<section id="H865FA54B9E4A4936923BD36BA3930A"><enum>2.</enum><header>Findings</header><text display-inline="no-display-inline"> Congress finds that—</text> 
<paragraph id="HFED47AB72E324D03B1DAD4C2A7D6F00"><enum>(1)</enum><text>aquatic invasive species are second only to habitat destruction as a cause of permanent losses in biological diversity of aquatic ecosystems of the United States;</text></paragraph> 
<paragraph id="HF415F38906FF4BFF8DBDCAF809F92B4"><enum>(2)</enum><text>aquatic invasive species continue to be introduced into water of the United States at an unacceptable rate;</text></paragraph> 
<paragraph id="H82E467730A784039926EC203FF3B5DD1"><enum>(3)</enum><text>aquatic invasive species damage infrastructure, disrupt commerce, outcompete native species, reduce biodiversity, and threaten human health;</text></paragraph> 
<paragraph id="H3C31636D32D14A92A52915CB2D123581"><enum>(4)</enum><text>the direct and indirect costs of aquatic invasive species to the economy of the United States amount to billions of dollars per year;</text></paragraph> 
<paragraph id="H0B6D058C1B9B42F58C558677B5BB98B6"><enum>(5)</enum><text>in the Great Lakes region, approximately $3,000,000,000 has been spent in the past 10 years to mitigate the damage caused by a single invasive species, the zebra mussel;</text></paragraph> 
<paragraph id="HF284D6B6B2C24C5900925EDCF82541C6"><enum>(6)</enum><text>wetlands suffer compound impacts from—</text> 
<subparagraph id="HAB60412390D64BE5BB00AA3764F94FB4"><enum>(A)</enum><text>terrestrial infestations (such as Nutria);</text></subparagraph> 
<subparagraph id="H57B9C71DEB814B889750A96954E8F2F"><enum>(B)</enum><text>aquatic infestations (such as Hydrilla); and</text></subparagraph> 
<subparagraph id="HF74BEC99A0A74008A4FA009F1589808D"><enum>(C)</enum><text>riparian infestations (such as Purple Loosestrife);</text></subparagraph></paragraph> 
<paragraph id="HBEF092DBA0424556A8CF9796D2645712"><enum>(7)</enum><text>prevention of aquatic invasive species is the most environmentally sound and cost-effective management approach because once established, aquatic invasive species are costly, and sometimes impossible to control;</text></paragraph> 
<paragraph id="H7211E77810014736A8CB7867CFF4DC2"><enum>(8)</enum><text>to be effective, the prevention, early detection, and control of and rapid response to aquatic invasive species should be coordinated regionally, nationally, and internationally;</text></paragraph> 
<paragraph id="H62CD0CDB04E9450DB72000841BC844E3"><enum>(9)</enum><text>pathway management is the most promising approach to reducing unplanned introductions of aquatic invasive species;</text></paragraph> 
<paragraph id="H238E49EEEBFC40FEBA5BB067D0F5179"><enum>(10)</enum><text>consistent national screening criteria are needed to evaluate the potential risk of nonindigenous aquatic species;</text></paragraph> 
<paragraph id="HDB8E876543414EF49804786FDC36D2CC"><enum>(11)</enum><text>States and regions have unique vulnerabilities with respect to aquatic invasive species and unique means for addressing aquatic invasive species;</text></paragraph> 
<paragraph id="H891989234F374466A290CF3EE276E7EF"><enum>(12)</enum><text display-inline="yes-display-inline"> a comprehensive research program which monitors pathways and ecosystems to detect the establishment and track the spread of invasive species, develop and demonstrate effective management and control methods, and monitor success of prevention and control efforts, is essential to accurate identification and management of high risk pathways; and</text></paragraph> 
<paragraph id="HE4979346A57B460785904EF40F6032E"><enum>(13)</enum><text display-inline="yes-display-inline">it is in the interest of the United States to understake a comprehensive and thorough program to research, prevent, manage, and control introductions of aquatic species that may become invasive and to coordinate that program to the extent possible with neighboring nations and efforts globally.</text></paragraph> </section> 
<section id="HC1768E9D71DA4FD6B2DA479E9026FFC8"><enum>3.</enum><header>Definitions</header><text display-inline="no-display-inline">Section 1003 of the Nonindigenous Aquatic Nuisance Prevention and Control Act of 1990 (<external-xref legal-doc="usc" parsable-cite="usc/16/4702">16 U.S.C. 4702</external-xref>) is amended to read as follows:</text>

<section id="H206FCCAE25AB42F700B5DE850500CEB"><enum>1003.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act, the following definitions apply:</text> 
<paragraph id="H2E2129933F684678B3EE75DB41D71C7B"><enum>(1)</enum><header>Administrator</header><text>The term <term>Administrator</term> means the Administrator of the Environmental Protection Agency.</text></paragraph> 
<paragraph id="HA94E0AC02D6049F1BB717C1566339DCC"><enum>(2)</enum><header>Aquatic ecosystems in the United States</header><text>The term <term>aquatic ecosystems in the United States</term> means freshwater, marine, and estuarine environments (including inland waters and wetlands), located in waters of the United States.</text></paragraph> 
<paragraph id="H479C282F6BE849318ECD705FE21D637"><enum>(3)</enum><header>Assistant Secretary</header><text>The term <term>Assistant Secretary</term> means the Assistant Secretary of the Army for Civil Works.</text></paragraph> 
<paragraph id="H2BDCD2AD5B3A4684AB00B90286508321"><enum>(4)</enum><header>Ballast water</header><text>The term <term>ballast water</term> means any water (with its suspended matter) used to maintain the trim and stability of a vessel.</text></paragraph> 
<paragraph id="H88BFB2822C434E7A91D025AFE7087C24"><enum>(5)</enum><header>Coastal voyage</header><text>The term <term>coastal voyage</term> means a voyage conducted entirely within the exclusive economic zone.</text></paragraph> 
<paragraph id="HE1E1FF0B149E47E183FD7E6E5E348C28"><enum>(6)</enum><header>Director</header><text>The term <term>Director</term> means the Director of the United States Fish and Wildlife Service.</text></paragraph> 
<paragraph id="H1B8E921C48974802B1093F50DD6967C1"><enum>(7)</enum><header>Environmentally sound</header><text>The term <term>environmentally sound</term>, when used in reference to any activity, refers to an activity that prevents or reduces introductions, or controls infestations, of aquatic invasive species in a manner that minimizes adverse effects on—</text> 
<subparagraph id="H64A119730EBC4A5A8DA36FFD50521269"><enum>(A)</enum><text>the structure and function of an ecosystem; and</text></subparagraph> 
<subparagraph id="HB8C7DADD56DC4929B228C898B5B39BA4"><enum>(B)</enum><text>nontarget organisms and ecosystems.</text></subparagraph></paragraph> 
<paragraph id="H6CBC4841EEDB45FAAD00B13502657BCF"><enum>(8)</enum><header>Exclusive economic zone</header><text>The term <term>exclusive economic zone</term> means the area comprised of—</text> 
<subparagraph id="H8650BF34088E47BDAD00DAD835516E3"><enum>(A)</enum><text>the Exclusive Economic Zone of the United States established by Proclamation Number 5030, dated March 10, 1983; and</text></subparagraph> 
<subparagraph id="H31FA30B42B6F460E8753245155DA7178"><enum>(B)</enum><text>the equivalent zones of Canada and Mexico.</text></subparagraph></paragraph> 
<paragraph id="H5198025CFDB4407FB9DA16B86D364639"><enum>(9)</enum><header>Great Lake</header><text>The term <term>Great Lake</term> means—</text> 
<subparagraph id="H7044C5FB1C344D6B8E96B4138ED02050"><enum>(A)</enum><text>Lake Erie;</text></subparagraph> 
<subparagraph id="H90BB897A2F094F4F8DE7F49DB5D50757"><enum>(B)</enum><text>Lake Huron (including Lake Saint Clair);</text></subparagraph> 
<subparagraph id="HFE22BF13183D48709B2556396487D5D5"><enum>(C)</enum><text>Lake Michigan;</text></subparagraph> 
<subparagraph id="HF0DDCF0F441C4145BD02D7C0E16CEC29"><enum>(D)</enum><text>Lake Ontario;</text></subparagraph> 
<subparagraph id="H15A56E4AEF2344099E1209CBF56273EC"><enum>(E)</enum><text>Lake Superior;</text></subparagraph> 
<subparagraph id="H40F08C375622468E804C1806462DADF2"><enum>(F)</enum><text>the connecting channels of those Lakes, including—</text> 
<clause id="H81AC156A37B44C0F94A5A3A5CD758DCA"><enum>(i)</enum><text>the Saint Mary’s River;</text></clause> 
<clause id="HB683E61DECD4447BBCAA2F9349ACD7F1"><enum>(ii)</enum><text>the Saint Clair River;</text></clause> 
<clause id="HBEAD46D1A81B46E78F27E5206B3E2EB"><enum>(iii)</enum><text>the Detroit River;</text></clause> 
<clause id="HB7D8880922C8457D9FF74C0A3BCC283"><enum>(iv)</enum><text>the Niagara River; and</text></clause> 
<clause id="H4DCFB11D4E104DD59D7E4DA8B5D6350"><enum>(v)</enum><text>the Saint Lawrence River to the Canadian border; and</text></clause></subparagraph> 
<subparagraph id="HBABCC9DFBBD24C38A6A5FE6BE730CDF4"><enum>(G)</enum><text>any other body of water located within the drainage basin of a Lake, River, or connecting channel described in any of subparagraphs (A) through (F).</text></subparagraph></paragraph> 
<paragraph id="H1A7A90A2877C422998FD522C69006BD9"><enum>(10)</enum><header>Great Lakes region</header><text>The term <term>Great Lakes region</term> means the region comprised of the States of Illinois, Indiana, Michigan, Minnesota, New York, Ohio, Pennsylvania, and Wisconsin.</text></paragraph> 
<paragraph id="HDBC8A9DFCF6C47A6B8C1CCCA1B78226C"><enum>(11)</enum><header>Indian tribe</header><text>The term <term>Indian tribe</term> has the meaning given the term in section 4 of the <act-name parsable-cite="ISDA">Indian Self-Determination and Education Assistance Act</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/25/450b">25 U.S.C. 450b</external-xref>).</text></paragraph> 
<paragraph id="H6C03F798A1E342ADB0DBDA1E4EE44CD0"><enum>(12)</enum><header>Interbasin waterway</header><text>The term <term>interbasin waterway</term> means a waterway that connects 2 distinct water basins.</text></paragraph> 
<paragraph id="HA8C3F21098534E51A3EDA6F7152F3600"><enum>(13)</enum><header>International Joint Commission</header><text>The term <term>International Joint Commission</term> means the commission established by article VII of the Treaty relating to boundary waters and questions arising along the boundary between the United States and Canada, signed at Washington on January 11, 1909 (36 Stat. 2448).</text></paragraph> 
<paragraph id="H5B948DC636D4422A81DD2B68B4ED5C9F"><enum>(14)</enum><header>Introduction</header><text>The term <term>introduction</term> means the transfer of an organism to an ecosystem outside the historic range of the species of which the organism is a member.</text></paragraph> 
<paragraph id="H162FCDEAB7F24EBE0026F2EFAAB584F"><enum>(15)</enum><header>Invasion</header><text>The term <term>invasion</term> means an infestation of an aquatic invasive species.</text></paragraph> 
<paragraph id="H626D5410E32840879687E5296ED4BE9"><enum>(16)</enum><header>Invasive Species</header><text>The term <term>invasive species</term> means a nonindigenous species the introduction of which into an ecosystem may cause harm to the economy, environment, human health, recreation, or public welfare.</text></paragraph> 
<paragraph id="HA22D5AA15AC84FC9923F4B000192AB00"><enum>(17)</enum><header>Invasive Species Council</header><text>The term <term>Invasive Species Council</term> means the interagency council established by section 3 of Executive Order No. 13112 (<external-xref legal-doc="usc" parsable-cite="usc/42/4321">42 U.S.C. 4321</external-xref> note).</text></paragraph> 
<paragraph id="H276A560EB6B947D38E8EE1801D611A"><enum>(18)</enum><header>Nonindigenous species</header><text>The term <term>nonindigenous species</term> means any species in an ecosystem beyond its historic range.</text></paragraph> 
<paragraph id="HB82C055B928F4EF9B55869C8DCB7C19"><enum>(19)</enum><header>Species in trade</header><text>The term <term>species in trade</term> means a species that has a documented history of being commercially imported into the United States in the period beginning on January 1, 1990, and ending on January 1, 2002.</text></paragraph> 
<paragraph id="HF1BF6F31100647F1A321E51C7BEE24B7"><enum>(20)</enum><header>Organism transfer</header><text>The term <term>organism transfer</term> means the movement of an organism of any species from one ecosystem to another ecosystem outside the historic range of the species.</text></paragraph> 
<paragraph id="H46C4E4F4DB57438D8D3F8E4663CD237"><enum>(21)</enum><header>Pathway</header><text>The term <term>pathway</term> means 1 or more vectors by which an invasive species is transferred from one ecosystem to another.</text></paragraph> 
<paragraph id="H167532B596204AAD0060A393BCF5F5E8"><enum>(22)</enum><header>Planned importation</header><text>The term <term>planned importation</term> means the purposeful movement of one or more nonindigenous organisms for use in the territorial limits of the United States.</text></paragraph> 
<paragraph id="H2C2E07D6D32945FABAC1073433F19156"><enum>(23)</enum><header>Regional panel</header><text>The term <term>regional panel</term> means a panel convened in accordance with section 1203.</text></paragraph> 
<paragraph id="HF6BCFCD303684BCCAC8F86F0C0F319C8"><enum>(24)</enum><header>Secretary</header><text>The term <term>Secretary</term> means the Secretary of Homeland Security.</text></paragraph> 
<paragraph id="HD59E52D100564F1BA68EC5D327AD4F72"><enum>(25)</enum><header>Species</header><text>The term <term>species</term> means any fundamental category of taxonomic classification, or any viable biological material, ranking below a genus or subgenus.</text></paragraph> 
<paragraph id="H2636FFEBA71D44E9B000F86967C03E67"><enum>(26)</enum><header>Task Force</header><text>The term <term>Task Force</term> means the Aquatic Invasive Species Task Force established by section 1201(a).</text></paragraph> 
<paragraph id="H9EED74C517734485822552762900C182"><enum>(27)</enum><header>Territorial sea</header><text>The term <term>territorial sea</term> means the belt of the sea measured from the baseline of the United States determined in accordance with international law, as set forth in Presidential Proclamation Number 5928, dated December 27, 1988.</text></paragraph> 
<paragraph id="H0B78329C861A480181E163FD533760F2"><enum>(28)</enum><header>Treatment</header><text>The term <term>treatment</term> means a mechanical, physical, chemical, biological, or other process or method of killing, removing, or rendering inviable, organisms.</text></paragraph> 
<paragraph id="H06FFDC79B8AF4F8BA6695E19739100F2"><enum>(29)</enum><header>Type approval</header><text>The term <term>type approval</term> means an approval procedure under which a type of system is initially certified as meeting a standard established by law (including a regulation) for a particular application if operated correctly.</text></paragraph> 
<paragraph id="HD758CF21F0774AB5979392C9CC9B300"><enum>(30)</enum><header>Under Secretary</header><text>The term <term>Under Secretary</term> means the Under Secretary of Commerce for Oceans and Atmosphere.</text></paragraph> 
<paragraph id="HEBFC8D3847234622A771E39988209EBF"><enum>(31)</enum><header>Undesirable impact</header><text>The term <term>undesirable impact</term> means economic, human health, aesthetic, or environmental degradation that is not necessary for, and is not clearly outweighed by, public health, environmental, or welfare benefits.</text></paragraph>

<subparagraph id="HA3E35D786A2843A900DF6419ADFB0089"><enum>(A)</enum><header>In general</header><text>The term <term>waters of the United States</term> means the navigable waters and territorial sea of the United States.</text></subparagraph> 
<subparagraph id="HDA39C150972A4E25896826993910F554"><enum>(B)</enum><header>Inclusion</header><text>The term <term>waters of the United States</term> includes the Great Lakes.</text></subparagraph></paragraph></section><after-quoted-block>.</after-quoted-block></quoted-block></section> 
<title id="H73A31453B90440EEB2B47F004D95598D"><enum>I</enum><header>Prevention of introduction of aquatic Invasive Species into waters of the United States by vessels</header> 
<section id="H5977B5ABB6AA4914BDC4F6747E5232C5"><enum>101.</enum><header>Vessel pathway requirements</header> 
<subsection id="H2DE256598FEA430FB5AA052894EFAF5"><enum>(a)</enum><header>Requirements for vessels operating in waters of the United States</header><text>Section 1101 of the Nonindigenous Aquatic Nuisance Prevention and Control Act of 1990 (<external-xref legal-doc="usc" parsable-cite="usc/16/4711">16 U.S.C. 4711</external-xref>) is amended by striking subsection (a) and inserting the following:</text> 
<quoted-block id="HBD9F5D7569A24AAB8522A158BB3E605B"> 
<subsection id="H06C904A21A3F49CEBB4364B97DBEAD50"><enum>(a)</enum><header>Requirements for all vessels operating in waters of the United States</header> 
<paragraph id="H192B714A84F64B35AB6EDB99B79F2FE9"><enum>(1)</enum><header>Invasive Species management plan</header> 
<subparagraph id="HEDFF31B5CB1F4FE8A7D5A5B86C1638F2"><enum>(A)</enum><header>In general</header><text>Effective beginning on the date that is 180 days after the issuance of guidelines pursuant to subparagraph (D) and the promulgation of guidelines or regulations under this section, each vessel that is equipped with ballast, and other towed vessels and structures, operating in waters of the United States shall have in effect, and have available for inspection, an aquatic invasive species management plan that prescribes safe and effective means by which the master of the vessel shall minimize introductions and transfers of invasive species by any part of the vessel, pursuant to the guidelines or regulations applicable to that vessel.</text></subparagraph> 
<subparagraph id="H4991822EB9C84213BBDFCBE40048AFB"><enum>(B)</enum><header>Specificity</header><text>The management plan shall be specific to the vessel (or group of vessels with characteristics similar to that of the vessel, as determined by the Secretary).</text></subparagraph> 
<subparagraph id="HF05C734BF98E48ACA9D23BFEB3A54BD3"><enum>(C)</enum><header>Requirements</header><text>The management plan shall include, at a minimum, such information as is requested by the Secretary pursuant to subparagraph (D), including—</text> 
<clause id="HBCD9D4BA96C34508A4A52E2CE2F01"><enum>(i)</enum><text>operational requirements to safely and effectively comply with the ballast water management requirements under paragraph (4);</text></clause> 
<clause id="H33979C5F8CAD4CA99EBA9124CA9B1C2"><enum>(ii)</enum><text>operational requirements to safely and effectively carry out any actions consistent with rapid response action required by States and approved by the Secretary under section 1211;</text></clause> 
<clause id="H1296C566D78947B3A533B041B732C7F1"><enum>(iii)</enum><text>other requirements specified in guidelines adopted by the International Maritime Organization;</text></clause> 
<clause id="HE71956D373564CA4005755D4CF9E1014"><enum>(iv)</enum><text>a description of all reporting requirements and a copy of each form necessary to meet those requirements;</text></clause> 
<clause id="HFBA44FA3060F4FA4B89C5C83953722FA"><enum>(v)</enum><text>the position of the officer responsible for implementation of ballast water management and reporting procedures on board;</text></clause> 
<clause id="HD0F79D5107BE460F96F5F4D600D1E58D"><enum>(vi)</enum><text>documents relevant to any ballast water management equipment or procedures;</text></clause> 
<clause id="H212AE7961658460191AE2D7CEADF9896"><enum>(vii)</enum><text>a description of the location of access points for sampling ballast or sediments pursuant to paragraph (3)(B)(vi);</text></clause> 
<clause id="H10FF112290B54A16B5CF15437CFDCCA6"><enum>(viii)</enum><text>a description of requirements relating to compliance with any approved rapid response strategy relevant to the voyage of the vessel;</text></clause> 
<clause id="HFCF31546A3C24C1DA7E4D5167C00CA2D"><enum>(ix)</enum><text>a contingency strategy applicable under subsection (k), if appropriate; and</text></clause> 
<clause id="HD6111778FFDA4A7F88A524FDE571AEB2"><enum>(x)</enum><text>such requirements described in subsection (e) as are applicable to the vessel.</text></clause></subparagraph> 
<subparagraph id="H59DB6FAC482F4A6FBA1900A6A31000F7"><enum>(D)</enum><header>Guidelines</header><text>Not later than 18 months after the date of enactment of the <short-title>National Aquatic Invasive Species Act of 2005</short-title>, the Secretary shall issue final guidelines for the development of invasive species management plans, including guidelines that—</text> 
<clause id="HDC1FE13B9C8A4F5CA61DEBE1F468DC58"><enum>(i)</enum><text>identify types of vessels for which plans are required;</text></clause> 
<clause id="H7718FB8A579E4BCF875FF85FAA34A7C8"><enum>(ii)</enum><text>establish processes for updating and revising the plans; and</text></clause> 
<clause id="HC3D77479B5214A78B8AF9C007881F81E"><enum>(iii)</enum><text>establish criteria for compliance with this subsection.</text></clause></subparagraph></paragraph> 
<paragraph id="H2C51E00102E84EA88B57B254A704D585"><enum>(2)</enum><header>Records</header><text>The master of a vessel shall—</text> 
<subparagraph id="H6CCF33F0DD0A4F6B00C9822D5990AF83"><enum>(A)</enum><text>maintain records of all ballast operations, for such period of time and including such information as the Secretary may specify;</text></subparagraph> 
<subparagraph id="H9850BF1C92F94A999187D771192E8D53"><enum>(B)</enum><text>permit inspection of the records by representatives of the Secretary and of the State in which the vessel has entered a port; and</text></subparagraph> 
<subparagraph id="HBFB45764B451463AA3D31E2E8136E52F"><enum>(C)</enum><text>transmit records to the National Ballast Information Clearinghouse established under section 1102(f).</text></subparagraph></paragraph> 
<paragraph id="HB5C056E4A97648B9833C987B84C56DE6"><enum>(3)</enum><header>Best management practices</header> 
<subparagraph id="HC8E1C38DEE664B46A9D60049DFB1A65B"><enum>(A)</enum><header>In general</header><text>Not later than 18 months after the date of enactment of the <short-title>National Aquatic Invasive Species Act of 2005</short-title>, the Secretary shall issue guidelines on best management practices to eliminate or minimize and monitor organism transfer by vessels.</text></subparagraph> 
<subparagraph id="H293437C0A7934664B4B4B6D9D8079BE"><enum>(B)</enum><header>Practices to be included</header><text>The best management practices shall include, but not be limited to—</text> 
<clause id="H1D9614E0CB2B4827005DA779F900C871"><enum>(i)</enum><text>sediment management in transoceanic vessels;</text></clause> 
<clause id="H1465F73C25CC4E25A5504F1E8F47A1AD"><enum>(ii)</enum><text>minimization of ballast water uptake in areas where there is a greater risk of harmful organisms entering ballast tanks (such as areas with toxic algal blooms or known outbreaks of aquatic invasive species);</text></clause> 
<clause id="HA3CC9135B9BA4E24A254BCEA56EBF936"><enum>(iii)</enum><text>avoidance of unnecessary discharge of ballast water in a port that was taken up in another port;</text></clause> 
<clause id="H95D8E17FC2B2407297B2D036003825B6"><enum>(iv)</enum><text>to the maximum extent practicable, collection and the proper disposal of debris from the cleaning of the hull;</text></clause> 
<clause id="H593BF42E74B942389026989FA2949CF9"><enum>(v)</enum><text>proper use of antifouling coating; and</text></clause> 
<clause id="HAB554579A40D450CA3B35CA9119440C5"><enum>(vi)</enum><text>provision of access points in ballast piping for sampling of ballast intake and discharge.</text></clause></subparagraph></paragraph> 
<paragraph id="H1471FBA83ED846FCAEE13DC33822AF7D"><enum>(4)</enum><header>Ballast water management</header> 
<subparagraph id="H18C2135CA24846C28000A2C3FB07067C"><enum>(A)</enum><header>In general</header><text>Each vessel equipped with a ballast water tank that enters a United States port, except for a vessel subject to subparagraph (B) and subsection (c), shall comply with the standards described in paragraphs (1) and (2) of subsection (b) and the regulations promulgated under subsection (e) relating to ballast water management.</text></subparagraph> 
<subparagraph id="H6D0EABE91A5145AE00D19E32BFB674EB"><enum>(B)</enum><header>Exceptions</header> 
<clause id="H52970397402E4F08907345D67B9E8720"><enum>(i)</enum><header>Vessels operating entirely within the exclusive economic zone</header><text>A vessel equipped with a ballast water tank that operates entirely within the exclusive economic zone shall not be required to comply with the standard described in subsection (b)(1).</text></clause> 
<clause id="H893894CDA3FA4C559BF8799CE687D42C"><enum>(ii)</enum><header>Vessels that operate exclusively in an enclosed aquatic ecosystem</header> 
<subclause id="H8F0420FE01D04016BBDD9C96A887FE00"><enum>(I)</enum><header>In general</header><text>A vessel equipped with ballast tanks and that operates exclusively in the upper 4 Great Lakes, or in another enclosed aquatic ecosystem in which the potential for movement of organisms by natural and anthropogenic means is not significantly altered by the movement of the vessel, is not required to comply with the standards described in paragraphs (1) and (2) of subsection (b).</text></subclause> 
<subclause id="H6990E443EC1A405F9518385FF4C2F491"><enum>(II)</enum><header>Additional enclosed aquatic ecosystems</header><text>The Administrator and Under Secretary, in consultation with regional panels of the Task Force, may determine the other enclosed aquatic ecosystems that are covered by subclause (I).</text></subclause></clause></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection> 
<subsection id="HADCEF410EC284F279350830001C87E2B"><enum>(b)</enum><header>Ballast water management standards and certification procedures</header><text>Section 1101 of the Nonindigenous Aquatic Nuisance Species Prevention and Control Act of 1990 (<external-xref legal-doc="usc" parsable-cite="usc/16/4711">16 U.S.C. 4711</external-xref>) is further amended—</text> 
<paragraph id="H5C2697F9AF2C4B33864B6CAD1B0879A3"><enum>(1)</enum><text>by striking subsections (b) through (f) and subsection (h); and</text></paragraph> 
<paragraph id="H6D0CF58712744D16B0752177ABFE061E"><enum>(2)</enum><text>by inserting after subsection (a) the following:</text> 
<quoted-block id="HC8FA045338B042E9B4B7FB4DBE34AD4D"> 
<subsection id="HB92C6C930F46462900D4AB2D52DFBCAD"><enum>(b)</enum><header>Ballast water management standards and certification procedures</header> 
<paragraph id="H9C0EDF3789BF4F338306E870B516F793"><enum>(1)</enum><header>Interim standards</header> 
<subparagraph id="HC29DDE07665B4CC7AA1E4742E64963DB"><enum>(A)</enum><header>In general</header><text>Not later than 18 months after the date of enactment of the <short-title>National Aquatic Invasive Species Act of 2005</short-title>, the Secretary, with the concurrence of the Administrator and in consultation with the Task Force, shall promulgate final regulations establishing interim standards indicating acceptable—</text> 
<clause id="H6F7F0E6342314B6BB36BB4F75D72F7C1"><enum>(i)</enum><text>operational performance for ballast water exchange (including contingency procedures in instances in which a safety exemption is used pursuant to subsection (k)); and</text></clause> 
<clause id="H58FF51621E8A41AA9BE0FC78872C8230"><enum>(ii)</enum><text>biological effectiveness of ballast water treatment systems (including onshore facilities and facilities on board vessels).</text></clause></subparagraph> 
<subparagraph id="H5A49E1A051C1499EA01583BC5D90066"><enum>(B)</enum><header>Requirements</header> 
<clause id="H0554077B65FF4D33B11B00C9DF663EF9"><enum>(i)</enum><header>Ballast water exchange</header><text>The interim standard for ballast water exchange described in subparagraph (A) shall require—</text> 
<subclause id="HD4E62AAD7D224F11A22D8C914ED4E2ED"><enum>(I)</enum><text>at least 1 empty-and-refill cycle on the high sea or in an alternative exchange area designated by the Secretary, of each ballast tank that contains ballast water to be discharged into waters of the United States;</text></subclause> 
<subclause id="H32378542482349599E14E37D37669D97"><enum>(II)</enum><text>in a case in which the master of a vessel determines that compliance with subclause (I) is impracticable, a sufficient number of flow-through exchanges of ballast water, on the high sea or in an alternative exchange area designated by the Secretary, to achieve replacement of at least 95 percent of ballast water in ballast tanks of the vessel, as determined by a certification dye study conducted or model developed in accordance with protocols developed under paragraph (3)(B)(i) and recorded in the management plan of a vessel pursuant to subsection (a)(1)(C)(i); and</text></subclause> 
<subclause id="H047019D8D7014F26B662C7513EFC7EC3"><enum>(III)</enum><text>an approved contingency procedure using best practicable technology or practices in instances in which a ballast water exchange is not undertaken pursuant to subsection (k).</text></subclause></clause> 
<clause id="HDA945D6509564CC9A33936E3EA5E8759"><enum>(ii)</enum><header>Ballast system design and water treatment systems</header><text>The interim standard for a ballast water system design and treatment system described in subparagraph (A) shall require that at least 95 percent of the live aquatic vertebrates, invertebrates, phytoplankton, and macroalgae, respectively, in ballast water taken in by a vessel or class of vessels be killed or removed from ballast discharge as determined by the qualified type approval process promulgated under paragraph (3)(B)(ii).</text></clause> 
<clause id="HC7B85EFAAFFB449C97391FA6A568FCD"><enum>(iii)</enum><header>Criteria; period of effectiveness</header><text>The interim standards described in clauses (i) and (ii) shall—</text> 
<subclause id="H18AA161230DE4BE09E3CBEE4BD8FA26E"><enum>(I)</enum><text>meet occupational safety and environmental soundness criteria described in paragraph (7); and</text></subclause> 
<subclause id="H2E673527AF6F428EBFECA9C903FA2C69"><enum>(II)</enum><text>cease to apply on the effective date of final standards developed pursuant to paragraph (2).</text></subclause></clause></subparagraph></paragraph> 
<paragraph id="HB7220770D53C4EE898C12685E2EAFA35"><enum>(2)</enum><header>Final standards</header> 
<subparagraph id="H63F1A7FD703646B89D00D59BF46770FF"><enum>(A)</enum><header>In general</header><text>Not later than 4 years after the date of enactment of the <short-title>National Aquatic Invasive Species Act of 2005</short-title>, the Administrator, in consultation with the Task Force and with the concurrence of the Secretary, shall promulgate final standards for ballast water discharge and other vessel operations determined to pose a significant risk to the environment through the introduction of nonindigenous species.</text></subparagraph> 
<subparagraph id="HEA055678EC724A4191F979AADDA6DD40"><enum>(B)</enum><header>Requirements</header><text>The final standards shall—</text> 
<clause id="H8A66D3B7E914463096D76E3C3D59B55"><enum>(i)</enum><text>result from application of the best available technology for—</text> 
<subclause id="H5432CA008C344AD0AEFE18BFD7B5BDD7"><enum>(I)</enum><text>the applicable category or class of vessels; and</text></subclause> 
<subclause id="HB579DA7CF2C24341A94F6F0015F200C3"><enum>(II)</enum><text>the new source or existing source status;</text></subclause></clause> 
<clause id="H5B3A374482C8497D873964D459646041"><enum>(ii)</enum><text>have the goal of eliminating the risk of introduction into waters of the United States by vessels of nonindigenous species, including plant, animal, and human pathogens;</text></clause> 
<clause id="HCA3C44C4DDF24E04B1454CF12FB9F3FB"><enum>(iii)</enum><text>consider findings of scientific and policy research; and</text></clause> 
<clause id="H768C79FD20574488AE3B4F261FAA6DB2"><enum>(iv)</enum><text>be measurable.</text></clause></subparagraph></paragraph> 
<paragraph id="HE32143A7FEB3421297F469989000037"><enum>(3)</enum><header>Certification of treatments or practices; enforcement</header> 
<subparagraph id="HEF1FCD05FCD54CEFABC36737FBCD04"><enum>(A)</enum><header>In general</header><text>Not later than the date on which interim standards are promulgated under paragraph (1) and final standards are promulgated under paragraph (2), the Secretary shall, with the concurrence of the Administrator, promulgate regulations for—</text> 
<clause id="H8DCBF4ABF3AA48A0BEE1E47B206D0026"><enum>(i)</enum><text>the certification of treatments or practices that comply with the standards; and</text></clause> 
<clause id="H5A4BE03588764DA2AB305715C625600"><enum>(ii)</enum><text>ongoing enforcement of the use of the treatments or practices.</text></clause></subparagraph> 
<subparagraph id="HB3DB6793A39342518DA45DF319AFCFEB"><enum>(B)</enum><header>Certification under interim standards</header><text>The certification of treatments and practices in compliance with the interim standard promulgated pursuant to paragraph (1) shall be based on a qualified type approval process, including—</text> 
<clause id="HBCCFC0486AE94F1BAA95AEFE1040D9A6"><enum>(i)</enum><text>protocol for ballast water exchange involving dye studies or models detailing flow dynamics of vessels described in paragraph (1)(B)(i)(II); and</text></clause> 
<clause id="H469BD5D0C3934D7684A4C6CD93AE4CB9"><enum>(ii)</enum><text>protocol for qualified type approval of ballast water treatment systems for the interim standard described in paragraph (1) that—</text> 
<subclause id="H4A7AB6979AB04109A88FEA3B7CF3F4FC"><enum>(I)</enum><text>is capable of determining the extent to which a ballast water treatment system complies with applicable standards, including limitations on that compliance caused by—</text> 
<item id="H166AD23DCB17471F91E9341D9599A378"><enum>(aa)</enum><text>biological, chemical, or physical conditions of water taken into ballast; and</text></item> 
<item id="HFBF4A114749E4C66B49238003288C3D5"><enum>(bb)</enum><text>conditions encountered during a voyage;</text></item></subclause> 
<subclause id="HE4F6D5F90CC74CB3BE04B6D300C08B9E"><enum>(II)</enum><text>is capable of determining the extent to which a ballast water treatment system—</text> 
<item id="HAC502AB62C824F3D9D179D6275D62112"><enum>(aa)</enum><text>is environmentally sound, based on criteria promulgated by the Administrator under paragraph (7)(A); and</text></item> 
<item id="H23491F66F50C4FA69CF7D8681BEE4CA8"><enum>(bb)</enum><text>is safe for vessel and crew;</text></item></subclause> 
<subclause id="H746F20700B5C42DEB3649EDD6EFF575C"><enum>(III)</enum><text>may be used in estimating the expected useful life of the ballast water treatment system, as determined on the basis of voyage patterns and normal use conditions;</text></subclause> 
<subclause id="H5200A119181B452ABC6331A55E009079"><enum>(IV)</enum><text>includes a shipboard testing component, and may include a shore-based testing component;</text></subclause> 
<subclause id="HF69BF208E42D4CDABA6FF0E4236712D8"><enum>(V)</enum><text>provides for appropriate monitoring; and</text></subclause> 
<subclause id="H6DD9D722E93A4DED00B95D6D736EA412"><enum>(VI)</enum><text>is cost effective.</text></subclause></clause></subparagraph> 
<subparagraph id="H34C90F18D9DD4F6283C980070ADB79B"><enum>(C)</enum><header>Certification under final standards</header><text>The certification of treatments in compliance with the final standards issued pursuant to paragraph (2) shall—</text> 
<clause id="HFFD3D527641445228BCF4309EB67300"><enum>(i)</enum><text>apply to all methods of ballast water management and system design, including—</text> 
<subclause id="H98425FD2BA144723B73B34D3A06B4C5E"><enum>(I)</enum><text>ballast water exchange;</text></subclause> 
<subclause id="H8FE9DBDDD8544B09B35E681E106C398E"><enum>(II)</enum><text>ballast water treatment systems; and</text></subclause> 
<subclause id="H606D5D527C914D15A6E69DE3632C07BB"><enum>(III)</enum><text>other vessel operations determined to pose a significant risk to the environment through the introduction of nonindigenous organisms;</text></subclause></clause> 
<clause id="H102C25E31FD24FF8AB093F726088FD3F"><enum>(ii)</enum><text>be reviewed and, as appropriate, revised not less often than every 3 years pursuant to subsection (f)(1);</text></clause> 
<clause id="H1ED433462445481D88209C7C6CFABADA"><enum>(iii)</enum><text>meet occupational safety and environmental soundness criteria described in paragraph (7); and</text></clause> 
<clause id="H6EF79D540F0546C094B100379972ECE7"><enum>(iv)</enum><text>apply beginning not later than October 1, 2011.</text></clause></subparagraph></paragraph> 
<paragraph id="H3AE0EF2978144A758CAD93D7F3DE7183"><enum>(4)</enum><header>Experimental approval for ballast water treatment</header> 
<subparagraph id="H4DF5EFACF0EE4877BBE702D161461454"><enum>(A)</enum><header>In general</header><text>Subject to subparagraph (B), if, before the date on which the Secretary promulgates interim ballast water management standards under paragraph (1), an owner or operator of a vessel seeks to conduct a treatment of ballast water—</text> 
<clause id="H9C272E002B7444DC96914D29357851D3"><enum>(i)</enum><text>the owner or operator shall apply to the Secretary for experimental approval of the treatment; and</text></clause> 
<clause id="HA5E659C607C84603AFC7A9195B032B75"><enum>(ii)</enum><text>the Secretary shall approve the treatment if—</text> 
<subclause id="HBC0D6083183C46690006D17395634B89"><enum>(I)</enum><text>the owner or operator provides to the Secretary independently peer-reviewed, pilot-scale information relating to the effectiveness and environmental soundness of the treatment;</text></subclause> 
<subclause id="H26ECCF15C4EF4F15AC101BE17F96CEB8"><enum>(II)</enum><text>the Secretary and the Administrator, in consultation with the Task Force (including relevant regional panels, and the Prevention Committee, of the Task Force), determine that the technology to be used for the treatment has significant potential to kill or remove at least 95 percent of the aquatic vertebrates, invertebrates, phytoplankton, and macro algae, respectively, in ballast water taken in by the class of vessel for which the treatment is sought to be conducted; and</text></subclause> 
<subclause id="HB4270A3951DD43BF88F55976F828E4F6"><enum>(III)</enum><text>the Administrator determines that the treatment meets environmental regulations.</text></subclause></clause></subparagraph> 
<subparagraph id="HA5EB6A664E2A4BC20025E253BFC73DD"><enum>(B)</enum><header>Limitations</header> 
<clause id="H069537B75677468683DDC29F8218D3D7"><enum>(i)</enum><header>Period of testing</header><text>Testing of the treatment system approved under this section may cease prior to the termination of the approval period described in clause (ii).</text></clause> 
<clause id="H2FCD967B5800474186621E4704598828"><enum>(ii)</enum><header>Period of approval</header><text>Approval under subparagraph (A) shall be granted for—</text> 
<subclause id="HDDB2509936D8473EBA4D82093028FA92"><enum>(I)</enum><text>a period of 10 years or the expected useful life of the treatment system, whichever is earlier; or</text></subclause> 
<subclause id="HB0FC25E8C9444E4797B801F1C31BB02"><enum>(II)</enum><text>until such time as the Secretary or Administrator (as appropriate) determine that (based on available information, including information developed pursuant to clause (iii)) there exists a serious deficiency in performance or environmental soundness of the system relative to anticipated performance or environmental soundness.</text></subclause></clause> 
<clause id="H3F1986E142564074A4E837D14769F57F"><enum>(iii)</enum><header>Information</header><text>As a condition of receiving experimental approval for a treatment under subparagraph (A)(ii), the owner or operator of a vessel shall agree to collect and report such information regarding the operational and biological effectiveness of the treatment through sampling of the intake and discharge ballast as the Secretary may request.</text></clause> 
<clause id="HC2F0D0B2AB8A4B6E85B507CCC8F7FA2"><enum>(iv)</enum><header>Renewal</header><text>An experimental approval may be renewed pursuant to paragraph (7)(B).</text></clause></subparagraph></paragraph> 
<paragraph id="HF0D5408BFE5D4078B570C1B5B67D55AD"><enum>(5)</enum><header>Incentives for use of treatment systems</header> 
<subparagraph id="H900B5062727A40A1822FD6A2753DD5CF"><enum>(A)</enum><header>In general</header><text>The Secretary, the Secretary of Transportation, and the Administrator shall assist owners or operators of vessels that seek to obtain experimental or interim approval for installation of ballast water treatment systems, including through providing guidance on—</text> 
<clause id="HB1AA72798F3E48F0802ECE61D8E03D1"><enum>(i)</enum><text>a sampling protocol and test program for cost-effective treatment evaluation;</text></clause> 
<clause id="H2D10F451E76E4995B76F7B5C2FACAFC"><enum>(ii)</enum><text>sources of sampling equipment and field biological expertise; and</text></clause> 
<clause id="H8C8A2F57615D43AAB2C1FE9C8DD80088"><enum>(iii)</enum><text>examples of shipboard evaluation studies.</text></clause></subparagraph> 
<subparagraph id="HDDB6BB0450E9498BA67DC4C15E50D5BC"><enum>(B)</enum><header>Selection of technologies and practices</header><text>In selecting technologies and practices for shipboard demonstration under section 1104(b), the Secretary of the Interior and the Secretary of Commerce shall give priority consideration to technologies and practices that have received or are in the process of receiving approval under paragraphs (1) and (4) of this subsection.</text></subparagraph> 
<subparagraph id="H2386AD6DA15D43A8A4DEFFB984AABBF2"><enum>(C)</enum><header>Annual summaries</header><text>The Secretary shall annually summarize, and make available to interested parties, all available information on the performance of technologies proposed for ballast treatment to facilitate the application process for experimental approval for ballast water treatment under paragraph (4).</text></subparagraph></paragraph> 
<paragraph id="H69382C3C6A26440CB1DE00591B95704C"><enum>(6)</enum><header>Application for approval</header> 
<subparagraph id="H866DCA1A4EFA4F3BBFB50256A040F078"><enum>(A)</enum><header>In general</header><text>The Secretary and the Administrator may approve only such applications for qualified type approval of the ballast water treatment system that are in such form and contain such information as the Secretary and Administrator may require.</text></subparagraph> 
<subparagraph id="HE3E0E6E31EF84E6AB5E7BBD6C22E007B"><enum>(B)</enum><header>Approval and disapproval</header> 
<clause id="H6DB089360FE3413E8397B120A5002E18"><enum>(i)</enum><header>In general</header><text>On receipt of an application under subparagraph (A)—</text> 
<subclause id="HE760A25C86D942AE87BB41B46F619506"><enum>(I)</enum><text>the Administrator shall, not later than 90 days after the date of receipt of the application—</text> 
<item id="HD8739B1AEEB048C4AE9FFCA509BCD1E5"><enum>(aa)</enum><text>review the application for compliance and consistency with environmental soundness criteria promulgated under paragraph (7)(A); and</text></item> 
<item id="HD8B3667EE96D4E978EB3FA5294034809"><enum>(bb)</enum><text>approve those ballast water treatment systems that meet those criteria; and</text></item></subclause> 
<subclause id="H9A7BCACAABAB4C68ABD560F1AE01DAE"><enum>(II)</enum><text>the Secretary, in consultation with the Task Force, shall, not later than 180 days after the date of receipt of the application—</text> 
<item id="H2B0AF3D9618E443D97F3A1A85042B62D"><enum>(aa)</enum><text>determine whether the ballast water treatment system covered by the application meets the requirements of this subsection, as appropriate;</text></item> 
<item id="H627ECB5F89B9429298003166ABB6451D"><enum>(bb)</enum><text>approve or disapprove the application; and</text></item> 
<item id="H3C5EA813D2C946B59C00A6CB30DD0096"><enum>(cc)</enum><text>provide the applicant written notice of approval or disapproval.</text></item></subclause></clause> 
<clause id="HB393AF7D4ADC4B4391EEBAA60446B0CA"><enum>(ii)</enum><header>Limitations</header><text>An application approved under clause (i) shall—</text> 
<subclause id="H1832824B41FF4D1F8DD7416F75933536"><enum>(I)</enum><text>be qualified with any limitations relating to voyage pattern, duration, or any other characteristic that may affect the effectiveness or environmental soundness of the ballast water treatment system covered by the application, as determined by the Secretary in consultation with the Administrator;</text></subclause> 
<subclause id="H4F3A8BBFDC364FC48B1B4BCC96796E33"><enum>(II)</enum><text>be applicable to a specific ship or group of ships, as determined by the Secretary;</text></subclause> 
<subclause id="H38426C44E53C405ABC106682CEA84980"><enum>(III)</enum><text>be valid for the lesser of—</text> 
<item id="HFA8BE981D4384E68ABAF95C287EBCC"><enum>(aa)</enum><text>a period of 10 years or the expected useful life of the treatment system, whichever is earlier; or</text></item> 
<item id="H247B891747FA443F8E00853D8F6EF38E"><enum>(bb)</enum><text>until such time as the Secretary or Administrator (as appropriate) determines that (based on available information, including information developed pursuant to paragraph (4)(B)(iii)) there exists a serious deficiency in performance or environmental soundness of the system relative to anticipated performance or environmental soundness; and</text></item></subclause> 
<subclause id="H108A44DB665749E1991E7B8C6832BB02"><enum>(IV)</enum><text>be renewed if—</text> 
<item id="HEF15B5ABF8D240DCAD73B533E2F72326"><enum>(aa)</enum><text>the Secretary determines that the ballast water treatment system remains in compliance with applicable standards as of the date of application for renewal; or</text></item> 
<item id="H360ACA1113124094B2EDAB7951FE4F70"><enum>(bb)</enum><text>the remaining useful life of the vessel is less than 10 years.</text></item></subclause></clause></subparagraph></paragraph> 
<paragraph id="HCBCAB51A806747BBA716EDED9C7FC992"><enum>(7)</enum><header>Environmental soundness criteria for ballast treatments</header> 
<subparagraph id="H57BFAD2011AF4BD78E12FD2FAA51F33D"><enum>(A)</enum><header>In general</header><text>The Administrator shall include in criteria promulgated under section 1202(k)(1)(A) specific criteria—</text> 
<clause id="HA9D8317889874D73AFA228D77447A0E1"><enum>(i)</enum><text>to ensure environmental soundness of ballast treatment systems; and</text></clause> 
<clause id="HD56C2466389D44F494C961609601F600"><enum>(ii)</enum><text>to grant environmental soundness exceptions under subparagraph (B).</text></clause></subparagraph> 
<subparagraph id="HAD9B58BEF96640B9B37DBD9CE00814D"><enum>(B)</enum><header>Exceptions</header> 
<clause id="H33C37175D1824F7500BD5232002EF900"><enum>(i)</enum><header>In general</header><text>In reviewing applications under paragraph (6)(B)(i)(I) in an emergency situation to achieve reductions in significant and acute risk of transfers of invasive species by vessels, the Secretary and the Administrator may jointly determine to make an exception to criteria described in subparagraph (A)(i).</text></clause> 
<clause id="H55E9E817D5C3482F88B7CDA420DD653F"><enum>(ii)</enum><header>Qualification of approvals</header><text>To be eligible for an exception under clause (i), an approval under paragraph (6)(B)(i)(I) shall be qualified under paragraph (6)(B)(ii).</text></clause></subparagraph></paragraph> 
<paragraph id="H3434545F61FE49609579FC214CD128B9"><enum>(8)</enum><header>Penalties</header><text>Paragraphs (1) and (2) of subsection (g) shall apply to a violation of a regulation promulgated under this subsection.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection></section> 
<section id="HDD96F6457ED448E7009C13BCDE81EF4D"><enum>102.</enum><header>Requirements for new vessels</header><text display-inline="no-display-inline">Section 1101 of the Nonindigenous Aquatic Nuisance Prevention and Control Act of 1990 (<external-xref legal-doc="usc" parsable-cite="usc/16/4711">16 U.S.C. 4711</external-xref>) is further amended by inserting after subsection (b) the following:</text> 
<quoted-block id="H12761D5451594A85820582C9039B8E84"> 
<subsection id="H6D3A2455AE184CA99CCE00C95E2DEA8D"><enum>(c)</enum><header>Design features and treatment systems for new vessels</header><text>A vessel of which construction begins on or after January 1, 2006, shall be equipped with design features and ballast water treatment systems that meet, at a minimum—</text> 
<paragraph id="H9821DB10CA1D43BCAC1C56502707E62"><enum>(1)</enum><text>the interim standards described in subsection (b)(1)(B)(ii); or</text></paragraph> 
<paragraph id="H8B5191BD212D4E73B4232D18B1A9B062"><enum>(2)</enum><text>on promulgation of final standards pursuant to subsection (b)(2)(A), such final standard as is applicable to the vessel.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></section> 
<section id="H452B17D513B240E7866C00D98BF50000"><enum>103.</enum><header>Great Lakes program</header><text display-inline="no-display-inline">Section 1101 of the Nonindigenous Aquatic Nuisance Prevention and Control Act of 1990 (<external-xref legal-doc="usc" parsable-cite="usc/16/4711">16 U.S.C. 4711</external-xref>) is further amended by inserting after subsection (c) the following:</text>

<subsection id="H273C49A97BA74F55803BE12900E4F331"><enum>(d)</enum><header>Great Lakes program</header> 
<paragraph id="HF83F53054D724636BF7C9E11738E655B"><enum>(1)</enum><header>Continuity of regulations and Great Lakes program</header> 
<subparagraph id="H1B9EF8DED8754F75BB92595836D44C02"><enum>(A)</enum><header>Regulations</header><text>Regulations promulgated under subsection (b) of this section, as in effect immediately before the enactment of the <short-title>National Aquatic Invasive Species Act of 2005</short-title>, shall remain in effect until such time as the regulations are revised or replaced by regulations promulgated pursuant to the <short-title>National Aquatic Invasive Species Act of 2005</short-title>.</text></subparagraph> 
<subparagraph id="H6D3F4C3FE87747878D83B5D195A6C24C"><enum>(B)</enum><header>Relationship to other programs</header><text>Upon implementation of a national mandatory ballast management program that is at least as comprehensive as the Great Lakes program established under subsection (b) of this section, as in effect immediately before the enactment of the <short-title>National Aquatic Invasive Species Act of 2005</short-title>, including regulations under that section (as determined by the Secretary, in consultation with the Governors of Great Lakes States)—</text> 
<clause id="HF4D2BA74030B48F3AC669DB8B496200"><enum>(i)</enum><text>the program regulating vessels and ballast water in the Great Lakes under this section shall terminate; and</text></clause> 
<clause id="HE4A78F3AE68A4330BC6F00E22F1FBFC3"><enum>(ii)</enum><text>the national program shall apply to such vessels and ballast water.</text></clause></subparagraph></paragraph> 
<paragraph id="H3F57E98B046D42838BD837B02EA1C29"><enum>(2)</enum><header>Review and revision</header> 
<subparagraph id="H7FB232A53E7D494CACC336903EEB61C6"><enum>(A)</enum><header>In general</header><text>Not later than 18 months after the date of enactment of the <short-title>National Aquatic Invasive Species Act of 2005</short-title>, the Secretary shall—</text> 
<clause id="HC6F3FB7499D24C1C0000166E4F2D2C1C"><enum>(i)</enum><text>review and revise regulations promulgated under this subsection; and</text></clause> 
<clause id="HA99A0CA9C1BB40F1AC733316121C00A8"><enum>(ii)</enum><text>promulgate the revised regulations.</text></clause></subparagraph> 
<subparagraph id="H3D48B72200A94250B5D1EB749CC859A6"><enum>(B)</enum><header>Contents</header><text>The revised regulations shall include at a minimum requirements under subsections (a) and (b) of this section.</text></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></section> 
<section id="H535B4EE7FACF465EADA4C083BF63C9E7"><enum>104.</enum><header>Authority of Secretary; regulations</header><text display-inline="no-display-inline">Section 1101 of the Nonindigenous Aquatic Nuisance Prevention and Control Act of 1990 (<external-xref legal-doc="usc" parsable-cite="usc/16/4711">16 U.S.C. 4711</external-xref>) is further amended by inserting after subsection (d) the following:</text>

<subsection id="H367B4CD8C55241DC823C02254F002E49"><enum>(e)</enum><header>Authority of Secretary; regulations</header> 
<paragraph id="H41307ADD40704A5888F789AE00F60035"><enum>(1)</enum><header>In general</header><text>Not later than 18 months after the date of enactment of the <short-title>National Aquatic Invasive Species Act of 2005</short-title>, the Secretary shall promulgate regulations to implement this section.</text></paragraph> 
<paragraph id="HC8ECB12271264F95973BEB1DDF795B84"><enum>(2)</enum><header>Program components</header> 
<subparagraph id="H149F9BA75EF846E48C025EB942FBD112"><enum>(A)</enum><header>In general</header><text>In carrying out paragraph (1), the Secretary shall promulgate a separate set of regulations for—</text> 
<clause id="HF439211E51CA4F0AA0354D9E169E3777"><enum>(i)</enum><text>ships that enter the Great Lakes after operating outside the exclusive economic zone; and</text></clause> 
<clause id="HB6E65085DDB04583B9573B78945F1E8C"><enum>(ii)</enum><text>ships that enter United States ports after operating outside the exclusive economic zone, excluding United States ports on the Great Lakes.</text></clause></subparagraph> 
<subparagraph id="H568FBB4902F245B0B409C6F186EAC253"><enum>(B)</enum><header>Duration</header><text>Regulations promulgated under subparagraph (A)(i) shall remain in effect until the Great Lakes program is terminated pursuant to subsection (d)(1)(B).</text></subparagraph></paragraph> 
<paragraph id="H578B8DBBBDA64DB89B28732CE97EE6B6"><enum>(3)</enum><header>Requirements</header><text>The regulations promulgated under paragraphs (1) shall—</text> 
<subparagraph id="H481108D478A643F1AE2DD1BB27A32954"><enum>(A)</enum><text>be consistent with interim and final standards issued under paragraphs (1) and (2) of subsection (b), as applicable;</text></subparagraph> 
<subparagraph id="HCF3F50F237B443A291B83CF124002753"><enum>(B)</enum><text>apply to all vessels to which the respective standards apply;</text></subparagraph> 
<subparagraph id="H2CC108EC1ACF4565B24E2619141D063C"><enum>(C)</enum><text>protect the safety of—</text> 
<clause id="H51A45F015F36464993C375E7018C8081"><enum>(i)</enum><text>each vessel; and</text></clause> 
<clause id="H20BE5003197D4D43AD2DA200988495DA"><enum>(ii)</enum><text>the crew and passengers of each vessel;</text></clause></subparagraph> 
<subparagraph id="HC364381AEB414DDBBE0563ED41371C87"><enum>(D)</enum><text>require a vessel described in paragraph (1)—</text> 
<clause id="HD13BCA1854F04526B52E9F4B12DF5F2B"><enum>(i)</enum><text>to carry out the exchange of ballast water of the vessel in waters beyond the exclusive economic zone in accordance with the standards and certification procedures promulgated under subsection (b);</text></clause> 
<clause id="H16975A8D9C03463FA64767ED6BC8D313"><enum>(ii)</enum><text>in a case in which the master of the vessel determines that compliance with clause (i) is impracticable, to exchange the ballast water of the vessel in other waters in which the exchange does not pose a threat of invasion or spread of nonindigenous species in waters of the United States, as designated by the Secretary; or</text></clause> 
<clause id="HFF6AC028526E4E42A4DF3B3B73430945"><enum>(iii)</enum><text>to use environmentally sound alternative ballast water management methods, including modification of the vessel ballast water tanks and intake systems, if the Secretary determines that such alternative methods are in accordance with standards and certification procedures promulgated under subsection (b);</text></clause></subparagraph> 
<subparagraph id="H975A02B796644866825130FF43FCAD5D"><enum>(E)</enum><text>provide for sampling of ballast intake and discharge flows through ballast piping to monitor compliance with the regulations;</text></subparagraph> 
<subparagraph id="H332D2A9EE9044CE8B448796FFA991636"><enum>(F)</enum><text>take into consideration—</text> 
<clause id="H17DAC20BBF7D4BA6A2935900AFF54F1B"><enum>(i)</enum><text>vessel types;</text></clause> 
<clause id="H3FE0243A70AE4073BDF2CA5C01D55B9E"><enum>(ii)</enum><text>variations in the ecological conditions of waters and coastal areas of the United States; and</text></clause> 
<clause id="H02EEF38AA4E34748B84ECA25C55CDC3"><enum>(iii)</enum><text>different operating conditions; and</text></clause></subparagraph> 
<subparagraph id="H473C5FF3CBCA46CBB3935652245ED930"><enum>(G)</enum><text>be based on the best scientific information available.</text></subparagraph></paragraph> 
<paragraph id="HC669F332BF394AA09DA5FACA6656848C"><enum>(4)</enum><header>Education and technical assistance</header><text>The Secretary may carry out education and technical assistance programs and other measures to promote compliance with the regulations promulgated under this subsection.</text></paragraph></subsection> 
<subsection id="H69C16E1DB7D449F0B50405F48951F993"><enum>(f)</enum><header>Periodic review and revision of regulations</header> 
<paragraph id="H5A06725BD1BF426296E268B034EDDAA"><enum>(1)</enum><header>In general</header><text>Not later than 3 years after the date of enactment of the <short-title>National Aquatic Invasive Species Act of 2005</short-title>, and not less often than every 3 years thereafter, the Secretary shall (with the concurrence of the Administrator, based on recommendations of the Task Force and information collected and analyzed by relevant research, and in accordance with criteria developed by the Task Force under paragraph (3))—</text> 
<subparagraph id="H7DD937520A434524A41103E6793F9679"><enum>(A)</enum><text>assess the compliance by vessels with regulations promulgated under this section;</text></subparagraph> 
<subparagraph id="H0885D88E16F0417CA9CFFDD527F3B7C2"><enum>(B)</enum><text>assess the effectiveness of the regulations referred to in subparagraph (A) in reducing the introduction and spread of aquatic invasive species by vessels; and</text></subparagraph> 
<subparagraph id="HCC32E244F2B442A1858714175F036D73"><enum>(C)</enum><text>as necessary, on the basis of the best scientific information available—</text> 
<clause id="H37AE15189D98456E9F5188872252F962"><enum>(i)</enum><text>revise the regulations referred to in subparagraph (A); and</text></clause> 
<clause id="HCD19DE1356304FEE8CBB00FE9D1391F3"><enum>(ii)</enum><text>promulgate additional regulations.</text></clause></subparagraph></paragraph> 
<paragraph id="HAFFFB006A4354875BBDB9925405B2EA7"><enum>(2)</enum><header>Special review and revision</header><text>Not later than 90 days after the date on which the Task Force makes a request to the Secretary for a special review and revision of the program, the Secretary shall (with the concurrence of the Administrator)—</text> 
<subparagraph id="HD0D4A296A5FB40108278DA2AD98D363"><enum>(A)</enum><text>conduct a special review of regulations in accordance with paragraph (1); and</text></subparagraph> 
<subparagraph id="H6ABF66E096E84884AFCE82494231645F"><enum>(B)</enum><text>as necessary, in the same manner as provided under paragraph (1)(C)—</text> 
<clause id="H060634F0C6C44FAFB50398476F18CA4"><enum>(i)</enum><text>revise those guidelines; or</text></clause> 
<clause id="HDA9003AA4FE64C14A3A9C7CFD2E2DD4B"><enum>(ii)</enum><text>promulgate additional regulations.</text></clause></subparagraph></paragraph> 
<paragraph id="H4B8D297B14364320B9056C00F92699B3"><enum>(3)</enum><header>Criteria for effectiveness</header><text>Not later than 1 year after the date of enactment of the <short-title>National Aquatic Invasive Species Act of 2005</short-title>, and every 3 years thereafter, the Task Force shall submit to the Secretary criteria for determining the adequacy and effectiveness of all regulations promulgated under this section.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></section> 
<section id="HF55E6514ED404414B9FEBE72B62E51"><enum>105.</enum><header>Sanctions</header><text display-inline="no-display-inline">Section 1101(g) of the Nonindigenous Aquatic Nuisance Prevention and Control Act of 1990 (<external-xref legal-doc="usc" parsable-cite="usc/16/1101">16 U.S.C. 1101(g)</external-xref>) is amended to read as follows:</text>

<subsection id="H03E5D8F1CF9B49AEA8DEE95E08664877"><enum>(g)</enum><header>Sanctions</header> 
<paragraph id="H7C8BB23EDDD344ED9D7D605191B9D8E9"><enum>(1)</enum><header>Civil penalties</header> 
<subparagraph id="HA7FEE350DB104FA70092DCB8492CF703"><enum>(A)</enum><header>In general</header><text>Any person that violates a regulation promulgated under this section shall be liable for a civil penalty in an amount not to exceed $50,000.</text></subparagraph> 
<subparagraph id="H73D42DBEF5A54A8BB520596C70057FBC"><enum>(B)</enum><header>Separate violations</header><text>Each day of a continuing violation constitutes a separate violation.</text></subparagraph> 
<subparagraph id="HF5C427E95FDD477E93DB14454FA3BFB"><enum>(C)</enum><header>Liability of vessels</header><text>A vessel operated in violation of a regulation promulgated under this Act shall be liable in rem for any civil penalty assessed under this subsection for that violation.</text></subparagraph></paragraph> 
<paragraph id="H448413AA232C44CCA1F0C0272D5E4291"><enum>(2)</enum><header>Criminal penalties</header><text>Any person that knowingly violates the regulations promulgated under subsection (b) is guilty of a class C felony.</text></paragraph> 
<paragraph id="H46F104ED35624C8E8F524F33EAA8A9DB"><enum>(3)</enum><header>Revocation of clearance</header><text>On request of the Secretary, the Secretary of the Treasury shall withhold or revoke the clearance of a vessel required by section 4197 of the Revised Statutes (<external-xref legal-doc="usc-appendix" parsable-cite="usc-appendix/46/91">46 App. U.S.C. 91</external-xref>), if the owner or operator of that vessel is in violation of the regulations promulgated under subsection (b).</text></paragraph> 
<paragraph id="HE80DCB3BAFAE43619FB2CDD2A9D4A7A3"><enum>(4)</enum><header>Exception to sanctions</header><text>This subsection does not apply to a failure to exchange ballast water if—</text> 
<subparagraph id="H86904E3841C945FC9119339311185532"><enum>(A)</enum><text>the master of a vessel, acting in good faith, decides that the exchange of ballast water will threaten the safety or stability of the vessel or the crew or passengers of the vessel; and</text></subparagraph> 
<subparagraph id="H5C127C023A6C4783B4BA92E7896991E0"><enum>(B)</enum><text>the vessel complies with—</text> 
<clause id="H9BF481EE96BF46B097B329DC5E456D77"><enum>(i)</enum><text>recordkeeping requirements of this title;</text></clause> 
<clause id="HB98F51C074334C8DB1C567B2677F6D00"><enum>(ii)</enum><text>contingency requirements of section 1211; and</text></clause> 
<clause id="H0C9E214F97EA4ADC97A2B6611B0065C"><enum>(iii)</enum><text>reporting requirements of this title.</text></clause></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></section> 
<section id="HC59A6D10B1B845538F005781BE2D691E"><enum>106.</enum><header>Program coordination</header><text display-inline="no-display-inline">Section 1101 of the Nonindigenous Aquatic Nuisance Prevention and Control Act of 1990 (<external-xref legal-doc="usc" parsable-cite="usc/16/1101">16 U.S.C. 1101</external-xref>) is further amended by striking subsections (h), (i), and (j) and inserting the following:</text> 
<quoted-block id="H2DD6A47C7C0E4DE28D0763CCD2426174"> 
<subsection id="HB534677B500942CCA812B3FB25B3D9C1"><enum>(h)</enum><header>Coordination with other agencies</header><text>The Secretary is encouraged to use (with consent) the expertise, facilities, members, or personnel of, appropriate Federal and State agencies and organizations that have routine contact with vessels, as determined by the Secretary.</text></subsection> 
<subsection id="HAE70F4768722405083118ED8C2D1704"><enum>(i)</enum><header>Consultation with canada, mexico, and other foreign governments</header><text>In developing the guidelines issued and regulations promulgated under this section, the Secretary is encouraged to consult with the Government of Canada, the Government of Mexico, and any other government of a foreign country that the Secretary, in consultation with the Task Force, determines to be necessary to develop and implement an effective international program for preventing the unintentional introduction and spread of nonindigenous species.</text></subsection> 
<subsection id="HC6DDE689529E4D5A9F3F43175798EF4C"><enum>(j)</enum><header>International cooperation</header><text>The Secretary, in cooperation with the International Maritime Organization of the United Nations and the Commission on Environmental Cooperation established pursuant to the North American Free Trade Agreement, is encouraged to enter into negotiations with the governments of foreign countries to develop and implement an effective international program for preventing the unintentional introduction and spread of nonindigenous species.</text> </subsection><after-quoted-block>.</after-quoted-block></quoted-block></section> 
<section id="H9051A8BB141649629653A91CABE3D864"><enum>107.</enum><header>Vessel safety</header><text display-inline="no-display-inline">Section 1101(k) of the Nonindigenous Aquatic Nuisance Prevention and Control Act of 1990 (<external-xref legal-doc="usc" parsable-cite="usc/16/1101">16 U.S.C. 1101(k)</external-xref>) is amended to read as follows:</text>

<subsection id="H06C0E1301C2245D887F5A5E64552A3EF"><enum>(k)</enum><header>Safety exemption</header> 
<paragraph id="HC35C3A4BE5744CD9873C4C2DE363E98C"><enum>(1)</enum><header>Master discretion</header><text>The Master of a vessel is not required to conduct a ballast water exchange if the Master determines that the exchange would threaten the safety or stability of the vessel, or the crew or passengers of the vessel, because of adverse weather, vessel architectural design, equipment failure, or any other extraordinary conditions.</text></paragraph> 
<paragraph id="HE3C413673A8E44A49B1498AF7CBE6285"><enum>(2)</enum><header>Other requirements</header><text>A vessel that does not exchange ballast water on the high seas under paragraph (1) shall not discharge ballast water in any harbor, except in accordance with a contingency strategy approved by the Secretary (and included in the invasive species management plan of the vessel) to reduce the risk of organism transfer by the discharge (using the best practicable technology and practices pursuant to regulations promulgated under subsection (b)(1)(B)(iii)).</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></section> 
<section id="H506FFF04E8F74D38A4447B53583DB010"><enum>108.</enum><header>Relationship to other law</header><text display-inline="no-display-inline">Section 1101 of the Nonindigenous Aquatic Nuisance Prevention and Control Act of 1990 (<external-xref legal-doc="usc" parsable-cite="usc/16/1101">16 U.S.C. 1101</external-xref>) is further amended by adding at the end the following:</text>

<subparagraph id="HF7D355AE7AD64C85A8E0676D265B01B"><enum>(B)</enum><header>Current ballast program</header><text>Subparagraph (A) shall not affect the ballast program for Department of Defense vessels in effect immediately before the enactment of the <short-title>National Aquatic Invasive Species Act of 2005</short-title>.</text></subparagraph></paragraph> 
<paragraph id="HBB943B2EE81E4F6EBF50638FEB1C484E"><enum>(3)</enum><header>Reports</header><text>Not later than 3 years after the date of enactment of the <short-title>National Aquatic Invasive Species Act of 2005</short-title>, and every 3 years thereafter, the Secretary of Defense shall submit to the Congress a report that includes a summary and analysis of the program carried out under this section.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph></subsection></section>

<section id="H48FB4C1E849141818B2B186E44E15B1D"><enum>201.</enum><header>Priority pathway management program</header><text display-inline="no-display-inline">Subtitle C of title I of the Nonindigenous Aquatic Nuisance Prevention and Control Act of 1990 (<external-xref legal-doc="usc" parsable-cite="usc/16/4721">16 U.S.C. 4721 et seq.</external-xref>) is amended by adding at the end the following:</text>

<section id="H531F27E1ECE7405197A456A42001943"><enum>1210.</enum><header>Priority pathway management program</header> 
<subsection id="H38C67B0FFACE43E8A14D44B54DBC034B"><enum>(a)</enum><header>Identification of high priority pathways</header><text>Not later than 2 years after the date of enactment of the <short-title>National Aquatic Invasive Species Act of 2005</short-title>, and every 3 years thereafter, the Task Force, in coordination with the Invasive Species Council and in consultation with representatives of States, industry, and other interested parties, shall, based on pathway surveys and other available research relating to the rates of introductions in waters of the United States—</text> 
<paragraph id="H61EAA53D4153416F93CB7C7E34C57F08"><enum>(1)</enum><text>identify those pathways that pose the highest risk for introductions of invasive species, both nationally and on a region-by-region basis unless further managed;</text></paragraph> 
<paragraph id="H3E66B1AEE739482EB17097BEB2B7893D"><enum>(2)</enum><text>develop recommendations for management strategies for those high-risk pathways;</text></paragraph> 
<paragraph id="H0E56E647EEC44FF699DC46A4939B4456"><enum>(3)</enum><text>include in the report to the Congress required under section 1201(f)(2)(B) a description of the identifications, strategies, and recommendations; and</text></paragraph> 
<paragraph id="H28B7E114A6954A2EAB32D9C570008749"><enum>(4)</enum><text>identify aquatic invasive species not yet introduced into waters of the United States that are likely to be introduced into waters of the United States unless preventative measures are taken.</text></paragraph></subsection> 
<subsection id="H26EA69CDCCFF4FB2BAF971DDD3D23329"><enum>(b)</enum><header>Management of high priority pathways</header><text>Not later than 3 years after the date of enactment of the <short-title>National Aquatic Invasive Species Act of 2005</short-title>, the Task Force or agencies of jurisdiction shall, to the maximum extent practicable, implement the strategies described in subsection (a)(2).</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></section> 
<section id="HF7E7E4B117A94722A9E272FCC0BF2692"><enum>202.</enum><header>Screening process for planned importations of live aquatic organisms</header><text display-inline="no-display-inline">Subtitle B of the Nonindigenous Aquatic Nuisance Prevention and Control Act of 1990 (<external-xref legal-doc="usc" parsable-cite="usc/16/4711">16 U.S.C. 4711 et seq.</external-xref>) is amended by adding at the end the following:</text>

<section id="HBB6D89C299AA456E99EBD6A9AA00467B"><enum>1105.</enum><header>Screening process for planned importations of live aquatic organisms</header> 
<subsection id="H495A60503B4747D19DA55E004C4F00D0"><enum>(a)</enum><header>In general</header><text>Not later than 3 years after the date of enactment of the <short-title>National Aquatic Invasive Species Act of 2005</short-title>, no live aquatic organism of a species not in trade shall be imported into the United States without screening and approval in accordance with subsections (c) and (d).</text></subsection> 
<subsection id="HAE736EA7E6D447F1AB359C23B391E8AD"><enum>(b)</enum><header>Guidelines</header> 
<paragraph id="HCB9E528EFF754CE2878439041600FDA"><enum>(1)</enum><header>In general</header><text>Not later than 30 months after the date of enactment of the <short-title>National Aquatic Invasive Species Act of 2005</short-title>, in consultation with regional panels convened under section 1203, States, tribes, and other stakeholders, the Invasive Species Council (in conjunction with the Task Force) shall issue guidelines for screening proposed planned importations of live aquatic organisms into the United States, that include—</text> 
<subparagraph id="HEBC3F096BAC44BF8930480547689EA80"><enum>(A)</enum><text>guidelines for minimum information requirements for determinations under subsection (c); and</text></subparagraph> 
<subparagraph id="HFB9943373979439F9E017571F640F1B"><enum>(B)</enum><text>guidelines for a simplified notification procedure for any additional shipments of organisms that may occur after completion of an initial screening process and determination under subsection (c).</text></subparagraph></paragraph> 
<paragraph id="H53DABC06EDC74E7D89D1012E89A5CD49"><enum>(2)</enum><header>Purpose</header><text>The purpose of the screening process shall be to prevent the introduction or establishment of aquatic invasive species in waters of the United States and contiguous waters of Canada and Mexico.</text></paragraph> 
<paragraph id="H8190476F7865463999C16C6B7F2C68DC"><enum>(3)</enum><header>Factors</header><text>In developing guidelines under this subsection and reviewing and revising the guidelines under subsection (j), the Invasive Species Council and the Task Force shall consider—</text> 
<subparagraph id="H68DF664EC7F24AE4851CA578CBBB3F3D"><enum>(A)</enum><text>the likelihood of the spread of species by human or natural means;</text></subparagraph> 
<subparagraph id="H4270CB47728D497FAAEFCE38EABAE1D"><enum>(B)</enum><text>species that may occur in association with the species planned for importation, including pathogens, parasites, and free-living organisms; and</text></subparagraph> 
<subparagraph id="HF2BA9BDA32A64673B3BC63767C000094"><enum>(C)</enum><text>regional differences in probability of invasion and associated impacts.</text></subparagraph></paragraph></subsection> 
<subsection id="H77A46DBE324D480180A4AF8C12077941"><enum>(c)</enum><header>Categories</header><text>The screening process conducted pursuant to subsection (d) shall require the identification, to the maximum extent practicable, to the species level or, at least, to the genus level, of live aquatic organisms proposed for importation and shall list—</text> 
<paragraph id="H99565C29A9CA42A884D4BDD07AFC048"><enum>(1)</enum><text>species with high or moderate probability of undesirable impacts to areas within the boundaries of the United States and contiguous areas of neighboring countries, to which the species is likely to spread; and</text></paragraph> 
<paragraph id="H2C5362DAD3104275B049BA04AA001BE7"><enum>(2)</enum><text>species on which there is insufficient information to determine the risk category based on guidelines issued pursuant to subsection (b)(1)(B).</text></paragraph></subsection> 
<subsection id="HEC725B8C8C2D45368F00D47000C9EA85"><enum>(d)</enum><header>Evaluation</header> 
<paragraph id="H170520A7F0FC4A9DA3F31796F527FC31"><enum>(1)</enum><header>In general</header><text>Not later than 180 days after the date of promulgation of guidelines under subsection (b), in consultation with regional panels convened under section 1203, States, tribes, and other stakeholders, a Federal agency with authority over an importation into the United States of a live organism of a species not in trade shall screen the species in accordance with guidelines promulgated under subsection (b).</text></paragraph> 
<paragraph id="H19E313FB9F054839B91344AD694400A3"><enum>(2)</enum><header>Delegation and authority</header><text>If no agency has authority described in paragraph (1) or an agency delegates the screening to the Director under subsection (h)—</text> 
<subparagraph id="HFFA9882B68C8468E9504D916CF9E2F7C"><enum>(A)</enum><text>the Director shall screen the organisms in accordance with subsections (a) and (b); and</text></subparagraph> 
<subparagraph id="HBFEBB6CD679C48AC828B33E8CE59686"><enum>(B)</enum><text>the Director may prohibit the importation of an organism of a species not in trade if the Director determines, based on evaluations consistent with the screening requirements promulgated under section (f), that the species has a high or moderate probability of undesirable impacts on areas within the boundaries of the United States and contiguous areas of neighboring countries to which the species may spread.</text></subparagraph></paragraph> 
<paragraph id="HE099142C18944FA7AC51D21E8E42A955"><enum>(3)</enum><header>Multiple jurisdiction</header><text>If more than 1 agency has jurisdiction over the importation of a live organism, the agencies shall conduct only 1 screening process as determined by a memorandum of understanding consistent with subsection (f), except that the Secretary of Agriculture, shall conduct screening of organisms imported to be cultured.</text></paragraph></subsection> 
<subsection id="HF96EBF454099415E80094C40DB17A086"><enum>(e)</enum><header>Requirements</header><text>A Federal agency of jurisdiction, or the Director, shall—</text> 
<paragraph id="H4B546C59C6714DEF8BD0604FCAF3D85F"><enum>(1)</enum><text>restrict or prohibit the importation into the United States from outside the United States of any species that is described in subsection (c)(1);</text></paragraph> 
<paragraph id="H9ACCFBB8862D42CFB09F1941905F9BDD"><enum>(2)</enum><text>prohibit the importation of any species described in subsection (c)(2), unless the importation is for the sole purpose of research that is conducted in accordance with section 1202(f)(2); and</text></paragraph> 
<paragraph id="HCA72E595AD844DC8B12388A8F900ED21"><enum>(3)</enum><text>make a determination under this subsection not later than 60 days after receiving a request for permission to import a live aquatic species.</text></paragraph></subsection> 
<subsection id="HB576135D5B3D45EABCB2ECF87985363B"><enum>(f)</enum><header>Memorandum of Understanding</header> 
<paragraph id="H51A8A8D2677D4207AC8F23DE108B033B"><enum>(1)</enum><header>In general</header><text>The Director of the United States Fish and Wildlife Service shall enter into a Memorandum of Understanding with the heads of the agencies of jurisdiction regarding the screening requirements contained in this section.</text></paragraph> 
<paragraph id="H58D33CE3DD174ADDA6AB16DE48238D34"><enum>(2)</enum><header>Contents</header><text>The Memorandum of Understanding shall contain, at a minimum—</text> 
<subparagraph id="H75B4D4BF58B14D8698C4AB0100751752"><enum>(A)</enum><text>a description of the relationship between and responsibilities of the agencies of jurisdiction, including a process designating a lead agency in cases in which multiple agencies may have jurisdiction over the screening of an aquatic species;</text></subparagraph> 
<subparagraph id="H79AA8582E8B94173A6A6F6D079900090"><enum>(B)</enum><text>the process by which the Director will delegate screening duties to and receive delegation from other agencies of jurisdiction; and</text></subparagraph> 
<subparagraph id="HFBB7EA14D24B437286E0D976E7451860"><enum>(C)</enum><text>the process by which agencies of jurisdiction will coordinate and share information required for the screening process.</text></subparagraph></paragraph></subsection> 
<subsection id="H60F8B770E389459B9E8810121683008F"><enum>(g)</enum><header>Delegation to Director</header><text>Any agency with authority over the planned importation of a live aquatic organism may delegate to the Director the screening process carried out under this section.</text></subsection> 
<subsection id="H22A700E23628450DA17C102DB25132FA"><enum>(h)</enum><header>Catalog of species in trade</header><text>Not later than 1 year after the date of enactment of the <short-title>National Aquatic Invasive Species Act of 2005</short-title>, the Director of the United States Geological Survey and the Director of the Smithsonian Environmental Research Center, in cooperation with agencies with jurisdiction over planned importations of live organisms, shall—</text> 
<paragraph id="HD508AF19A889410882B064035BA59ED3"><enum>(1)</enum><text>develop and update as necessary a catalog of species in trade; and</text></paragraph> 
<paragraph id="HCE381CE578494BB6BADA001CEE8213CC"><enum>(2)</enum><text>include the list in the information provided to the public pursuant to section 1102(f).</text></paragraph></subsection> 
<subsection id="HE8EAC630DEB94955AA4FE39C47FB9D99"><enum>(i)</enum><header>Review and revision</header> 
<paragraph id="H4CE958A65B3D43E5B3061657C32D0088"><enum>(1)</enum><header>In general</header><text>At least once every 3 years, the Council, in conjunction with the Task Force, shall use research on early detection and monitoring under section 1106, among other information sources, to review and revise the screening, guidelines, and process carried out under this section.</text></paragraph> 
<paragraph id="H392D29310DA44F88BBF19899D8A166D0"><enum>(2)</enum><header>Report</header><text>The Invasive Species Council shall include in its report to Congress required pursuant to section 1201(f)(2)(B)—</text> 
<subparagraph id="H6A87AB38317445AE82ECA0C699B24D61"><enum>(A)</enum><text>an evaluation of the effectiveness of the screening processes carried out under this section;</text></subparagraph> 
<subparagraph id="H669AF3D654AF414594A58FB81345B038"><enum>(B)</enum><text>an evaluation of the consistency of the application of the screening by agencies; and</text></subparagraph> 
<subparagraph id="H8AFB306DDE98447288CFF24FC4926D25"><enum>(C)</enum><text>recommendations for revisions of the processes.</text></subparagraph></paragraph></subsection> 
<subsection id="HBBE2BD5DC85148358B23DA8400B8F3BB"><enum>(j)</enum><header>Prohibitions</header><text>It shall be unlawful for any person subject to the jurisdiction of the United States to import an organism of a species described under subsection (c) or (d) or in violation of regulations promulgated under this section.</text></subsection> 
<subsection id="H8E498F06B23246EDA49BB66D6500E650"><enum>(k)</enum><header>Penalties</header> 
<paragraph id="HF14E19349DE34E03B4F4BC38103C0900"><enum>(1)</enum><header>Civil penalties</header><text>Any person who violates subsection (j) shall be liable for a civil penalty in an amount not to exceed $50,000.</text></paragraph> 
<paragraph id="H13FD837D5EE34106B3DE868219B6CEB"><enum>(2)</enum><header>Criminal penalties</header><text>Any person who knowingly violates subsection (j) is guilty of a class C felony.</text></paragraph></subsection> 
<subsection id="H85AA1D78CF3F46C58775DFA914C21855"><enum>(l)</enum><header>Fees</header><text>The head of any agency that has jurisdiction over a planned importation of a species subject to screening under this Act may increase the amount of any appropriate fee that is charged under an authority of law to offset the cost of any screening process carried out under this section.</text></subsection> 
<subsection id="HCBED5D0138F941579500F18064384F52"><enum>(m)</enum><header>Information</header><text>A Federal agency conducting a screening process under this section shall make the results of the process available to the public (including international organizations).</text></subsection> 
<subsection id="H7C7B93EC106245D8930055F780CA6D25"><enum>(n)</enum><header>Regulations</header><text>The Director may issue regulations to implement this section.</text></subsection> 
<subsection id="HFD30475B5B1F477EA374FCE0D0A4039E"><enum>(o)</enum><header>Applicability: effect on other laws</header><text>Nothing in this section shall be construed as repealing, superseding, or modifying any provision of Federal or state law.</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></section></title>

<section id="H53F09811B5554F2BB024451F8717F404"><enum>301.</enum><header>Early detection</header><text display-inline="no-display-inline">Subtitle B of the Nonindigenous Aquatic Nuisance Prevention and Control Act of 1990 (<external-xref legal-doc="usc" parsable-cite="usc/16/4711">16 U.S.C. 4711 et seq.</external-xref>) (as amended by section 202) is amended by adding at the end the following:</text>

<paragraph id="H67B3F7B214AB4B2E84FD48B11721D84E"><enum>(1)</enum><header>In general</header><text>Not later than 18 months after the date of enactment of the <short-title>National Aquatic Invasive Species Act of 2005</short-title>, in conjunction with the Council, the Task Force shall develop and promulgate a set of sampling protocols, a geographic plan, and budget to support a national system of ecological surveys to rapidly detect recently established aquatic invasive species in waters of the United States.</text></paragraph> 
<paragraph id="H62C0FEBB505C4F89ACB7FDD878D39636"><enum>(2)</enum><header>Contents</header><text>The protocols, plan, and budget shall, at a minimum—</text> 
<subparagraph id="H14ADF197E699496B844531DCF2A315A9"><enum>(A)</enum><text>address a diversity of aquatic ecosystems of the United States (including inland and coastal waters);</text></subparagraph> 
<subparagraph id="H95FD480C10AD453BA4A9592CEE84CDC"><enum>(B)</enum><text>encourage State, local, port, and tribal participation in monitoring;</text></subparagraph> 
<subparagraph id="H6737F90AE8D141D4962C838D8DB1A01C"><enum>(C)</enum><text>balance scientific rigor with practicability, timeliness, and breadth of sampling activity;</text></subparagraph> 
<subparagraph id="H7F7D9CD86424488387A02D004692E74B"><enum>(D)</enum><text>consider the pathways and/or organisms identified under section 1210;</text></subparagraph> 
<subparagraph id="H66A7C85D2C404ECFA966B3DDB3411668"><enum>(E)</enum><text>include a capacity to evaluate the impacts of permitted importations screened by the processes established under section 1105; and</text></subparagraph> 
<subparagraph id="H32A0C149938B4AC9A557BB6B5430B492"><enum>(F)</enum><text>include clear lines of communication with appropriate Federal, State, and regional rapid response authorities.</text></subparagraph></paragraph> 
<paragraph id="HDC3B509F806B4B1EB41144C08D491C93"><enum>(3)</enum><header>Implementation</header><text>Not later than 3 years after the date of enactment of the <short-title>National Aquatic Invasive Species Act of 2005</short-title>, the Director of the United States Fish and Wildlife Service, the Administrator of the National Oceanic and Atmospheric Administration, and the Administrator (in consultation with the Invasive Species Council and in coordination with other agencies) shall implement a national system of ecological surveys that is—</text> 
<subparagraph id="H666A82CD0ED14F87AE6706C1F768FDF9"><enum>(A)</enum><text>carried out in cooperation with State, local, port, tribal authorities, and other non-Federal entities (such as colleges and universities); and</text></subparagraph> 
<subparagraph id="H1131BF057ADC42BDB404B93CA37891DB"><enum>(B)</enum><text>based on the protocols, plan, and budget published under subsection (a)(1) and any public comment.</text></subparagraph></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></section> 
<section id="HC7D94EA35F3846729E483732F64DC02F"><enum>302.</enum><header>Rapid response</header><text display-inline="no-display-inline">Subtitle C of title I of the Nonindigenous Aquatic Nuisance Prevention and Control Act of 1990 (<external-xref legal-doc="usc" parsable-cite="usc/16/4721">16 U.S.C. 4721 et seq.</external-xref>) is further amended by adding at the end the following:</text>

<subsection id="HD0F8800D85394E289F07E3CFE0248126"><enum>(a)</enum><header>State Rapid Response Contingency Strategies</header> 
<paragraph id="H8F80EC2FB14C490F93F1FDE8DDA23321"><enum>(1)</enum><header>Emergency funds for rapid response</header><text>A State that has in effect a rapid response contingency strategy for invasive species in the State, including rapid assessment capabilities, that is approved under paragraph (2) shall be eligible to receive emergency funding to remain available until expended to implement rapid response measures for aquatic invasive species under the strategy, subject to renewal, as determined by the Secretary of the Interior and the Secretary in accordance with paragraph (2).</text></paragraph> 
<paragraph id="HD271037F1E564D6BA31B13B9C2AFF6E4"><enum>(2)</enum><header>Approval of Rapid Response Contingency Strategies</header><text>The Task Force, in consultation with the Invasive Species Council, shall approve a State rapid response contingency strategy described in paragraph (1) if the strategy—</text> 
<subparagraph id="HD5D1CD0A97BF451D8E81043320F9666F"><enum>(A)</enum><text>identifies all key governmental and nongovernmental partners to be involved in carrying out the strategy;</text></subparagraph> 
<subparagraph id="H5B40E9D722344588006E2EA6E6648CA"><enum>(B)</enum><text>clearly designates the authorities and responsibilities of each partner, including the authority of any State or government of an Indian tribe to distribute emergency funds;</text></subparagraph> 
<subparagraph id="H8569977F3A1D4765A03E0079178CA3AC"><enum>(C)</enum><text>specifies criteria for rapid response measures, including a diagnostic system that—</text> 
<clause id="H42779100D5DE4C24BEF59F15006B3975"><enum>(i)</enum><text>distinguishes cases in which rapid response has a likelihood of success and cases in which rapid response has no likelihood of success;</text></clause> 
<clause id="H73A2CF430CE249C4A273372D2E48DB83"><enum>(ii)</enum><text>distinguishes rapid response measures from ongoing management and control of established populations of aquatic invasive species; and</text></clause> 
<clause id="H6950CC1B23F24BE392455BD88125EF74"><enum>(iii)</enum><text>distinguishes instances in which the rate and probability of organism dispersal is significantly altered by vessel movements;</text></clause></subparagraph> 
<subparagraph id="H0D696706A05C40AB9CCBD584D059EA1B"><enum>(D)</enum><text>includes an early detection strategy that supports or complements the early detection and monitoring system developed under section 1106;</text></subparagraph> 
<subparagraph id="H75E0663F55504DB59064EDD62F769773"><enum>(E)</enum><text>provides for a monitoring capability to assess—</text> 
<clause id="H7DC488D734BE49CD8646B698C96647AB"><enum>(i)</enum><text>the extent of infestations; and</text></clause> 
<clause id="H035FE073B36B42168B703D4994379F36"><enum>(ii)</enum><text>the effectiveness of rapid response efforts;</text></clause></subparagraph> 
<subparagraph id="H4CF9377296874EABBD27D7292DAAE28D"><enum>(F)</enum><text>to the maximum extent practicable, is integrated into the State aquatic invasive species management plan approved under section 1204;</text></subparagraph> 
<subparagraph id="HE131AA2DFBCD4E729B13DD7845AE66D2"><enum>(G)</enum><text>to the maximum extent possible, does not use rapid response tools that do not meet environmental criteria developed under subsection (e)(4);</text></subparagraph> 
<subparagraph id="HF599C10E7A324951ADA59CDBBF32A990"><enum>(H)</enum><text>includes a public education and outreach component directed at—</text> 
<clause id="HE6D01CC9233D41FA00AA86245D7CB222"><enum>(i)</enum><text>potential pathways for spread of aquatic invasive species; and</text></clause> 
<clause id="H0CA69F21AF91483EBF5B0080C637002E"><enum>(ii)</enum><text>persons involved in industries and recreational activities associated with those pathways; and</text> 
<subclause indent="up2" id="HBEEEE80A0BD14095B11273C3CB2000ED"><enum>(I)</enum><text>to the extent that the strategy involves vessels, conforms with guidelines issued by the Secretary under subsection (c)(2).</text></subclause></clause></subparagraph></paragraph></subsection> 
<subsection id="H3B3C95BAE1A34299002E2BBA326FB3A5"><enum>(b)</enum><header>Regional Rapid Response Contingency Strategies</header><text>The Task Force, with the concurrence of the Invasive Species Council and in consultation with the regional panels of the Task Force established under section 1203, shall encourage the development of regional rapid response contingency strategies that—</text> 
<paragraph id="HF5A7B1D49779443793F913B992B752D1"><enum>(1)</enum><text>provide a consistent and coordinated approach to rapid response; and</text></paragraph> 
<paragraph id="HE46DC3714D384EF991FA4B17D3912C19"><enum>(2)</enum><text>are approved by—</text> 
<subparagraph id="H3059852F423D4E01A3CFF7D79E7CC1F7"><enum>(A)</enum><text>the Secretary; and</text></subparagraph> 
<subparagraph id="H7750A0D8670E4380BAC4B5ACF94CE33"><enum>(B)</enum><text>the Governors and Indian tribes having jurisdiction over areas within a region.</text></subparagraph></paragraph></subsection> 
<subsection id="H154629B4143B4311BFF6333F845698D4"><enum>(c)</enum><header>Model Rapid Response Contingency Strategies</header><text>Not later than 18 months after the date of enactment of the <short-title>National Aquatic Invasive Species Act of 2005</short-title>—</text> 
<paragraph id="H6AF20745D6964A61B5771EA8FDD2D999"><enum>(1)</enum><text>the Task Force, with the concurrence of the Invasive Species Council and the regional panels of the Task Force established under section 1203, shall develop—</text> 
<subparagraph id="HC738A2E9A4194205839200DA5F60289B"><enum>(A)</enum><text>a model State rapid response contingency strategy for aquatic invasive species, including rapid assessment capability, that includes, to the maximum extent practicable, the components listed under subparagraphs (A) through (H) of subsection (a)(2); and</text></subparagraph> 
<subparagraph id="H9403032D762540BEB10004A5AC266EDE"><enum>(B)</enum><text>a model regional rapid response contingency strategy for aquatic invasive species; and</text></subparagraph></paragraph> 
<paragraph id="H939C22E29F5948C194B94DCE954473"><enum>(2)</enum><text>the Secretary, in concurrence with the Task Force and the regional panels, shall issue guidelines that describe vessel-related requirements that may be used in a rapid response contingency strategy, including specific requirements for strategy approved under this section.</text></paragraph></subsection> 
<subsection id="HE74F2F8E4AC549E8AA15005E2B1992DA"><enum>(d)</enum><header>Cost sharing</header> 
<paragraph id="H799BAA84562D498ABC49A1663B8D1868"><enum>(1)</enum><header>State Rapid Response Contingency Strategies</header><text>The Federal share of the cost of activities carried out under a State rapid response contingency strategy approved under subsection (a) shall be not less than 50 percent.</text></paragraph> 
<paragraph id="HE1BF8AEE5F8041ABAD53B080E9623DB8"><enum>(2)</enum><header>Regional Rapid Response Contingency Strategies</header><text>The Federal share of the cost of activities carried out under a regional rapid response contingency strategy approved under subsection (b) shall be not less than 75 percent.</text></paragraph> 
<paragraph id="H771A9BCB536A48709E006C44EC1344AF"><enum>(3)</enum><header>In-kind contributions</header><text>States or regions that receive Federal funds for rapid response activities may provide matching funds in the form of in-kind contributions.</text></paragraph></subsection> 
<subsection id="H16EAD66D61AA4920AB7E8D08F31B87A0"><enum>(e)</enum><header>Federal rapid response teams</header> 
<paragraph id="H33153F8034BC4296A394BA884E477600"><enum>(1)</enum><header>Establishment of teams</header><text>Not later than 1 year after the date of enactment of the <short-title>National Aquatic Invasive Species Act of 2005</short-title>, the Invasive Species Council, in coordination with the Task Force and the heads of appropriate Federal agencies, shall establish a Federal rapid response team for each of the 10 Federal regions that comprise the Standard Federal Regional Boundary System.</text></paragraph> 
<paragraph id="H14374FADDA1B45CA9C34115B4BBF3718"><enum>(2)</enum><header>Duties of teams</header><text>Each Federal rapid response team shall, at a minimum—</text> 
<subparagraph id="HFE4D4143C5854FED8855E3D181B2FECB"><enum>(A)</enum><text>implement rapid eradication or control responses for newly detected aquatic invasive species on Federal and tribal land;</text></subparagraph> 
<subparagraph id="H24838969E1004767AE01885B06DE4344"><enum>(B)</enum><text>carry out, or assist in carrying out, rapid responses for newly detected aquatic invasive species on non-Federal land at the request of a State, Indian tribe, or group of States or Indian tribes;</text></subparagraph> 
<subparagraph id="H670FF89944164FB6B7DCE011FACCFADB"><enum>(C)</enum><text>provide training and expertise for State, tribal, or regional rapid responders;</text></subparagraph> 
<subparagraph id="H52C84180045746F39BFB4309BC2D985B"><enum>(D)</enum><text>provide central sources of information for rapid responders;</text></subparagraph> 
<subparagraph id="H63E769B6462841FB9DABD7B347F3C291"><enum>(E)</enum><text>maintain a list of researchers and rapid response volunteers; and</text></subparagraph> 
<subparagraph id="HBCEBAE2E35864F309B25D484DFF2AC95"><enum>(F)</enum><text>in carrying out any rapid response activity with respect to an aquatic noxious weed listed under section 412(f) of the Plant Protection Act (<external-xref legal-doc="usc" parsable-cite="usc/7/7712">7 U.S.C. 7712(f)</external-xref>), include representatives of the Animal and Plant Health Inspection Service.</text></subparagraph></paragraph> 
<paragraph id="HF9FA066A3B9141B5B4058B844CC950FA"><enum>(3)</enum><header>Criteria for identifying cases of rapid response warranting Federal assistance</header><text>Not later than 1 year after the date of enactment of the <short-title>National Aquatic Invasive Species Act of 2005</short-title>, the Task Force, with the concurrence of the Invasive Species Council, shall develop criteria to identify cases of rapid response warranting Federal assistance under this subsection, including criteria relating to, at a minimum—</text> 
<subparagraph id="H57A2E760404B4EE5824D46B65E9955D7"><enum>(A)</enum><text>the extent to which infestations of aquatic invasive species may be managed successfully by rapid response;</text></subparagraph> 
<subparagraph id="H48DC0AF1517547DDAE00228301D7B68"><enum>(B)</enum><text>the extent to which rapid response efforts may differ from ongoing management and control; and</text></subparagraph> 
<subparagraph id="H1A68EA3022354B7B96473000E7859D5B"><enum>(C)</enum><text>the extent to which infestations of nonindigenous aquatic invasive species are considered to be an acute or chronic threat to—</text> 
<clause id="HED02C67E381D45428CDAACE32CE1D2CF"><enum>(i)</enum><text>biodiversity of native fish and wildlife;</text></clause> 
<clause id="H8AC9A4D11F6E4CAEB4016500A3A0A57F"><enum>(ii)</enum><text>habitats of native fish and wildlife; or</text></clause> 
<clause id="H1E9AB3DE0313487BA74FF8C181D0FAFD"><enum>(iii)</enum><text>human health.</text></clause></subparagraph></paragraph> 
<paragraph id="H3835A0E826AB462CB1C9BAE0579458C2"><enum>(4)</enum><header>Environmental criteria</header><text>Not later than 1 year after the date of enactment of the <short-title>National Aquatic Invasive Species Act of 2005</short-title>, the Administrator, in consultation with the Invasive Species Council, the Secretary of Transportation, the Task Force (including regional panels of the Task Force established under section 1203), the Director, and the Director of the National Marine Fisheries Service, shall develop environmental criteria to minimize nontarget environmental impacts of rapid responses carried out pursuant to this section.</text></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></section> 
<section id="H69BF14454E484DE4B2E69368DD714227"><enum>303.</enum><header>Dispersal barriers</header> <text display-inline="no-display-inline">Section 1202 of the Nonindigenous Aquatic Nuisance Prevention and Control Act of 1990 (<external-xref legal-doc="usc" parsable-cite="usc/16/4722">16 U.S.C. 4722</external-xref>) is amended—</text> 
<paragraph id="HF7D0BFB277B443E299BECBC575CBE94"><enum>(1)</enum><text>by redesignating subsections (j) and (k) as subsections (l) and (m), respectively; and</text></paragraph> 
<paragraph id="H728177078F66488494C7B8FA4D2400FF"><enum>(2)</enum><text>by inserting after subsection (i) the following:</text>

<subsection id="H28C41819D04543A1B5975F3046231827"><enum>(j)</enum><header>National dispersal barrier program</header> 
<paragraph id="H569752C86E40480E97D6CFABA5E0045"><enum>(1)</enum><header>Chicago River Ship and Sanitary Canal dispersal barrier project</header> 
<subparagraph id="H3AAE52B3C24C4F44A129DCD8BDFDE73B"><enum>(A)</enum><header>In general</header><text>The Assistant Secretary, with the concurrence of the Administrator, shall complete construction of, operate, and maintain, the Chicago River Ship and Sanitary Canal dispersal barrier project.</text></subparagraph> 
<subparagraph id="H34A7E4DB4DF5409EBB21CFC34ED40900"><enum>(B)</enum><header>Consultation</header><text>Subparagraph (A) shall be carried out in consultation with the appropriate Federal, State, local, and other nongovernmental entities.</text></subparagraph> 
<subparagraph id="H420DC53D474B45EF9EB0285300A3E5D5"><enum>(C)</enum><header>Construction</header><text>The completed barrier project shall include additions to the dispersal barrier in existence on the date of enactment of the National Aquatic Species Act of 2005, including—</text> 
<clause id="H47973D79B89A4464BFD84DC40085FCD7"><enum>(i)</enum><text>backup power;</text></clause> 
<clause id="H461235CC579C448EBF181622B395C549"><enum>(ii)</enum><text>a research vessel launching crane;</text></clause> 
<clause id="HB4A74B9D96FE4894B840EEEEA58F65CE"><enum>(iii)</enum><text>replacement electrodes;</text></clause> 
<clause id="H5BC8EE8670A5414EAE58D53B009FD943"><enum>(iv)</enum><text>other barrier elements, as available and appropriate;</text></clause> 
<clause id="H6120B10C08FB4FE3A584463BDB00A133"><enum>(v)</enum><text>an acoustic monitoring system;</text></clause> 
<clause id="HFA8C69502F2D4B04BCB75211FB8900CE"><enum>(vi)</enum><text>an emergency egress system; and</text></clause> 
<clause id="HB4905A66FCC9403CAEE7A3877DF4E394"><enum>(vii)</enum><text>a second long-service life dispersal barrier.</text></clause></subparagraph> 
<subparagraph id="H964107CE06BA4FF788B1863374D9E0CF"><enum>(D)</enum><header>Feasibility study of Chicago River Ship and Sanitary Canal</header> 
<clause id="HB75E08C4EE914ACB8F05DB12101B8B49"><enum>(i)</enum><header>In general</header><text>Not later than 3 years after the date of enactment of the <short-title>National Aquatic Invasive Species Act of 2005</short-title>, the Assistant Secretary, in consultation with appropriate Federal, State, local, and nongovernmental entities, shall conduct a feasibility study of the full range of options available to prevent the spread of aquatic species through the Chicago River Ship and Sanitary dispersal barrier.</text></clause> 
<clause id="H9600D1C31D1A4E53A8F52DC207ADC6A1"><enum>(ii)</enum><header>Matters to be studied</header><text>The study shall—</text> 
<subclause id="HDE9C9C0FE75947699D257E00072D4FA4"><enum>(I)</enum><text>provide recommendations concerning additional and long-term measures necessary to improve the performance of the Chicago River Ship and Sanitary Canal dispersal barrier; and</text></subclause> 
<subclause id="H9BF90B27B8D4491AA09BA352B7AC6194"><enum>(II)</enum><text>examine methods and measures necessary to achieve, to the maximum extent practicable, 100-percent efficacy of the barrier with respect to aquatic invasive species of fish and maximum efficacy of the barrier with respect to other taxa of aquatic invasive species.</text></subclause></clause></subparagraph></paragraph> 
<paragraph id="HE77B04032918414100449400012B6C96"><enum>(2)</enum><header>Monitoring program</header> 
<subparagraph id="H107E5DE04B794D918D34BFF90303EED2"><enum>(A)</enum><header>Establishment</header><text>Not later than 1 year after the date of enactment of the <short-title>National Aquatic Invasive Species Act of 2005</short-title>, the Secretary of the Interior shall establish an interbasin and intrabasin monitoring program.</text></subparagraph> 
<subparagraph id="HEB9FB6A28894441483A2A48C7D95B6E1"><enum>(B)</enum><header>Required elements</header><text>The monitoring program shall—</text> 
<clause id="HF50BE98B602E4117AC805D1916FA5DD7"><enum>(i)</enum><text>track aquatic invasive species moving through the Chicago River Ship and Sanitary Canal, the Lake Champlain Canal, other interbasin waterways, and major river systems as recommended by regional panels convened under section 1203;</text></clause> 
<clause id="H4FFED97B3ACF4AC1966FEC36FCAD2020"><enum>(ii)</enum><text>assess the efficacy of dispersal barriers and other measures in preventing the spread of aquatic invasive species through the waterways; and</text></clause> 
<clause id="H3548E860DC714B1FAAB2DB4E3C29AAF2"><enum>(iii)</enum><text>identify waterways suitable for dispersal barrier demonstration projects, in addition to the waterways at which dispersal barrier demonstration projects were carried out before the date of enactment of the <short-title>National Aquatic Invasive Species Act of 2005</short-title>.</text></clause></subparagraph> 
<subparagraph id="HE2E7D507F5F24EF99902A321859800FA"><enum>(C)</enum><header>Reports</header><text>The Secretary of the Interior shall issue biennial reports on the findings of the monitoring program.</text></subparagraph></paragraph> 
<paragraph id="HDEF8BD55ADFC4032A0003C588F41698C"><enum>(3)</enum><header>Prevention and mitigation plans for army corps of engineers projects</header><text>In developing projects involving interbasin waterways or other hydrologic alternations that could create pathways for aquatic invasive species, the Assistant Secretary shall develop adequate prevention and mitigation plans for controlling the dispersal of aquatic invasive species.</text></paragraph> 
<paragraph id="HCA672AAA858B4D3189BCD701F3D39375"><enum>(4)</enum><header>Technical assistance</header><text>The Great Lakes Environmental Research Laboratory of the National Oceanic and Atmospheric Administration shall provide technical assistance to appropriate entities to assist in the research conducted under this subsection.</text></paragraph> 
<paragraph id="H3BF5C2B8B0FF404DB4B4DF4C71103D57"><enum>(5)</enum><header>Reports</header><text>Not later than 3 years after the date of enactment of the <short-title>National Aquatic Invasive Species Act of 2005</short-title>, the Assistant Secretary and the Director shall jointly submit to the Congress a report that describes—</text> 
<subparagraph id="HFACCD8A0778B43B3861DE74568CF0099"><enum>(A)</enum><text>the efficacy of the Chicago River Ship and Sanitary Canal dispersal barrier project; and</text></subparagraph> 
<subparagraph id="HF56B7675220D47799CCAED6899A66B45"><enum>(B)</enum><text>a plan to provide for additional dispersal barrier demonstration projects and further research needs.</text></subparagraph></paragraph> 
<paragraph id="H1863CB6854234E7DA3EC744882F68ECD"><enum>(6)</enum><header>Additional waterways</header><text>The Assistant Secretary, with the concurrence of the Administrator, and other relevant Federal agencies, shall—</text> 
<subparagraph id="HAEC67C39CDF84ED39395EB62B9228500"><enum>(A)</enum><text>identify additional waterways suitable for the construction of new dispersal barriers (based on the monitoring program established under paragraph (2)); and</text></subparagraph> 
<subparagraph id="HA294F0B00F6448ADA59073EFCE89DED8"><enum>(B)</enum><text>construct, maintain, and operate such dispersal barriers as necessary.</text></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section> 
<section id="HB8AE9B3DEC544BCC9C004F502587D85D"><enum>304.</enum><header>Environmental soundness</header><text display-inline="no-display-inline">Section 1202 of the Nonindigenous Aquatic Nuisance Prevention and Control Act of 1990 (<external-xref legal-doc="usc" parsable-cite="usc/16/4722">16 U.S.C. 4722</external-xref>) is further amended by inserting after subsection (j) the following:</text> 
<quoted-block id="H224A716EE6894642BCA17FAD19613EDC"> 
<subsection id="HC217B3541A1443FDAA3020E7D7F5B08F"><enum>(k)</enum><header>Improvement of treatment methods for aquatic Invasive Species</header> 
<paragraph id="HEFE8BB7D65054A288F231CB12651A493"><enum>(1)</enum><header>Criteria to evaluate environmental soundness of treatment methods</header> 
<subparagraph id="HE4F0856F90EB4864A5986C3CC668BC2"><enum>(A)</enum><header>In general</header><text>Not later than 1 year after the date of enactment of the <short-title>National Aquatic Invasive Species Act of 2005</short-title>, the Administrator, in consultation and cooperation with the Secretary, the Invasive Species Council, and the Task Force (including any regional panels of the Task Force) shall promulgate criteria to evaluate the treatment methods described in subparagraph (B) for the purpose of ensuring that the treatment methods pose no significant threat of adverse effect on human health, public safety, or the environment (including air quality and the aquatic environment) that is acute, chronic, cumulative, or collective.</text></subparagraph> 
<subparagraph id="H1AD0F0C0E314457FBA27912C391863D5"><enum>(B)</enum><header>Treatment methods</header><text>The treatment methods referred to in subparagraph (A) are all mechanical, physical, chemical, biological, and other treatment methods used in bodies of water of the United States (regardless of whether the bodies of water are navigable and regardless of the origin of the waters), to prevent, treat, or respond to the introduction of aquatic invasive species.</text></subparagraph> 
<subparagraph id="HF5E858D682524606B0163EB8CEDFE8E1"><enum>(C)</enum><header>Consultation</header><text>In carrying out subparagraph (A), the Administrator shall consult with—</text> 
<clause id="H3618DA7412AA48ED80B5D5533937B3B8"><enum>(i)</enum><text>the Secretary of Transportation;</text></clause> 
<clause id="HFB53A8EE4B6D4AC2A44200BA87874505"><enum>(ii)</enum><text>the Task Force (including the regional panels of the Task Force established under section 1203);</text></clause> 
<clause id="H8BB3E2D5113A4870B6136D6491E797F9"><enum>(iii)</enum><text>the Director;</text></clause> 
<clause id="H755EC6137D7342818F45986C43539549"><enum>(iv)</enum><text>the Assistant Secretary;</text></clause> 
<clause id="HF6AD51737A8044348F351423006D6600"><enum>(v)</enum><text>the Director of the National Marine Fisheries Service; and</text></clause> 
<clause id="H238A85861BB642E1B1F62943D82D2308"><enum>(vi)</enum><text>relevant State agencies.</text></clause></subparagraph></paragraph> 
<paragraph id="H260C70AB7AD149A7BA535FB0E2F29FAC"><enum>(2)</enum><header>Publication of information on environmentally sound treatment methods</header><text>The Administrator, in consultation with the Invasive Species Council, shall publish (not later than 1 year after the date of enactment of the <short-title>National Aquatic Invasive Species Act of 2005</short-title>) and update annually—</text> 
<subparagraph id="HA64EE7D6CBA84D8BA26D9655E1B4ECA7"><enum>(A)</enum><text>a list of environmentally sound treatment methods that may apply to a potential aquatic invasive species response effort;</text></subparagraph> 
<subparagraph id="HF9752907F16A483E8DDDF98C518896B6"><enum>(B)</enum><text>accompanying research that supports the environmental soundness of each approved treatment method; and</text></subparagraph> 
<subparagraph id="H5D9A194C6FBD4479805002E48CBE7ED"><enum>(C)</enum><text>explicit guidelines under which each treatment method can be used in an environmentally sound manner.</text></subparagraph></paragraph> 
<paragraph id="H514408E9BB4E46DDAD6F94002C2DFD72"><enum>(3)</enum><header>Reports</header><text>The Invasive Species Council and Task Force shall include the information described in paragraph (2) in the reports submitted under section 1201(f)(2)(B).</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></section>

<subparagraph id="HD3C480D7B5D540258C37705D9C03A9D7"><enum>(B)</enum><header>Public outreach</header> 
<clause id="H6CCEFAB36DC54634BFB9C958767D663"><enum>(i)</enum><header>Public warnings</header><text>Not later than 180 days after the date of enactment of the <short-title>National Aquatic Invasive Species Act of 2005</short-title>, each Federal officer of an agency that provides Federal funds to States for building or maintaining public access points to United States water bodies shall amend the guidelines of the agency, in consultation with relevant State agencies, to encourage the posting of regionally specific public warnings or other suitable informational and educational materials at the access points regarding—</text> 
<subclause id="HBA93A5F61E3A4CA200BCF6EF0292001B"><enum>(I)</enum><text>the danger of spread of aquatic invasive species through the transport of recreational watercraft; and</text></subclause> 
<subclause id="HB3D793682D5248DDB05101587C3E07FA"><enum>(II)</enum><text>methods for removing organisms prior to transporting a watercraft.</text></subclause></clause> 
<clause id="HD6361A0871A341CDBA00F4CF629745F2"><enum>(ii)</enum><header>Cleaning of watercraft at marinas</header><text>Not later than 1 year after the date of enactment of the <short-title>National Aquatic Invasive Species Act of 2005</short-title>, the Under Secretary and the Director (in cooperation with the Task Force and in consultation with the States, relevant industry groups, and Indian tribes) shall develop an education, outreach, and training program directed toward marinas and marina operators regarding—</text> 
<subclause id="H909864281B5D4B59B0D41300CE9B7FC3"><enum>(I)</enum><text>checking watercraft for live organisms;</text></subclause> 
<subclause id="H138F9E38572040818E24AD7B3B261C31"><enum>(II)</enum><text>removing live organisms from the watercraft before the watercraft are commercially or recreationally trailered;</text></subclause> 
<subclause id="H21A8F9A7FB554AECBECAEB1A38DED13"><enum>(III)</enum><text>encouraging regular hull cleaning and maintenance, avoiding in-water hull cleaning; and</text></subclause> 
<subclause id="HD70F645BEB754D6B89E5EA87F18640FF"><enum>(IV)</enum><text>other activities, as identified by the Secretary.</text></subclause></clause> 
<clause id="H1756A3A8846A4B359E2699BEA7B11939"><enum>(iii)</enum><header>Proper disposal of nonindigenous live aquatic organisms in trade</header><text>The Task Force shall—</text> 
<subclause id="H52C494268DEA4233884F13BACEF05754"><enum>(I)</enum><text>not later than 1 year after the date of enactment of the <short-title>National Aquatic Invasive Species Act of 2005</short-title>, develop (in consultation with industry and other affected parties) issue guidelines for proper disposal of live nonindigenous aquatic organisms in trade; and</text></subclause> 
<subclause id="HFFFBA523091E4259B7E900A8286E57B5"><enum>(II)</enum><text>use the guidelines in appropriate public information and outreach efforts.</text></subclause></clause></subparagraph> 
<subparagraph id="HB09AFB9E03C44F96B42BD3560073C167"><enum>(C)</enum><header>100th meridian program</header> 
<clause id="H2342DA97B4B44FF38501666F65A97B9E"><enum>(i)</enum><header>In general</header><text>Not later than 1 year after the date of enactment of the <short-title>National Aquatic Invasive Species Act of 2005</short-title>, the Task Force shall expand the information and education program directed at recreational boaters in States from which watercraft are transported westward across the 100th meridian.</text></clause> 
<clause id="HF6B1C83635534C15B7A728CE5B68CFA6"><enum>(ii)</enum><header>Activities</header><text>In carrying out the program, the task force shall—</text> 
<subclause id="H790B25DB521B4445815E090146F86164"><enum>(I)</enum><text>survey owners of watercraft transported westward across the 100th meridian to determine the States of origin of most such owners;</text></subclause> 
<subclause id="H54A3F892D47D4A1695330362E90043F"><enum>(II)</enum><text>provide information directly to watercraft owners concerning the importance of cleaning watercraft carrying live organisms before transporting the watercraft; and</text></subclause> 
<subclause id="H9C6A8866E0964CF2843B1649A3208115"><enum>(III)</enum><text>support education and information programs of the States of origin to ensure that the State programs address westward spread.</text></subclause></clause></subparagraph> 
<subparagraph id="H8511E2428369482FB209648009116301"><enum>(D)</enum><header>Information and education program by National Park Service</header><text>The Secretary of the Interior, acting through the Director of the National Park Service, shall develop a program to provide public outreach and other educational activities to prevent the spread of aquatic invasive species by recreational watercraft in parkland or through events sponsored by the National Park Service.</text></subparagraph></paragraph> 
<paragraph id="H8014932811ED456D8E963918E5F3A500"><enum>(3)</enum><header>Outreach to industry</header><text>The Task Force, in conjunction with the Invasive Species Council, shall carry out activities to inform and promote voluntary cooperation and regulatory compliance by members of the national and international maritime, horticultural, aquarium, aquaculture, and pet trade industries with screening, monitoring, and control of the transportation of aquatic invasive species.</text></paragraph> 
<paragraph id="HA0751FCCE31F486600D787461DE2B000"><enum>(4)</enum><header>Public access to monitoring information</header><text>The Task Force, the Invasive Species Council, and other relevant agencies, shall maintain information on the Internet regarding—</text> 
<subparagraph id="H2934BE8967554DD8BBD237BA678C1C2C"><enum>(A)</enum><text>the best approaches for the public and private interests to use in assisting with national early detection and monitoring of aquatic invasive species in waters of the United States;</text></subparagraph> 
<subparagraph id="HB52E2C4BAF18458AAEB2C1C2B4E2F55"><enum>(B)</enum><text>contact locations for joining a national network of monitoring stations;</text></subparagraph> 
<subparagraph id="HE86F110D71474095B9019F31CC9E83AB"><enum>(C)</enum><text>approved State Management Plans under section 1204(a) and Rapid Response Contingency Strategies under sections 1211(a)(2) and 1211(c); and</text></subparagraph> 
<subparagraph id="H9ED147CBED134A358697E08BDC01C812"><enum>(D)</enum><text>the list of potential invaders under section 1201(a)(4).</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section></title>

<subparagraph id="H443643BB6F334A1FB47FD698C3EEF3AA"><enum>(C)</enum><text>establish any regional panels or task forces in coordination with the regional panels of the Task Force convened under section 1203.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection> 
<subsection id="H974EFFF704B5460BB54322C0004400F8"><enum>(c)</enum><header>Coordination with other programs</header><text>Section 1202(c) of the Nonindigenous Aquatic Nuisance Prevention and Control Act of 1990 (<external-xref legal-doc="usc" parsable-cite="usc/16/4722">16 U.S.C. 4722(c)</external-xref>) is amended by adding at the end the following:</text>

<clause id="H9ED9F882269F41F7A4E7E5109B64F538"><enum>(i)</enum><text>any list of species of wildlife under the Lacey Act Amendments of 1981 (<external-xref legal-doc="usc" parsable-cite="usc/16/3371">16 U.S.C. 3371 et seq.</external-xref>) (including regulations under such Act); or</text></clause> 
<clause id="HEFCB3884407B431F8B845BABA54FAFE"><enum>(ii)</enum><text>any list of noxious weeds under the Plant Protection Act (<external-xref legal-doc="usc" parsable-cite="usc/7/7701">7 U.S.C. 7701 et seq.</external-xref>) (including regulations promulgated under that Act contained in part 360 of title 7, Code of Federal Regulations (or any successor regulations)).</text></clause></subparagraph> 
<subparagraph id="H0B5EC02110594C22B724B3D5364C0156"><enum>(B)</enum><header>Process</header><text>The Task Force may use the screening process developed pursuant to section 1105 to identify species pursuant to subparagraph (A).</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection> 
<subsection id="HDA1C33D053554AC0811F1EE5B6CDA598"><enum>(d)</enum><header>Regional coordination</header><text>Section 1203 of the Nonindigenous Aquatic Nuisance Prevention and Control Act of 1990 (<external-xref legal-doc="usc" parsable-cite="usc/16/4723">16 U.S.C. 4723</external-xref>) is amended by adding at the end the following:</text>

<subsection id="HE12C78AD8AA14B0DA115BF4F3502DABE"><enum>(d)</enum><header>Annual interregional meeting</header><text>The Task Force shall annually convene all regional panels established pursuant to this Act for the purpose of information transfer between and among panels, and between the panels and the Task Force, regarding aquatic invasive species management.</text></subsection> 
<subsection id="HA31EF65A062B4DB5B6D5C881A1049BD8"><enum>(e)</enum><header>Organizations</header><text>An interstate organization that has a Federal charter authorized by law, interstate agreement, or Executive order for purposes of fisheries or natural resource management may receive funds under this Act to implement activities authorized under this Act.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection> 
<subsection id="H0D8DCD4F14054ADB98ECF3F77CDDB05C"><enum>(e)</enum><header>State aquatic Invasive Species management plans</header><text>Section 1204(a) of the Nonindigenous Aquatic Nuisance Prevention and Control Act of 1990 (<external-xref legal-doc="usc" parsable-cite="usc/16/4724">16 U.S.C. 4724(a)</external-xref>) is amended—</text> 
<paragraph id="H0AC31CB7B08D4E6487AB65E6B2273867"><enum>(1)</enum><text>in paragraph (2)(A) by inserting before the semicolon at the end the following: <quote>, including, in accordance with guidelines issued by the Task Force under paragraph (5)</quote>—</text>

<subparagraph id="HE365CBB0DAD24639B7046561D171B3F8"><enum>(A)</enum><header>In general</header><text>Not later than 1 year after the date of enactment of the <short-title>National Aquatic Invasive Species Act of 2005</short-title>, the Task Force shall publish in the Federal Register guidelines for the development of plans under this subsection, including guidelines for reporting progress in implementing the plans, to encourage consistency in implementation of and reporting under those plans.</text></subparagraph> 
<subparagraph id="HB095CC52891F447386296500F431EB56"><enum>(B)</enum><header>Guidelines</header><text>The guidelines published under subparagraph (A) shall include, for the purpose of paragraph (2)(A), guidelines concerning—</text> 
<clause id="HDFB2E1F46BDD4DFCB280021F5EDEE3D"><enum>(i)</enum><text>rapid response contingency strategies under section 1211;</text></clause> 
<clause id="H5F313C2203B447EE9612A8517B005B55"><enum>(ii)</enum><text>early detection and monitoring strategies under section 1211(a)(2)(D);</text></clause> 
<clause id="H56E2FCE75C874C26AF8B15B5CFCF8208"><enum>(iii)</enum><text>aquatic plant control programs;</text></clause> 
<clause id="H596A552EC33549C9A926CC51003B6DE1"><enum>(iv)</enum><text>screening of planned introductions pursuant to and consistent with section 1105; and</text></clause> 
<clause id="HB501CDA7E6D144399E38A7A1A9AACB3E"><enum>(v)</enum><text>the review and revision of requirements of this subsection and the reapproval process under this subsection.</text></clause></subparagraph></paragraph> 
<paragraph id="HCE8B4A26EBEE43069F51C1F936345661"><enum>(6)</enum><header>Relationship to other plans</header> 
<subparagraph id="HB66A1B0160FC4A0D83FDC23F476E86BD"><enum>(A)</enum><header>In general</header><text>A plan approved under paragraph (4) shall be deemed to meet any State planning requirement of the program established under section 104 of the River and Harbor Act of 1958 (<external-xref legal-doc="usc" parsable-cite="usc/33/610">33 U.S.C. 610</external-xref>) for a plan to control noxious aquatic plant growths.</text></subparagraph> 
<subparagraph id="H51EAAC070C034A0BAFEBBD93F10E4A4"><enum>(B)</enum><header>Enforcement</header><text>Funds provided to States for implementation of plans pursuant to section 1204 may be used by States to enforce requirements relating to aquatic invasive species under the Plant Protection Act (<external-xref legal-doc="usc" parsable-cite="usc/7/7701">7 U.S.C. 7701 et seq.</external-xref>) (including regulations promulgated under that Act contained in part 360 of title 7, Code of Federal Regulations (or any successor regulations)).</text></subparagraph></paragraph> 
<paragraph id="H977468BDC2D34885B28361294C6F15A9"><enum>(7)</enum><header>Review and revision</header> 
<subparagraph id="H1E9FE2065F0446C7B352ADE83E79D079"><enum>(A)</enum><header>In general</header><text>Each State shall periodically review and, as necessary and subject to subparagraph (B), revise the management plan of the State in accordance with guidelines of the Task Force under paragraph (5).</text></subparagraph> 
<subparagraph id="H8B513290E83C4A88A06C5FA9C018F372"><enum>(B)</enum><header>Update of existing plans</header><text>A State plan approved under the section before the date of the enactment of the National Aquatic Species Act of 2005 shall be revised by the State under guidelines issued by the Director to conform to the guidelines published under paragraph (5), but shall be treated as a plan approved under this subsection for purposes of grants under this section.</text></subparagraph></paragraph> 
<paragraph id="HB6069082C3ED4F170093248198097301"><enum>(8)</enum><header>Other State Management Plans</header><text>In addition to the management plans required under this subsection, the Director shall encourage each State to develop and implement new, and expand existing, State management plans to improve State actions to prevent and control aquatic invasive species.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection> 
<subsection id="H8C37026E8F9E4A67A7C7FAB6A9E51FE1" display-inline="no-display-inline"><enum>(f)</enum><header>Grant program</header><text>Section 1204(b)(1) of the Nonindigenous Aquatic Nuisance Prevention and Control Act of 1990 (<external-xref legal-doc="usc" parsable-cite="usc/16/4724">16 U.S.C. 4724(b)(1)</external-xref>) is amended by striking <quote>subsection (a) for the implementation of those plans.</quote> and inserting the following:</text> 
<quoted-block style="OLC" id="HF0F0D5AC7AE64BDE84F79532EB3F4BDC" display-inline="yes-display-inline"><text display-inline="yes-display-inline">subsection (a)—</text> 
<subparagraph id="H7D4B9DD9CD7A4DB5B8F5BBCCA771C132" indent="up1"><enum>(A)</enum><text>to develop those plans with a total amount that does not exceed 10 percent of the amounts made available for grants under this section for each fiscal year; and</text></subparagraph> 
<subparagraph id="H8CC8358201CD4F2ABCC34E026F1F6D6F" indent="up1"><enum>(B)</enum><text>to implement those plans.</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection></section> 
<section id="HFF8F1CACF0424415B7C5FC32CA022FF5"><enum>402.</enum><header>International coordination</header><text display-inline="no-display-inline">Subtitle E of the Nonindigenous Aquatic Nuisance Prevention and Control Act of 1990 (<external-xref legal-doc="usc" parsable-cite="usc/16/4751">16 U.S.C. 4751 et seq.</external-xref>) is amended—</text>

<subsection id="H99EC1CB2A2AD42BCAAF100C554269867"><enum>(a)</enum><header>In general</header><text>The Task Force, the Invasive Species Council, and the Secretary of State shall, to the maximum extent practicable, coordinate activities to ensure that international efforts to prevent and manage aquatic invasive species (including through the International Maritime Organization, the International Convention on the Exploration of the Sea, the Global Invasive Species Program, and other appropriate programs) are coordinated with policies of the United States established by this Act.</text></subsection> 
<subsection id="HA36573ED666841C4ADDD717FAC4C5E90"><enum>(b)</enum><header>Coordination with neighboring countries</header> 
<paragraph id="H078D53744D9E42D183AFD306409F5C66"><enum>(1)</enum><header>In general</header><text>The Task Force, in consultation with the Secretary of State, shall include in the report required by section 1202(m) a description of the means by which international agreements and regulations with countries that share a border with the United States will be implemented and enforced by Federal agencies (including a clarification of the roles and responsibilities of those agencies).</text></paragraph> 
<paragraph id="HFD42EB082D0B47B4AB92143848005698"><enum>(2)</enum><header>Negotiations</header><text>As soon as practicable after the date of enactment of the <short-title>National Aquatic Invasive Species Act of 2005</short-title>, the Secretary of State may enter into negotiations with—</text> 
<subparagraph id="HCFC181E7C43F46F2B7146C27FA7DDD58"><enum>(A)</enum><text>Canada to issue a request that the International Joint Commission, by not later than 18 months after the date of enactment of that Act, review, research, conduct hearings on, and submit to the parties represented on the International Joint Commission a report that describes the success of current policies of governments in the United States and Canada having jurisdiction over the Great Lakes in anticipating and preventing biological invasions of the aquatic ecosystem in the Great Lakes, including—</text> 
<clause id="H9487392614B143C400F27B7CF6D33E81"><enum>(i)</enum><text>an analysis of current Federal, State or Provincial, local, and international laws, enforcement practices, and agreements;</text></clause> 
<clause id="H2252672D0A21416C9100263E3DB7E600"><enum>(ii)</enum><text>an analysis of prevention efforts related to all likely pathways for biological invasions of the aquatic ecosystem in the Great Lakes; and</text></clause> 
<clause id="HA6AD5BE39B5847F19BC1B0FBEAE4D6A"><enum>(iii)</enum><text>recommendations of the International Joint Commission for means by which to improve and harmonize the policies and enforcement practices referred to in clause (i); and</text></clause></subparagraph> 
<subparagraph id="H402F55D32AC1464FAD792B5F5BF6D832"><enum>(B)</enum><text>Mexico, to ensure coordination of efforts of the United States with efforts of Mexico to manage invasive species established in the United States-Mexico border region.</text></subparagraph></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section></title>

<section id="HB24E9A9FD59448DFA2A4DC99745C0373"><enum>501.</enum><header>Authorization of appropriations</header><text display-inline="no-display-inline">Section 1301 of the Nonindigenous Aquatic Nuisance Prevention and Control Act of 1990 (<external-xref legal-doc="usc" parsable-cite="usc/16/4741">16 U.S.C. 4741</external-xref>) is amended to read as follows:</text>

<subsection id="HBBCFA496289C46C29736BE16A036007C"><enum>(a)</enum><header>In general</header><text>Except as otherwise provided in this section, there are authorized to be appropriated such sums as are necessary to carry out this Act for each of fiscal years 2006 through 2010.</text></subsection> 
<subsection id="HDCAF2A3D106244479F33C065DB3BEDE"><enum>(b)</enum><header>Task Force and aquatic Nuisance Species program</header><text>There are authorized to be appropriated for each of fiscal years 2006 through 2010—</text> 
<paragraph id="HD702529A8AAD4499AADD5CA300F254ED"><enum>(1)</enum><text>$8,000,000, to carry out activities of the Task Force under section 1202, of which—</text> 
<subparagraph id="HF7600C47AE3942E6B2BEBDAD1E0849D6"><enum>(A)</enum><text>$4,000,000 shall be used by the Director;</text></subparagraph> 
<subparagraph id="HACE6A634845E4094866CC812AB4CB54D"><enum>(B)</enum><text>$3,000,000 shall be used by the National Oceanic and Atmospheric Administration; and</text></subparagraph> 
<subparagraph id="H03510FDB3D13470296F6B1ED662627BB"><enum>(C)</enum><text>$1,000,000 shall be used by the Invasive Species Council;</text></subparagraph></paragraph> 
<paragraph id="H3E54D373E79D47F5A3A8F7AAE481D5F7"><enum>(2)</enum><text>$30,000,000, to provide grants under section 1204(b);</text></paragraph> 
<paragraph id="H6E76F4C04C554649BA8EE2B121F054F4"><enum>(3)</enum><text>$3,000,000, to provide assistance to the regional panels of the Task Force; and</text></paragraph>

<subsection id="H77FC742A5BA34CBF8EEB95C156C11734"><enum>(c)</enum><header>International coordination</header><text>There is authorized to be appropriated to the Department of State to carry out section 1403 $1,000,000 for each of fiscal years 2006 through 2010.</text></subsection> 
<subsection id="HCFB3D7BD53994F9EAF86EAD0DB85031"><enum>(d)</enum><header>Prevention of introduction by vessels of aquatic Invasive Species into waters of the United States</header><text>There are authorized to be appropriated for each of fiscal years 2006 through 2010—</text> 
<paragraph id="HA36F39561E774D1CA893F95C238FF0BB"><enum>(1)</enum><text>$6,000,000, to be used by the Secretary to carry out section 1101;</text></paragraph> 
<paragraph id="H3A4157528B884317B2090059A1813DA2"><enum>(2)</enum><text>$2,500,000, to be used by the Administrator to carry out section 1101; and</text></paragraph> 
<paragraph id="H38649CD0378C4B08879DCD4900D4431F"><enum>(3)</enum><text>$2,750,000, to be used by the Task Force to carry out section 1101, of which—</text> 
<subparagraph id="H815996033527462291E6696ABCDE9E"><enum>(A)</enum><text>$1,500,000 shall be used by the Director; and</text></subparagraph> 
<subparagraph id="H4D8E86EA63154DEDAD8639D1F78900DD"><enum>(B)</enum><text>$1,250,000 shall be used by the National Oceanic and Atmospheric Administration.</text></subparagraph></paragraph></subsection> 
<subsection id="H38F80C44149B487F00D1BBF4E2DEB756"><enum>(e)</enum><header>Prevention of the introduction by nonvessel pathways of aquatic Invasive Species into waters of the United States</header><text>There are authorized to be appropriated for each of fiscal years 2006 through 2010—</text> 
<paragraph id="HFBD12EC2629F430EAFE70000E77D983D"><enum>(1)</enum><text>$5,000,000, to carry out the priority pathway management program under section 1210, of which—</text> 
<subparagraph id="HCD0281E856F049368C5B68A3FEC723D3"><enum>(A)</enum><text>$2,000,000 shall be used by the National Oceanic and Atmospheric Administration; and</text></subparagraph> 
<subparagraph id="H7E73FC3BA3A04B1281A054DFEF6224C"><enum>(B)</enum><text>$3,000,000 shall be used by the Director;</text></subparagraph></paragraph> 
<paragraph id="H1CC2BEFB2A924136AAAFD232FF431272"><enum>(2)</enum><text>$1,000,000, to be used by the Invasive Species Council to establish screening guidelines under section 1105(b); and</text></paragraph> 
<paragraph id="HCD01C44BB43F48C0BEE14BADE49089D"><enum>(3)</enum><text>$3,500,000, to be used by the Director to promulgate and implement screening requirements under section 1105(g).</text></paragraph></subsection> 
<subsection id="H59FBFFD2BF1343F59C6D2BA27BF6A9A9"><enum>(f)</enum><header>Early detection and monitoring</header><text>There is authorized to be appropriated, to carry out early detection, monitoring, and survey planning and implementation under section 1106, $2,000,000 for each of fiscal years 2006 and 2007 and $10,000,000 for each of fiscal years 2008 through 2010, of which—</text> 
<paragraph id="H70C6C3B09425435DA555F177DF792F7B"><enum>(1)</enum><text>for each of fiscal years 2006 and 2007—</text> 
<subparagraph id="HC9C41C11D0D2472A8CBC21B1171B932"><enum>(A)</enum><text>$1,000,000 shall be used by the National Oceanic and Atmospheric Administration; and</text></subparagraph> 
<subparagraph id="H885C5E1B75C0461B977015B7DCE08F02"><enum>(B)</enum><text>$1,000,000 shall be used by the Director; and</text></subparagraph></paragraph> 
<paragraph id="H43FDBF656E744FEFBB723FADE5236EF0"><enum>(2)</enum><text>for each of fiscal years 2008 through 2010—</text>

<paragraph id="H68A7890CEBAD4D26B37ECEF100326250"><enum>(1)</enum><header>Dispersal barriers</header><text>There are authorized to be appropriated for each of fiscal years 2006 through 2010—</text> 
<subparagraph id="H1416D5BFE7744174BC6F363BD9C113D0"><enum>(A)</enum><text>$300,000, to be used by the Assistant Secretary in carrying out operation and maintenance of the Chicago River Canal Dispersal Barrier under section 1202(j)(1);</text></subparagraph> 
<subparagraph id="HBF77C3F977D34FAF9D80B9DCDBD572F5"><enum>(B)</enum><text>$1,800,000, to be used by the Assistant Secretary in carrying out the complete construction of the Chicago River Canal Dispersal Barrier;</text></subparagraph> 
<subparagraph id="H6E51E08BB8894ED5B5CBCF45F907F0DE"><enum>(C)</enum><text>$8,000,000, to be used by the Assistant Secretary for the construction of a second long-service life barrier for the Chicago River Canal;</text></subparagraph> 
<subparagraph id="H8020F2A1773D466687AF6EE582877802"><enum>(D)</enum><text>$500,000, to be used by the Assistant Secretary to carry out a feasibility study for the construction described in subparagraph (C); and</text></subparagraph>

<subparagraph id="H2288876435834A6C949CFEA7C7E89C1F"><enum>(A)</enum><text>$25,000,000, to the rapid response fund of the Secretary of the Interior established under section 1211;</text></subparagraph> 
<subparagraph id="HD2E206A201AD4360AEE57695F5007C2D"><enum>(B)</enum><text>$1,000,000, to be used by the Invasive Species Council in developing the State and regional rapid response contingency strategy under section 1211; and</text></subparagraph> 
<subparagraph id="H820CC354B32E4158AAD3C3A3B1E0024"><enum>(C)</enum><text>$1,500,000, to be used for Federal rapid response teams under section 1211(e), of which—</text> 
<clause id="H7FF5F689281F4E0B9BF7A4488DD2F02"><enum>(i)</enum><text>$500,000 shall be used by the National Oceanic and Atmospheric Administration; and</text></clause> 
<clause id="HFEEB0CA411C14442AF54B500FFF1AD51"><enum>(ii)</enum><text>$1,000,000 shall be used by the Director.</text></clause></subparagraph></paragraph> 
<paragraph id="H9870A5DA8F6D40CD8C3B9E7E43A0B8F5"><enum>(3)</enum><header>Environmental soundness</header><text>There is authorized to be appropriated for establishment under section 1202(k) of criteria for the improvement of treatment methods for aquatic invasive species $600,000 for each of fiscal years 2006 through 2009.</text></paragraph> </subsection> 
<subsection id="HDD4D0A87222F4E69A855DC40A01FEAD8"><enum>(h)</enum><header>Information, education, and outreach</header><text>There are authorized to be appropriated for each of fiscal years 2006 through 2010—</text> 
<paragraph id="H438CB5CFA3A6447791EA9EF388A9372D"><enum>(1)</enum><text>$500,000, to be used by the Secretary of the Interior to carry out the information and education program under section 1202(h)(2)(D);</text></paragraph> 
<paragraph id="H9D7B41A7CA7445A1B6AEC261424D552C"><enum>(2)</enum><text>$750,000, to be used by the Director in carrying out the 100th meridian program under section 1202(h)(2)(C);</text></paragraph>
