<official-title>To amend the Federal Election Campaign Act of 1971 to clarify the requirements for the disclosure of identifying information within authorized campaign communications which are printed, to apply certain requirements regarding the disclosure of identifying information within communications made through the Internet, to apply certain disclosure requirements to prerecorded telephone calls, and for other purposes.</official-title>

<section section-type="section-one" id="HFB4BD63A1641494B93977CD3E5B1BA" display-inline="no-display-inline"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Stand By Your Internet Ad Act of 2005</short-title></quote>.</text></section>
<section id="H6882B5E9F46B492E8861120082B92498"><enum>2.</enum><header>Clarification of presentation of identifying information within authorized printed campaign communications</header>
<subsection id="H30F093DCB4854BC2009F121DA8888903"><enum>(a)</enum><header>Application to communications transmitted through the Internet</header><text>Section 318(c) of the <act-name parsable-cite="FECA">Federal Election Campaign Act of 1971</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/2/441d">2 U.S.C. 441d(c)</external-xref>) is amended in the matter preceding paragraph (1) by striking <quote>subsection (a)</quote> and inserting the following: <quote>subsection (a), including the text of any communication described in such subsection which is transmitted through the Internet,</quote>.</text></subsection>
<subsection id="H90F3133229A94AB1854640EAC3AEF3E"><enum>(b)</enum><header>Inclusion of clearly readable identifying statement</header><text>Section 318(c) of the <act-name parsable-cite="FECA">Federal Election Campaign Act of 1971</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/2/441d">2 U.S.C. 441d(c)</external-xref>) is amended—</text>
<paragraph id="H38098B7D4A6B4878000016C3FBF74264"><enum>(1)</enum><text>by striking <quote>and</quote> at the end of paragraph (2);</text></paragraph>
<paragraph id="H9554FAB8C2124605B261E9FA83D536F5"><enum>(2)</enum><text>by striking the period at the end of paragraph (3) and inserting <quote>; and</quote>; and</text></paragraph>
<paragraph id="HCC1D13AD0CD64B6E9B34A0ADCF976D00"><enum>(3)</enum><text>by adding at the end the following new paragraph:</text>

<paragraph id="H38C8510DF2BE4E269ED18BB113002DC7"><enum>(4)</enum><text>in the case of a communication described in paragraph (1) or (2) of such subsection, include a clearly readable statement identifying the candidate and stating that the candidate has approved the communication which occupies not less than 10 percent of the total area of the communication (or, in the case of the text of a communication transmitted through the Internet, is continuously visible and occupies such portion of the visible screen as may be necessary to be clearly legible based on the Internet connection of the recipient of the communication).</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection></section>
<section id="HB7C53DB91DB449D7ABC34F67BCDA093"><enum>3.</enum><header>Application of disclosure requirements for audio and video communications to audio and video portions of communications transmitted through Internet</header><text display-inline="no-display-inline">Section 318(d)(1) of the <act-name parsable-cite="FECA">Federal Election Campaign Act of 1971</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/2/441d">2 U.S.C. 441d(d)(1)</external-xref>) is amended by adding at the end the following new subparagraph:</text>

<subparagraph id="H7FC7812570744D18A68114E25A06EC6"><enum>(C)</enum><header>Audio and video portions of communications transmitted through Internet</header><text>In the case of a communication described in paragraph (1) or (2) of subsection (a) which is transmitted through the Internet—</text>
<clause id="HA0C496F12F4642ACB5B4C1C8FFD12CA5"><enum>(i)</enum><text>any audio portion of the communication shall meet the requirements applicable under subparagraph (A) to communications transmitted through radio; and</text></clause>
<clause id="H8A687C912159499291E7C2C602A7AE3D"><enum>(ii)</enum><text>any video portion of the communication shall meet the requirements applicable under subparagraph (B) to communications transmitted through television.</text></clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></section>
<section id="H597979A27A6D483AAEFD947D76C13631"><enum>4.</enum><header>Disclosure requirements for campaign communications made through prerecorded telephone calls</header>
<subsection id="H723278FEDA69410F9C26C8405F33005B"><enum>(a)</enum><header>Application of requirements</header><text>Section 318(a) of the <act-name parsable-cite="FECA">Federal Election Campaign Act of 1971</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/2/441d">2 U.S.C. 441d(a)</external-xref>) is amended by inserting after <quote>mailing,</quote> each place it appears the following: <quote>telephone call which consists in substantial part of a prerecorded audio message,</quote>.</text></subsection>
<subsection id="H45DFFF78DEE5472B9162D9072E6E309E"><enum>(b)</enum><header>Treatment as audio communication</header><text>Section 318(d)(1) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/2/441d">2 U.S.C. 441d(d)(1)</external-xref>), as amended by section 3, is further amended by adding at the end the following new subparagraph:</text>

<subparagraph id="HD4F0E44F5103407CB979BEEB322E01D"><enum>(D)</enum><header>Prerecorded telephone calls</header><text>Any communication described in paragraph (1) or (2) of subsection (a) which is a telephone call which consists in substantial part of a prerecorded audio message shall meet the requirements applicable under subparagraph (A) to communications transmitted through radio, except that the statement required under such subparagraph shall be made at the beginning of the telephone call.</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection></section>
<section id="H5A88216BA88741390092472875C98294"><enum>5.</enum><header>Effective date</header><text display-inline="no-display-inline">The amendments made by this Act shall apply with respect to communications made on or after the expiration of the 90-day period which begins on the date of the enactment of this Act.</text></section>
