<official-title>To amend the Surface Mining Control and Reclamation Act of 1977 to reauthorize and reform the Abandoned Mine Reclamation Program, and for other purposes.</official-title>

<section section-type="section-one" id="H0D79802171FE44F3AF00F09BE003F674" display-inline="no-display-inline"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Abandoned Mine Lands Reclamation Reform Act of 2005</short-title></quote>.</text></section> 
<section id="HF20AB02FFCCE43B48C5B00FF43E388EB"><enum>2.</enum><header>Amendments to surface mining Act</header> 
<subsection id="H3C756C871E094F6D9E49D2199D212D8"><enum>(a)</enum><header>Amendments to Section 401</header> 
<paragraph display-inline="yes-display-inline" id="HB12BEBC78DAD4B9B978705BD75DCA779"><enum>(1)</enum><text>Section 401 of the Surface Mining Control and Reclamation Act of 1977 (<external-xref legal-doc="usc" parsable-cite="usc/30/1231">30 U.S.C. 1231</external-xref>) is amended as follows:</text> 
<subparagraph indent="up1" id="HEE6B0B569DE54BED8557D4E6206D787F"><enum>(A)</enum><text>In subsection (c) by striking paragraphs (2) and (6) and redesignating paragraphs (3) through (13) in order as paragraphs (2) through (11).</text></subparagraph> 
<subparagraph indent="up1" id="HD5F4849589F54B9E87BD8D001FC5E660"><enum>(B)</enum><text>In subsection (e)—</text> 
<clause id="H4F6A83CC76EB4EFA8E3477361DDE33B7"><enum>(i)</enum><text>in the second sentence, by striking <quote>the needs of such fund</quote> and inserting <quote>achieving the purposes of the transfers under section 402(h)</quote>; and</text></clause> 
<clause id="H3314877F871F43E5817423B29BE40211"><enum>(ii)</enum><text>in the third sentence, by inserting before the period the following: <quote>for the purpose of the transfers under section 402(h).</quote>.</text></clause></subparagraph></paragraph> 
<paragraph indent="up1" id="H7543611150034704BD1FE2E2B405079B"><enum>(2)</enum><text>Section 712(b) of the Surface Mining Control and Reclamation Act of 1977 (<external-xref legal-doc="usc" parsable-cite="usc/30/1302">30 U.S.C. 1302(b)</external-xref>) is amended by striking <quote>section 401(c)(11)</quote> and inserting <quote>section 401(c)(9)</quote>.</text></paragraph></subsection> 
<subsection id="HA40626961DD3436A8BC2096419A800AB"><enum>(b)</enum><header>Amendments to Section 402</header><text>Section 402 of the Surface Mining Control and Reclamation Act of 1977 (<external-xref legal-doc="usc" parsable-cite="usc/30/1232">30 U.S.C. 1232</external-xref>) is amended as follows:</text> 
<paragraph id="H7CD513A553FE48B9AD78F3051C24FE3"><enum>(1)</enum><text>In subsection (a)—</text> 
<subparagraph id="H49DA6E7AACAA46AC84CB2398DE1EF58B"><enum>(A)</enum><text>by striking <quote>35</quote> and inserting <quote>28</quote>;</text></subparagraph> 
<subparagraph id="H979F0074045845BD88AA80EC1FB4EA18"><enum>(B)</enum><text>by striking <quote>15</quote> and inserting <quote>12</quote>; and</text></subparagraph> 
<subparagraph id="H50B9F44DD566483F95B2F59972A3F726"><enum>(C)</enum><text>by striking <quote>10 cents</quote> and inserting <quote>8 cents</quote>.</text></subparagraph></paragraph> 
<paragraph id="H2107B503A1F146FE9E09845FF9979B5E"><enum>(2)</enum><text>In subsection (b) by striking <quote>June 30, 2005</quote> and all that follows through the end of the sentence and inserting <quote>September 30, 2020.</quote>.</text> </paragraph>

<paragraph id="H5190F7529B5F4761A4C0F0E115D77471"><enum>(7)</enum><text>Subsection (g)(6) is amended to read as follows:</text>

<paragraph indent="up1" id="H37BBCB2946D941AB9CD451D7919F5483"><enum>(6)</enum> 
<subparagraph id="HF4BF23FCE53B4705A91FE96B529317DC" display-inline="yes-display-inline"><enum>(A)</enum><text>Any State with an approved abandoned mine reclamation program pursuant to section 405 may receive and retain, without regard to the 3-year limitation referred to in paragraph (1)(D), up to 10 percent of the total of the grants made annually to such State under paragraphs (1) and (5) if such amounts are deposited into an acid mine drainage abatement and treatment fund established under State law, from which amounts (together with all interest earned on such amounts) are expended by the State for the abatement of the causes and the treatment of the effects of acid mine drainage in a comprehensive manner within qualified hydrologic units affected by coal mining practices.</text> </subparagraph> 
<subparagraph indent="up1" id="HB79FEDFCB9EB440AB4C0F2FD5C192EF"><enum>(B)</enum><text>For the purposes of this paragraph, the term <term>qualified hydrologic unit</term> means a hydrologic unit—</text> 
<clause id="H6309FFA47B8E4331892CAA048D11C1A4"><enum>(i)</enum><text>in which the water quality has been significantly affected by acid mine drainage from coal mining practices in a manner that adversely impacts biological resources; and</text></clause> 
<clause id="HEED07F14FEEC492083F1D4ECDDD58645"><enum>(ii)</enum><text>that contains lands and waters that are—</text> 
<subclause id="H62AAD454FB294AE98D95634EA4228740"><enum>(I)</enum><text>eligible pursuant to section 404 and include any of the priorities set forth in section 403(a); and</text></subclause> 
<subclause id="H2B35A641ED59498A009B669317281000"><enum>(II)</enum><text>the subject of expenditures by the State from the forfeiture of bonds required under section 509 or from other States sources to abate and treat acid mine drainage.</text></subclause></clause></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph> 
<paragraph id="HD8E6C321BEEB4E30A9E50062E6EC8658"><enum>(8)</enum><text>Subsection (g)(7) is amended to read as follows:</text>

<paragraph indent="up1" id="HD9843C2E35F04CAA86C6AD765D705DBB"><enum>(7)</enum><text>In complying with the priorities set forth in section 403(a), any State or Indian tribe may use amounts available in grants made annually to such State or tribe under paragraphs (1) and (5) for the reclamation of eligible lands and waters set forth in section 403(a)(3) prior to the completion of reclamation projects under paragraphs (1) and (2) of section 403(a) only if the expenditure of funds for such reclamation is done in conjunction with the expenditure of funds for reclamation projects under paragraphs (1) and (2) of section 403(a).</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph> 
<paragraph id="HC5091F93758E4707853CEC56E15F06DD"><enum>(9)</enum><text>Subsection (g)(8) is amended to read as follows:</text> 
<quoted-block id="H18FF8CF984694C86AB38FA0051E06649"> 
<paragraph indent="up1" id="H453799A337934CCF9FD0A359267075EE"><enum>(8)</enum><text>In making the grants referred to in paragraph (1)(C), the Secretary, using amounts allocated to a State or Indian tribe under subparagraphs (A) or (B) of paragraph (1) or as necessary amounts available to the Secretary under paragraph (3), shall assure total grant awards of not less than $2,000,000 annually to each State and each Indian tribe. Notwithstanding any other provision of law, this paragraph applies to the State of Tennessee.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block> </paragraph></subsection> 
<subsection id="H1303741B3E9142E0A396FAEA6400E7F4"><enum>(c)</enum><header>Amendments to Section 403</header><text>Section 403 of the Surface Mining Control and Reclamation Act of 1977 (<external-xref legal-doc="usc" parsable-cite="usc/30/1233">30 U.S.C. 1233(a)</external-xref>) is amended as follows:</text> 
<paragraph id="HAA5C68C6CB9942759253DF74E2BED99"><enum>(1)</enum><text>In subsection (a)—</text> 
<subparagraph id="H8598A290468B440DAC687B4BB20B87D"><enum>(A)</enum><text>in paragraph (1) by striking <quote>general welfare,</quote>;</text></subparagraph> 
<subparagraph id="H0A3684C7902D420299ED4688D22964F3"><enum>(B)</enum><text>in paragraph (2) by striking <quote>health, safety, and general welfare</quote> and inserting <quote>health and safety</quote>, and inserting <quote>and</quote> after the semicolon at the end;</text></subparagraph> 
<subparagraph id="H9FB26332E7644E94B0535352264FEBE6"><enum>(C)</enum><text>in paragraph (3) by striking the semicolon at the end and inserting a period; and</text></subparagraph> 
<subparagraph id="H54E4C0D9EACE4192A7513C00BAF17418"><enum>(D)</enum><text>by striking paragraphs (4) and (5).</text></subparagraph></paragraph> 
<paragraph id="H8D4BA8CAE78740F0BBFE721C98BA98DC"><enum>(2)</enum><text>In subsection (b)—</text> 
<subparagraph id="H59F265E3237645519B239CFB134D78F1"><enum>(A)</enum><text>by striking the heading and inserting <quote>Water Supply Restoration.—</quote>; and</text></subparagraph>

<subsection id="HC1DEA0A48C8A4EE9AB7946006B7788BF"><enum>(d)</enum><header>Amendment to Section 406</header><text>Section 406(h) of the Surface Mining Control and Reclamation Act of 1977 (<external-xref legal-doc="usc" parsable-cite="usc/30/1236">30 U.S.C. 1236(h)</external-xref>) is amended by striking <quote>Soil Conservation Service</quote> and inserting <quote>Natural Resources Conservation Service</quote>.</text></subsection> 
<subsection id="H465083E48CDB414E00E13FC9700091C2"><enum>(e)</enum><header>Further amendment to Section 406</header><text>Section 406 of the Surface Mining Control and Reclamation Act of 1977 (<external-xref legal-doc="usc" parsable-cite="usc/30/1236">30 U.S.C. 1236</external-xref>) is amended by adding at the end the following:</text> 
<quoted-block id="H136B6EC870174841853B25C843CE6D64"> 
<subsection id="H71AC8D814CFD4F3D0041D85DA9AF284F"><enum>(i)</enum><text>There is authorized to be appropriated to the Secretary of Agriculture, from amounts in the Treasury other than amounts in the fund, such sums as may be necessary to carry out this section.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection> 
<subsection id="H116152EFCBE1437BBD549692BE988264"><enum>(f)</enum><header>Amendment to Section 408</header><text>Section 408(a) of the Surface Mining Control and Reclamation Act of 1977 (<external-xref legal-doc="usc" parsable-cite="usc/30/1238">30 U.S.C. 1238</external-xref>) is amended by striking <quote>who owned the surface prior to May 2, 1977, and</quote>.</text></subsection> 
<subsection id="H5A805061AE314A66902D159FE99C6040"><enum>(g)</enum><header>Amendments to Section 411</header><text>Section 411 of the Surface Mining Control and Reclamation Act of 1977 (<external-xref legal-doc="usc" parsable-cite="usc/30/1240a">30 U.S.C. 1240a</external-xref>) is amended as follows:</text> 
<paragraph id="H6C96A06170844783A7ED801C17A38E1B"><enum>(1)</enum><text>In subsection (a) by inserting <quote>(1)</quote> before the first sentence, and by adding at the end the following:</text> 
<quoted-block id="H6244F9950B3042018DF730B1B0CBA64"> 
<paragraph indent="up1" id="H3B46A2F4E059425CA45C2FE0F21D978B"><enum>(2)</enum><text>The Secretary may, on the Secretary’s own volition, make the certification referred to in paragraph (1) on behalf of any State or Indian tribe referred to in paragraph (1) if on the basis of the inventory referred to in section 403(c) all reclamation projects relating to the priorities set forth in section 403(a) for eligible lands and water pursuant to section 404 in such State or tribe have been completed. The Secretary shall only make such certification after notice in the Federal Register and opportunity for public comment.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph> 
<paragraph id="H1A8280939B1E4F87A9E6458DE7B2E2B3"><enum>(2)</enum><text>By adding at the end the following:</text> 
<quoted-block id="HAAEB0BEAF28446CCAD95823CB940004D"> 
<subsection id="HE46D0FDDEDCD49CE86D8C8EC6EB4DDBE"><enum>(h)</enum><header>State share for certain certified States</header> 
<paragraph display-inline="yes-display-inline" id="H17A42F5CABDC4F82002D805BE245AC63"><enum>(1)</enum> 
<subparagraph id="HA83A3E33280649DE84D38CAF36EA4E79" display-inline="yes-display-inline"><enum>(A)</enum><text>From moneys referred to in subsection (a) of section 35 of the <act-name parsable-cite="MLA">Mineral Leasing Act</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/30/191">30 U.S.C. 191(a)</external-xref>) that are paid into the Treasury after the date of the enactment of this subsection and that are not paid to States under section 35 of the <act-name parsable-cite="MLA">Mineral Leasing Act</act-name> or reserved as part of the reclamation fund under such section, the Secretary shall pay to each qualified State, on a proportional basis, an amount equal to the sum of the aggregate unappropriated amount allocated to such qualified State under section 402(g)(1)(A).</text> </subparagraph> 
<subparagraph indent="up2" id="H02DAA09EBCBC4DD7A146B56C309C902D"><enum>(B)</enum><text>In this paragraph the term <term>qualified State</term> means a State for which a certification is made under subsection (a) and in which there are public domain lands available for leasing under the <act-name parsable-cite="MLA">Mineral Leasing Act</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/30/181">30 U.S.C. 181 et seq.</external-xref>)</text></subparagraph></paragraph> 
<paragraph indent="up1" id="HBF1228AB53B14388AC7BE7B1B85F4F"><enum>(2)</enum><text>Payments to States under this subsection shall be made, without regard to any limitation in section 401(d), in the same manner as if paid under section 35 of the <act-name parsable-cite="MLA">Mineral Leasing Act</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/30/191">30 U.S.C. 191</external-xref>) and concurrently with payments to States under that section.</text></paragraph> 
<paragraph indent="up1" id="H3D4F241512AF4E21ADEE212975D42633"><enum>(3)</enum><text>The amount allocated to any State under section 402(g)(1)(A) that is paid to such State as a result of a payment under paragraph (1) of this subsection shall be reallocated and available for grants under section 402(g)(5).</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection> 
<subsection id="HB0EA1D2AC39F409B9CE24F0375D3FA94"><enum>(h)</enum><header>Extension of limitation on application of prohibition on issuance of permit</header><text>Section 510(e) of the Surface Mining Control and Reclamation Act of 1977 (<external-xref legal-doc="usc" parsable-cite="usc/30/1260">30 U.S.C. 1260(e)</external-xref>) is amended by striking <quote>2004</quote> and inserting <quote>2020</quote>.</text> </subsection></section> 
<section section-type="subsequent-section" id="H7A535E54A07A445EBC269EC500BBFFD" display-inline="no-display-inline"><enum>3.</enum><header>Transfers of interest earned by abandoned mine reclamation fund</header><text display-inline="no-display-inline">Section 402(h) of the Surface Mining Control and Reclamation Act of 1977 (<external-xref legal-doc="usc" parsable-cite="usc/30/1232">30 U.S.C. 1232(h)</external-xref>) is amended to read as follows:</text> 
<quoted-block id="HE5C11A4EDE1347C1AB9538EAD3E6B0AF"> 
<subsection id="HF6E1924DB28B4DC6A01B3E15C84C80EC"><enum>(h)</enum><header>Transfers of interest earned by fund</header> 
<paragraph id="H0FC2585AD65A4EFEB9252FAE81D6C6D1"><enum>(1)</enum><header>In general</header><text>The Secretary shall, as of the beginning of each fiscal year beginning on or after October 1, 2005, and before making any allocation with respect to the fiscal year under subsection (g), use an amount not to exceed the amount of interest that the Secretary estimates will be earned and paid to the fund during the fiscal year to make the transfers described in paragraph (2).</text></paragraph> 
<paragraph id="HB5C59AD3EE9D493BA8717904393B7D91"><enum>(2)</enum><header>Transfers described</header><text>The transfers referred to in paragraph (1) are the following:</text> 
<subparagraph id="H60CB3BA066004040A160239E00F36E50"><enum>(A)</enum><header>United Mine Workers of America Combined Benefit Fund</header><text>A transfer to the United Mine Workers of America Combined Benefit Fund, in an amount equal to the difference between—</text> 
<clause id="HF467B0643E6945E79F005ECC88CEDA6C"><enum>(i)</enum><text>the amount that the trustees of the Combined Benefit Fund estimate will be expended from the premium accounts maintained by the Combined Benefit Fund for the fiscal year of the fund in which the transfer is made; minus</text></clause> 
<clause id="HD48AC755D8AA48DF80883387AFF1B0A4"><enum>(ii)</enum><text>the amount the trustees of the Combined Benefit Fund estimate the Combined Benefit Fund will receive during such fiscal year in required health benefit premiums.</text></clause></subparagraph> 
<subparagraph id="HD504162213BC4BF2866236B509CA400"><enum>(B)</enum><header>United Mine Workers of America 1992 Benefit Plan</header><text>A transfer to the United Mine Workers of America 1992 Benefit Plan, in an amount equal to the difference between—</text> 
<clause id="H1DCC941CE9564B2FA106F12725A39BB"><enum>(i)</enum><text>the amount that the trustees of the 1992 Benefit Plan estimate will be expended from the 1992 Benefit Plan during the next calendar year to provide the benefits required by the 1992 Benefit Plan on the date of enactment of this subparagraph; minus</text></clause> 
<clause id="H2DC775EFB61B4E70AC2EB900DEB9D583"><enum>(ii)</enum><text>the amount that the trustees of the 1992 Benefit Plan estimate the 1992 Benefit Plan will receive during such calendar year in required monthly per beneficiary premiums, including the amount of any security provided to the 1992 Benefit Plan that is available for use in the provision of benefits.</text></clause></subparagraph> 
<subparagraph id="H81F2DEDCDAEC4DC6891FE1B26C27F943"><enum>(C)</enum><header>Multiemployer Health Benefit Plan</header><text>A transfer to the multiemployer health benefit plan established after July 20, 1992, by the parties that are the settlors of the 1992 Benefit Plan referred to in subparagraph (B), in an amount equal to the difference between—</text> 
<clause id="H2951F88EB5094EF7A9069E777722E0AB"><enum>(i)</enum><text>the amount that the trustees of the multiemployer health benefit plan estimate will be expended from such plan during the next calendar year, to provide benefits no greater than those provided by such plan on the date of enactment of this subparagraph; minus</text></clause> 
<clause id="H1218AF0BF2514BE59F05B8213E98DC98"><enum>(ii)</enum><text>the amount of income that such trustees estimate such plan will receive during such calendar year.</text></clause></subparagraph></paragraph> 
<paragraph id="HBC8EA1E08C44434183B8433823B8456C"><enum>(3)</enum><header>Adjustment</header><text>If, for any fiscal year, the amount of a transfer under subparagraph (A), (B), or (C) of paragraph (2) is more or less than the amount required to be transferred under that subparagraph, the Secretary shall appropriately adjust the amount transferred under that subparagraph for the next fiscal year.</text></paragraph> 
<paragraph id="H5AFD6E08F93845148D11C039B7B52C8F"><enum>(4)</enum><header>Additional amounts</header> 
<subparagraph id="H5B1AE2100E7844E98F03E1B028FDFAE7"><enum>(A)</enum><header>Previously credited interest</header><text>Notwithstanding any other provision of law, any interest credited to the fund that has not previously been transferred to the Combined Benefit Fund referred to in paragraph (2)(A) under this section shall be used—</text> 
<clause id="H34BA8D521F0B4BFAA54FBA436D619DE3"><enum>(i)</enum><text>to transfer to the Combined Benefit Fund such amounts as are estimated by the trustees of the Combined Benefit Fund to offset the amount of any deficit in net assets in the Combined Benefit Fund; and</text></clause> 
<clause id="HFC0C38A6F8D245E181130000C9B35C43"><enum>(ii)</enum><text>to the extent any such interest remains after the transfer under clause (i), to make the transfers described in subparagraphs (A), (B), and (C) of paragraph (2).</text></clause></subparagraph> 
<subparagraph id="H9344CC4CFE964B418EA5BE044B795800"><enum>(B)</enum><header>Previously allocated amounts</header><text>All amounts allocated under subsection (g)(2), including interest, before the date of enactment of this subparagraph for the program set forth under section 406, but not appropriated prior to such date, shall be available to the Secretary to make the transfers described in paragraph (2).</text></subparagraph></paragraph> 
<paragraph id="H8E39183DC8AE4BD09E00E578955FC243"><enum>(5)</enum><header>Limitations</header> 
<subparagraph id="H404F5E00F89D480B99C71D495D7D19CA"><enum>(A)</enum><header>Availability of funds for next fiscal year</header><text>The Secretary may make transfers under subparagraphs (B) and (C) of paragraph (2) for a fiscal year only if the Secretary determines, using actuarial projections provided by the trustees of the Combined Benefit Fund referred to in paragraph (2)(A), that amounts will be available under paragraph (1), after such transfer, for the next fiscal year for making the transfer under paragraph (2)(A).</text></subparagraph> 
<subparagraph id="H4482581954054CF6A732C2939F778C99"><enum>(B)</enum><header>Rate of contributions of obligors</header><text>A transfer under paragraph (2)(C) shall not be made for a fiscal year unless the persons that are obligated to contribute to the plan referred to in paragraph (2)(C) on the date of the transfer are obligated to make such contributions at rates that are no less than those in effect on the date of enactment of this subparagraph.</text></subparagraph> 
<subparagraph id="H0BB5A1A52ABA4B0BB61074E1CECB9898"><enum>(C)</enum><header>Number of eligible beneficiaries</header><text display-inline="yes-display-inline">Transfers under paragraph (2)(C) shall not exceed the amount required to provide benefits required by the plan referred to in paragraph (2)(C) to the number of eligible beneficiaries under such plan as of December 31, 2005.</text></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></section> 
<section id="H78614194E2C04B74B57F94B4ECA25E8D"><enum>4.</enum><header>Provisions relating to the implementation of this Act</header> 
<subsection id="HCE6F5CC0D12B4D98A17B8C97C8F25D18"><enum>(a)</enum><header>Transition rules</header> 
<paragraph display-inline="yes-display-inline" id="H36B5B30DF13A4CDBBFC240046CEDD0"><enum>(1)</enum><text>Amounts allocated under section 402(g)(2) of the Surface Mining Control and Reclamation Act of 1977 (<external-xref legal-doc="usc" parsable-cite="usc/30/1232">30 U.S.C. 1232(g)(2)</external-xref>) (excluding interest) prior to the date of enactment of this Act for the program set forth under section 406 of that Act (<external-xref legal-doc="usc" parsable-cite="usc/30/1236">30 U.S.C. 1236</external-xref>), but not appropriated prior to such date, shall be available in fiscal year 2005 and thereafter for the transfers referred to in section 402(h) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/30/1232">30 U.S.C. 1232(h)</external-xref>), as amended by this Act, in the same manner as are other amounts available for such transfers.</text></paragraph> 
<paragraph indent="up1" id="HB340AB63057D47B8A1BE4399A0424C18"><enum>(2)</enum><text>Notwithstanding any other provision of law, interest credited to the fund established by section 401 of the Surface Mining Control and Reclamation Act of 1977 (<external-xref legal-doc="usc" parsable-cite="usc/30/1231">30 U.S.C. 1231</external-xref>) that is not transferred to the Combined Benefit Fund referred to in section 402(h) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/30/1232">30 U.S.C. 1232(h)</external-xref>), as amended by this Act, prior to the date of enactment of this Act shall be available in fiscal year 2005 and thereafter for the transfers referred to in section 402(h) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/30/1232">30 U.S.C. 1232(h)</external-xref>), as amended by this Act, in the same manner as are other amounts available for such transfers.</text></paragraph></subsection> 
<subsection id="HEFE808CB6191439BA6B2C5B9AFCFFABC"><enum>(b)</enum><header>Inventory</header><text>Within one year after the date of enactment of this Act, the Secretary of the Interior shall complete a review of all additions made, pursuant to amendments offered by States and Indian tribes after December 31, 1998, to the inventory referred to in section 403(c) of the Surface Mining Control and Reclamation Act of 1977 (<external-xref legal-doc="usc" parsable-cite="usc/30/1233">30 U.S.C. 1233(c)</external-xref>) to ensure that such additions reflect eligible lands and waters pursuant to section 404 of such Act (<external-xref legal-doc="usc" parsable-cite="usc/30/1234">30 U.S.C. 1234</external-xref>) that meet the priorities set forth in paragraphs (1) and (2) of section 403(a) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/30/1233">30 U.S.C. 1233(a)</external-xref> (1) and (2)), and are correctly identified pursuant to such priorities. Any lands or waters that were included in the inventory pursuant to the general welfare standard set forth in section 403(a) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/30/1233">30 U.S.C. 1233(a)</external-xref>) before the date of enactment of this Act that are determined in the review to no longer meet the criteria set forth in paragraphs (1) and (2) of section 403(a) of such Act, as amended by this Act, shall be removed from the inventory.</text></subsection></section>
