruise vessel;</text></paragraph> 
<paragraph id="H19ABFB7B47184D3DA0ADE0026CA29CE"><enum>(2)</enum><text>provide for routine announced and unannounced inspections of—</text> 
<subparagraph id="HA30CDA9832A245AEBA20B02200348BE0"><enum>(A)</enum><text>cruise vessel environmental compliance records and procedures; and</text></subparagraph> 
<subparagraph id="H428DDA68FE484FC6B7C363148447B2BF"><enum>(B)</enum><text>the functionality and proper operation of installed equipment for abatement and control of any cruise vessel discharge (which equipment shall include equipment intended to treat sewage, graywater, or bilge water);</text></subparagraph></paragraph> 
<paragraph id="H9C72D08A241C448EB61B82C427A2A149"><enum>(3)</enum><text>require the sampling and testing of cruise vessel discharges that require the owner, operator, or master, or other individual in charge, of a cruise vessel—</text> 
<subparagraph id="HA143DB9C3CE248BFB17741F8EC0DA2B"><enum>(A)</enum><text>to conduct that sampling or testing; and</text></subparagraph> 
<subparagraph id="HA2CE5328DFCE4F45B251F3C6FAAD93F0"><enum>(B)</enum><text>to produce any records of the sampling or testing;</text></subparagraph></paragraph> 
<paragraph id="HE8834598D07C4955A7D857B02BC3DA49"><enum>(4)</enum><text>require any owner, operator, or master, or other individual in charge, of a cruise vessel who has knowledge of a discharge from the cruise vessel in violation of this Act (including regulations promulgated under this Act) to immediately report that discharge to the Commandant (who shall provide notification of the discharge to the Administrator); and</text></paragraph> 
<paragraph id="HAED1BA85BEA24967AE5277777B99E15C"><enum>(5)</enum><text>require the owner, operator, or master, or other individual in charge, of a cruise vessel to provide to the Commandant and Administrator a blueprint of each cruise vessel that includes the location of every discharge pipe and valve.</text></paragraph></subsection> 
<subsection id="H880335D515D74433AB47A5A15DF822E5"><enum>(c)</enum><header>Evidence of compliance</header> 
<paragraph id="HDE41A2CA7A7B4199A348C0EED800F758"><enum>(1)</enum><header>Vessel of the United States</header> 
<subparagraph id="H3F6BF95142334E8F877EE92B8643DB2"><enum>(A)</enum><header>In general</header><text>A cruise vessel registered in the United States to which this Act applies shall have a certificate of inspection issued by the Commandant.</text></subparagraph> 
<subparagraph id="H94EAA1120E8448C892EAD5546848D554"><enum>(B)</enum><header>Issuance of certificate</header><text>The Commandant may issue a certificate described in subparagraph (A) only after the cruise vessel has been examined and found to be in compliance with this Act, including prohibitions on discharges and requirements for effluent limits, as determined by the Commandant.</text></subparagraph> 
<subparagraph id="H958976D0C58B469ABC19389823036338"><enum>(C)</enum><header>Validity of certificate</header><text>A certificate issued under this paragraph—</text> 
<clause id="HC4DB5454B03A4471B3003893C670BFB"><enum>(i)</enum><text>shall be valid for a period of not more than 5 years, beginning on the date of issuance of the certificate;</text></clause> 
<clause id="HC545A3A373764E8B000639EA3F3278DD"><enum>(ii)</enum><text>may be renewed as specified by the Commandant; and</text></clause> 
<clause id="HE40D9CA7E7D646F3A1770036DBB6CEBE"><enum>(iii)</enum><text>shall be suspended or revoked if the Commandant determines that the cruise vessel for which the certificate was issued is not in compliance with the conditions under which the certificate was issued.</text></clause></subparagraph> 
<subparagraph id="H292ACCE7AF4E45C883DE4DB6F4942E49"><enum>(D)</enum><header>Special certificates</header><text>The Commandant may issue special certificates to certain vessels that exhibit compliance with this Act and other best practices, as determined by the Commandant.</text></subparagraph></paragraph> 
<paragraph id="H6672499F0393432783CCB8620411414"><enum>(2)</enum><header>Foreign vessel</header> 
<subparagraph id="HA489EDD614C24358A439781DD31FBB19"><enum>(A)</enum><header>In general</header><text>A cruise vessel registered in a country other than the United States to which this Act applies may operate in the waters of the United States, or visit a port or place under the jurisdiction of the United States, only if the cruise vessel has been issued a certificate of compliance by the Commandant.</text></subparagraph> 
<subparagraph id="H25CCF9E5901B4B0A83CC4EF98156C762"><enum>(B)</enum><header>Issuance of certificate</header><text>The Commandant may issue a certificate described in subparagraph (A) to a cruise vessel only after the cruise vessel has been examined and found to be in compliance with this Act, including prohibitions on discharges and requirements for effluent limits, as determined by the Commandant.</text></subparagraph> 
<subparagraph id="H477A9CF0621142FBAC4593B2FCDB12BB"><enum>(C)</enum><header>Acceptance of foreign documentation</header><text>The Commandant may consider a certificate, endorsement, or document issued by the government of a foreign country under a treaty, convention, or other international agreement to which the United States is a party, in issuing a certificate of compliance under this paragraph (except that such a certificate, endorsement, or document shall not serve as a proxy for certification of compliance with this Act).</text></subparagraph> 
<subparagraph id="H3E9CF38BB4B6405BBAB281FD3FBDA7F"><enum>(D)</enum><header>Validity of certificate</header><text>A certificate issued under this section—</text> 
<clause id="H871F670D175843D8A3D5191EC7E62611"><enum>(i)</enum><text>shall be valid for a period of not more than 24 months, beginning on the date of issuance of the certificate;</text></clause> 
<clause id="HCB619A63019E47C59200D2FBB514E060"><enum>(ii)</enum><text>may be renewed as specified by the Commandant; and</text></clause> 
<clause id="HEB5938C9FE654507BCBFB5FEAEC08A9"><enum>(iii)</enum><text>shall be suspended or revoked if the Commandant determines that the cruise vessel for which the certificate was issued is not in compliance with the conditions under which the certificate was issued.</text></clause></subparagraph></paragraph></subsection> 
<subsection id="H85B7AA0189F1489189C18DD357032857"><enum>(d)</enum><header>Cruise observer pilot program</header> 
<paragraph id="HBE2A12966A0840799F5B52E4DAD1D3DC"><enum>(1)</enum><header>In general</header><text>Not later than 1 year after the date of enactment of this Act, the Commandant shall establish, and for each of fiscal years 2006 through 2008, shall carry out, a program for the placement of 2 or more independent observers on cruise vessels for the purpose of monitoring and inspecting cruise vessel operations, equipment, and discharges to ensure compliance with—</text> 
<subparagraph id="H3FF4B155A51642B1981B17847144C8AF"><enum>(A)</enum><text>this Act (including regulations promulgated under this Act); and</text></subparagraph> 
<subparagraph id="H9424F31ADD064AA2BA0604DEF4E226C2"><enum>(B)</enum><text>all other relevant Federal laws (including regulations) and international agreements.</text></subparagraph></paragraph> 
<paragraph id="HDD51FAE29203484992167CBD65CCA08C"><enum>(2)</enum><header>Responsibilities</header><text>An observer described in paragraph (1) shall—</text> 
<subparagraph id="H59BF5A64973D412599ACB38D3D00006B"><enum>(A)</enum><text>observe and inspect—</text> 
<clause id="HB1BD80508AB4400281143BFE7606F5DF"><enum>(i)</enum><text>onboard environmental treatment systems;</text></clause> 
<clause id="HED660DFBBE844EAE9E2B342D904EF300"><enum>(ii)</enum><text>use of shore-based treatment and storage facilities;</text></clause> 
<clause id="HFF909BD88C364B3ABFA7C441E34DEF7"><enum>(iii)</enum><text>discharges and discharge practices; and</text></clause> 
<clause id="H6CDD3C91722B461F9B1220A2C4F6536"><enum>(iv)</enum><text>blueprints, logbooks, and other relevant information;</text></clause></subparagraph> 
<subparagraph id="H255E75C82106492F962E2C13C4977838"><enum>(B)</enum><text>have the authority to interview and otherwise query any crew member with knowledge of vessel operations;</text></subparagraph> 
<subparagraph id="H76490DC094B84F9EA0E6EFD6596984ED"><enum>(C)</enum><text>have access to all data and information made available to government officials under this section; and</text></subparagraph> 
<subparagraph id="H626C474F597649B78141E4200A4D9F6"><enum>(D)</enum><text>immediately report any known or suspected violation of this Act or any other applicable Federal law or international agreement to—</text> 
<clause id="H11DD6B28717046559E91AC587433AB31"><enum>(i)</enum><text>the Coast Guard; and</text></clause> 
<clause id="H6DB6154BF2ED414FB640F821E9B985B"><enum>(ii)</enum><text>the Environmental Protection Agency.</text></clause></subparagraph></paragraph> 
<paragraph id="HE3764963D3A5449183D531E272AC669E"><enum>(3)</enum><header>Report</header><text>Not later than January 31, 2008, the Commandant shall submit to Congress a report describing the results, and recommendations for continuance, of the program under this subsection.</text></paragraph></subsection> 
<subsection id="H5BD6CCAE430B4FD6941F6151FA0074EC"><enum>(e)</enum><header>Onboard monitoring system pilot program</header> 
<paragraph id="H119270FBC9934C6DBC8FAD3DC2F727CF"><enum>(1)</enum><header>In general</header><text>Not later than 1 year after the date of enactment of this Act, the Administrator of the National Oceanic and Atmospheric Administration, in consultation with the Administrator and the Commandant, shall establish, and for each of fiscal years 2006 through 2011, shall carry out, with industry partners as necessary, a pilot program to develop and promote commercialization of technologies to provide real-time data to Federal agencies regarding—</text> 
<subparagraph id="H62FB9E6F29AB404BA1D924D1EE3D73B7"><enum>(A)</enum><text>graywater and sewage discharges from cruise vessels; and</text></subparagraph> 
<subparagraph id="H0666BB607A83441AB389134FC8D142BF"><enum>(B)</enum><text>functioning of cruise vessel components relating to pollution control.</text></subparagraph></paragraph> 
<paragraph id="HD67795E4C4604614AEBFD6BD69058926"><enum>(2)</enum><header>Technology requirements</header><text>Technologies developed under the program under this subsection—</text> 
<subparagraph id="HDD4F2F3BB6F14FC19FA79F41A080EAC4"><enum>(A)</enum><text>shall have the ability to record—</text> 
<clause id="HE533FF79747D425488BE04803110A8A2"><enum>(i)</enum><text>the location and time of discharges from cruise vessels;</text></clause> 
<clause id="HE02A3D4DF53E4E7BADCFA6DF788BDE1"><enum>(ii)</enum><text>the source, content, and volume of those discharges; and</text></clause> 
<clause id="H0890916C8C3A46F0B1E31956C8BF45F"><enum>(iii)</enum><text>the state of components relating to pollution control at the time of the discharges, including whether the components are operating correctly; and</text></clause></subparagraph> 
<subparagraph id="HEA9242EB2D5341F38BDCFBF4ECE7312"><enum>(B)</enum><text>shall be tested on not less than 10 percent of all cruise vessels operating in the territorial sea of the United States, including large and small vessels.</text></subparagraph></paragraph> 
<paragraph id="H9CB84619F10C4B27B438003C25BC92E3"><enum>(3)</enum><header>Participation of industry</header> 
<subparagraph id="H2D98F24933494B52B70042678D533F68"><enum>(A)</enum><header>Competitive selection process</header><text>Industry partners willing to participate in the program may do so through a competitive selection process conducted by the Administrator of the National Oceanic and Atmospheric Administration.</text></subparagraph> 
<subparagraph id="HDEB2435706FF4317A205B651878B00EE"><enum>(B)</enum><header>Contribution</header><text>A selected industry partner shall contribute not less than 20 percent of the cost of the project in which the industry partner participates.</text></subparagraph></paragraph> 
<paragraph id="HF03EA5D058A14DA4BCFB18BE39300742"><enum>(4)</enum><header>Report</header><text>Not later than January 31, 2008, the Administrator of the National Oceanic and Atmospheric Administration shall submit to Congress a report describing the results, and recommendations for continuance, of the program under this subsection.</text></paragraph></subsection></section> 
<section id="H686FEB729DAE43A1BCBA4C4138FEBC81"><enum>7.</enum><header>Employee protection</header> 
<subsection id="H5989B81DA051484EB890CBA3D6FE5EA2"><enum>(a)</enum><header>Prohibition of discrimination against persons filing, instituting, or testifying in proceedings under this Act</header><text>No person shall terminate the employment of, or in any other way discriminate against (or cause the termination of employment of or discrimination against), any employee or any authorized representative of employees by reason of the fact that the employee or representative—</text> 
<paragraph id="HD34F2F6179DD4CE789F9B800CB292EB"><enum>(1)</enum><text>has filed, instituted, or caused to be filed or instituted any proceeding under this Act; or</text></paragraph> 
<paragraph id="HDA9E522979C7475B83A1FC995673E29D"><enum>(2)</enum><text>has testified or is about to testify in any proceeding resulting from the administration or enforcement of the provisions of this Act.</text></paragraph></subsection> 
<subsection id="H7BEE3354DDED4C87B3CE64A46F59D993"><enum>(b)</enum><header>Application for review; investigation; hearings; review</header> 
<paragraph id="H4C65DEB0EAB24F619B859B5960B4B49"><enum>(1)</enum><header>In general</header><text>An employee or a representative of employees who believes that the termination of the employment of the employee has occurred, or that the employee has been discriminated against, as a result of the actions of any person in violation of subsection (a) may, not later than 30 days after the date on which the alleged violation occurred, apply to the Secretary of Labor for a review of the alleged termination of employment or discrimination.</text></paragraph> 
<paragraph id="HD1DC502929874047BAFA7E2323CD5B00"><enum>(2)</enum><header>Application</header><text>A copy of an application for review filed under paragraph (1) shall be sent to the respondent.</text></paragraph> 
<paragraph id="H1A0E3947BCDE4A59B5464F1276B01D45"><enum>(3)</enum><header>Investigation</header> 
<subparagraph id="H190AFC9D253C4806AB6B5322003E1C60"><enum>(A)</enum><header>In general</header><text>On receipt of an application for review under paragraph (1), the Secretary of Labor shall carry out an investigation of the complaint.</text></subparagraph> 
<subparagraph id="H30859D2A8527474FA9D93C07DE1C2FB6"><enum>(B)</enum><header>Requirements</header><text>In carrying out this subsection, the Secretary of Labor shall—</text> 
<clause id="HECA720498AC546BEB02C007E3E4F05D6"><enum>(i)</enum><text>provide an opportunity for a public hearing at the request of any party to the review to enable the parties to present information relating to the alleged violation;</text></clause> 
<clause id="H542780077FCD4AC19BA1F8C77158914C"><enum>(ii)</enum><text>ensure that, at least 5 days before the date of the hearing, each party to the hearing is provided written notice of the time and place of the hearing; and</text></clause> 
<clause id="H2BE4B60C4C5446A0B751D000499E0135"><enum>(iii)</enum><text>ensure that the hearing is on the record and subject to <external-xref legal-doc="usc" parsable-cite="usc/5/554">section 554</external-xref> of title 5, United States Code.</text></clause></subparagraph> 
<subparagraph id="HBA4945AAA6304BA9BD429B40B132BD7E"><enum>(C)</enum><header>Findings of Commandant</header><text>On completion of an investigation under this paragraph, the Secretary of Labor shall—</text> 
<clause id="H3818272FB1B54206B160A6DF58F1258E"><enum>(i)</enum><text>make findings of fact;</text></clause> 
<clause id="H2B10FBF41AC542BDBCFF34AB7DCC67F"><enum>(ii)</enum><text>if the Secretary of Labor determines that a violation did occur, issue a decision, incorporating an order and the findings, requiring the person that committed the violation to take such action as is necessary to abate the violation, including the rehiring or reinstatement, with compensation, of an employee or representative of employees to the former position of the employee or representative; and</text></clause> 
<clause id="H9368CE5CBF474705AF47293453EF0100"><enum>(iii)</enum><text>if the Secretary of Labor determines that there was no violation, issue an order denying the application.</text></clause></subparagraph> 
<subparagraph id="H608A922138E449A1A3CB7C56CDD0BDC"><enum>(D)</enum><header>Order</header><text>An order issued by the Secretary of Labor under subparagraph (C) shall be subject to judicial review in the same manner as orders and decisions of the Administrator are subject to judicial review under this Act.</text></subparagraph></paragraph></subsection> 
<subsection id="H654ADAE4C7BE4441AE2F71774666AF00"><enum>(c)</enum><header>Costs and expenses</header><text>In any case in which an order is issued under this section to abate a violation, at the request of the applicant, a sum equal to the aggregate amount of all costs and expenses (including attorney’s fees), as determined by the Secretary of Labor, to have been reasonably incurred by the applicant for, or in connection with, the institution and prosecution of the proceedings, shall be assessed against the person committing the violation.</text></subsection> 
<subsection id="HC2A3BF651F6547FCB6E957098996FAAA"><enum>(d)</enum><header>Deliberate violations by employee acting without direction from employer or agent</header><text>This section shall not apply to any employee that, without direction from the employer of the employee (or agent of the employer), deliberately violates any provision of this Act.</text></subsection></section> 
<section id="H4321084742314502A74D556C4FCF835E"><enum>8.</enum><header>Judicial review</header> 
<subsection id="H74AA9B9152A84F76937EF9FAF59F17CB"><enum>(a)</enum><header>Review of actions by Administrator or Commandant; selection of court; fees</header> 
<paragraph id="H3A7DB6C8261A4BF7A13F75C12580165E"><enum>(1)</enum><header>Review of actions</header> 
<subparagraph id="HF35263F412C6482F86C5391C09331282"><enum>(A)</enum><header>In general</header><text>Any interested person may petition for a review, in the United States circuit court for the circuit in which the person resides or transacts business directly affected by the action of which review is requested—</text> 
<clause id="H1D838A3E0FAF4A2B9B6F1641BA432E91"><enum>(i)</enum><text>of an action of the Commandant in promulgating any effluent limit under section 5; or</text></clause> 
<clause id="HC4FA40CB6F4042028E753C59DB1051CC"><enum>(ii)</enum><text>of an action of the Commandant in carrying out an inspection, sampling, or testing under section 6.</text></clause></subparagraph> 
<subparagraph id="HCBB0752DBA674FD882941160E594227B"><enum>(B)</enum><header>Deadline for review</header><text>A petition for review under subparagraph (A) shall be made—</text> 
<clause id="H6D812AD9A8DF4A97A718742B1296E94"><enum>(i)</enum><text>not later than 120 days after the date of promulgation of the limit or standard relating to the review sought; or</text></clause> 
<clause id="H9DFBB18403F84054B2E0EB89E830545C"><enum>(ii)</enum><text>if the petition for review is based solely on grounds that arose after the date described in clause (i), as soon as practicable after that date.</text></clause></subparagraph></paragraph> 
<paragraph id="H7878DE51A3CE40FFA7742400F231FA16"><enum>(2)</enum><header>Civil and criminal enforcement proceedings</header><text>An action of the Commandant or Administrator with respect to which review could have been obtained under paragraph (1) shall not be subject to judicial review in any civil or criminal proceeding for enforcement.</text></paragraph> 
<paragraph id="HD995471B33B348BD84E693FCF799A9A3"><enum>(3)</enum><header>Award of fees</header><text>In any judicial proceeding under this subsection, a court may award costs of litigation (including reasonable attorney and expert witness fees) to any prevailing or substantially prevailing party in any case in which the court determines such an award to be appropriate.</text></paragraph></subsection> 
<subsection id="HC7951903F88E494CA76F01CF30A9648"><enum>(b)</enum><header>Additional evidence</header> 
<paragraph id="H9B329A12DBF64851A53CC78846C51594"><enum>(1)</enum><header>In general</header><text>In any judicial proceeding instituted under subsection (a) in which review is sought of a determination under this Act required to be made on the record after notice and opportunity for hearing, if any party applies to the court for leave to adduce additional evidence, and demonstrates to the satisfaction of the court that the additional evidence is material and that there were reasonable grounds for the failure to adduce the evidence in the proceeding before the Commandant or Administrator, the court may order the additional evidence (and evidence in rebuttal of the additional evidence) to be taken before the Commandant or Administrator, in such manner and on such terms and conditions as the court determines to be appropriate.</text></paragraph> 
<paragraph id="HED1F9B414D024B2EA070121864008EDB"><enum>(2)</enum><header>Modification of findings</header><text>On admission of additional evidence under paragraph (1), the Commandant or Administrator—</text> 
<subparagraph id="HECC15E3D63D749808EAE593D0000A9AA"><enum>(A)</enum><text>may modify findings of fact of the Commandant or Administrator, as the case may be, relating to a judicial proceeding, or make new findings of fact, by reason of the additional evidence so admitted; and</text></subparagraph> 
<subparagraph id="H2420A6BD0221465700E1F9B8924E7090"><enum>(B)</enum><text>shall file with the return of the additional evidence any modified or new findings, and any related recommendations, for the modification or setting aside of any original determinations of the Commandant or Administrator.</text></subparagraph></paragraph></subsection></section> 
<section id="H792B1BD7E9834C89BB89143BD3D6048"><enum>9.</enum><header>Enforcement</header> 
<subsection id="H06B30C9539684169B1319E179E825933"><enum>(a)</enum><header>In general</header><text>Any person that violates section 4 or any regulation promulgated under this Act may be—</text> 
<paragraph id="H95BB801FBC0B46C9B98D9FDD1D887C86"><enum>(1)</enum><text>assessed a class I or class II penalty described in subsection (b); or</text></paragraph> 
<paragraph id="H8F00E56B6D164288A9D73D28AC078B52"><enum>(2)</enum><text>assessed a civil penalty in a civil action under subsection (c).</text></paragraph></subsection> 
<subsection id="HC083372430AC4F40B13BA0D6D9929033"><enum>(b)</enum><header>Amount of administrative penalty</header> 
<paragraph id="H2716AD250F824562BC4E47F0146089A6"><enum>(1)</enum><header>Class i</header><text>The amount of a class I civil penalty under subsection (a)(1) shall not exceed—</text> 
<subparagraph id="H2341123AF7704880B8A2899D56436645"><enum>(A)</enum><text>$10,000 per violation; or</text></subparagraph> 
<subparagraph id="HC224D4CC5D684BD38B71DAD440C9FC3E"><enum>(B)</enum><text>$25,000 in the aggregate, in the case of multiple violations.</text></subparagraph></paragraph> 
<paragraph id="H1A2FFA63BB15481D91BC93D644A0C1BC"><enum>(2)</enum><header>Class ii</header><text>The amount of a class II civil penalty under subsection (a)(1) shall not exceed—</text> 
<subparagraph id="H019DD3E60FF349B5982484F587B6F75"><enum>(A)</enum><text>$10,000 per day for each day during which the violation continues; or</text></subparagraph> 
<subparagraph id="H6954455B05904301ADD858E608FE04EC"><enum>(B)</enum><text>$125,000 in the aggregate, in the case of multiple violations.</text></subparagraph></paragraph> 
<paragraph id="HD308ED38C1864BEB809058FDA5B2CDFA"><enum>(3)</enum><header>Separate violations</header><text>Each day on which a violation continues shall constitute a separate violation.</text></paragraph> 
<paragraph id="HD6E1E56175A24E86985C8BDF2F7E00DC"><enum>(4)</enum><header>Determination of amount</header><text>In determining the amount of a civil penalty under subsection (a)(1), the Commandant or the court, as the case may be, shall consider—</text> 
<subparagraph id="H7606D02CD2004F0187288F0032C4E79E"><enum>(A)</enum><text>the seriousness of the violation;</text></subparagraph> 
<subparagraph id="H23A396855DC449A79F9D00E6B8C12DA4"><enum>(B)</enum><text>any economic benefit resulting from the violation;</text></subparagraph> 
<subparagraph id="HEDBB9422C41E49BB001FE050D7623364"><enum>(C)</enum><text>any history of violations;</text></subparagraph> 
<subparagraph id="H0155213820364337945F53461759B9EB"><enum>(D)</enum><text>any good-faith efforts to comply with the applicable requirements;</text></subparagraph> 
<subparagraph id="H23C58FA0260C449CB34FA59D57BFEB88"><enum>(E)</enum><text>the economic impact of the penalty on the violator; and</text></subparagraph> 
<subparagraph id="H82275228676E49E6BCB00047C537B969"><enum>(F)</enum><text>such other matters as justice may require.</text></subparagraph></paragraph> 
<paragraph id="H03E8DD4BFF294987BF57F7C3C0499BB"><enum>(5)</enum><header>Procedure for class i penalty</header> 
<subparagraph id="H5D5BD84EC5264C5DB9DAF6DAF6510346"><enum>(A)</enum><header>In general</header><text>Before assessing a civil penalty under this subsection, the Commandant shall provide to the person to be assessed the penalty—</text> 
<clause id="HCFB046AD765F4F7E8CBBDC66231C37BD"><enum>(i)</enum><text>written notice of the proposal of the Commandant to assess the penalty; and</text></clause> 
<clause id="H103385623D6B400EB2B265AF47344410"><enum>(ii)</enum><text>the opportunity to request, not later than 30 days after the date on which the notice is received by the person, a hearing on the proposed penalty.</text></clause></subparagraph> 
<subparagraph id="H5A2F8769AA4245ACB1A3D153AB0293D1"><enum>(B)</enum><header>Hearing</header><text>A hearing described in subparagraph (A)(ii)—</text> 
<clause id="HC34665CD6C334B50BCA308A8564C8AE"><enum>(i)</enum><text>shall not be subject to section <external-xref legal-doc="usc" parsable-cite="usc/5/554">554</external-xref> or <external-xref legal-doc="usc" parsable-cite="usc/5/556">556</external-xref> of title 5, United States Code; but</text></clause> 
<clause id="HD9A4A34857D145129F55B55EFD093223"><enum>(ii)</enum><text>shall provide a reasonable opportunity to be heard and to present evidence.</text></clause></subparagraph></paragraph> 
<paragraph id="H807CF0016F724A44B82847E32351F341"><enum>(6)</enum><header>Procedure for class ii penalty</header> 
<subparagraph id="HC22132F0CEF2438196A34F521EE9EE13"><enum>(A)</enum><header>In general</header><text>Except as otherwise provided in this subsection, a class II civil penalty shall be assessed and collected in the same manner, and subject to the same provisions, as in the case of civil penalties assessed and collected after notice and an opportunity for a hearing on the record in accordance with <external-xref legal-doc="usc" parsable-cite="usc/5/554">section 554</external-xref> of title 5, United States Code.</text></subparagraph> 
<subparagraph id="H3DFEECBDF5DE46B08B4EBBE4D038E85E"><enum>(B)</enum><header>Rules</header><text>The Commandant may promulgate rules for discovery procedures for hearings under this subsection.</text></subparagraph></paragraph> 
<paragraph id="H88FBC6B06D8A48A49BAA098168177855"><enum>(7)</enum><header>Rights of interested persons</header> 
<subparagraph id="HBB6E3B4B50FD4AE7892CE4831E7F2900"><enum>(A)</enum><header>Public notice</header><text>Before issuing an order assessing a class II civil penalty under this subsection, the Commandant shall provide public notice of and reasonable opportunity to comment on the proposed issuance of each order.</text></subparagraph> 
<subparagraph id="H53FDBE2F08E24D47807372FDCED321D3"><enum>(B)</enum><header>Presentation of evidence</header> 
<clause id="HB293081E38B94C759C8EFCBACC4698E2"><enum>(i)</enum><header>In general</header><text>Any person that comments on a proposed assessment of a class II civil penalty under this subsection shall be given notice of—</text> 
<subclause id="H3184CAB6D3B8414BB0AFFDCD13A31B09"><enum>(I)</enum><text>any hearing held under this subsection; and</text></subclause> 
<subclause id="HC341F8F3F8A9408995ADDA6C3D8FBA11"><enum>(II)</enum><text>any order assessing the penalty.</text></subclause></clause> 
<clause id="HC9BE638058CE48A999EFF08B32212BEA"><enum>(ii)</enum><header>Hearing</header><text>In any hearing described in clause (i)(I), a person described in clause (i) shall have a reasonable opportunity to be heard and to present evidence.</text></clause></subparagraph> 
<subparagraph id="H2B6471814CC846AA818714FF64A55E30"><enum>(C)</enum><header>Rights of interested persons to a hearing</header> 
<clause id="HCC11338C8B7441BAA94CD5836903D7F3"><enum>(i)</enum><header>In general</header><text>If no hearing is held under subparagraph (B) before the date of issuance of an order assessing a class II civil penalty under this subsection, any person that commented on the proposed assessment may, not later than 30 days after the date of issuance of the order, petition the Commandant—</text> 
<subclause id="HD547CE6DAD4F4C8EB87CBD1133D8DF05"><enum>(I)</enum><text>to set aside the order; and</text></subclause> 
<subclause id="H53CDAE8768D74EE3A919F791B77C15BD"><enum>(II)</enum><text>to provide a hearing on the penalty.</text></subclause></clause> 
<clause id="H01E25A0246EB4234AA18D100796DC04"><enum>(ii)</enum><header>New evidence</header><text>If any evidence presented by a petitioner in support of the petition under clause (i) is material and was not considered in the issuance of the order, as determined by the Commandant, the Commandant shall immediately—</text> 
<subclause id="H02E3F4B4B5384633BC29102D56E24988"><enum>(I)</enum><text>set aside the order; and</text></subclause> 
<subclause id="H410534A0F858402980DB133635012927"><enum>(II)</enum><text>provide a hearing in accordance with subparagraph (B)(ii).</text></subclause></clause> 
<clause id="H3278B93FC99841B6844E697488D7FA00"><enum>(iii)</enum><header>Denial of hearing</header><text>If the Commandant denies a hearing under this subparagraph, the Commandant shall provide to the petitioner, and publish in the Federal Register, notice of and the reasons for the denial.</text></clause></subparagraph></paragraph> 
<paragraph id="H283BBEAF9E3D45DDB3C15DB356F4D0EB"><enum>(8)</enum><header>Finality of order</header> 
<subparagraph id="H8686233E48294906A848CE8D4BE33639"><enum>(A)</enum><header>In general</header><text>An order assessing a class II civil penalty under this subsection shall become final on the date that is 30 days after the date of issuance of the order unless, before that date—</text> 
<clause id="HF1826AEEDEFD4F4AA3B872B50723C63C"><enum>(i)</enum><text>a petition for judicial review is filed under paragraph (10); or</text></clause> 
<clause id="H2C1BADBB78A1424BA72BEF06036F67D2"><enum>(ii)</enum><text>a hearing is requested under paragraph (7)(C).</text></clause></subparagraph> 
<subparagraph id="HEAE9901DEF934F7083EC2025EA1400C2"><enum>(B)</enum><header>Denial of hearing</header><text>If a hearing is requested under paragraph (7)(C) and subsequently denied, an order assessing a class II civil penalty under this subsection shall become final on the date that is 30 days after the date of the denial.</text></subparagraph></paragraph> 
<paragraph id="H3C5DCF0FEF5041D6BB893C96674FB07"><enum>(9)</enum><header>Effect of action on compliance</header><text>No action by the Commandant under this subsection shall affect the obligation of any person to comply with any provision of this Act.</text></paragraph> 
<paragraph id="H3946FE7B1698493F8B36FEC6516775F4"><enum>(10)</enum><header>Judicial review</header> 
<subparagraph id="HD6841C2ABDD845438BC1642BA43D25C9"><enum>(A)</enum><header>In general</header><text>Any person against which a civil penalty is assessed under this subsection, or that commented on the proposed assessment of such a penalty in accordance with paragraph (7), may obtain review of the assessment in a court described in subparagraph (B) by—</text> 
<clause id="H4926DC09D35E4E4EA2B76D7A7A33BB0"><enum>(i)</enum><text>filing a notice of appeal with the court within the 30-day period beginning on the date on which the civil penalty order is issued; and</text></clause> 
<clause id="H3FF90C68290B4188B0352917F2EEAB32"><enum>(ii)</enum><text>simultaneously sending a copy of the notice by certified mail to the Commandant and the Attorney General.</text></clause></subparagraph> 
<subparagraph id="H38946775093C4D05942E15EB49DB6586"><enum>(B)</enum><header>Courts of jurisdiction</header><text>Review of an assessment under subparagraph (A) may be obtained by a person—</text> 
<clause id="HA8D9DAD98CC245EEA82F6B42C63815B4"><enum>(i)</enum><text>in the case of assessment of a class I civil penalty, in—</text> 
<subclause id="H78D8479245F4463FA323598374A1934E"><enum>(I)</enum><text>the United States District Court for the District of Columbia; or</text></subclause> 
<subclause id="HA3DD6FDBDB24460E9E35CE4382E329F0"><enum>(II)</enum><text>the United States district court for the district in which the violation occurred; or</text></subclause></clause> 
<clause id="HB6B18A987BB74FB19B9238E4541F5985"><enum>(ii)</enum><text>in the case of assessment of a class II civil penalty, in—</text> 
<subclause id="H0C14B6334E944904A2EC87A196838FB5"><enum>(I)</enum><text>the United States Court of Appeals for the District of Columbia Circuit; or</text></subclause> 
<subclause id="H4D9448455BF140F59FA6ACE335591078"><enum>(II)</enum><text>the United States circuit court for any other circuit in which the person resides or transacts business.</text></subclause></clause></subparagraph> 
<subparagraph id="H8627F9397AC24170990300480643A991"><enum>(C)</enum><header>Copy of record</header><text>On receipt of notice under subparagraph (A)(ii), the Commandant, shall promptly file with the appropriate court a certified copy of the record on which the order assessing a civil penalty that is the subject of the review was issued.</text></subparagraph> 
<subparagraph id="H2B85B78429D049D0A2362D608BCCF356"><enum>(D)</enum><header>Substantial evidence</header><text>A court with jurisdiction over a review under this paragraph—</text> 
<clause id="HA359639C9677452ABA7962001D54A9B8"><enum>(i)</enum><text>shall not set aside or remand an order described in subparagraph (C) unless—</text> 
<subclause id="H5DCE8CA9CC094CCBB4A39715E02E11B4"><enum>(I)</enum><text>there is not substantial evidence in the record, taken as a whole, to support the finding of a violation; or</text></subclause> 
<subclause id="HA43CBBBEE30D40ECA6E09BE7E548D432"><enum>(II)</enum><text>the assessment by the Commandant of the civil penalty constitutes an abuse of discretion; and</text></subclause></clause> 
<clause id="H46DEB62F5C6D4416AF6F214E9946FF8E"><enum>(ii)</enum><text>shall not impose additional civil penalties for the same violation unless the assessment by the Commandant of the civil penalty constitutes an abuse of discretion.</text></clause></subparagraph></paragraph> 
<paragraph id="HE9DA73EAFDD140CCA087F012F4A90073"><enum>(11)</enum><header>Collection</header> 
<subparagraph id="H83883EFFC4A843C9A90600C4FB0885E4"><enum>(A)</enum><header>In general</header><text>If any person fails to pay an assessment of a civil penalty after the assessment has become final, or after a court in a proceeding under paragraph (10) has entered a final judgment in favor of the Commandant, the Commandant shall request the Attorney General to bring a civil action in an appropriate district court to recover—</text> 
<clause id="H942A21737B62480A816DAADA2E842708"><enum>(i)</enum><text>the amount assessed; and</text></clause> 
<clause id="HF7F6C402B0774FB0BBD8CADDF1E28F91"><enum>(ii)</enum><text>interest that has accrued on the amount assessed, as calculated at currently prevailing rates beginning on the date of the final order or the date of the final judgment, as the case may be.</text></clause></subparagraph> 
<subparagraph id="HDD941178883C456B9702F74732A1F76D"><enum>(B)</enum><header>Nonreviewability</header><text>In an action to recover an assessed civil penalty under subparagraph (A), the validity, amount, and appropriateness of the civil penalty shall not be subject to judicial review.</text></subparagraph> 
<subparagraph id="H9968E9B199F94A0FB907CE6D8F0005F2"><enum>(C)</enum><header>Failure to pay penalty</header><text>Any person that fails to pay, on a timely basis, the amount of an assessment of a civil penalty under subparagraph (A) shall be required to pay, in addition to the amount of the civil penalty and accrued interest—</text> 
<clause id="H4BA65FBBCA6649D5AE9C2DD1000062EE"><enum>(i)</enum><text>attorney’s fees and other costs for collection proceedings; and</text></clause> 
<clause id="H30B4C7B466C3433B9EBD192121585C92"><enum>(ii)</enum><text>for each quarter during which the failure to pay persists, a quarterly nonpayment penalty in an amount equal to 20 percent of the aggregate amount of the assessed civil penalties and nonpayment penalties of the person that are unpaid as of the beginning of the quarter.</text></clause></subparagraph></paragraph> 
<paragraph id="H5108C70D24D24438A100C0ED6BC2EC00"><enum>(12)</enum><header>Subpoenas</header> 
<subparagraph id="H7A997557AFBF4E0D8E87CACF3F51889"><enum>(A)</enum><header>In general</header><text>The Commandant may issue subpoenas for the attendance and testimony of witnesses and the production of relevant papers, books, or documents in connection with hearings under this subsection.</text></subparagraph> 
<subparagraph id="H25AF9990D7114D5380402E5EB05E6D69"><enum>(B)</enum><header>Refusal to obey</header><text>In case of contumacy or refusal to obey a subpoena issued under this paragraph and served on any person—</text> 
<clause id="H6B8BE72267DC434FAA6F0045C4CAB409"><enum>(i)</enum><text>the United States district court for any district in which the person is found, resides, or transacts business, on application by the United States and after notice to the person, shall have jurisdiction to issue an order requiring the person to appear and give testimony before the Commandant or to appear and produce documents before the Commandant; and</text></clause> 
<clause id="H1AE4578E05424861ACA5B6503500F704"><enum>(ii)</enum><text>any failure to obey such an order of the court may be punished by the court as a contempt of the court.</text></clause></subparagraph></paragraph></subsection> 
<subsection id="H4E0DD8E1E95F403BB4A9E95F180174C9"><enum>(c)</enum><header>Civil action</header><text>The Commandant may commence, in the United States district court for the district in which the defendant is located, resides, or transacts business, a civil action to impose a civil penalty under this subsection in an amount not to exceed $25,000 for each day of violation.</text></subsection> 
<subsection id="H9E82A6C735314AFB81A811B2AF58E183"><enum>(d)</enum><header>Criminal penalties</header> 
<paragraph id="HE5C728286DDC413D984B00994FB901D5"><enum>(1)</enum><header>Negligent violations</header><text>A person that negligently violates section 4 or any regulation promulgated under this Act commits a Class A misdemeanor.</text></paragraph> 
<paragraph id="H7B9B2FD05BC745989C155BF6EDFA0045"><enum>(2)</enum><header>Knowing violations</header><text>Any person that knowingly violates section 4 or any regulation promulgated under this Act commits a Class D felony.</text></paragraph> 
<paragraph id="HAF70BC3D0DD8435C886EBE1EE5D47310"><enum>(3)</enum><header>False statements</header><text>Any person that knowingly makes any false statement, representation, or certification in any record, report, or other document filed or required to be maintained under this Act or any regulation promulgated under this Act, or that falsifies, tampers with, or knowingly renders inaccurate any testing or monitoring device or method required to be maintained under this Act or any regulation promulgated under this Act, commits a Class D felony.</text></paragraph></subsection> 
<subsection id="HA7AE73F8ACCB4B5EA63FDBA745B6B6EB"><enum>(e)</enum><header>Rewards</header> 
<paragraph id="HED3C6BE8655E4D8E8FDD1225D6299B01"><enum>(1)</enum><header>Payments to individuals</header> 
<subparagraph id="H265CD07DB68B411CADCBF6495DA59C03"><enum>(A)</enum><header>In general</header><text>The Commandant or the court, as the case may be, may order payment, from a civil penalty or criminal fine collected under this section, of an amount not to exceed <fraction>1/2</fraction> of the civil penalty or fine, to any individual who furnishes information that leads to the payment of the civil penalty or criminal fine.</text></subparagraph> 
<subparagraph id="H4BA6EDED6AD641B4A7D7921F8F92398C"><enum>(B)</enum><header>Multiple individuals</header><text>If 2 or more individuals provide information described in subparagraph (A), the amount available for payment as a reward shall be divided equitably among the individuals.</text></subparagraph> 
<subparagraph id="H20797F44E1AB4B90BD7027D7C3C5391E"><enum>(C)</enum><header>Ineligible individuals</header><text>No officer or employee of the United States, a State, or an Indian tribe who furnishes information or renders service in the performance of the official duties of the officer or employee shall be eligible for a reward payment under this subsection.</text></subparagraph></paragraph> 
<paragraph id="H382E4E8472CD4976AB46AECBC070123D"><enum>(2)</enum><header>Payments to States or Indian tribes</header><text>The Commandant or the court, as the case may be, may order payment, from a civil penalty or criminal fine collected under this section, to a State or Indian tribe providing information or investigative assistance that leads to payment of the penalty or fine, of an amount that reflects the level of information or investigative assistance provided.</text></paragraph> 
<paragraph id="H74CA9E6F572C4B3800C2A50080FA00B4"><enum>(3)</enum><header>Payments divided among States, Indian tribes, and individuals</header><text>In a case in which a State or Indian tribe and an individual under paragraph (1) are eligible to receive a reward payment under this subsection, the Commandant or the court shall divide the amount available for the reward equitably among those recipients.</text></paragraph></subsection> 
<subsection id="H05337E6C337744379405D84EFFA1DB88"><enum>(f)</enum><header>Liability in rem</header><text>A cruise vessel operated in violation of this Act or any regulation promulgated under this Act—</text> 
<paragraph id="HE31EF68E30D74BB6B2F1EC745B3D8FBF"><enum>(1)</enum><text>shall be liable in rem for any civil penalty or criminal fine imposed under this section; and</text></paragraph> 
<paragraph id="HF3E1185C27B245168833E79E2864F900"><enum>(2)</enum><text>may be subject to a proceeding instituted in the United States district court for any district in which the cruise vessel may be found.</text></paragraph></subsection> 
<subsection id="H8F0A1B27576848908EA19EB3C111191C"><enum>(g)</enum><header>Compliance orders</header> 
<paragraph id="HA339F5E6E6924603A4F7E97EE5C6953B"><enum>(1)</enum><header>In general</header><text>If the Commandant determines that any person is in violation of section 4 or any regulation promulgated under this Act, the Commandant shall—</text> 
<subparagraph id="H0D1B9229670F4704BBB506EF73366C0"><enum>(A)</enum><text>issue an order requiring the person to comply with the section or requirement; or</text></subparagraph> 
<subparagraph id="HC321E6D356AF46AA979B69318D5E35F2"><enum>(B)</enum><text>bring a civil action in accordance with subsection (b).</text></subparagraph></paragraph> 
<paragraph id="HF5DC1E9B13B1423D8166B9FBA88C4CA"><enum>(2)</enum><header>Copies of order, service</header> 
<subparagraph id="HE6F79C8F35EE46B283F2E636F9789DF3"><enum>(A)</enum><header>Corporate orders</header><text>In any case in which an order under this subsection is issued to a corporation, a copy of the order shall be served on any appropriate corporate officer.</text></subparagraph> 
<subparagraph id="H31E4AAA56982438E85A9EF1504CC93BB"><enum>(B)</enum><header>Method of service; specifications</header><text>An order issued under this subsection shall—</text> 
<clause id="H29118DE325E64BFA935FED681C5D025C"><enum>(i)</enum><text>be by personal service;</text></clause> 
<clause id="H0BD7193393A04BFEB54E7FEDF41C0007"><enum>(ii)</enum><text>state with reasonable specificity the nature of the violation for which the order was issued; and</text></clause> 
<clause id="H997DDF6FC04B49F1A3BBE9448593C58E"><enum>(iii)</enum><text>specify a deadline for compliance that is not later than—</text> 
<subclause id="HDF1AEC749FEF41EF8100B4D789CFD600"><enum>(I)</enum><text>30 days after the date of issuance of the order, in the case of a violation of an interim compliance schedule or operation and maintenance requirement; and</text></subclause> 
<subclause id="H35218BCB70FF49D2861D3EC62C26FC54"><enum>(II)</enum><text>such date as the Commandant, taking into account the seriousness of the violation and any good faith efforts to comply with applicable requirements, determines to be reasonable, in the case of a violation of a final deadline.</text></subclause></clause></subparagraph></paragraph></subsection> 
<subsection id="HD491824CF38D42B6B84FFF167BF693C"><enum>(h)</enum><header>Civil actions</header> 
<paragraph id="HB2E72EF6C7EE4244ACDF00CD779091C8"><enum>(1)</enum><header>In general</header><text>The Commandant may commence a civil action for appropriate relief, including a permanent or temporary injunction, for any violation for which the Commandant is authorized to issue a compliance order under this subsection.</text></paragraph> 
<paragraph id="H8D256A2C3522475197F2068336F66035"><enum>(2)</enum><header>Court of jurisdiction</header> 
<subparagraph id="H918F9202F03640C7A5BE6F08605D870"><enum>(A)</enum><header>In general</header><text>A civil action under this subsection may be brought in the United States district court for the district in which the defendant is located, resides, or is doing business.</text></subparagraph> 
<subparagraph id="HDA150C43274B4F6E98EE54E653CC9E02"><enum>(B)</enum><header>Jurisdiction</header><text>A court described in subparagraph (A) shall have jurisdiction to grant injunctive relief to address a violation, and require compliance, by the defendant.</text></subparagraph></paragraph></subsection></section> 
<section id="HC3E36BD04B5148FF9BBFCB4EF4756982"><enum>10.</enum><header>Citizen suits</header> 
<subsection id="H807BDB34E529474FB140001F41E69854"><enum>(a)</enum><header>Authorization</header><text>Except as provided in subsection (c), any citizen may commence a civil action on his or her own behalf—</text> 
<paragraph id="H9FB3179781214BCFAA1B9C002EBA1E20"><enum>(1)</enum><text>against any person (including the United States and any other governmental instrumentality or agency to the extent permitted by the eleventh amendment of the Constitution) that is alleged to be in violation of—</text> 
<subparagraph id="HA9767CB8A4494AD3B3413B638DC5AED7"><enum>(A)</enum><text>the conditions imposed by section 4;</text></subparagraph> 
<subparagraph id="H6D73649043C54284AFAEBDC4A15DF7A"><enum>(B)</enum><text>an effluent limit or management standard under this Act; or</text></subparagraph> 
<subparagraph id="HA36CBEE5ABFB4C259EB459A474F680B1"><enum>(C)</enum><text>an order issued by the Administrator or Commandant with respect to such a condition, effluent limit, or performance standard; or</text></subparagraph></paragraph> 
<paragraph id="HB9047982A2FC4BA2B6F702AA17A7D614"><enum>(2)</enum><text>against the Administrator or Commandant, in a case in which there is alleged a failure by the Administrator or Commandant to perform any nondiscretionary act or duty under this Act.</text></paragraph></subsection> 
<subsection id="H5F443D2AE2AE424EB3FDB6AC68579400"><enum>(b)</enum><header>Jurisdiction</header><text>The United States district courts shall have jurisdiction, without regard to the amount in controversy or the citizenship of the parties—</text> 
<paragraph id="HD9611DA59C10468C86198DCABFC10063"><enum>(1)</enum><text>to enforce a condition, effluent limit, performance standard, or order described in subsection (a)(1);</text></paragraph> 
<paragraph id="H2F0B0CF5BC274BD9A4A879D8EC181700"><enum>(2)</enum><text>to order the Administrator or Commandant to perform a nondiscretionary act or duty described in subsection (a)(2); and</text></paragraph> 
<paragraph id="HEC5815968797476EAC268DB44CFBBD0"><enum>(3)</enum><text>to apply any appropriate civil penalties under section 9(b).</text></paragraph></subsection> 
<subsection id="H2006E25170994776B112219BA7ED00B6"><enum>(c)</enum><header>Notice</header><text>No action may be commenced under this section—</text> 
<paragraph id="HA6656A31EC964CF28DAC4EE39E9F2D18"><enum>(1)</enum><text>before the date that is 60 days after the date on which the plaintiff gives notice of the alleged violation—</text> 
<subparagraph id="HDE2877169B0E440F9F2763EE25624042"><enum>(A)</enum><text>to the Administrator or Commandant; and</text></subparagraph> 
<subparagraph id="H8B503F29552F4D47A9358300D447C043"><enum>(B)</enum><text>to any alleged violator of the condition, limit, standard, or order; or</text></subparagraph></paragraph> 
<paragraph id="HEEA8C9DC03BA4A8E8EBBA8A6F47EF7A9"><enum>(2)</enum><text>if the Administrator or Commandant has commenced and is diligently prosecuting a civil or criminal action on the same matter in a court of the United States (but in any such action, a citizen may intervene as a matter of right).</text></paragraph></subsection> 
<subsection id="H1E3CFE20EB284269BFB6AFDFF6D17FF"><enum>(d)</enum><header>Venue</header> 
<paragraph id="HD658924695B04BE19712D217A97D45C"><enum>(1)</enum><header>In general</header><text>Any civil action under this section shall be brought in—</text> 
<subparagraph id="H059686F7CC094A96B9AB0589E4006DA"><enum>(A)</enum><text>the United States District Court for the District of Columbia; or</text></subparagraph> 
<subparagraph id="H9A31917632CC42C599AC78CDC4A04280"><enum>(B)</enum><text>any other United States district court for any judicial district in which a cruise vessel or the owner or operator of a cruise vessel are located.</text></subparagraph></paragraph> 
<paragraph id="H3E624BEE60324439B792E59118BA2E13"><enum>(2)</enum><header>Intervention</header><text>In a civil action under this section, the Administrator or the Commandant, if not a party, may intervene as a matter of right.</text></paragraph> 
<paragraph id="HCD9510A363F8440A9ED8D168749F11D2"><enum>(3)</enum><header>Procedures</header> 
<subparagraph id="HD0A71F6110A64865B3E9E74FBA4C7691"><enum>(A)</enum><header>Service</header><text>In any case in which a civil action is brought under this section in a court of the United States, the plaintiff shall serve a copy of the complaint on—</text> 
<clause id="HE593774CEAB648BF9F856EA7A59FA1DB"><enum>(i)</enum><text>the Attorney General;</text></clause> 
<clause id="H533382A9BB7C4832B324301413D947B4"><enum>(ii)</enum><text>the Administrator; and</text></clause> 
<clause id="H2AEDCE744C974FE0A4C957252300CC78"><enum>(iii)</enum><text>the Commandant.</text></clause></subparagraph> 
<subparagraph id="H7A41C9E5B4764A7389C35B08B518DA82"><enum>(B)</enum><header>Consent judgments</header><text>No consent judgment shall be entered in a civil action under this section to which the United States is not a party before the date that is 45 days after the date of receipt of a copy of the proposed consent judgment by—</text> 
<clause id="HDA17CF3299494FE18B70AAF3C7433CDA"><enum>(i)</enum><text>the Attorney General;</text></clause> 
<clause id="HAA05578BD59841DEA6CEF7C76BFABAC5"><enum>(ii)</enum><text>the Administrator; and</text></clause> 
<clause id="H8384160FBFC9474B90E169CC51F22D3"><enum>(iii)</enum><text>the Commandant.</text></clause></subparagraph></paragraph></subsection> 
<subsection id="HB1F47A53C4AD48B3A0C83D35E63BEC98"><enum>(e)</enum><header>Litigation costs</header> 
<paragraph id="H55FB45AEB9124C220092321D86A26468"><enum>(1)</enum><header>In general</header><text>A court of jurisdiction, in issuing any final order in any civil action brought in accordance with this section, may award costs of litigation (including reasonable attorney’s and expert witness fees) to any prevailing or substantially prevailing party, in any case in which the court determines that such an award is appropriate.</text></paragraph> 
<paragraph id="H31EB5C1D04AA4040A89B4C949799434F"><enum>(2)</enum><header>Security</header><text>In any civil action under this section, the court of jurisdiction may, if a temporary restraining order or preliminary injunction is sought, require the filing of a bond or equivalent security in accordance with the Federal Rules of Civil Procedure.</text></paragraph></subsection> 
<subsection id="HDD0FC7944FA04611BE12883FB37ED598"><enum>(f)</enum><header>Statutory or common law rights not restricted</header><text>Nothing in this section restricts the rights of any person (or class of persons) under any statute or common law to seek enforcement or other relief (including relief against the Administrator or Commandant).</text></subsection> 
<subsection id="HFAC31A31206D46B28268E73C32E4CD5"><enum>(g)</enum><header>Civil action by State governors</header><text>A Governor of a State may commence a civil action under subsection (a) of this section, without regard to the limitation under subsection (c), against the Administrator or Commandant in any case in which there is alleged a failure of the Administrator or Commandant to enforce an effluent limit or performance standard under this Act, the violation of which is causing—</text> 
<paragraph id="HC3C9861E01F2448B963600E3A61D1B20"><enum>(1)</enum><text>an adverse effect on the public health or welfare in the State; or</text></paragraph> 
<paragraph id="HCE92A96B12AF45F4B2B941E6BE07609C"><enum>(2)</enum><text>a violation of any water quality requirement in the State.</text></paragraph></subsection></section> 
<section id="H95D5BD74A1F5422DB45122E0741F0908"><enum>11.</enum><header>Alaskan cruise vessels</header> 
<subsection id="H8E29E5AACD5B4FF8B044A19910C2F879"><enum>(a)</enum><header>Definition of Alaskan cruise vessel</header><text>In this section, the term <term>Alaskan cruise vessel</term> means a cruise vessel—</text> 
<paragraph id="H7BC650A193904B21BA2736F7EF55A208"><enum>(1)</enum><text>that seasonally operates in water of or surrounding the State of Alaska;</text></paragraph> 
<paragraph id="H82A54B2D4249474FA16C57FDA6352A9"><enum>(2)</enum><text>in which is installed, not later than the date of enactment of this Act (or, at the option of the Commandant, not later than September 30 of the fiscal year in which this Act is enacted), and certified by the State of Alaska for continuous discharge and operation in accordance with all applicable Federal and State law (including regulations), an advanced treatment system for the treatment and discharge of graywater and sewage; and</text></paragraph> 
<paragraph id="HB400FC95FF234EDF8E2D9FE59EDCBD1C"><enum>(3)</enum><text>that enters a port of the United States.</text></paragraph></subsection> 
<subsection id="H5E00FF35CDEB42438D8CACD36C00789E"><enum>(b)</enum><header>Applicability</header> 
<paragraph id="H8B45272070F649F1B72EA78E197B5D00"><enum>(1)</enum><header>In general</header><text>Except as provided in paragraph (2), an Alaskan cruise vessel shall not be subject to this Act (including regulations promulgated under this Act) until the date that is 15 years after the date of enactment of this Act.</text></paragraph> 
<paragraph id="H6BDF651231644585A5B8788D4C95046C"><enum>(2)</enum><header>Exceptions</header><text>An Alaskan cruise vessel—</text> 
<subparagraph id="H25E07AEDFC19493C975860BB5800A0B7"><enum>(A)</enum><text>shall not be subject to the minimum effluent limits prescribed under section 5(b) until the date that is 3 years after the date of enactment of this Act;</text></subparagraph> 
<subparagraph id="H8819E638D00F41AB823394235B914200"><enum>(B)</enum><text>shall not be subject to effluent limits promulgated under section 5(a) or 5(c) until the date that is 6 years after the date of enactment of this Act; and</text></subparagraph> 
<subparagraph id="HBD672BD039E7474700F00057C9021400"><enum>(C)</enum><text>shall be prohibited from discharging sewage, graywater, and bilge water in the territorial sea, in accordance with this Act, as of the date of enactment of this Act.</text></subparagraph></paragraph></subsection></section> 
<section id="H2C92C1C6765B4EC982597C1B33D233CA"><enum>12.</enum><header>Ballast water</header><text display-inline="no-display-inline">It is the sense of Congress that action should be taken to enact legislation requiring strong, mandatory standards for ballast water to reduce the threat of aquatic invasive species.</text></section> 
<section id="H7793EEFE13544A2AA27108D0BC804DA3"><enum>13.</enum><header>Funding</header> 
<subsection id="H28026B1825CC4D55BB9EBE0500D397A5"><enum>(a)</enum><header>Authorization of appropriations</header><text>There are authorized to be appropriated to the Commandant and the Administrator such sums as are necessary to carry out this Act for each of fiscal years 2006 through 2010.</text></subsection> 
<subsection id="HAC79DD3717FF408E841CE3E74ED57859"><enum>(b)</enum><header>Cruise Vessel Pollution Control Fund</header> 
<paragraph id="HC13B5589A32549E7B6C79D663E857100"><enum>(1)</enum><header>Establishment</header><text>There is established in the general fund of the Treasury a separate account to be known as the <quote>Cruise Vessel Pollution Control Fund</quote> (referred to in this section as the <quote>Fund</quote>).</text></paragraph> 
<paragraph id="H5BE15AD178324CA600B63C37C7195FA4"><enum>(2)</enum><header>Appropriation of amounts</header><text>There are appropriated to the Fund such amounts as are deposited in the Fund under subsection (c)(5).</text></paragraph> 
<paragraph id="H88194E5D94C74F8B83BC76C38F5D414C"><enum>(3)</enum><header>Use of amounts in Fund</header><text>The Administrator and the Commandant may use amounts in the fund, without further appropriation, to carry out this Act.</text></paragraph></subsection> 
<subsection id="HA0123A539A194DF78E82DC63BFBA2242"><enum>(c)</enum><header>Fees on cruise vessels</header> 
<paragraph id="H2C2783E0959940A29DF2A0AD64C3CDA"><enum>(1)</enum><header>In general</header><text>The Commandant shall establish and collect from each cruise vessel a reasonable and appropriate fee, in an amount not to exceed $10 for each paying passenger on a cruise vessel voyage, for use in carrying out this Act.</text></paragraph> 
<paragraph id="HCE0EEE305A37415C893824048376C72B"><enum>(2)</enum><header>Adjustment of fee</header> 
<subparagraph id="H892BDE9B551B4D3D9E57D86DA37DF31E"><enum>(A)</enum><header>In general</header><text>The Commandant shall biennially adjust the amount of the fee established under paragraph (1) to reflect changes in the Consumer Price Index for All Urban Consumers published by the Department of Labor during each 2-year period.</text></subparagraph> 
<subparagraph id="HAC11836D9CDF4E09A1CFC8D439A1E400"><enum>(B)</enum><header>Rounding</header><text>The Commandant may round the adjustment in subparagraph (A) to the nearest <fraction>1/10</fraction> of a dollar.</text></subparagraph></paragraph> 
<paragraph id="H74A3222180B54DAFAFDE1700F2A0189"><enum>(3)</enum><header>Factors in establishing fees</header> 
<subparagraph id="HBB5F939837D3422B8CE5169309E9EF7"><enum>(A)</enum><header>In general</header><text>In establishing fees under paragraph (1), the Commandant may establish lower levels of fees and the maximum amount of fees for certain classes of cruise vessels based on—</text> 
<clause id="HAFF3AC28A845499FB8D1FD4D6C181EF"><enum>(i)</enum><text>size;</text></clause> 
<clause id="H15776822414C45A2BF66066013D5C838"><enum>(ii)</enum><text>economic share; and</text></clause> 
<clause id="H78DFCC09E6104D958DD313E97089F148"><enum>(iii)</enum><text>such other factors as are determined to be appropriate by the Commandant and Administrator.</text></clause></subparagraph> 
<subparagraph id="H50264FBE3C814E649FE1F39165C87D05"><enum>(B)</enum><header>Fee schedules</header><text>Any fee schedule established under paragraph (1), including the level of fees and the maximum amount of fees, shall take into account—</text> 
<clause id="H158B98F021CF495AA89D645CB2F550A6"><enum>(i)</enum><text>cruise vessel routes;</text></clause> 
<clause id="H4DBA755858834000ACB9C3292C4C2A3"><enum>(ii)</enum><text>the frequency of stops at ports of call by cruise vessels; and</text></clause> 
<clause id="H8B30A7518D544822AF6592EE756C00E3"><enum>(iii)</enum><text>other relevant considerations.</text></clause></subparagraph></paragraph> 
<paragraph id="H1066C7C3A1C2494CB4838634BD9780CF"><enum>(4)</enum><header>Collection of fees</header><text>A fee established under paragraph (1) shall be collected by the Commandant from the owner or operator of each cruise vessel to which this Act applies.</text></paragraph> 
<paragraph id="H3085A2EE689A42AF9B3F16C777658018"><enum>(5)</enum><header>Deposits to Fund</header><text>Notwithstanding any other provision of law, all fees collected under this subsection, and all penalties and payments collected for violations of this Act, shall be deposited into the Fund.</text></paragraph></subsection></section> 
<section id="HCD97E84F978C4E17A298A01683B5F62B"><enum>14.</enum><header>Effect on other law</header> 
<subsection id="H0FB599426291439797EDC6762BA16EED"><enum>(a)</enum><header>United States</header><text>Nothing in this Act restricts, affects, or amends any other law or the authority of any department, instrumentality, or agency of the United States.</text></subsection> 
<subsection id="H9637DB9CD55A4C3EB8F80297C2EDEC58"><enum>(b)</enum><header>States and interstate agencies</header> 
<paragraph id="HBDFE6D82B08043C490541BA4FB494FAC"><enum>(1)</enum><header>In general</header><text>Except as provided in paragraph (2), nothing in this Act precludes or denies the right of any State (including a political subdivision of a State) or interstate agency to adopt or enforce—</text> 
<subparagraph id="H3ECEE51C6BC945F7B8A272E81ACD53D"><enum>(A)</enum><text>any standard or limit relating to the discharge of pollutants by cruise ships; or</text></subparagraph> 
<subparagraph id="HF5ED0B0F5F954782B380634F563C7D36"><enum>(B)</enum><text>any requirement relating to the control or abatement of pollution.</text></subparagraph></paragraph> 
<paragraph id="HC4139AB1DAE1463986AE24ACF481E730"><enum>(2)</enum><header>Exception</header><text>If an effluent limit, performance standard, water quality standard, or any other prohibition or limitation is in effect under Federal law, a State (including a political subdivision of a State) or interstate agency described in paragraph (1) may not adopt or enforce any effluent limit, performance standard, water quality standard, or any other prohibition that—</text> 
<subparagraph id="H8691240F2CC7472D90B4DB0000F2E9E9"><enum>(A)</enum><text>is less stringent than the effluent limit, performance standard, water quality standard, or other prohibition or limitation under this Act; or</text></subparagraph> 
<subparagraph id="H683450D754714A42BF9D759F9DC89930"><enum>(B)</enum><text>impairs or in any manner affects any right or jurisdiction of the State with respect to the waters of the State.</text></subparagraph></paragraph></subsection></section>
