<section section-type="section-one" id="H6BFE1EB7312D413F96FE7DBE6CBADC9E" display-inline="no-display-inline"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Keep America Healthy Act of 2005</short-title></quote>.</text></section>
<section id="H5CEDD8ED77D040BB86D434502C5533C0"><enum>2.</enum><header>Optional Medicaid coverage of uninsured, poor adults</header>
<subsection id="HDCF52942D32B49F580566D9FAAA70013"><enum>(a)</enum><header>Availability of Medicaid coverage for uninsured, poor adults</header>
<paragraph id="H66E95CE600C645B09FA5F4A300AA30D8"><enum>(1)</enum><header>Addition of optional coverage group</header><text>Section 1902(a)(10)(A)(ii) of the <act-name parsable-cite="SSA">Social Security Act</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/42/1396a">42 U.S.C. 1396a(a)(10)(A)(ii)</external-xref>) is amended—</text>
<subparagraph id="HB6134EF3A88E414CBAABD41F79D9A685"><enum>(A)</enum><text>by striking <quote>or</quote> at the end of subclause (XVII);</text></subparagraph>
<subparagraph id="HD28C006C61ED4880878516D77DD7E146"><enum>(B)</enum><text>by striking the semicolon at the end of subclause (XVIII) and inserting <quote>, or</quote>; and</text></subparagraph>
<subparagraph id="H8E58E380BE284E2297B370D5DFD42D1B"><enum>(C)</enum><text>by adding at the end the following new subclause:</text>

<paragraph id="H87A36BAC22A94E06AF6407EBD553BAB"><enum>(2)</enum><header>Eligibility standards for new eligibility group</header><text>Section 1902 of such Act is further amended by adding at the end the following new subsection:</text>

<subsection id="H1FDF0B1CD45B436C9D2422F456DCE337"><enum>(cc)</enum><header>Coverage of uninsured, poor adults</header><text>For purposes of subsection (a)(10)(A)(ii)(XIX), individuals described in this subsection are individuals who meet the following requirements:</text>
<paragraph id="HA0B957D0673E42E98BB446186C9C7D3D"><enum>(1)</enum><header>Age</header><text>The individual is at least 21 years of age but is under 65 years of age.</text></paragraph>
<paragraph id="HF932B637E15146BD9E018BD54D9ED459"><enum>(2)</enum><header>Income</header><text>The income of the individual’s family does not exceed a percentage (not to exceed 200 percent) specified by the State of the poverty line (as defined in section 2110(c)(5)) applicable to a family of the size involved and, at the option of a State, the individual’s resources do not exceed such resource level as the State may establish, so long as such resource level is not more restrictive than the resources an individual may have and obtain benefits under the supplemental security income program under title XVI.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection>
<subsection id="HD3D320E27C924E31A5AD34487023D047"><enum>(b)</enum><header>Provision of enhanced Federal medical assistance as incentive for States to increase coverage</header>
<paragraph id="H49880E25E31B4DEE99CC4D58BD2B608E"><enum>(1)</enum><header>Application of enhanced Federal medical assistance percentage</header><text>Section 1905(b)(4) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1396d">42 U.S.C. 1396d(b)(4)</external-xref>) is amended by inserting <quote>or section 1902(a)(10)(A)(ii)(XIX)</quote> after <quote>section 1902(a)(10)(A)(ii)(XVIII)</quote>.</text></paragraph>
<paragraph id="H758E2FA8B479436C83A61F8131A855A1"><enum>(2)</enum><header>Increase in Medicaid payment limit for territories to accommodate expanded coverage for residents of Puerto Rico, the virgin islands, guam, American Samoa, and the Northern Mariana Islands</header><text>Section 1108 of such Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1308">42 U.S.C. 1308</external-xref>) is amended—</text>
<subparagraph id="HD92185003FC34EE6B72BEB00C6B800BD"><enum>(A)</enum><text>in subsection (f), by striking <quote>subsection (g)</quote> and inserting <quote>subsections (g) and (h)</quote>; and</text></subparagraph>
<subparagraph id="H237211EEB67B4D0BB714D6B9EF2DA08D"><enum>(B)</enum><text>by adding at the end the following new subsection:</text>

<subsection id="HC0B8C7772F2D47DA9EB32098CBBF8198"><enum>(h)</enum><header>Increase in Medicaid payment limit to accommodate expanded coverage under the Keep America Healthy Act</header>
<paragraph id="H84C98A84C204404880CDDAF5DF2AEB4"><enum>(1)</enum><header>Fiscal year 2006 and thereafter</header><text>With respect to fiscal year 2006 and each succeeding fiscal year, if Puerto Rico, the Virgin Islands, Guam, the Northern Mariana Islands, or American Samoa provides for coverage of individuals under section 1902(a)(10)(A)(ii)(XIX) in a fiscal year, the amounts otherwise determined for the respective territory under subsections (f) and (g) for such fiscal year shall be increased by a percentage (estimated by the Secretary) equal to 120 percent of the State average Keep America Healthy percentage, estimated by the Secretary under paragraph (2) for the fiscal year involved.</text></paragraph>
<paragraph id="H999DB2CA43C64DF4A8595E607CE95B43"><enum>(2)</enum><header>Annual estimation of State average Keep America Healthy percentage</header><text>For each such fiscal year the Secretary shall estimate a State average Keep America Healthy percentage equal to (A) the total Federal payments under title XIX for the fiscal year for the 50 States and the District of Columbia that are attributable to individuals made eligible for benefits under section 1902(a)(10)(A)(ii)(XIX), divided by (B) the total Federal payments under such title the fiscal year for such States and District.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph></subsection>
<subsection id="H4A6F2B4295DA4B0AAE79856344CA831F"><enum>(c)</enum><header>Conforming and technical amendments</header>
<paragraph display-inline="yes-display-inline" id="H5051F43F26F243E6B7B8FE45C05707BF"><enum>(1)</enum><text>Section 1903(f)(4) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1396b">42 U.S.C. 1396b(f)(4)</external-xref>) is amended by inserting <quote>1902(a)(10)(A)(ii)(XIX),</quote> after <quote>1902(a)(10)(A)(ii)(XVIII),</quote>.</text></paragraph>
<paragraph indent="up1" id="H4CE2261DCB90402798E0E1A8D28D42B"><enum>(2)</enum><text>Section 1905(a) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1396d">42 U.S.C. 1396d(a)</external-xref>) is amended, in the matter before paragraph (1)—</text>
<subparagraph id="H36063DB58D30490EB010A8C202893443"><enum>(A)</enum><text>by striking <quote>or</quote> at the end of clause (xii);</text></subparagraph>
<subparagraph id="H288B219C96194876AA2DEFD833AF8EA6"><enum>(B)</enum><text>by adding <quote>or</quote> at the end of clause (xiii); and</text></subparagraph>
<subparagraph id="H7F4FA01358844056A9B57F96E837ECF9"><enum>(C)</enum><text>by inserting after clause (xiii) the following new clause:</text>

<clause indent="up1" id="H0E1EE8BC95AF4BC3A775FDB100154E17"><enum>(xiv)</enum><text>individuals described in section 1902(cc),</text></clause><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph>
<paragraph indent="up1" id="H703C3AE3A0C44F368D7C0140C738E4A3"><enum>(3)</enum><text>Section 1905(u)(4) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1396d">42 U.S.C. 1396d(u)(4)</external-xref>) is amended by inserting before the period at the end the following: <quote>for individuals not covered under section 1902(a)(10)(A)(ii)(XIX)</quote>.</text></paragraph></subsection>
<subsection id="H07D12FC27B1349B48C061D4F042C9D2F"><enum>(d)</enum><header>Effective date</header><text>The amendments made by this section shall take effect on October 1, 2005.</text></subsection></section>
