<official-title>To amend title 3, United States Code, to extend the date provided for the meeting of electors of the President and Vice President in the States and the date provided for the joint session of Congress held for the counting of electoral votes, and for other purposes.</official-title>

<section id="HC5A54B20332F449F93A05147654C5537" section-type="section-one" display-inline="no-display-inline"><enum>1.</enum><header>Short Title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Count Every Vote Act of 2005</short-title></quote>. </text></section> 
<section id="HEFB92118E8E7410093F95F57B5DFC85"><enum>2.</enum><header>Extension of Dates Provided for Meeting of Electors and Joint Session of Congress for Counting Electoral Votes</header> 
<subsection id="HC13C2E1379344521954EC357DD3491ED"><enum>(a)</enum><header>Meeting of Electors in States</header><text><external-xref legal-doc="usc" parsable-cite="usc/3/7">Section 7</external-xref> of title 3, United States Code, is amended by striking <quote>the first Monday after the second Wednesday in December next following their appointment</quote> and inserting the following: <quote>the first day (or, if such day is a Sunday, the second day) occurring after the January 1 that next follows their appointment</quote>.</text></subsection> 
<subsection id="HA132D2F2DDBA46BC93D41563757283C1"><enum>(b)</enum><header>Ensuring Timely Delivery of Certificates and Votes by States</header> 
<paragraph id="H5D023359B8BD4B88A820004655D0F996"><enum>(1)</enum><header>Certificate of appointed electors</header><text>Section 6 of such title is amended by striking <quote>communicate by registered mail under the seal of the State to the Archivist of the United States</quote> and inserting the following: <quote>communicate to the Archivist of the United States, by the most expeditious method available (including overnight delivery or a secure form of electronic transmission) to ensure receipt not later than the second day that follows the date described in section 7,</quote>.</text></paragraph> 
<paragraph id="H324144342FE94A479948A64869081100"><enum>(2)</enum><header>Disposition of certificates by electors</header><text>Section 11 of such title is amended—</text> 
<subparagraph id="HB16D2696457847F0A143AF5CF55C5498"><enum>(A)</enum><text>by striking <quote>by registered mail</quote> each place it appears; </text></subparagraph> 
<subparagraph id="HF9B6C8AE51BB414F86E4D5971FB5C22E"><enum>(B)</enum><text>by striking <quote>The electors shall dispose</quote> and inserting <quote>(a) <header-in-text level="subsection">In General.—</header-in-text>The electors shall dispose</quote>; and</text></subparagraph> 
<subparagraph id="HD56B3FBFD9F342D0BB961CFBCAF797A6"><enum>(C)</enum><text>by adding at the end the following new subsection:</text>

<subsection id="H03302C678B8741AFB5F81DBF33EC8D3F"><enum>(b)</enum><header>Method of Delivery and Transmission</header><text>The electors shall carry out the delivery and transmission requirements of this section by the most expeditious method available (including overnight delivery or a secure form of electronic transmission) to ensure receipt of the certificates and lists by the President of the Senate and the Archivist of the United States not later than the second day that follows the date described in section 7.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph> 
<paragraph id="H3513720A108A4DFEB092E1634BEEB4F8"><enum>(3)</enum><header>Final deadline for delivery</header><text>Section 12 of such title is amended—</text> 
<subparagraph id="HFFDBA60896EA4909A03DF1F5F3BEADA"><enum>(A)</enum><text display-inline="yes-display-inline">by striking <quote>the fourth Wednesday in December</quote> and inserting <quote>the second day that follows the date described in section 7</quote>; and</text></subparagraph> 
<subparagraph id="H256915DEA18349D5A0FB8E1149AA8B07"><enum>(B)</enum><text>by striking <quote>transmit same by registered mail to the President of the Senate at the seat of government</quote> and inserting the following: <quote>transmit such certificate and list to the President of the Senate at the seat of government by such method as may be necessary (including overnight delivery or a secure form of electronic transmission) to ensure that such certificate and list is received by the President of the Senate or the Archivist of the United States not later than the second day that follows the date described in section 7</quote>.</text></subparagraph></paragraph> 
<paragraph id="HFCF6486D60CB4963B6E126D8B700004C"><enum>(4)</enum><header>Demand on district court judge</header><text>Section 13 of such title is amended—</text> 
<subparagraph id="HA90EB3A4BF624AC6AA816511EAA099E3"><enum>(A)</enum><text display-inline="yes-display-inline">by striking <quote>the fourth Wednesday in December</quote> and inserting <quote>the second day that follows the date described in section 7</quote>;</text></subparagraph> 
<subparagraph id="H0D6E226E106747DC9911E405CDFC86AD"><enum>(B)</enum><text>by striking <quote>send a special messenger to</quote> and inserting <quote>immediately notify</quote>; and</text></subparagraph> 
<subparagraph id="HFAA9A7632950431C93D900D98C2CD5AF"><enum>(C)</enum><text>by striking <quote>shall forthwith transmit that list by the hand of the messenger to the seat of government</quote> and inserting <quote>shall take such action as may be necessary (including overnight delivery or a secure form of electronic transmission) to ensure that such certificate and list is received by the President of the Senate not later than 24 hours after receipt of the Archivist’s notice</quote>. </text></subparagraph></paragraph></subsection> 
<subsection id="HBF9C0F1FB022426B8873C15EF1A6534D"><enum>(c)</enum><header>Joint Session For Counting Electoral Votes</header><text>The first sentence of section 15 of such title is amended by striking <quote>the sixth day of January succeeding every meeting of the electors</quote> and inserting the following: <quote>the second day (or, if such day is a Sunday, the third day) that follows the deadline for the receipt of certificates and votes by the President of the Senate or the Archivist of the United States under section 12</quote>.</text></subsection></section> 
<section id="H0EE5F10570E34704896634C2C04F5F9"><enum>3.</enum><header>Extension of Safe Harbor Period for Resolution of Controversy or Contest Regarding Appointment of Electors</header><text display-inline="no-display-inline"><external-xref legal-doc="usc" parsable-cite="usc/3/5">Section 5</external-xref> of title 3, United States Code, is amended by striking <quote>six days</quote> each place it appears and inserting <quote>3 days</quote>. </text></section> 
<section id="HD2BC206292554D738800B9A6E100DD17"><enum>4.</enum><header>Effective Date</header><text display-inline="no-display-inline">The amendments made by this Act shall apply with respect to the Presidential election held in November 2008 and each succeeding Presidential election.</text></section>
