<section section-type="section-one" id="H56E740A8EB5A492FB400F0DEB373884D" display-inline="no-display-inline"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Amtrak Reauthorization Act of 2005</short-title></quote>.</text></section> 
<section id="H9BD2CA84F1FE4B3DA906DD298432C358"><enum>2.</enum><header>Authorization of appropriations</header><text display-inline="no-display-inline"><external-xref legal-doc="usc" parsable-cite="usc/49/24104">Section 24104</external-xref> of title 49, United States Code, is amended to read as follows:</text>

<section id="H8AA6C6EAE9EE43B888D190A46B00E623"><enum>24104.</enum><header>Authorization of appropriations</header> 
<subsection id="HBCC41F4885EA4A6CA136CB1BFA8229F1"><enum>(a)</enum><header>In general</header><text>There are authorized to be appropriated to the Secretary of Transportation $2,000,000,000 for each of the fiscal years 2006 through 2008, for the benefit of Amtrak for capital expenditures under chapters 243, 247, and 249 of this title, operating expenses, and payments described in subsection (b).</text></subsection> 
<subsection id="HA55FC459FEEA4892B3576F25F32F1600"><enum>(b)</enum><header>Mandatory payments</header> 
<paragraph id="H612F1E3296434FC3AFCE4B09AFB54797"><enum>(1)</enum><header>In general</header><text>Funds authorized under subsection (a) shall include—</text> 
<subparagraph id="HD92AED795FE54FAABDB1C810A44FAD83"><enum>(A)</enum><text>an amount equal to the amount Amtrak is required to pay under <external-xref legal-doc="usc" parsable-cite="usc/26/3221">section 3221</external-xref> of the Internal Revenue Code of 1986 (<external-xref legal-doc="usc" parsable-cite="usc/26/3221">26 U.S.C. 3221</external-xref>) that is more than the amount needed for anticipated benefits for individuals who retire from Amtrak and for their beneficiaries; and</text></subparagraph> 
<subparagraph id="HC41B4758063E48CE88F2359F222C5DA1"><enum>(B)</enum><text>amounts necessary to pay—</text> 
<clause id="H29FF0EFB508E4337A3DF5597D3EB6C2F"><enum>(i)</enum><text>obligations of Amtrak under section 8(a) of the Railroad Unemployment Insurance Act (<external-xref legal-doc="usc" parsable-cite="usc/45/358">45 U.S.C. 358(a)</external-xref>) due in those fiscal years that are more than obligations of Amtrak calculated on an experience-related basis; and</text></clause> 
<clause id="H6684F016C8D44EB2864F3BD794A88C17"><enum>(ii)</enum><text>obligations of Amtrak due under <external-xref legal-doc="usc" parsable-cite="usc/26/3321">section 3321</external-xref> of the Internal Revenue Code of 1986 (<external-xref legal-doc="usc" parsable-cite="usc/26/3321">26 U.S.C. 3321</external-xref>).</text></clause></subparagraph></paragraph> 
<paragraph id="H52F3AD2E8B6F432A91C9CE73732C7668"><enum>(2)</enum><header>Request for transfer of funds</header><text>The Secretary shall make payments to the Treasury of amounts authorized under paragraph (1) only after the Secretary has received from Amtrak a request for the transfer of such funds, which shall include materials supporting, to the satisfaction of the Secretary, the amount of the request.</text></paragraph></subsection> 
<subsection id="H52559CD36E804757A6C56B288F94B0BD"><enum>(c)</enum><header>Contractual obligations</header><text>From amounts appropriated pursuant to this section, the Secretary and the Amtrak Board of Directors shall ensure that sufficient funds are reserved to satisfy Amtrak’s contractual obligations for commuter and State-supported passenger rail service.</text></subsection> 
<subsection id="H836E72A29B2E451288B14C23927E409B"><enum>(d)</enum><header>Annual business plan and supplemental reports</header> 
<paragraph id="H7A9240176FF44700A4E706E1C11016F"><enum>(1)</enum><header>Business plan</header><text>Not later than September 15 of each of 2005, 2006, and 2007, Amtrak shall transmit to the Secretary and the Congress a comprehensive business plan for the subsequent fiscal year, including, as applicable, targets for ridership, revenues, and capital and operating expenses. The plan shall include the following:</text> 
<subparagraph id="H3AC62150DD7C4F89B9F3D1ECABF242E9"><enum>(A)</enum><text>A separate accounting of such targets for each of the following:</text> 
<clause id="H1D8C175F4D0846A4AB91514D6E524D69"><enum>(i)</enum><text>Northeast Corridor.</text></clause> 
<clause id="HC6612FB999494C72BD4820D8E9C6F4D5"><enum>(ii)</enum><text>Commuter service.</text></clause> 
<clause id="H89F1352F4AC24F05941374988FF9E24"><enum>(iii)</enum><text>Long-distance Amtrak service.</text></clause> 
<clause id="H2D0A050BF46E4B4783FE31918F661C2B"><enum>(iv)</enum><text>State-supported service.</text></clause> 
<clause id="H9330E9AEAD704467BA196E7CE9FF5D37"><enum>(v)</enum><text>Commercial activities (including contract operations and mail and express).</text></clause><continuation-text continuation-text-level="subparagraph">The plan shall also include targets for each intercity train route, including Autotrain.</continuation-text></subparagraph> 
<subparagraph id="H8B619D76CF4E4395B6F04579002C80A9"><enum>(B)</enum><text>With respect to capital projects, a description of the work to be funded, a work timetable, cost estimates, and a list of other funding sources if the project is not entirely funded by the Federal Government.</text></subparagraph></paragraph> 
<paragraph id="HA0040CD707BA410DA1DB9C9C4C8B754D"><enum>(2)</enum><header>Supplemental reports</header><text>Not later than October 1, 2005, and once each alternate month thereafter, Amtrak shall transmit to the Secretary and the Congress a supplemental report regarding the business plan transmitted under paragraph (1), which shall describe the work completed to date, any changes to the business plan, and the reasons for such changes.</text></paragraph></subsection> 
<subsection id="H333F9939D3984874BC4845E6D88B4B4B"><enum>(e)</enum><header>Availability of amounts and early appropriations</header> 
<paragraph display-inline="yes-display-inline" id="HB156A9F3F4524DC182E81D321E2002F"><enum>(1)</enum><text>Amounts appropriated under this section remain available until expended.</text></paragraph> 
<paragraph indent="up1" id="HF10C5944EEFD4608A97D02478BC506A6"><enum>(2)</enum><text>Amounts for capital acquisitions and improvements may be appropriated in a fiscal year before the fiscal year in which the amounts will be obligated.</text></paragraph></subsection> 
<subsection id="HB3CF889377AE480C9C5865ECAE24727F"><enum>(f)</enum><header>Limitations on use</header><text>Amounts appropriated under this section may not be used to subsidize operating losses of commuter rail passenger or rail freight transportation.</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></section>
