<official-title>To amend the District of Columbia Home Rule Act to provide the District of Columbia with autonomy over its budgets, and for other purposes.</official-title>

<section section-type="section-one" id="HB59151C733B645AF00CDDDB38B777CB7" display-inline="no-display-inline"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>District of Columbia Budget Autonomy Act of 2005</short-title></quote>.</text></section> 
<section id="HC94FE1B84FB743699FEEBA56FFFC27C7"><enum>2.</enum><header>Enactment of District of Columbia local budget</header> 
<subsection id="H05FB6FBF70034A93846153C397001231"><enum>(a)</enum><header>In general</header><text>Section 446 of the District of Columbia Home Rule Act (sec. 1–204.46, D.C. Official Code) is amended to read as follows:</text>

<section id="HCDA5893126CB434EA6B587B00151875"><enum>446.</enum><header>Enactment of local budget</header> 
<subsection display-inline="yes-display-inline" id="HD3BCDA78760046CBB22801154FDCDFB"><enum>(a)</enum><header>Adoption of budgets and supplements</header><text>The Council, within 56 calendar days after receipt of the budget proposal from the Mayor, and after public hearing, shall by Act adopt the annual budget for the District of Columbia government. Any supplements thereto shall also be adopted by Act by the Council after public hearing.</text></subsection> 
<subsection id="H6D5077D21D124F4A9C8F37009FEDC307"><enum>(b)</enum><header>Transmission to President during control years</header><text>In the case of a budget for a fiscal year which is a control year, the budget so adopted shall be submitted by the Mayor to the President for transmission by him to the Congress, except that the Mayor shall not transmit any such budget, or amendments or supplements thereto, to the President until the completion of the budget procedures contained in this Act and the District of Columbia Financial Responsibility and Management Assistance Act of 1995.</text></subsection> 
<subsection id="HE31314F5A38D4ED9938CF94D4F451669"><enum>(c)</enum><header>Prohibiting obligations and expenditures not authorized under budget</header><text>Except as provided in section 445A(b), section 467(d), section 471(c), section 472(d), section 475(e), section 483(d), and subsections (f), (g), (h)(3), and (i)(3) of section 490, no amount may be obligated or expended by any officer or employee of the District of Columbia government unless—</text> 
<paragraph id="HE90B33BFF9EB4C38B733BBB4AB6FBCBA"><enum>(1)</enum><text>such amount has been approved by an Act of the Council (and then only in accordance with such authorization) and a copy of such Act has been transmitted by the Chairman to the Congress; or</text></paragraph> 
<paragraph id="H6A09B0740BEC426E9E681974C8DFB58"><enum>(2)</enum><text>in the case of an amount obligated or expended during a control year, such amount has been approved by an Act of Congress (and then only in accordance with such authorization).</text></paragraph></subsection> 
<subsection id="H638054D6BDA2456300BF61FF19DDC2B8"><enum>(d)</enum><header>Restrictions on reprogramming of amounts</header><text>After the adoption of the annual budget for a fiscal year (beginning with the annual budget for fiscal year 1995), no reprogramming of amounts in the budget may occur unless the Mayor submits to the Council a request for such reprogramming and the Council approves the request, but only if any additional expenditures provided under such request for an activity are offset by reductions in expenditures for another activity.</text></subsection> 
<subsection id="HDA1F95CF9B8348B99E043C78884F033F"><enum>(e)</enum><header>Definition</header><text>In this part, the term <term>control year</term> has the meaning given such term in section 305(4) of the District of Columbia Financial Responsibility and Management Assistance Act of 1995.</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection> 
<subsection id="H41B689832C2649F0A2E35DFAF4B30794"><enum>(b)</enum><header>Length of congressional review period for budget acts</header><text>Section 602(c) of such Act (sec. 1–206.02(c), D.C. Official Code) is amended—</text> 
<paragraph id="H033364BE74A74CC6AD04CD374DABA217"><enum>(1)</enum><text>in the second sentence of paragraph (1), by striking <quote>paragraph (2)</quote> and inserting <quote>paragraphs (2) and (4)</quote>; and</text></paragraph> 
<paragraph id="HD7C30996F6D8454AB1EECEC447C3E4F5"><enum>(2)</enum><text>by adding at the end the following new paragraph:</text> 
<quoted-block id="H768A855443A94C088B14C2CE911C378B"> 
<paragraph indent="up1" id="H1B296A3B47484E18A5D085B96BC18DB"><enum>(4)</enum><text>In the case of any Act transmitted under the first sentence of paragraph (1) to which section 446 applies and for which the fiscal year involved is not a control year, such Act shall take effect upon the expiration of the 30-calendar-day period beginning on the day such Act is transmitted, or upon the date prescribed by such Act, whichever is later, unless during such 30-day period, there has been enacted into law a joint resolution disapproving such Act. If such 30-day period expires on any day on which neither House is in session because of an adjournment sine die, a recess of more than three days, or an adjournment of more than three days, the period applicable under the previous sentence shall be extended for 5 additional days (excluding Saturdays, Sundays, and holidays, and any day on which neither House is in session because of an adjournment sine die, a recess of more than three days, or an adjournment of more than three days). In any case in which any such joint resolution disapproving such an Act has, within the applicable period, passed both Houses of Congress and has been transmitted to the President, such resolution, upon becoming law, subsequent to the expiration of such period, shall be deemed to have repealed such Act, as of the date such resolution becomes law. The provisions of section 604 shall apply with respect to any joint resolution disapproving any Act pursuant to this paragraph.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection> 
<subsection id="HABD335B99EAD4CFB926314A4B2AFC385"><enum>(c)</enum><header>Conforming amendments</header> 
<paragraph display-inline="yes-display-inline" id="HA632A97EF8D14144B158B4491CCD8C6D"><enum>(1)</enum><text>Sections 467(d), 471(c), 472(d)(2), 475(e)(2), and 483(d), and subsections (f), (g)(3), (h)(3), and (i)(3) of section 490 of such Act are each amended by striking <quote>The fourth sentence of section 446</quote> and inserting <quote>Section 446(c)</quote>.</text></paragraph> 
<paragraph indent="up1" id="H9C7AE86F757B45D68CF30CBD57E364"><enum>(2)</enum><text>The third sentence of section 412(a) of such Act (sec. 1–204.12(a), D.C. Official Code) is amended by inserting <quote>for a fiscal year which is a control year described in such section</quote> after <quote>section 446 applies</quote>.</text></paragraph> 
<paragraph indent="up1" id="HA46E283D296441CDA050A4345E3D4858"><enum>(3)</enum><text>Section 202(c)(2) of the District of Columbia Financial Responsibility and Management Assistance Act of 1995 (sec. 47–392.02(c)(2), D.C. Official Code) is amended by striking <quote>the first sentence of section 446</quote> and inserting <quote>section 446(a)</quote>.</text></paragraph> 
<paragraph indent="up1" id="HF4EAB2535B1E4E05931E1066373181BF"><enum>(4)</enum><text>Section 202(d)(3)(A) of the District of Columbia Financial Responsibility and Management Assistance Act of 1995 (sec. 47–392.02(d)(3)(A), D.C. Official Code) is amended by striking <quote>the first sentence of section 446</quote> and inserting <quote>section 446(a)</quote>.</text></paragraph> 
<paragraph indent="up1" id="H7052786BE53541D8BDD7036968A64EA7"><enum>(5)</enum><text>Section 11206 of the National Capital Revitalization and Self-Government Improvement Act of 1997 (sec. 24–106, D.C. Official Code) is amended by striking <quote>the fourth sentence of section 446</quote> and inserting <quote>section 446(c)</quote>.</text></paragraph></subsection> 
<subsection id="HC53E7B40378746168886F427DC0255A6"><enum>(d)</enum><header>Clerical amendment</header><text>The item relating to section 446 in the table of contents of such Act is amended to read as follows:</text>

<subsection id="H12D584119F97447CB89BF9293774EDC"><enum>(a)</enum><header>In general</header><text>Section 404(f) of the District of Columbia Home Rule Act (sec. 1–204.4(f), D.C. Official Code) is amended by striking <quote>transmitted by the Chairman to the President of the United States</quote> both places it appears and inserting the following: <quote>incorporated in such Act (or, in the case of an item or provision contained in a budget act for a control year, transmitted by the Chairman to the President)</quote>.</text></subsection> 
<subsection id="H661225792B2D439300DD7D35EA023D70"><enum>(b)</enum><header>Conforming amendment</header><text>Section 404(f) of such Act (sec. 1–204.04(f), D.C. Official Code) is amended—</text> 
<paragraph id="HF850E5CD13554E1EB2588EC1FFD4972"><enum>(1)</enum><text>by striking <quote>(f)</quote> and inserting <quote>(f)(1)</quote>;</text></paragraph> 
<paragraph id="H15202C006A124175AB5900BCDAE77E31"><enum>(2)</enum><text>in the fifth sentence, by striking <quote>(as defined in section 305(4) of the District of Columbia Financial Responsibility and Management Assistance Act of 1995), this subsection</quote> and inserting <quote>this paragraph</quote>; and</text></paragraph> 
<paragraph id="H386921D501B0435D9207DC65C002B7D"><enum>(3)</enum><text>by adding at the end the following new paragraph:</text>

Official Code) is amended—</text> 
<paragraph id="H6C41465975F64D96A6D1713C533561B"><enum>(1)</enum><text>by striking <quote>Act of Congress</quote> each place it appears and inserting <quote>act of the Council (or Act of Congress, in the case of a year which is a control year)</quote>; and</text></paragraph> 
<paragraph id="HAE3EB75E0DB84D80AA2C92FAF448B07C"><enum>(2)</enum><text>by striking <quote>Acts of Congress</quote> and inserting <quote>acts of the Council (or Acts of Congress, in the case of a year which is a control year)</quote>.</text></paragraph></section> 
<section id="H7FF11C981317441A87CB5E377C6CA32D"><enum>5.</enum><header>Other conforming amendments relating to changes in Federal role in budget process</header> 
<subsection id="H4989BDC06E784C43AE4724685EAB25EF"><enum>(a)</enum><header>Federal authority over budget-making process</header><text>Section 603(a) of the District of Columbia Home Rule Act (sec. 1–206.03, D.C. Official Code) is amended by inserting before the period at the end the following: <quote>for a fiscal year which is a control year</quote>.</text></subsection> 
<subsection id="H011ABF71976046EDA57FF7008619CE23"><enum>(b)</enum><header>Restrictions applicable during control years</header><text>Section 603(d) of such Act (sec. 1–206.03(d), D.C. Official Code) is amended to read as follows:</text>

<subsection id="H1423E6D1C7E14F76A8866747E384F2AC"><enum>(d)</enum><text>In the case of a fiscal year which is a control year, the Council may not approve, and the Mayor may not forward to the President, any budget which is not consistent with the financial plan and budget established for the fiscal year under subtitle A of title II of the District of Columbia Financial Responsibility and Management Assistance Act of 1995.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection> 
<subsection id="H0B6260F107FE4EC0AAF1AD19BC001D52"><enum>(c)</enum><header>Definition</header><text>Section 603(f) of such Act (sec. 1–206.03(f), D.C. Official Code) is amended to read as follows:</text>

<section id="HE30F00DB7E524C5DAEC06500B1D4DD93"><enum>6.</enum><header>Continuation of general provisions in appropriations acts</header><text display-inline="no-display-inline">Any general provision contained in a general appropriation bill which includes the appropriation of Federal payments to the District of Columbia for a fiscal year (or, in the case of such a bill which is included as a division, title, or other portion of another general appropriation bill, any general provision contained in such division, title, or other portion) in effect on the date of enactment of this Act shall remain in effect until the date of the enactment of a general appropriation bill which includes the appropriation of Federal payments to the District of Columbia for the following fiscal year.</text></section> 
<section id="H659C9BDB591D414BB2E4C697F3FEA98E"><enum>7.</enum><header>Effective date</header><text display-inline="no-display-inline">The amendments made by this Act shall apply to budgets of the District of Columbia for fiscal years beginning on or after October 1, 2006.</text></section>
