<official-title>To amend the Truth in Lending Act to protect consumers from usury and unreasonable fees, and for other purposes.</official-title>

<section id="HE39508240DE546EE00E273B66D034400" section-type="section-one" display-inline="no-display-inline"><enum>1.</enum><header>Short Title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Loan Shark Prevention Act</short-title></quote>.</text></section> 
<section id="HBB1C144FEB14414FA387465B5279CAB9"><enum>2.</enum><header>National consumer credit usury rate</header><text display-inline="no-display-inline">Section 107 of the Truth in Lending Act (<external-xref legal-doc="usc" parsable-cite="usc/15/1606">15 U.S.C. 1606</external-xref>) is amended by adding at the end thereof the following new subsection:</text>

<subsection id="HF49B329B74A34090BBEAA5A442F850A4"><enum>(f)</enum><header>National consumer credit usury rate</header><text>The annual percentage rate applicable to any extension of credit may not exceed by more than 8 percentage points the rate established under <external-xref legal-doc="usc" parsable-cite="usc/26/6621">section 6621(a)(2)</external-xref> of the Internal Revenue Code of 1986, as determined by the Board.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></section> 
<section id="H95E881289F3145E8AF509F004456B9F8"><enum>3.</enum><header>Cap on fees charged by financial institutions</header> 
<subsection id="H4D4067CCF48942989D3BE5491D949670"><enum>(a)</enum><header>In General</header><text>Chapter 1 of the Truth in Lending Act (<external-xref legal-doc="usc" parsable-cite="usc/15/1601">15 U.S.C. 1601 et seq.</external-xref>) is amended by adding at the end the following new section:</text>

<section id="H50E30CC70F564A58AD2FAB70D4BAA1EA"><enum>115.</enum><header>Cap on fees</header><text display-inline="no-display-inline">The amount of any fee or charge that a creditor may impose, under the terms of a credit transaction, may not exceed $15.</text> </section><after-quoted-block>.</after-quoted-block></quoted-block></subsection> 
<subsection id="H4D1C6580ECE74566ACE8032883CD05A5"><enum>(b)</enum><header>Clerical Amendment</header><text>The table of sections for chapter 1 of the Truth in Lending Act is amended by inserting after the item relating to section 114 the following new item:</text>

<subsection id="HCB5E119A9BAB4ED698EAB7A8F98DE944"><enum>(a)</enum><header>In General</header><text display-inline="yes-display-inline">Subsection (d) of section 604 of the Fair Credit Reporting Act (<external-xref legal-doc="usc" parsable-cite="usc/15/1681b">15 U.S.C. 1681b(d)</external-xref>) is amended to read as follows:</text>

<subsection id="HFF8C887F049B4809A21B36382DA6AD9"><enum>(d)</enum><header>Limitation on use of consumer report</header> 
<paragraph id="H389EC34D371945F39664E212E5B8B1A2"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">No credit card issuer may use any negative information contained in a consumer report to increase any annual percentage rate applicable to a credit card account, or to remove or increase any introductory annual percentage rate of interest applicable to such account, for reasons other than actions or omissions of the card holder that are directly related to such account.</text></paragraph> 
<paragraph id="HC5C941112C094623B120AA8FE4E40078"><enum>(2)</enum><header>Notice to consumer</header><text display-inline="yes-display-inline">The limitation under paragraph (1) on the use by a credit card issuer of information in a consumer report shall be clearly and conspicuously described to the consumer by the credit card issuer in any disclosure or statement required to be made to the consumer under this title or any other title of this Act.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection> 
<subsection id="H27DABFEA04A24956A3B48E124219B089"><enum>(b)</enum><header>Technical and Conforming Amendment</header><text display-inline="yes-display-inline">Section 604(a)(3)(F)(ii) of the Fair Credit Reporting Act (<external-xref legal-doc="usc" parsable-cite="usc/15/1681b">15 U.S.C. 1681b(a)(3)(F)(ii)</external-xref>) is amended by inserting <quote>subject to subsection (d)</quote> before <quote>to review</quote>.</text></subsection></section>
