<section id="H0D6BA6261CBC401D9D25396272626B10" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Chemical Facility Security Act of 2005</short-title></quote>.</text></section> 
<section id="H4743D19BF83E4FEBB344DBC0FCFB97C"><enum>2.</enum><header>Findings</header><text display-inline="no-display-inline">The Congress finds the following:</text> 
<paragraph id="HB918578112EB47E69C7F868954805600"><enum>(1)</enum><text>Industries that manufacture, distribute, and process chemicals are crucial components of the national economy and the critical infrastructure of the United States—</text> 
<subparagraph id="HD2C04CA207F548AB8517B19F00176E79"><enum>(A)</enum><text>in their own right; and</text></subparagraph> 
<subparagraph id="HB90E85F9C28E4C8CB025BB6732269F66"><enum>(B)</enum><text>because those industries supply resources essential to the functioning of other critical infrastructure.</text></subparagraph></paragraph> 
<paragraph id="H93A00E110D93464391D4CDC96971D228"><enum>(2)</enum><text>A terrorist attack on a facility that manufactures, processes, or uses potentially dangerous chemicals, or a theft of those chemicals from such a facility for use in a terrorist attack, could pose a serious threat to—</text> 
<subparagraph id="H39597F03571948F59184238B9CA12DE2"><enum>(A)</enum><text>public health, safety, and welfare;</text></subparagraph> 
<subparagraph id="HDC37FF467AF344DC96C080267EFBF445"><enum>(B)</enum><text>critical infrastructure; and</text></subparagraph> 
<subparagraph id="H66D34B81DF7C44AAACE387131081652D"><enum>(C)</enum><text>national security.</text></subparagraph></paragraph> 
<paragraph id="H29BBB20D6AE64B4BB425E3A71243E181"><enum>(3)</enum><text>While Federal, State, and local governments share primary responsibility for preventing, detecting, and responding to terrorist attacks, the owners and operators of facilities that manufacture, process, or use potentially dangerous chemicals should make every reasonable effort to protect those facilities against the threat of such attacks.</text></paragraph> 
<paragraph id="H442A60824D1F48BFA5D8DF66B0151CE"><enum>(4)</enum><text>While programs to protect the health and safety of workers, the public, and the environment by reducing the potential for accidental releases of potentially dangerous chemicals, including the consequences of worst-case releases of those chemicals, are in place as required by numerous Federal and State laws, the events of September 11, 2001, demonstrate the need to ensure that appropriate security measures are taken to address the threat of acts of terrorism against facilities that manufacture, use, or process potentially dangerous chemicals.</text></paragraph></section> 
<section id="HE726434706804BC68598C8C1241C0058"><enum>3.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text> 
<paragraph id="H19AD6A9CEFED4C70829855D264738BC"><enum>(1)</enum><header>Administrator</header><text>The term <term>Administrator</term> means the Administrator of the Environmental Protection Agency.</text></paragraph> 
<paragraph id="HFE99525608C34ABA8792195357090355"><enum>(2)</enum><header>Chemical source</header><text>The term <term>chemical source</term> means a stationary source as defined in section 112(r)(2)(C) of the Clean Air Act (<external-xref legal-doc="usc" parsable-cite="usc/42/7412">42 U.S.C. 7412(r)(2)(C)</external-xref>) at which a substance of concern is present in more than a threshold quantity, as defined in or established under paragraphs (3) and (5) of section 112(r) of the Clean Air Act (<external-xref legal-doc="usc" parsable-cite="usc/42/7412">42 U.S.C. 7412(r)</external-xref>), subject to the authority of the Secretary under section 5(f) to designate additional categories of stationary sources as chemical sources or to exempt categories of existing chemical sources from such designation.</text></paragraph> 
<paragraph id="HCC72A0AB627F4AFE9100B32974A81007"><enum>(3)</enum><header>Department</header><text>The term <term>Department</term> means the Department of Homeland Security.</text></paragraph> 
<paragraph id="H39A07CB4EE6342B0B6D7F2924606EBF2"><enum>(4)</enum><header>Environment</header><text>The term <term>environment</term> has the meaning given the term in section 101 of the Comprehensive Environmental Response, Compensation, and Liability Act of 1980 (<external-xref legal-doc="usc" parsable-cite="usc/42/9601">42 U.S.C. 9601</external-xref>).</text></paragraph> 
<paragraph id="H176A44EFD097493D8B5CF00998095CA4"><enum>(5)</enum><header>Owner or operator</header><text>The term <term>owner or operator</term> has the meaning given the term in section 112(a) of the Clean Air Act (<external-xref legal-doc="usc" parsable-cite="usc/42/7412">42 U.S.C. 7412(a)</external-xref>).</text></paragraph> 
<paragraph id="HB825189C61CF47D3B72EE3E6C5306DFA"><enum>(6)</enum><header>Release</header><text>The term <term>release</term> has the meaning given the term in section 101 of the Comprehensive Environmental Response, Compensation, and Liability Act of 1980 (<external-xref legal-doc="usc" parsable-cite="usc/42/9601">42 U.S.C. 9601</external-xref>).</text></paragraph> 
<paragraph id="HEAC78F66CB5949B0B3742C6D2BFEB92F"><enum>(7)</enum><header>Secretary</header><text>The term <term>Secretary</term> means the Secretary of Homeland Security.</text></paragraph> 
<paragraph id="H1CA68B123D2F4939A994C7717960A1DD"><enum>(8)</enum><header>Security measure</header> 
<subparagraph id="HACF24EBEE03D4F0700C2C8236DAD9EC"><enum>(A)</enum><header>In general</header><text>The term <term>security measure</term> means an action carried out to ensure or enhance the security of a chemical source.</text></subparagraph> 
<subparagraph id="H12E2F5AD4C034CE8006006FB00EA2317"><enum>(B)</enum><header>Inclusions</header><text>The term <term>security measure</term>, with respect to a chemical source, includes measures such as—</text> 
<clause id="H30D9AFC7066249C6A60052EDA5EF8E39"><enum>(i)</enum><text>employee training and background checks;</text></clause> 
<clause id="H37814E15F2484B83833860D88218E1FF"><enum>(ii)</enum><text>the limitation and prevention of access to controls of the chemical source;</text></clause> 
<clause id="H375BBD34F1CA44B9871F7D9534D3C59C"><enum>(iii)</enum><text>the protection of the perimeter of the chemical source;</text></clause> 
<clause id="H2DB7206CDFAE40E7BFEB5B259F158FEC"><enum>(iv)</enum><text>the installation and operation of intrusion detection sensors;</text></clause> 
<clause id="H3A53B342C483457C8B8CE6C6BF5F59A1"><enum>(v)</enum><text>the implementation of measures to increase computer or computer network security;</text></clause> 
<clause id="H41D25CB4AC3345D2B80602D289FA00AB"><enum>(vi)</enum><text>the implementation of other security-related measures to protect against or reduce the threat of—</text> 
<subclause id="H1C8B6A33A6BC482BAC036E4B07047481"><enum>(I)</enum><text>a terrorist attack on the chemical source; or</text></subclause> 
<subclause id="H0BB72D46E36849499965C1FEE473EA00"><enum>(II)</enum><text>the theft of a substance of concern for offsite release in furtherance of an act of terrorism; and</text></subclause></clause> 
<clause id="H8C8F2C5CA545420A9FD161847CD3249B"><enum>(vii)</enum><text>conduct of any similar security-related activity, as determined by the Secretary.</text></clause></subparagraph></paragraph> 
<paragraph id="H51C925D8749D46B0A32E001EB273B209"><enum>(9)</enum><header>Substance of concern</header><text>The term <term>substance of concern</term> means a chemical substance present at a chemical source in more than a threshold quantity, subject to the authority of the Secretary under section 5(g) to designate new substances as substances of concern, exempt existing substances of concern from such designation, or adjust the threshold quantity for a substance of concern.</text></paragraph> 
<paragraph id="H498E4303F0BB43CD87372C709D234B6E"><enum>(10)</enum><header>Terrorism</header><text>The term <term>terrorism</term> has the meaning given the term in section 2 of the Homeland Security Act of 2002 (<external-xref legal-doc="usc" parsable-cite="usc/6/101">6 U.S.C. 101</external-xref>).</text></paragraph> 
<paragraph id="H33AEBB62AAAB4608A75D14C1277F403E"><enum>(11)</enum><header>Terrorist release</header><text>The term <term>terrorist release</term> means—</text> 
<subparagraph id="HB032D6276F174A0AB400DCC0B840BE35"><enum>(A)</enum><text>a release from a chemical source into the environment of a substance of concern that is caused by an act of terrorism; or</text></subparagraph> 
<subparagraph id="H04728A7F64A6497483B4FBAC829CDD82"><enum>(B)</enum><text>the theft of a substance of concern by a person for offsite release in furtherance of an act of terrorism.</text></subparagraph></paragraph></section> 
<section id="HF88AFCD1C06C46D39482B7273D887E08"><enum>4.</enum><header>Designation of and requirements for high-priority categories</header> 
<subsection id="H6815B58BE0D64C4EA2FFF6FFF7B1025D"><enum>(a)</enum><header>Designation and regulation of high-priority categories by the secretary</header><text>Not later than 1 year after the date of enactment of this Act, the Secretary, in consultation with the Administrator, shall promulgate regulations to designate certain combinations of chemical sources and substances of concern as high-priority categories based on the severity of the threat posed by a terrorist release from the chemical sources.</text></subsection> 
<subsection id="H5476A793FF794672A5085961B533C73C"><enum>(b)</enum><header>Factors to be considered</header><text>In designating high-priority categories under subsection (a), the Secretary, in consultation with the Administrator, shall consider—</text> 
<paragraph id="H3660F75414724CCB9EBD3C26DB4291E2"><enum>(1)</enum><text>the severity of the harm that could be caused by a terrorist release;</text></paragraph> 
<paragraph id="HD454DF0CBA64448DB049B117FA20157"><enum>(2)</enum><text>the proximity to population centers;</text></paragraph> 
<paragraph id="H561B59AADAC7434BB842612D784D2F63"><enum>(3)</enum><text>the threats to national security;</text></paragraph> 
<paragraph id="H2DF7C5076C61482B8579E51BF929459E"><enum>(4)</enum><text>the threats to critical infrastructure;</text></paragraph> 
<paragraph id="HDCF813A6ABF947368DD13FDF50764974"><enum>(5)</enum><text>the nature and quantity of substances of concern at a given facility; and</text></paragraph> 
<paragraph id="HEE2585E8BF094DAE9C8CBAD16EDC6600"><enum>(6)</enum><text>such other security-related factors as the Secretary, in consultation with the Administrator, determines to be appropriate.</text></paragraph></subsection></section> 
<section id="H3217AB33F55E49A6A964D1584218AB17"><enum>5.</enum><header>Vulnerability assessments and site security plans</header> 
<subsection id="H52098A1939B347339500F4B74839E458"><enum>(a)</enum><header>Requirement</header> 
<paragraph id="HFA0975624C984D74A5CD0517E881E46F"><enum>(1)</enum><header>In general</header><text>Not later than 1 year after the date of enactment of this Act, the Secretary shall promulgate regulations that require the owner or operator of each chemical source—</text> 
<subparagraph id="H9D39E94074064B4CA97B5C8D008B96F7"><enum>(A)</enum><text>to conduct an assessment of the vulnerability of the chemical source to a terrorist release, including identifying hazards that may result from a terrorist release;</text></subparagraph> 
<subparagraph id="H3C7107E71D7544E6BFF4F300B07BF441"><enum>(B)</enum><text>to prepare and implement a site security plan that addresses the results of the vulnerability assessment;</text></subparagraph> 
<subparagraph id="HFA5271FDE4394C358C4F9700D3F19151"><enum>(C)</enum><text>in the case of a chemical source that is in a high-priority category under regulations under section 4, to provide to the Secretary a copy of the vulnerability assessment conducted under subparagraph (A) and the site security plan prepared under subparagraph (B); and</text></subparagraph> 
<subparagraph id="HAFF5A769EC0B4451944DFA48707E33FF"><enum>(D)</enum><text>in the case of a chemical source that is not in a high-priority category under regulations promulgated under section 4, to provide to the Department, on request, copies of the vulnerability assessment and site security plan for review.</text></subparagraph></paragraph> 
<paragraph id="H94D4C6F5EC32443A809457B7CB9EC92D"><enum>(2)</enum><header>Deadlines</header> 
<subparagraph id="H4275E5E6BF4F4111BC9088A6A8AD8CC0"><enum>(A)</enum><header>In general</header><text>The Secretary shall specify in regulations promulgated under paragraph (1) specific deadlines for the completion and certification of vulnerability assessments and site security plans under subsection (b).</text></subparagraph> 
<subparagraph id="H1B14D1ED3C9C4AAA9D7367047E6CB7B1"><enum>(B)</enum><header>Alternative deadlines</header><text>The Secretary may establish deadlines other than deadlines described in subparagraph (A) for different categories of chemical sources based on the regulatory criteria specified in subsection (e).</text></subparagraph></paragraph> 
<paragraph id="HD7B8DEF2D3454CCB83B5E4A7ADDE60B0"><enum>(3)</enum><header>Contents of site security plan</header><text>A site security plan required under the regulations promulgated under paragraph (1)—</text> 
<subparagraph id="H27DA9082695A48DAADF130BF90D4F8DE"><enum>(A)</enum> 
<clause id="H542E080A17F7449A0056AF67736ECE6E" display-inline="yes-display-inline"><enum>(i)</enum><text>shall include security measures to reduce the vulnerability of the chemical source covered by the plan to a terrorist release; and</text></clause> 
<clause id="H5EFFBD0AAA424A1A92673754B19669CC" indent="up1"><enum>(ii)</enum><text>may include other actions and procedures appropriate to reduce the vulnerability of the chemical source to a terrorist release; and</text></clause></subparagraph> 
<subparagraph id="HD637FFAD17694D15B091558459ACBD50"><enum>(B)</enum><text>shall describe, at a minimum, particular equipment, plans, and procedures that could be implemented or used by or at the chemical source in the event of a terrorist release.</text></subparagraph></paragraph> 
<paragraph id="H3A156F89D9C84A03001903D528AE674D"><enum>(4)</enum><header>Threat information</header><text>To the maximum extent practicable under applicable authority and in the interests of national security, the Secretary shall provide to an owner or operator of a chemical source required to prepare a vulnerability assessment and site security plan threat information that is relevant to the chemical source.</text></paragraph></subsection> 
<subsection id="HAEB6845C9B4D4DA3B748F11B4CBDAA3E"><enum>(b)</enum><header>Certification and submission</header> 
<paragraph id="H52F5A94C2EC04C3CA2E6F5C2B1F01FC"><enum>(1)</enum><header>In general</header><text>Each owner or operator of a chemical source that is not in a high-priority category shall certify in writing to the Secretary that the owner or operator has completed a vulnerability assessment, and has developed and implemented or is implementing a site security plan, in accordance with this Act, including—</text> 
<subparagraph id="HAC430067745347F4AAC9F19BE6202100"><enum>(A)</enum><text>regulations promulgated under subsection (a)(1); and</text></subparagraph> 
<subparagraph id="H1EBEBC9412FC427B8F8F0079491BA529"><enum>(B)</enum><text>any applicable procedures, protocols, or standards endorsed or recognized by the Secretary under subsection (c)(2).</text></subparagraph></paragraph> 
<paragraph id="HE4F6241BA2DF49D596AF871C77F18C00"><enum>(2)</enum><header>Oversight</header><text>The Secretary shall, at such times and places as the Secretary determines to be appropriate, conduct or require the conduct of vulnerability assessments and other activities to ensure and evaluate compliance with—</text> 
<subparagraph id="HA8A623BE34AE40579BF582E3AF601437"><enum>(A)</enum><text>this Act (including regulations promulgated under subsection (a)(1)); and</text></subparagraph> 
<subparagraph id="H1A080DFF55D04309906465D78F3EA800"><enum>(B)</enum><text>other applicable procedures, protocols, or standards endorsed or recognized by the Secretary under subsection (c)(2).</text></subparagraph></paragraph></subsection> 
<subsection id="H3B738672633A4F480081B75E42A5EFFC"><enum>(c)</enum><header>Specified standards</header> 
<paragraph id="H203EB4807E1845EA80BB9E28091CC026"><enum>(1)</enum><header>In general</header><text>The Secretary may—</text> 
<subparagraph id="HF4C7C4E8909D4DADB0F5CBB1288C2E84"><enum>(A)</enum><text>establish procedures, protocols, and standards for vulnerability assessments and site security plans;</text></subparagraph> 
<subparagraph id="H2DBC2F39A103493BBF9383663FF99535"><enum>(B)</enum><text>establish provisions identifying security measures that, if implemented, would establish the sufficiency of a vulnerability assessment or site security plan; and</text></subparagraph> 
<subparagraph id="H8077AE8817AD4BEEA02B4103B89E12E3"><enum>(C)</enum><text>require that a vulnerability assessment and site security plan address a particular threat or type of threat.</text></subparagraph></paragraph> 
<paragraph id="HD04D23EFDD82463EB292C02BF179BD53"><enum>(2)</enum><header>Existing procedures, protocols, and standards</header><text>Upon petition by any person of the Secretary, any procedures, protocols, and standards established by the Secretary under paragraph (1)(A) shall endorse or recognize procedures, protocols, and standards—</text> 
<subparagraph id="HF8A1CCA5C1A0474FBF00D07F9FEAD64"><enum>(A)</enum><text>that are established by—</text> 
<clause id="H672F870762ED47B8883E603E84471873"><enum>(i)</enum><text>industry;</text></clause> 
<clause id="H3E23BBEABA59407E86B8B35320CE6ED0"><enum>(ii)</enum><text>Federal, State, or local authorities; or</text></clause> 
<clause id="H3D664DDB105B47178FA3D3CA00292495"><enum>(iii)</enum><text>other applicable law; and</text></clause></subparagraph> 
<subparagraph id="H1930366A99964C3D9214026245F1C1BE"><enum>(B)</enum><text>the requirements of which the Secretary determines to be—</text> 
<clause id="HA86B7E602D3746039006C70890FEFC1C"><enum>(i)</enum><text>substantially equivalent to the requirements under subsection (a); and</text></clause> 
<clause id="H7A09A705312048C388D61054EB00D279"><enum>(ii)</enum><text>in effect on or after the date of enactment of this Act.</text></clause></subparagraph></paragraph> 
<paragraph id="HA3B67F601BD04F169C4725FB8BD86B7F"><enum>(3)</enum><header>No action by secretary</header><text>If the Secretary does not endorse or recognize existing procedures, protocols, and standards described in paragraph (2)(A), the Secretary shall provide to each person that submitted a petition under paragraph (2) a written notification that includes a clear explanation of the reasons why the endorsement or recognition was not made.</text></paragraph></subsection> 
<subsection id="H510871D35970403DA5F402502EFD3435"><enum>(d)</enum><header>Preparation of assessments and plans</header><text>As of the date of endorsement or recognition by the Secretary of a particular procedure, protocol, or standard under subsection (c)(2), any vulnerability assessment or site security plan that is prepared by a chemical source before, on, or after the date of endorsement or recognition of, and in accordance with, that procedure, protocol, or standard, shall be exempt from subsection (c) and paragraphs (1) and (3) of subsection (a) (including such a vulnerability assessment or site security plan prepared before, on, or after the date of enactment of this Act).</text></subsection> 
<subsection id="H801EDF520F744795BDC3CC6EC5D0071"><enum>(e)</enum><header>Regulatory criteria</header><text>In exercising the authority under subsections (a) and (c) with respect to a chemical source, the Secretary shall consider—</text> 
<paragraph id="HA09172EF66AA46B6A3BF9E208741A4C8"><enum>(1)</enum><text>the likelihood that a chemical source will be the target of terrorism;</text></paragraph> 
<paragraph id="H78921BE99DC14624BE124EC4318C28A5"><enum>(2)</enum><text>the nature and quantity of the substances of concern present at a chemical source;</text></paragraph> 
<paragraph id="HEFF4CE6CFB3A4568822CB8FC82DE61"><enum>(3)</enum><text>the potential extent of death, injury, or serious adverse effects to human health or the environment that would result from a terrorist release;</text></paragraph> 
<paragraph id="HD43B3313BD7F4C869FFD7ED109D7B00"><enum>(4)</enum><text>the potential harm to critical infrastructure and national security from a terrorist release;</text></paragraph> 
<paragraph id="HE0143DDAB24741A3A6C28BCD9BED6F41"><enum>(5)</enum><text>cost and technical feasibility;</text></paragraph> 
<paragraph id="H9FAFA29F19A244119B04B737FD1650C0"><enum>(6)</enum><text>scale of operations; and</text></paragraph> 
<paragraph id="HB691A7D6957A43598D3F2555383EF300"><enum>(7)</enum><text>such other security-related factors as the Secretary determines to be appropriate and necessary to protect the public health and welfare, critical infrastructure, and national security.</text></paragraph></subsection> 
<subsection id="HB523E7E3683B4FA38888EB0085246952"><enum>(f)</enum><header>Designation and exemption of chemical sources</header> 
<paragraph id="HF94967E5A2B244F4A4E4754CB3A7BBFD"><enum>(1)</enum><header>In general</header><text>The Secretary may, from time to time, by regulation—</text> 
<subparagraph id="HFD3BDFCF59274ECF8CF7AB977E03EC42"><enum>(A)</enum><text>designate certain categories of stationary sources as chemical sources under this Act; or</text></subparagraph> 
<subparagraph id="H5EB9AB0BF98E469CBD2209D012077957"><enum>(B)</enum><text>exempt certain categories of stationary sources from designation as chemical sources,</text></subparagraph><continuation-text continuation-text-level="paragraph">without regard to whether a substance of concern is present at such sources in more than a threshold quantity.</continuation-text></paragraph> 
<paragraph id="HCC797E6EBF3F4325BF7DE1DAD1DECDF0"><enum>(2)</enum><header>Considerations</header><text>In designating or exempting a chemical source under paragraph (1), the Secretary shall consider the factors described in subsection (e).</text></paragraph> 
<paragraph id="HB665BCEF41AC473695E485DE28362867"><enum>(3)</enum><header>Regulations</header><text>The Secretary may make a designation or exemption under paragraph (1) in regulations promulgated under subsection (a)(1).</text></paragraph> 
<paragraph id="H8D8F6B1A798346CA91AB006CFB6A87"><enum>(4)</enum><header>Future determinations</header><text>Not later than 3 years after the date of promulgation of regulations under subsections (a)(1) and (c), and every 3 years thereafter, the Secretary shall, after considering the criteria described in subsection (e), determine whether to designate or exempt particular categories of chemical sources under this subsection.</text></paragraph></subsection> 
<subsection id="HF108AF71BAC64E2CAB1E3433F98B77E3"><enum>(g)</enum><header>Designation, exemption, and adjustment of threshold quantities of substances of concern</header> 
<paragraph id="H605C0AC29BC7448BA951603957B7C4BE"><enum>(1)</enum><header>In general</header><text>The Secretary may, by regulation—</text> 
<subparagraph id="H60194A57E9B24CF89FB4B797A1BB5504"><enum>(A)</enum><text>designate certain chemical substances in particular threshold quantities as substances of concern under this Act;</text></subparagraph> 
<subparagraph id="H4700475C379443C99C89E1A0CD2DF5C9"><enum>(B)</enum><text>exempt certain chemical substances from designation as substances of concern under this Act; and</text></subparagraph> 
<subparagraph id="H24FC1AF0C51847EFAB776FEFB13853DB"><enum>(C)</enum><text>adjust the threshold quantity of a chemical substance.</text></subparagraph></paragraph> 
<paragraph id="HEC3960CC49C44C4800A6DEC1E9913EDA"><enum>(2)</enum><header>Considerations</header><text>In designating or exempting a chemical substance or adjusting the threshold quantity of a chemical substance under paragraph (1), the Secretary shall consider the potential extent of death, injury, or serious adverse effects to human health or the environment that would result from a terrorist release of the chemical substance.</text></paragraph> 
<paragraph id="HB4A4BE83D5D240298E1545EF184286F"><enum>(3)</enum><header>Regulations</header><text>The Secretary may make a designation, exemption, or adjustment under paragraph (1) in regulations promulgated under subsection (a)(1).</text></paragraph></subsection> 
<subsection id="H835B9D1D85D84D8C825B00909CBCD3CA"><enum>(h)</enum><header>Five-Year Review</header><text>Not later than 5 years after the date of certification of a vulnerability assessment and a site security plan under subsection (b)(1), and not less often than every 5 years thereafter (or on such a schedule as the Secretary may establish by regulation), the owner or operator of the chemical source covered by the vulnerability assessment or site security plan shall—</text> 
<paragraph id="H5A64879890034860896EBA023524DE7"><enum>(1)</enum><text>review the adequacy of the vulnerability assessment and site security plan; and</text></paragraph> 
<paragraph id="H01213BCA4BF948B49291373990E16200"><enum>(2)</enum> 
<subparagraph id="H6CE6B7DD0C074ABE0061F77BEFF87034" display-inline="yes-display-inline"><enum>(A)</enum><text>certify to the Secretary that the chemical source has completed the review and implemented any modifications to the site security plan; and</text></subparagraph> 
<subparagraph id="H89DB5EE1D287415DB600C5C9829BDD7" indent="up1"><enum>(B)</enum><text>upon request by the Secretary, submit to the Secretary a description of any changes to the vulnerability assessment or site security plan.</text> </subparagraph></paragraph></subsection> 
<subsection id="H5A502D4F2EC24B95943C3FCA71B0C68D"><enum>(i)</enum><header>Submission of changes for high-priority chemical sources</header><text>The owner or operator of a chemical source that is in a high-priority category under regulations under section 4 shall provide to the Secretary a description of any change made to the vulnerability assessment or site security plan required for the chemical source under this section, by not later than 90 days after the date the change is made.</text></subsection> 
<subsection id="HFDFD7231436A492F9336CBA0B247226C"><enum>(j)</enum><header>Protection of information</header> 
<paragraph id="H3A406F68BC9849968FA8C8BE17F42FD3"><enum>(1)</enum><header>Disclosure exemption</header><text>All information obtained in accordance with this Act, and all information derived from that information (including information shared with Federal, State, and local governmental entities under paragraphs (2) and (3))—</text> 
<subparagraph id="H7CEBE6D1AFB14A2A92E7679E61BF11A0"><enum>(A)</enum><text>shall not be disclosed by any Federal agency, under <external-xref legal-doc="usc" parsable-cite="usc/5/552">section 552</external-xref> of title 5, United States Code, or otherwise;</text></subparagraph> 
<subparagraph id="H9B604D7573974B7DA0F75224FB52C311"><enum>(B)</enum><text>shall not be disclosed under any State or local law providing for public access to information; and</text></subparagraph> 
<subparagraph id="HE85F5E3FA0E44B70A36CB547D319BE51"><enum>(C)</enum><text>shall not be subject to discovery or admitted into evidence in any Federal or State civil judicial or administrative proceeding, other than an action under section 10.</text></subparagraph></paragraph> 
<paragraph id="H1DC4D1268DF443E0A7E3DC47D3FB9F00"><enum>(2)</enum><header>Development of protocols</header> 
<subparagraph id="H52F156DA0D6841E4AE9DFC548413F5F2"><enum>(A)</enum><header>In general</header><text>The Secretary, in consultation with the Director of the Office of Management and Budget and appropriate Federal law enforcement and intelligence officials, and in a manner consistent with existing protections for sensitive or classified information, shall, by regulation, establish confidentiality protocols for maintenance and use of information that is obtained from owners or operators of chemical sources and provided to the Secretary under this Act.</text></subparagraph> 
<subparagraph id="HD4956ACBB1884B1F856C0008D1A1BB72"><enum>(B)</enum><header>Requirements for protocols</header><text>A protocol established under subparagraph (A) shall ensure that—</text> 
<clause id="HAD37BC88D07F4CBCB2C1DE0829B0397B"><enum>(i)</enum><text>each copy of a vulnerability assessment or site security plan submitted to the Secretary, all information contained in or derived from that assessment or plan, and other information obtained under section 8, is maintained in a secure location; and</text></clause> 
<clause id="H88BB4ED3E14240AC9C310481D1AC52C7"><enum>(ii)</enum><text>except as provided in paragraph (3)(B), access to the copies of the vulnerability assessments and site security plans submitted to the Secretary, and other information obtained under section 8, shall be limited to persons designated by the Secretary.</text></clause></subparagraph></paragraph> 
<paragraph id="HEE493B9AB7244F6185FE11CD6208C52"><enum>(3)</enum><header>Penalties for unauthorized disclosure</header> 
<subparagraph id="H2EB771D2A6DF49FFBE827654797257F7"><enum>(A)</enum><header>In general</header><text>Except as provided in subparagraph (B), any individual who acquires any information described in paragraph (2)(A) (including any reproduction of that information or any information derived from that information), and who knowingly or recklessly discloses the information, shall—</text> 
<clause id="H4B9520C6EE79451C9E9D0490191B06EF"><enum>(i)</enum><text>be imprisoned not more than 1 year, fined in accordance with <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/18/227">chapter 227</external-xref> of title 18, United States Code (applicable to class A misdemeanors), or both; and</text></clause> 
<clause id="HEE34F5D1CB874EB2A4AC44AA9248055C"><enum>(ii)</enum><text>if a Federal employee, be removed from Federal office or employment.</text></clause></subparagraph> 
<subparagraph id="HBC4D21F66DCB4BC68EED7C94E8C3B508"><enum>(B)</enum><header>Exceptions</header> 
<clause id="H4DF55BF129A94F83B2A490DC2EDCC068"><enum>(i)</enum><header>In general</header><text>Subparagraph (A) shall not apply to a person described in that subparagraph that discloses information described in paragraph (2)(A)—</text> 
<subclause id="HDC5F1E5DFE06499389681C43EF620009"><enum>(I)</enum><text>to an individual designated by the Secretary under paragraph (2)(B)(ii); or</text></subclause> 
<subclause id="H9B5E9E48760B4FCDBDD9F9FA6FDB000"><enum>(II)</enum><text>for use in any administrative or judicial proceeding to impose a penalty for failure to comply with a requirement of this Act.</text></subclause></clause> 
<clause id="H2CEC90594D8545588F64B1A2F6ADF577"><enum>(ii)</enum><header>Law enforcement officials and first responders</header><text>Notwithstanding subparagraph (A), an individual referred to in paragraph (2)(B)(ii) who is an officer or employee of the United States may share with a State or local law enforcement or other official (including a first responder) the contents of a vulnerability assessment or site security plan, or other information described in that paragraph, to the extent disclosure is necessary to carry out this Act.</text></clause></subparagraph></paragraph></subsection></section> 
<section id="H0C19570EE2F9498CACFBA48692D7C1AA"><enum>6.</enum><header>Enforcement</header> 
<subsection id="H450F3E28F93E4FF4A275DBE1911CECB"><enum>(a)</enum><header>Failure to certify or submit</header><text>If an owner or operator of a chemical source fails to certify or submit a vulnerability assessment or site security plan in accordance with this Act, the Secretary may issue an order requiring the certification and submission of a vulnerability assessment or site security plan in accordance with this Act.</text></subsection> 
<subsection id="HA4B2EAD6AB96493BBA6FADF06110666F"><enum>(b)</enum><header>Disapproval</header><text>The Secretary may disapprove a vulnerability assessment or site security plan if the Secretary determines that—</text> 
<paragraph id="HD26413DBE2B847BFA66EA07D81504143"><enum>(1)</enum><text>the vulnerability assessment or site security plan does not comply with regulations promulgated under subsections (a)(1) and (c) of section 5; or</text></paragraph> 
<paragraph id="HD7E7B25FCD3947C5B54D567EC5F32821"><enum>(2)</enum><text>the site security plan, or the implementation of the site security plan, is insufficient to address—</text> 
<subparagraph id="H000E5AE11AF246FDABD71C34AF754F4E"><enum>(A)</enum><text>the results of a vulnerability assessment of a chemical source; or</text></subparagraph> 
<subparagraph id="H81E9C63341AB4E228529A2F93EF25CF"><enum>(B)</enum><text>a threat of a terrorist release.</text></subparagraph></paragraph></subsection> 
<subsection id="HB68D2C5B06AD4B5F9B2EDC0090EAB15D"><enum>(c)</enum><header>Compliance</header><text>If the Secretary disapproves a vulnerability assessment or site security plan of a chemical source under subsection (b), the Secretary shall—</text> 
<paragraph id="H66629942851A4DFA8CAD3B46000479E"><enum>(1)</enum><text>provide the owner or operator of the chemical source a written notification of the determination that includes a clear explanation of deficiencies in the vulnerability assessment, site security plan, or implementation of the assessment or plan;</text></paragraph> 
<paragraph id="H5A63C614574141A28518449DF9FF45FE"><enum>(2)</enum><text>consult with the owner or operator of the chemical source to identify appropriate steps to achieve compliance; and</text></paragraph> 
<paragraph id="H2A4ECF4ED1634C9F9D17E49FE87F1654"><enum>(3)</enum><text>if, following that consultation, the owner or operator of the chemical source does not achieve compliance in accordance by such date as the Secretary determines to be appropriate under the circumstances, issue an order requiring the owner or operator to revise, recertify, and submit the assessment or plan to correct deficiencies specified in the order.</text></paragraph></subsection> 
<subsection id="HE73D28EEBF994A549E15CC252F636BC"><enum>(d)</enum><header>Protection of information</header><text>Any determination of disapproval or order made or issued under this section—</text> 
<paragraph id="HAE8F4605163B496F98E7EE16A2449287"><enum>(1)</enum><text>shall not be disclosed by any Federal agency, under <external-xref legal-doc="usc" parsable-cite="usc/5/552">section 552</external-xref> of title 5, United States Code, or otherwise;</text></paragraph> 
<paragraph id="H6B4841B78BC44B3D9032A134D64B0263"><enum>(2)</enum><text>shall not be disclosed under any State or local law providing for public access to information; and</text></paragraph> 
<paragraph id="H97F3EE288088444A8B8DC8E8B2F532E6"><enum>(3)</enum><text>shall not be subject to discovery or admitted into evidence in any Federal or State civil judicial or administrative proceeding, other than an action under section 10.</text></paragraph></subsection></section> 
<section id="H61D79C07652D4544A6DF9731F1594AB"><enum>7.</enum><header>Interagency technical support and cooperation</header><text display-inline="no-display-inline">The Secretary—</text> 
<paragraph id="H1427D4F6B416419BA5362D17EE56F1CF"><enum>(1)</enum><text>may request other Federal agencies to provide technical and analytical support (other than field work) in implementing this Act; and</text></paragraph> 
<paragraph id="H398E7001DFFC42B79B529244985058C8"><enum>(2)</enum><text>may provide reimbursement for such technical and analytical support received as the Secretary determines to be appropriate.</text></paragraph></section> 
<section id="HAF01D3211FA7473883A2E25F85FFF1B5"><enum>8.</enum><header>Recordkeeping; site inspections; production of information</header> 
<subsection id="HA65FF8633F6A4DC4BB30E0B0B97963A6"><enum>(a)</enum><header>Recordkeeping</header><text>The owner or operator of a chemical source that is required to prepare a vulnerability assessment or site security plan under section 5(a) shall maintain a current copy of those documents.</text></subsection> 
<subsection id="H65FFC34A91554D0FA4CCE7EDDABBA1FC"><enum>(b)</enum><header>Right of entry</header><text>In carrying out this Act, the Secretary (or a designee), on presentation of credentials, shall have a right of entry to, on, or through—</text> 
<paragraph id="H355BAAD947204187AE0095E093CBC72"><enum>(1)</enum><text>any premises of an owner or operator of a chemical source described in subsection (a); and</text></paragraph> 
<paragraph id="HDD1B680E010A4C01927D82644779D0D"><enum>(2)</enum><text>any premises on which any record required to be maintained under subsection (a) is located.</text></paragraph></subsection> 
<subsection id="HB22D520D70324FCE8930646F99BE349B"><enum>(c)</enum><header>Requests for records</header><text>In carrying out this Act, the Secretary (or a designee) may require the submission of, or, on presentation of credentials, may at reasonable times seek access to and copy—</text> 
<paragraph id="H1872ABB3BFF24E73B1506826434EBF7D"><enum>(1)</enum><text>any records, reports, or other information described in subsection (a); and</text></paragraph> 
<paragraph id="H85D3D72FA5774EA6A845B08D3DA00A1"><enum>(2)</enum><text>any other documentation necessary for—</text> 
<subparagraph id="H689074E0E7094270B4230800E8E2AF03"><enum>(A)</enum><text>review or analysis of a vulnerability assessment or site security plan; or</text></subparagraph> 
<subparagraph id="HC053627328254604A208422E44F6426C"><enum>(B)</enum><text>implementation of a site security plan.</text></subparagraph></paragraph></subsection> 
<subsection id="HEA3F91608104487E8DFB380021813158"><enum>(d)</enum><header>Compliance</header><text>If the Secretary determines that an owner or operator of a chemical source is not maintaining, producing, or permitting access to records as required by this section, the Secretary may issue an order requiring compliance with the relevant provisions of this section.</text></subsection></section> 
<section id="HE48CF4E42FCC4BAF9FE926EDEDB61B7B"><enum>9.</enum><header>Integration with other authorities</header><text display-inline="no-display-inline">A chemical source that is required to prepare a facility vulnerability assessment and a facility security plan or emergency response plan under the provisions of <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/46/701">chapter 701</external-xref> of title 46, United States Code, or section 1433 of the Safe Drinking Water Act (<external-xref legal-doc="usc" parsable-cite="usc/42/300i-2">42 U.S.C. 300i-2</external-xref>) shall not be subject to the requirements of this Act, unless the owner or operator petitions the Secretary to be subject to the requirements of this Act in lieu of those established by such provisions.</text></section> 
<section id="HABEB216DBE364C8483744DC8E7BB68E1"><enum>10.</enum><header>Penalties</header> 
<subsection id="H5B9A28FAF8194A1297F622C8D2870003"><enum>(a)</enum><header>Judicial relief</header><text>Any owner or operator of a chemical source that violates or fails to comply with any order issued by the Secretary under this Act or a site security plan submitted to the Secretary under this Act (or, in the case of an exemption described in section 5(d), a procedure, protocol, or standard endorsed or recognized by the Secretary under section 5(c)) may, in a civil action brought in United States district court, be subject, for each day on which the violation occurs or the failure to comply continues, to—</text> 
<paragraph id="H0593DC5005ED4B959EDD5933B6300000"><enum>(1)</enum><text>an order for injunctive relief; or</text></paragraph> 
<paragraph id="H9D8FC62D56A04243B66DE4691FC66414"><enum>(2)</enum><text>a civil penalty of not more than $50,000.</text></paragraph></subsection> 
<subsection id="HA3052957F07340F6AE38CF796539A67C"><enum>(b)</enum><header>Administrative penalties</header> 
<paragraph id="H8DB13D7C9B8B4ABA844C9EF3FF2F01DA"><enum>(1)</enum><header>Penalty orders</header><text>The Secretary may issue an administrative penalty of not more than $250,000 for failure to comply with an order issued by the Secretary under this Act.</text></paragraph> 
<paragraph id="HC4B54C6AAE16490CB2944864BFF28787"><enum>(2)</enum><header>Notice and hearing</header><text>Before issuing an order described in paragraph (1), the Secretary shall provide to the person against which the penalty is to be assessed—</text> 
<subparagraph id="H95DD2DB8F4024037BFFE2663A92437DB"><enum>(A)</enum><text>written notice of the proposed order; and</text></subparagraph> 
<subparagraph id="HD8B116791FE345E089F181865F977682"><enum>(B)</enum><text>the opportunity to request, not later than 30 days after the date on which the person receives the notice, a hearing on the proposed order.</text></subparagraph></paragraph> 
<paragraph id="HA0954658AEA949E9B1D1E44C88230761"><enum>(3)</enum><header>Procedures</header><text>The Secretary may promulgate regulations outlining the procedures for administrative hearings and appropriate review, including necessary deadlines.</text></paragraph></subsection> 
<subsection id="HB625C3C00CB14085978B3FADD5BB9B"><enum>(c)</enum><header>Treatment of information in judicial proceedings</header><text>Information submitted to or obtained by the Secretary, information derived from that information, and information submitted by the Secretary under this Act shall be treated in any judicial or administrative action as if the information were classified material.</text></subsection></section> 
<section id="H34769F60E75F472BB53552BC035BD87B"><enum>11.</enum><header>Provision of training</header><text display-inline="no-display-inline">The Secretary may provide training to State and local officials and owners and operators in furtherance of the purposes of this Act.</text></section> 
<section id="HE07F9C37E08B4E83ADBBEE4CE3567718"><enum>12.</enum><header>Provision of assessments and response plans under safe drinking water act</header><text display-inline="no-display-inline">Section 1433 of the Safe Drinking Water Act (<external-xref legal-doc="usc" parsable-cite="usc/42/300i-2">42 U.S.C. 300i–2</external-xref>) is amended by adding at the end the following:</text> 
<quoted-block id="H4CAA0EB493134201996D48A07D496435" style="OLC"> 
<subsection id="H18FCA286EA894E3A8553E8BB287D14F"><enum>(f)</enum><header>Provision of assessments and response plans to Secretary of Homeland Security</header><text>Pursuant to section 202 of the Homeland Security Act of 2002 (<external-xref legal-doc="public-law" parsable-cite="pl/107/296">Public Law 107–296</external-xref>; <external-xref legal-doc="usc" parsable-cite="usc/6/122">6 U.S.C. 122</external-xref>), the Administrator shall, upon request by the Secretary of Homeland Security, provide to the Secretary any vulnerability assessment or emergency response plan received by the Administrator under this section.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></section> 
<section id="HFCAA6431D0FF4332883C13F59E4988BF"><enum>13.</enum><header>No effect on requirements under other law</header><text display-inline="no-display-inline">Except as provided in section 5(j), section 6(c), section 9, and section 12, nothing in this Act affects any duty or other requirement imposed under any other Federal or State law.</text></section>
