<official-title>To amend title XVIII of the Social Security Act to authorize expansion of Medicare coverage of medical nutrition therapy services.</official-title>

<section section-type="section-one" id="HF4925E9A6DDD4FC5AAB24341C180AE3E" display-inline="no-display-inline"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Medicare Medical Nutrition Therapy Act of 2005</short-title></quote>.</text></section> 
<section id="H967007BD0E6D44288906CBCC031866F8"><enum>2.</enum><header>Authorizing expansion of medicare coverage of medical nutrition therapy services</header> 
<subsection id="HA9309FBAC5CC44A8A788D796EB1BA42"><enum>(a)</enum><header>Authorizing expanded eligible population</header><text>Section 1861(s)(2)(V) of the <act-name parsable-cite="SSA">Social Security Act</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/42/1395x">42 U.S.C. 1395x(s)(2)(V)</external-xref>) is amended—</text> 
<paragraph id="H3924906659014B58A79D2E1EF3906451"><enum>(1)</enum><text>by redesignating clauses (i) through (iii) as subclauses (I) through (III), respectively, and indenting each such clause an additional 2 ems;</text></paragraph> 
<paragraph id="HF7923C8F2C4941CB89B8D6A3D25CDC33"><enum>(2)</enum><text>by striking <quote>in the case of a beneficiary with diabetes or a renal disease who—</quote> and inserting the following: </text> 
<quoted-block style="OLC" id="HADE964570E414FB299C01A3D4FD9EF0" display-inline="no-display-inline"><quoted-block-continuation-text quoted-block-continuation-text-level="subparagraph">in the case of a beneficiary—</quoted-block-continuation-text> 
<clause id="H35AFC86C914E495397326D00C1B9F34D"><enum>(i)</enum><text>with diabetes or a renal disease who—</text></clause><after-quoted-block>;</after-quoted-block></quoted-block></paragraph> 
<paragraph id="HE4E11F74640042F2974287806CD1F707"><enum>(3)</enum><text>by adding <quote>or</quote> at the end of subclause (III) of clause (i), as so designated; and</text></paragraph> 
<paragraph id="H0378DD9F78604C3BB6329351CA9BE81F"><enum>(4)</enum><text>by adding at the end the following new clause:</text> 
<quoted-block style="OLC" id="H6C37F84C7AB0479BADEB35E25F90B9F7" display-inline="no-display-inline"> 
<clause id="H5DBDE83DC18848BBA52CC1296C9776D9"><enum>(ii)</enum><text>who is not described in clause (i) but who has another disease, condition, or disorder for which the Secretary has made a national coverage determination (under section 1869(f)(1)(B)) for the coverage of such services;</text></clause><after-quoted-block>.</after-quoted-block></quoted-block></paragraph> </subsection> 
<subsection id="H3FCF96D972444416B7AE501EAF9E85B3"><enum>(b)</enum><header>Coverage of services furnished by physicians</header><text>Section 1861(vv)(1) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395x">42 U.S.C. 1395x(vv)(1)</external-xref>) is amended by inserting <quote>, physician,</quote> after <quote>a registered dietician </quote>. </text></subsection> 
<subsection id="H2A4B9DE0BB83497791B25EBDBF6EAAE6"><enum>(c)</enum><header>National coverage determination process</header><text>In making a national coverage determination described in section 1861(s)(2)(V)(ii) of the Social Security Act, as added by subsection (a)(4), the Secretary of Health and Human Services, through the Director of the Centers for Medicare and Medicaid Services, shall—</text> 
<paragraph id="HB703FBD57FD24126B27352A0AF86AB"><enum>(1)</enum><text>consult with dietetic and nutrition professional organizations in determining appropriate protocols for coverage of medical nutrition therapy services for individuals with different diseases, conditions, and disorders; and</text></paragraph> 
<paragraph id="H07A765EEAC7D4825B3B9E4CC82E008F"><enum>(2)</enum><text>consider the degree to which medical nutrition therapy interventions prevent or help prevent the onset or progression of more serious diseases, conditions, or disorders.</text></paragraph></subsection> 
<subsection id="H071A8D1E821A4C119C8529225C830680"><enum>(d)</enum><header>Effective date</header><text>The amendments made by this section shall apply to services furnished on or after January 1, 2006.</text></subsection></section>
