<section id="HE1A075DD9225416CBFA8E8B944879D09" section-type="section-one"><enum>1.</enum><header>Matching willing United States workers with employers</header> 
<subsection id="HC44FC1DC513144BC99ED904315E37547"><enum>(a)</enum><header>In general</header><text>Section 212 of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1182">8 U.S.C. 1182</external-xref>) is amended—</text> 
<paragraph id="HB50A2F9B8A03419DA32679D2FC10A641"><enum>(1)</enum><text>by redesignating the subsection (t) added by section 1(b)(2) of <external-xref legal-doc="public-law" parsable-cite="pl/108/449">Public Law 108–449</external-xref> (118 Stat. 3470) as subsection (u); and</text></paragraph> 
<paragraph id="H7417612E1E7542A0AE61D75ED21387A"><enum>(2)</enum><text>by adding at the end the following:</text> 
<quoted-block id="H778E903EC07B4ED0BAE76C4434AA400" style="OLC"> 
<subsection id="H08EDB2CCBA9C4FBC9F2413C2B687ECFC"><enum>(v)</enum> 
<paragraph id="H0FF519EDEA2E43749F0091A763002C00" display-inline="yes-display-inline"><enum>(1)</enum><text>No alien may be admitted or provided status as a nonimmigrant under section 101(a)(15)(H)(ii)(b) unless the employer, in addition to meeting all other requirements specified in this Act, has filed with the Secretary of Homeland Security and the Secretary of Labor the following:</text> 
<subparagraph id="H30595DF714A64A8EB2168C62C21E4F7F" indent="up1"><enum>(A)</enum><text>A signed attestation stating that the employer, prior to filing the attestation, advertised each position for which the employer seeks such a nonimmigrant on the Internet-based job database provided jointly by the Department of Labor and State employment security agencies and known as <quote>America’s Job Bank</quote> for at least 14 consecutive days.</text></subparagraph> 
<subparagraph id="H436BFA66951B43118F509E4D4FF2B100" display-inline="no-display-inline" indent="up1"><enum>(B)</enum><text>Documentation from the employer’s account on such database showing the number of jobs posted by the employer and the number of resumes the employer received in response to each job posting.</text></subparagraph></paragraph> 
<paragraph id="H177CDA148C3148EE989CAC92C01426C" indent="up1"><enum>(2)</enum> 
<subparagraph id="HBF1A3BD6D5F44B43987CE902C13EA8F2" display-inline="yes-display-inline"><enum>(A)</enum><text>The Secretary of Labor, in consultation with the Secretary of Homeland Security, shall establish procedures to verify the accuracy and veracity of the documentation required under paragraph (1)(B).</text></subparagraph> 
<subparagraph id="H6B2C19BB17224620BD24B81EAAF012A9" indent="up1"><enum>(B)</enum><text display-inline="yes-display-inline">An employer found to have submitted false or inaccurate documentation shall be ineligible to file a petition under section 214(c)(1) with respect to any nonimmigrant under section 101(a)(15)(H)(ii)(b)—</text> 
<clause id="H33B7F6226E334243815F6575F36200EE"><enum>(i)</enum><text>for a period of 3 years in the case of a first violation; and</text></clause> 
<clause id="H440CA28911A145A4005FDD828FAD4181"><enum>(ii)</enum><text>for a period of 10 years in the case of a second or subsequent violation.</text></clause></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection> 
<subsection id="H51EFD5E417FB47D1BF21B07873E9AD67"><enum>(b)</enum><header>Effective date</header><text>The amendment made by subsection (a) shall take effect 180 days after the date of the enactment of this Act.</text></subsection></section> 
<section id="HE722268A10ED465D82BDBDEAABBF08AB"><enum>2.</enum><header>Matching nonimmigrant workers with employers</header> 
<subsection id="HA70F90182FDC4373BDAD74A53D516EC6"><enum>(a)</enum><header>In general</header><text>Section 214(g)(1) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1184">8 U.S.C. 1184(g)(1)(B)</external-xref>) is amended to read as follows:</text> 
<quoted-block id="H30043D78345B4213B0AB8D1C50D97DB2" style="OLC"> 
<subparagraph id="H7E628AF6DC40492DACD1344F6DCCEF01" indent="up1"><enum>(B)</enum><text>under section 101(a)(15)(H)(ii)(b) may not exceed 131,000, of which not more than 65,500 aliens shall be issued visas or otherwise provided nonimmigrant status during the first 6 months of such fiscal year.</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection> 
<subsection id="H036A68BED6C2412CB6C75C46B20017F3"><enum>(b)</enum><header>Effective date</header><text>The amendment made by subsection (a) shall take effect on the first day of the first fiscal year beginning after the date of the enactment of this Act.</text></subsection></section> 
<section id="H7B1092D1326F4A10A324CF10F731AD3E"><enum>3.</enum><header>Ensuring that H–2b workers return home</header> 
<subsection id="H1C68449F68294EAAA3B2ED54C05ADF"><enum>(a)</enum><header>Discouraging community ties</header><text>Section 101(a)(15)(H) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1101">8 U.S.C. 1101(a)(15)(H)</external-xref>) is amended, in the matter following clause (iii), by striking <quote>this paragraph if accompanying</quote> and inserting <quote>this subparagraph, except any alien described in section 101(a)(15)(H)(ii)(b), if accompanying</quote>.</text> </subsection> 
<subsection id="H2D86BFC96582496AB24DDA8200886805"><enum>(b)</enum><header>Establishing realistic expectations</header><text>Section 214(b) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1184">8 U.S.C. 1184(b)</external-xref>) is amended—</text> 
<paragraph id="H95D63C1CD982482D97D3F5115402796D"><enum>(1)</enum><text>by striking <quote>(b)</quote> and inserting <quote>(b)(1)</quote>; and</text></paragraph> 
<paragraph id="HA5F3942780424856A569AEB1E85427B"><enum>(2)</enum><text>by adding at the end the following:</text> 
<quoted-block id="H203E6F393CD3491100A3B964C8B67329" style="OLC"> 
<paragraph id="HE5BED32951EF434783F5815CC4A66BB6" indent="up1"><enum>(2)</enum><text>In order to overcome the presumption described in paragraph (1), an alien seeking the nonimmigrant status described in section 101(a)(15)(H)(ii)(b), at the time of application for a nonimmigrant visa, shall be required to execute as a contract an affidavit—</text> 
<subparagraph id="HD1FB0B8BCE43466C99F8423708730368"><enum>(A)</enum><text>stating that the alien understands the terms of such nonimmigrant status, including the prohibition on accompanying family members and the requirement that the alien depart the United States before the alien’s period of authorized stay expires;</text></subparagraph> 
<subparagraph id="HE0D49C2A15174A489FBB889483108B16"><enum>(B)</enum><text>stating that the alien agrees—</text> 
<clause id="HE5F084F9B49E4D3A00CCCFB0D92E5B7E"><enum>(i)</enum><text>to depart the United States in full compliance with the requirements of the entry and exit data system (as defined in section 7208(b) of the Intelligence Reform and Terrorism Prevention Act of 2004 (<external-xref legal-doc="usc" parsable-cite="usc/8/1365b">8 U.S.C. 1365b(b)</external-xref>)), once such requirements are implemented at the port of departure from which the alien intends to departs; and</text></clause> 
<clause id="H8EFBC3C523194FEF9EE709259DEBB4B0"><enum>(ii)</enum><text>to appear in person before an immigration inspector immediately prior to departure from the United States so that the inspector can record the alien’s departure until such time as such requirements are implemented; and</text></clause></subparagraph> 
<subparagraph id="HBD3E379AB0E24660BD61CBBBBEA26CE5"><enum>(C)</enum><text>affirming that the alien understands that the alien will be permanently ineligible for any immigrant or nonimmigrant visa should the alien fail to depart the United States in the manner described in subparagraph (B).</text></subparagraph></paragraph> 
<paragraph id="H3E4A301F1DE14B14A5A8627B44262E58" indent="up1"><enum>(3)</enum><text>At each port of departure where the exit procedures of the system referred to in paragraph (2)(B)(i) have not been implemented or are not functional at all times the port is open, the Secretary of Homeland Security shall designate at least one inspector during each shift to record the departure of nonimmigrants described in section 101(a)(15)(H)(ii)(b).</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection></section> 
<section id="H541FA51106C84070A93FB56F67E6494C"><enum>4.</enum><header>Mandatory participation in basic pilot program</header><text display-inline="no-display-inline">Section 402(e) of the Illegal Immigration Reform and Immigrant Responsibility Act of 1996 (<external-xref legal-doc="usc" parsable-cite="usc/8/1324a">8 U.S.C. 1324a</external-xref> note) is amended—</text> 
<paragraph id="H095AF395AAEE4BE7B66D00A097DCBA8"><enum>(1)</enum><text>by redesignating paragraph (3) as paragraph (4); and</text></paragraph> 
<paragraph id="HDEB85B24D4734A59844347656134CBF8"><enum>(2)</enum><text>by inserting after paragraph (2) the following:</text> 
<quoted-block style="OLC" id="H12895296EBC5483AB8B0046EF79297CA" display-inline="no-display-inline"> 
<paragraph id="HFEDC3E32BA704F20801C7F86182DC511"><enum>(3)</enum><header>Employers of H-2b nonimmigrants</header><text display-inline="yes-display-inline">Beginning January 1, 2006, any employer who employs one or more aliens described in section 101(a)(15)(H)(ii)(b) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1101">8 U.S.C. 1101(a)(15)(H)(ii)(b)</external-xref>) shall participate in, and comply with the terms of, the basic pilot program described in section 403(a) with respect to all hiring, recruitment, or referral conducted by the employer. In addition to the consequences described in paragraph (4), failure to comply with the preceding sentence shall result in permanent revocation by the Secretary of Homeland Security of the authority of the employer to employ aliens described in such section 101(a)(15)(H)(ii)(b).</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section> 
<section id="H3E5B1CB39F1047E081D323C200FCCB21"><enum>5.</enum><header>Offsets for the increase in H–2b cap</header> 
<subsection id="HB6851D83660341AEAFD0006395F90014"><enum>(a)</enum><header>Elimination of diversity immigrant program</header> 
<paragraph id="HE4D97BF524FB4A5D8FAADB4C553CFE2D"><enum>(1)</enum><header>Worldwide level of diversity immigrants</header><text>Section 201 of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1151">8 U.S.C. 1151</external-xref>) is amended—</text> 
<subparagraph id="H4F1EE5A13158489C89F6BA39C1EC3B03"><enum>(A)</enum><text>in subsection (a)—</text> 
<clause id="H7E40AEC1F66E48EAB6917F2F63F7BB98"><enum>(i)</enum><text>by inserting <quote>and</quote> at the end of paragraph (1);</text></clause> 
<clause id="H799D709A21054FC300A07BEFC63EAA66"><enum>(ii)</enum><text>by striking <quote>; and</quote> at the end of paragraph (2) and inserting a period; and</text></clause> 
<clause id="HC270A721379A4EEDAA932C0087D8981E"><enum>(iii)</enum><text>by striking paragraph (3); and</text></clause></subparagraph> 
<subparagraph id="HF27CED4B909745B4A572F87001D2842"><enum>(B)</enum><text>by striking subsection (e).</text></subparagraph></paragraph> 
<paragraph id="H65ECE2BFA7EC41AB90133C21F823A580"><enum>(2)</enum><header>Allocation of diversity immigrant visas</header><text>Section 203 of such Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1153">8 U.S.C. 1153</external-xref>) is amended—</text> 
<subparagraph id="HD9F77AE60DBA4931AA7581F52CF4DAB4"><enum>(A)</enum><text>by striking subsection (c);</text></subparagraph> 
<subparagraph id="H3D6A0C288A6B4BAB99CF65A0F1FB3942"><enum>(B)</enum><text>in subsection (d), by striking <quote>(a), (b), or (c),</quote> and inserting <quote>(a) or (b),</quote>;</text></subparagraph> 
<subparagraph id="H84D602D52FBB4E2FB8D7E56F93008DB1"><enum>(C)</enum><text>in subsection (e), by striking paragraph (2) and redesignating paragraph (3) as paragraph (2);</text></subparagraph> 
<subparagraph id="HF21599D5B1EF4F91B2002EA4BC557090"><enum>(D)</enum><text>in subsection (f), by striking <quote>(a), (b), or (c)</quote> and inserting <quote>(a) or (b)</quote>; and</text></subparagraph> 
<subparagraph id="H8325554B9E964A008F8EEBD6BCE61EA4"><enum>(E)</enum><text>in subsection (g), by striking <quote>(a), (b), and (c)</quote> and inserting <quote>(a) and (b)</quote>.</text></subparagraph></paragraph> 
<paragraph id="H110DDDCF3972461495A120091C107FA"><enum>(3)</enum><header>Procedure for granting immigrant status</header><text>Section 204 of such Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1154">8 U.S.C. 1154</external-xref>) is amended—</text> 
<subparagraph id="HE52917289979454A83AE007FD6E52427"><enum>(A)</enum><text>by striking subsection (a)(1)(I); and</text></subparagraph> 
<subparagraph id="HE807F0AA2E2847888003C61BA3FFED60"><enum>(B)</enum><text>in subsection (e), by striking <quote>(a), (b), or (c)</quote> and inserting <quote>(a) or (b)</quote>.</text></subparagraph></paragraph></subsection> 
<subsection id="H9811DE697E504ADD99798332B8C0BE03"><enum>(b)</enum><header>Elimination of <quote>other workers</quote> classification</header> 
<paragraph id="HE4F30B7FE9F2445B80BA4473ABDFA3CF"><enum>(1)</enum><header>Worldwide level of employment-based immigrants</header><text>Section 201(d)(1)(A) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1151">8 U.S.C. 1151(d)(1)</external-xref> (A)) is amended by striking <quote>140,000,</quote> and inserting <quote>130,000,</quote>.</text></paragraph> 
<paragraph id="HC0F44C5303AF43898CF886615C385BFF"><enum>(2)</enum><header>Preference allocation for employment-based immigrants</header><text>Section 203(b) of the Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1153">8 U.S.C. 1153(b)</external-xref>) is amended—</text> 
<subparagraph id="H5D72C78B497F4734A5E0D94DF9C992EA"><enum>(A)</enum><text>in paragraph (1), by striking <quote>28.6</quote> and inserting <quote>30.8</quote>;</text></subparagraph>

<subsection id="HB887DDACE0C543F4A174F4F762BCAFA5"><enum>(c)</enum><header>Modifications to <quote>NACARA</quote> temporary reductions</header><text>Section 203 of the Nicaraguan Adjustment and Central American Relief Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1101">8 U.S.C. 1101</external-xref> note) is amended—</text> 
<paragraph id="HC5CA02262EEC499ABAC869C4079C81C7"><enum>(1)</enum><text>by amending the subsection heading of subsection (d) to read as follows: <header-in-text level="subsection" style="OLC"><quote>Temporary reduction in visas for brothers and sisters of citizens.—</quote></header-in-text>;</text></paragraph> 
<paragraph id="H0E28D47E92B24E0000AC9822F1AC9F8F"><enum>(2)</enum><text>in paragraph (1) of subsection (d), by striking <quote>section 201(e)</quote> and all that follows through the period and inserting <quote>section 203(a)(4) of the Immigration and Nationality Act shall be reduced by 10,000 from the number of visas otherwise available under such section for such fiscal year.</quote>;</text></paragraph> 
<paragraph id="H1D885CB62C354C83AD28C6112CD877AA"><enum>(3)</enum><text>by striking subsection (e); and</text></paragraph>

<subsection id="HC13DEB3BC22F4E8293A34DC8752C8FAF"><enum>(d)</enum><header>Effective date</header><text>The amendments made by this section shall take effect on the first day of the first fiscal year that begins after the date of the enactment of this Act.</text></subsection> </section>
