<section id="H193C5CF35F034BF5A163848E12F25071" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Broadcast Ownership for the 21st Century Act</short-title></quote>.</text> </section> 
<section id="HF9A5DD7E78284A62B8625714521CB7D3"><enum>2.</enum><header>Cross-ownership limitations</header> 
<subsection id="H3A167CCECD1C497F90D2B24319E5E3D"><enum>(a)</enum><header>Rule changes required</header><text>The Federal Communications Commission shall modify section 73.3555 of its regulations (47 CFR 73.3555) by eliminating any provisions limiting the granting or renewal of an AM or FM radio or television broadcast station license to any party (including parties under common control) on the basis of the ownership, operation, or control by such party of a daily newspaper.</text></subsection> 
<subsection id="H4E8E92849E1D454DAB2E516EBE749549"><enum>(b)</enum><header>Deadline for actions</header><text>The Federal Communications Commission shall complete all actions necessary to complete the modifications required by this section within 90 days after the date of enactment of this Act.</text></subsection></section> 
<section id="HB39C1A913FDA4A7D97D058260746BED2"><enum>3.</enum><header>Television multiple ownership</header><text display-inline="no-display-inline">Section 310 of the <act-name parsable-cite="CA34">Communications Act of 1934</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/47/310">47 U.S.C. 310</external-xref>) is amended by adding at the end the following new subsection:</text>

<subsection id="H76FE69550A584ABC9B84DEB06B322768"><enum>(f)</enum><header>National audience reach calculation</header><text>In calculating the national audience reach limitations for television stations under the Commission’s regulations, UHF television stations shall be attributed with no more than 50 percent of the television households in their market.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></section> 
<section id="H0B211D0585C34FA69003E211CFCCE02"><enum>4.</enum><header>Limitation on Federal Communications Commission authority</header> 
<subsection id="H7D4650156BB94284B537C56B4D346C40"><enum>(a)</enum><header>Amendment</header><text>Section 202(c)(1)(B) of the Telecommunications Act of 1996 is amended by striking <quote>39 percent</quote> and inserting <quote>45 percent</quote>.</text></subsection> 
<subsection id="H40497183CECB423C9327B655F5C2C84F"><enum>(b)</enum><header>Deadline for implementation</header><text>The Federal Communications Commission shall amend its regulations to implement the amendment made by subsection (a) within 90 days after the date of enactment of this Act. In amending such regulations, the Commission shall not revise section 73.3555(e)(2)(i) of its regulations (47 CFR 73.3555(e)(2)(i)).</text></subsection></section> 
<section id="HC9F5715BBAB8446199B05FEE2DAD49EF"><enum>5.</enum><header>Multiple television station ownership</header> 
<subsection id="H8688D92F866E4EF000C65BF26B5CB7FE"><enum>(a)</enum><header>Local television multiple ownership rule changes required</header><text>The Federal Communications Commission shall revise its rule for local television multiple ownership set forth in section 73.3555(b) of its regulations (47 CFR 73.3555(b)) to permit a person or entity to directly or indirectly own, operate, or control two television stations in the same designated market area if—</text> 
<paragraph id="H98271A7649014F5C00003000A1B0942F"><enum>(1)</enum><text>the grade B contours of such stations do not overlap; or</text></paragraph> 
<paragraph id="HADC4F5A58BCF40FABB9F9B39E170A3E6"><enum>(2)</enum><text>the grade B contours of such stations do overlap and at least 6 independent broadcast or cable television voices would remain in the designated market area after the transfer of ownership, operation, or control of the license of the stations in question.</text></paragraph></subsection> 
<subsection id="H75A3FDE5A4784344997DAE71FD86A2F6"><enum>(b)</enum><header>Independent voices</header><text>In making the revision required by subsection (a), the Commission shall determine the number of independent broadcast or cable television voices that would remain as follows:</text> 
<paragraph id="H58042A7D9863454C9D616BDEE236F3C"><enum>(1)</enum><header>Broadcast television stations</header><text>Each independently owned and operating full power broadcast television station within the designated market area shall be counted as one independent voice.</text></paragraph> 
<paragraph id="H6566099533894E46864739F82D5549D8"><enum>(2)</enum><header>One cable system counted</header><text>Regardless of how many individual cable systems operate in the designated market area, if cable television is generally available to households in the area, cable television shall be treated as one independent voice.</text></paragraph></subsection></section>
