<official-title>To provide a technical correction to the Federal preemption of State or local laws concerning the markings and identification of imitation or toy firearms entering into interstate commerce.</official-title>

<section id="H4D1462D506714B7E9C903CBE9204D247" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Toy Gun Marking Improvement Act</short-title></quote>.</text></section> 
<section id="H8B16314107AA4F0A971E4F719E45128C"><enum>2.</enum><header>Preemption of State or local laws concerning the markings and identification of imitation or toy firearms</header><text display-inline="no-display-inline">Section 4(g) of the Federal Energy Management Improvement Act of 1988 (<external-xref legal-doc="usc" parsable-cite="usc/15/5001">15 U.S.C. 5001(g)</external-xref>) is amended by striking <quote>which provide for markings</quote> and all that follows through <quote>firearm developed prior to 1898; or</quote> and inserting the following: </text> 
<quoted-block style="OLC" id="HF8DB94482BBC46688BA0E42C3E50A743" display-inline="yes-display-inline"><text display-inline="yes-display-inline">relating to markings, identification, or sale of toy, look-alike, and imitation firearms. No State or local subdivision shall—</text> 
<paragraph id="H230D1545A70747A2978DA6B0C26687E"><enum>(1)</enum><text>prohibit the sale or manufacture of any look-alike, nonfiring, toy or collector replica of an antique firearm developed prior to 1898; or</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block> </section>
