(c)In this Act:
(1)The term all-hazard event
means an emergency or disaster resulting from—
(A)a natural disaster; or
(B)an accident or intentional or negligent act that causes widespread damage or harm.
(2)The term children
means persons who have not attained the age of 18.
(3)The term effective public warning
means practical, comprehensible, and timely information given to all individuals threatened by an all-hazard event sufficient to enable them to act to protect their safety and well-being in a timely manner.
(4)Indian ocean tsunami; tsunamiThe term Indian Ocean tsunami
or tsunami
means the tsunami that resulted from the earthquake that occurred off the west coast of northern Sumatra, Indonesia, on December 26, 2004.
(5)The term orphan
means a child deprived by death of one or both parents.
(6)The term unaccompanied children
means children separated from their family.
2.Congress finds the following:
(1)On December 26, 2004, a powerful earthquake measuring 9.0 on the Richter Scale occurred off the west coast of northern Sumatra, Indonesia, triggering a tsunami that struck countries throughout South and Southeast Asia, as well as the coast of East Africa.
(2)The Indian Ocean tsunami caused death and destruction on a massive scale, with more than 200,000 people killed, more than 120,000 people missing, and displacing more than 1,000,000 people.
(3)The earthquake and tsunami affected more than 3,000,000 people in more than 11 countries many of whom now lack basic survival requirements and the risk of numerous additional deaths due to shortages of clean water, adequate shelter, food, sanitation, and basic healthcare remains.
(4)An estimated one-third of those individuals killed or affected by the Indian Ocean tsunami are children.
(5)Orphans and unaccompanied children are particularly vulnerable to disease, hunger, and exploitation.
(6)United States relief agencies and the United States military responded with immediate and significant emergency assistance that saved countless lives and provided relief to many individuals in great need in the aftermath of the Indian Ocean tsunami.
(7)Unprecedented levels of private United States donations to private relief organizations, at least $1,000,000,000 to date, demonstrate the tremendous generosity of the American people.
(8)The United States and the international community have to date pledged an estimated $6,400,000,000 in emergency and medium- and long-term reconstruction assistance for countries affected by the Indian Ocean tsunami.
(9)Numerous international nongovernmental organizations have contributed greatly to the humanitarian response by providing relief to the millions who survived the Indian Ocean tsunami.
(10)Some national governments, municipal governments, and local communities in the Indian Ocean region require assistance to provide basic services for their citizens, including for orphans and unaccompanied children.
(11)A number of organizations, including the United Nations Children’s Fund (UNICEF), Save the Children, World Vision, the International Committee of the Red Cross, and other organizations, are leading the effort to reunify children with their families, provide protection against traffickers, and provide food, shelter, education, counseling, and many other vital services.
(12)The International Early Warning Program identified the following four elements of effective early warning systems:
(A)Prior knowledge of the risks faced by communities.
(B)Technical monitoring of hazards.
(C)Getting understandable warnings to those at risk.
(D)Knowledge and preparedness of how to act by those threatened by disasters.
3.Congress makes the following declarations of policy:
(1)The large-scale destruction and loss of life caused by the Indian Ocean tsunami requires a robust and appropriate humanitarian response by the United States to assist and promote the relief and recovery of individuals and communities affected by the Indian Ocean tsunami.
(2)The United States is committed to providing assistance for the medium- and long-term relief of victims of the Indian Ocean tsunami and for the recovery and reconstruction of communities in countries affected by the tsunami.
(3)The United States is committed to working with international partners, including the United Nations, donor countries, international financial institutions, and international and indigenous nongovernmental organizations to assist in the medium- and long-term recovery and reconstruction of those communities in countries affected by the tsunami.
(4)The United States is committed to working with host governments, municipal governments, local communities, and local civil society organizations, in implementing immediate humanitarian assistance and medium- and long-term recovery and reconstruction assistance to ensure that priority needs are met.
(5)In areas of civil conflict, it shall be the policy of the United States to utilize civilian international and indigenous humanitarian relief organizations to the greatest extent possible in the direct implementation of disaster relief. Such policy requires the Government of the United States to urge the respective national governments to engage all relevant conflict parties to create an environment which promotes the safe and unimpeded access to the disaster region.
(6)It shall be the policy of the United States in civil conflict areas to prioritize its humanitarian assistance to the greatest extent possible toward the most vulnerable groups, including children, women, and persons with disabilities. Women and children in particular are at the greatest risk of being trafficked into extremely abusive situations, and frequently are forced to become combatants in a civil conflict.
4.The purposes of this Act are—
(1)to provide assistance for the urgent humanitarian needs of the people and communities in countries affected by the Indian Ocean tsunami;
(2)to provide assistance for the medium- and long-term recovery and reconstruction needs of the people and communities in countries affected by the Indian Ocean tsunami;
(3)to provide assistance to children who are orphaned or currently unaccompanied as a result of the Indian Ocean tsunami;
(4)to provide assistance for regional and international programs to develop and establish effective public warning systems in foreign countries in order to respond to all-hazard events; and
(5)to replenish United States Government funds that were expended to provide assistance in the immediate aftermath of the Indian Ocean tsunami so as to render such funds available for future foreign assistance objectives of the United States.
<enum>I</enum><header>Assistance for relief, recovery, and reconstruction of people and countries affected by the Indian Ocean tsunami </header>
<section id="H97846643C5E946EDA4FE61BB3F180599"><enum>101.</enum><header>Assistance for urgent humanitarian needs</header>
<subsection id="HE7E7E69D13FD4ECA84ABAEE87434B959"><enum>(a)</enum><header>Authorization</header><text display-inline="yes-display-inline">In accordance with the provisions of section 491 of the Foreign Assistance Act of 1961 (<external-xref legal-doc="usc" parsable-cite="usc/22/2292">22 U.S.C. 2292</external-xref>), the President is authorized to provide assistance, on such terms and conditions as the President may determine, to meet the urgent humanitarian needs of the people and communities in countries affected by the Indian Ocean tsunami.</text></subsection>
<subsection id="HF4EBC8F72E8141839DA3710035E58198"><enum>(b)</enum><header>Activities supported</header><text>Assistance provided under subsection (a) shall, to the maximum extent practicable, be used to provide—</text>
<paragraph id="H1FCFC048418A42D1AE8328968C4E92DF"><enum>(1)</enum><text>emergency food, shelter, and medical assistance;</text></paragraph>
<paragraph id="H6305503D47A549FE894790226C8B94EF"><enum>(2)</enum><text>clean drinking water and sanitation;</text></paragraph>
<paragraph id="HA88875A873CB4F08BBA607EFBAA461"><enum>(3)</enum><text display-inline="yes-display-inline">preventative health care, including childhood vaccination, therapeutic feeding, maternal child health services, psychosocial services, and infectious diseases surveillance and treatment;</text></paragraph>
<paragraph id="H170F212E98A140E0877C3DED759D5200"><enum>(4)</enum><text>family tracing and reunification services; and</text></paragraph>
<paragraph id="HC1E6FC802321431FB2B366A7992CDB89"><enum>(5)</enum><text display-inline="yes-display-inline">support for the recovery of economic livelihoods of families.</text></paragraph></subsection></section>
<section id="H2D646EDD3A0E47B499118FF5F45FF41"><enum>102.</enum><header>Assistance for medium- and long-term recovery and reconstruction</header>
<subsection id="H3B46CCA4D4464438A8D4F10723564C2E"><enum>(a)</enum><header>Authorization</header><text display-inline="yes-display-inline">In accordance with the provisions of part I of the Foreign Assistance Act of 1961 (<external-xref legal-doc="usc" parsable-cite="usc/22/2151">22 U.S.C. 2151 et seq.</external-xref>), the President is authorized to provide assistance, on such terms and conditions as the President may determine, to meet the medium- and long-term recovery and reconstruction needs of the people and communities in countries affected by the Indian Ocean tsunami.</text></subsection>
<subsection id="H8AA863A869BC41AE9F1B00DF2ADDD28"><enum>(b)</enum><header>Activities supported</header><text>Assistance provided under subsection (a) shall, to the maximum extent practicable, be used to carry out the following activities:</text>
<paragraph id="H408EE1D8FC8B455C81AAE26B3C3CBE57"><enum>(1)</enum><text display-inline="yes-display-inline">Rebuilding health clinics, hospitals, and other health infrastructure.</text> </paragraph>
<paragraph id="H0E895CA30A254427BDF5C3AC00FBA447"><enum>(2)</enum><text display-inline="yes-display-inline">Providing training and capacity-building assistance, with a particular emphasis on training and assistance for women and children.</text></paragraph>
<paragraph id="HA7DD8310A8F1499BB511C3FB01074C7E"><enum>(3)</enum><text display-inline="yes-display-inline">Restoring and rehabilitating water and sanitation services, including disease control services.</text></paragraph>
<paragraph id="HC6A13CC820B746E781A5AAB340F5D1F5"><enum>(4)</enum><text display-inline="yes-display-inline">Providing care and support to orphans and unaccompanied children.</text></paragraph>
<paragraph id="H987586C2790D4008AB8D49969F0041D0"><enum>(5)</enum><text display-inline="yes-display-inline">Rebuilding and re-equipping schools, community centers, and other social and educational facilities.</text></paragraph>
<paragraph id="H8E820C7451D046BFBA9B406DEA4E50A7"><enum>(6)</enum><text display-inline="yes-display-inline">Providing training and capacity-building assistance to educators and administrators, with a particular emphasis on training and assistance for women.</text> </paragraph>
<paragraph id="H8C397B3D928C41E8A7833686FD7FF95E"><enum>(7)</enum><text display-inline="yes-display-inline">Rebuilding the transportation infrastructure.</text></paragraph>
<paragraph id="HD8DF36DB34164B14BAB95719577C59EA"><enum>(8)</enum><text display-inline="yes-display-inline">Reconstructing the rural and urban infrastructure, with a particular emphasis on the reconstruction of roads and bridges.</text></paragraph>
<paragraph id="HCA7C806E3A444433AEAA337127E2CBE"><enum>(9)</enum><text display-inline="yes-display-inline">Rebuilding and restoring the agricultural infrastructure and productivity.</text></paragraph>
<paragraph id="H37370E7B3DC2485687781C63E4056EB3"><enum>(10)</enum><text display-inline="yes-display-inline">Promoting efforts to restore economic livelihoods supports, such as microenterprise and microfinance programs.</text></paragraph>
<paragraph id="H26773AC9C89A4F32A705E08871D0AF28"><enum>(11)</enum><text display-inline="yes-display-inline">Promoting environmental management.</text></paragraph>
<paragraph id="H928000C4824441739D62662EDD451C24"><enum>(12)</enum><text display-inline="yes-display-inline">Improving disaster preparedness and management systems.</text></paragraph>
<paragraph id="H34595F03C33640668217BF6004B25EA4"><enum>(13)</enum><text display-inline="yes-display-inline">Improving anti-corruption and transparency mechanisms.</text></paragraph></subsection>
<subsection id="H6E9CC86316D64610B189A9464F8E032B"><enum>(c)</enum><header>Targeting of assistance</header><text display-inline="yes-display-inline">In light of the unprecedented levels of private donations to relief organizations in response to the Indian Ocean tsunami, and in order to increase efficiency, avoid duplication, and coordinate the division of labor among assistance providers, the President should, to the maximum extent practicable—</text>
<paragraph id="HDB2E6490FD40433FBFD2C1848500C43B"><enum>(1)</enum><text display-inline="yes-display-inline">direct United States assistance under this section to activities and sectors that can provide a comparative advantage over privately-funded assistance, including such sectors as physical infrastructure and private sector recovery; and</text></paragraph>
<paragraph id="HCF5351D34E904954AF4D14EC1390DBE5"><enum>(2)</enum><text display-inline="yes-display-inline">design the delivery of United States assistance under this section to make a significant improvement in the performance and the long-term sustainability in the damaged sector targeted for assistance.</text></paragraph></subsection> </section>
<section id="HCFC8B937B30F42C8A24BB823C2D413DB" display-inline="no-display-inline" commented="no"><enum>103.</enum><header>Assistance for orphans and unaccompanied children</header>
<subsection id="HCF460E9253FB4051A8A546DB3348C255" commented="no"><enum>(a)</enum><header>Authorization</header><text display-inline="yes-display-inline">The President shall provide assistance to children who are orphaned or currently unaccompanied as a result of the Indian Ocean tsunami.</text></subsection>
<subsection id="H3A4AE480D6F34923AB08C9C600632F84" commented="no"><enum>(b)</enum><header>Activities supported</header><text>Assistance provided under subsection (a) should include programs to—</text>
<paragraph id="H33E84069258440E5BE65431C92F0B037" commented="no"><enum>(1)</enum><text>identify and register unaccompanied children and reunify them with their immediate families, or extended families, when necessary;</text></paragraph>
<paragraph id="HE4B2476C3ABB4C528FD75232D40002AC" commented="no"><enum>(2)</enum><text display-inline="yes-display-inline">provide immediate care and counseling for orphans and unaccompanied children during the identification and reunification process; </text></paragraph>
<paragraph id="HC94A858C1B6842638CC32DD56E4800E4" commented="no"><enum>(3)</enum><text display-inline="yes-display-inline">create mechanisms to protect against child trafficking, sexual abuse, and attempts to forcibly recruit children into militias; and</text></paragraph>
<paragraph id="H69BE2E70CAD543D087F2B2BFDE1B122C" commented="no"><enum>(4)</enum><text>provide for the long-term needs of children not reunified with immediate family. </text></paragraph></subsection>
<subsection id="H13E2D0ADA1BE4C5F9E838813EDEFC05C" commented="no"><enum>(c)</enum><header>Administrative provisions</header><text>In carrying out any programs under the terms of this section, the President shall—</text>
<paragraph id="H22FAE622F6EB4E46B3A1632166D55621" commented="no"><enum>(1)</enum><text>provide funds for projects to United States nongovernmental organizations, multilateral institutions, and international and indigenous nongovernmental organizations with expertise in caring for orphans and unaccompanied children;</text></paragraph>
<paragraph id="H6D4487C2648B4206A6FA09A3D061ED7D" commented="no"><enum>(2)</enum><text>require all governments and nongovernmental organizations that receive assistance under this section to agree to international standards on the treatment of orphans and children; and</text></paragraph>
<paragraph id="HAB1C0D513E154223ADEB64D87C7209F2" commented="no"><enum>(3)</enum><text>coordinate with other departments and agencies of the United States Government that have responsibilities related to child trafficking, child labor, and other issues related to orphans and unaccompanied children.</text></paragraph></subsection>
<subsection id="HF2F4BF758193426990005700B529DA41" commented="no"><enum>(d)</enum><header>Terms and conditions</header><text>Assistance under this section may be provided on such other terms and conditions as the President may determine.</text></subsection></section>
<section id="HC8E1AB797B624CDE983905BAE1A64BCC" section-type="subsequent-section" display-inline="no-display-inline"><enum>104.</enum><header>Voluntary contribution to Interpol for disaster victim identification efforts</header><text display-inline="no-display-inline">Of the amounts authorized to be appropriated to the Department of State for <quote>Voluntary Contributions to International Organizations</quote> for fiscal years 2005 and 2006, $500,000 for each such fiscal year is authorized to be appropriated for a United States contribution to Interpol for its disaster victim identification efforts relating to the Indian Ocean tsunami.</text></section>
<section id="H6D12E07E93864949BF50A9367C07FF21"><enum>105.</enum><header>Activities of the Overseas Private Investment Corporation</header><text display-inline="no-display-inline">It is the sense of Congress that the Overseas Private Investment Corporation should, in accordance with its development mandate and its commitment to fostering private investment and enhancing the ability of private enterprise to make its full contribution to the development process, exercise its authorities under title IV of chapter 2 of part I of the Foreign Assistance Act of 1961 (<external-xref legal-doc="usc" parsable-cite="usc/22/2191">22 U.S.C. 2191 et seq.</external-xref>) to further increase efforts to promote and support United States-sponsored private investment in countries affected by the Indian Ocean tsunami, including—</text>
<paragraph id="H6B9067EE721D446F8FA2956379184193"><enum>(1)</enum><text display-inline="yes-display-inline">issuing loans, guaranties, and insurance, to support infrastructure reconstruction, housing, small- and medium-sized enterprises, fishing and tourism, and other projects, as appropriate; and</text></paragraph>
<paragraph id="HAF0FD8AEE7724BE68DE32F36A1908B56"><enum>(2)</enum><text display-inline="yes-display-inline">undertaking a special initiative that includes—</text>
<subparagraph id="HC33FDDF83F484BD28FD6CE8D82E863CB"><enum>(A)</enum><text display-inline="yes-display-inline">carrying out an outreach program to involve United States businesses in the recovery process and exploring potential new public-private partnerships, supported by the Corporation, which will assist those affected countries; and</text></subparagraph>
<subparagraph id="H385C945E9D8D436E997C2E5E56323C33"><enum>(B)</enum><text display-inline="yes-display-inline">consulting and coordinating with host country governments and international financial institutions to promote private investment in priority sectors.</text></subparagraph></paragraph></section>
<section id="H9F2A74F5C13044F784B1E8E7E0956DB"><enum>106.</enum><header>Assistance for effective public warning systems in foreign countries</header>
<subsection id="H1598220612544E8A855D475FD4F0085"><enum>(a)</enum><header>Authorization</header><text display-inline="yes-display-inline">The President is authorized to provide assistance for regional and international programs, including providing such assistance through the United Nation’s International Early Warning Program to develop and establish effective public warning systems in foreign countries in order to respond to all-hazard events.</text></subsection>
<subsection id="HC5FA4004516F4582AC141FB22C070050"><enum>(b)</enum><header>Activities supported</header><text>Assistance provided under subsection (a) shall, to the maximum extent practicable, be used to—</text>
<paragraph id="H3B89969FDD6D45179FF95C3985B624F1"><enum>(1)</enum><text display-inline="yes-display-inline">develop monitoring technologies and systems;</text></paragraph>
<paragraph id="HA997C2FE56FA4C22819F16DB80D68C81"><enum>(2)</enum><text display-inline="yes-display-inline">establish communications infrastructure necessary to provide effective public warnings;</text></paragraph>
<paragraph id="HF5DAE124996A45F0863179B3A225F67C"><enum>(3)</enum><text display-inline="yes-display-inline">provide technical expertise and training to foreign countries about risk assessment procedures and the design and deployment of effective public warning systems;</text></paragraph>
<paragraph id="HE602B2F7C3C044738D1B46931EE58FA4"><enum>(4)</enum><text display-inline="yes-display-inline">establish public education campaigns that inform local populations about the proper ways to react to effective public warnings concerning all-hazard events so as to minimize the loss of life and property.</text></paragraph></subsection></section>
<section id="HA719BE9B7DA540068634B65F89129DD2" commented="no"><enum>107.</enum><header>Replenishment of funds expended for assistance in the immediate aftermath of the Indian Ocean tsunami</header>
<subsection id="HAA0CEDB059864AF18CF31840FCB68617"><enum>(a)</enum><header>Replenishment</header><text display-inline="yes-display-inline">From amounts available to carry out this Act, there is authorized to be appropriated to the President such sums as may be necessary to replenish funds expended under the provisions of law described in subsection (b) for assistance provided in the immediate aftermath of the Indian Ocean tsunami.</text></subsection>
<subsection id="H7D601200C75348DBBA97B8086C5E034"><enum>(b)</enum><header>Provisions of law</header><text>The provisions of law referred to in subsection (a) are the following:</text>
<paragraph id="H8EB78A56D2954BCC870594F4AAC04DF4" commented="no"><enum>(1)</enum><text>Chapter 9 of part I of the Foreign Assistance Act of 1961 (<external-xref legal-doc="usc" parsable-cite="usc/22/2292">22 U.S.C. 2292 et seq.</external-xref>; relating to international disaster assistance).</text></paragraph>
<paragraph id="H317F9E621664470F8CBD65FCAD1500F" commented="no"><enum>(2)</enum><text>Section 506 of the Foreign Assistance Act of 1961 (<external-xref legal-doc="usc" parsable-cite="usc/22/2318">22 U.S.C. 2318</external-xref>; relating to emergency drawdown authority).</text></paragraph>
<paragraph id="H761DEFD9949E42869C86CEB1B753FC9C" commented="no"><enum>(3)</enum><text display-inline="yes-display-inline">Title II of the Agricultural Trade Development and Assistance Act of 1954 (<external-xref legal-doc="usc" parsable-cite="usc/7/1721">7 U.S.C. 1721 et seq.</external-xref>; relating to emergency food assistance).</text></paragraph>

<enum>II</enum><header>General provisions</header>
<section id="H15A8FDD80A9F4BBAADFB62EE53195800"><enum>201.</enum><header>Coordination of assistance</header>
<subsection id="H2E83246D160244DFAC2F4D7558000250"><enum>(a)</enum><header>Coordination</header><text display-inline="yes-display-inline">The President, acting through the Secretary of State, shall consult and coordinate with the United Nations, international financial institutions, and governments of countries affected by the Indian Ocean tsunami in the implementation and delivery of assistance under title I of this Act to ensure that the priority needs identified by the governments of such countries are met.</text></subsection>
<subsection id="H807924A83542409CAF28D0D9393DFCDA"><enum>(b)</enum><header>Designation of senior government official</header><text display-inline="yes-display-inline">In order to ensure that assistance under title I of this Act is implemented in a transparent, efficient, and effective manner and targets those people and communities that are most in need, the President shall designate a senior official of the United States Government who shall be responsible for—</text>
<paragraph id="HCC4E5784D01E4F1A856673593FC0B349"><enum>(1)</enum><text>designing an overall strategy to define and advance the objectives of assistance under title I of this Act;</text></paragraph>
<paragraph id="H0D465E9DD90A484391CB69AD3FFD7FCF"><enum>(2)</enum><text>ensuring program and policy coordination among departments and agencies of the United States Government in carrying out the policies set forth in this Act;</text></paragraph>
<paragraph id="H22500E4A461A4FE4877F96EBC0F32A1"><enum>(3)</enum><text>coordinating with other countries and international organizations with respect to assistance authorized by this Act;</text></paragraph>
<paragraph id="HF2D03A7A29DC41FF8E17FDEEC49410A9"><enum>(4)</enum><text>ensuring proper management, implementation, and oversight by departments and agencies of the United States Government that are responsible for assistance programs authorized by this Act; and</text></paragraph>
<paragraph id="H2AA460E8E52E42EBA1E900F4CD47AAD"><enum>(5)</enum><text>resolving policy and program disputes among departments and agencies of the United States Government with respect to assistance authorized by this Act.</text></paragraph></subsection></section>
<section id="H8C60F2D0F2274EFCB4F7A5CDBB1C21D8"><enum>202.</enum><header>Implementation of assistance</header> <text display-inline="no-display-inline"> The Administrator of the United States Agency for International Development shall have primary responsibility for providing assistance under title I of this Act, under the overall foreign policy guidance of the Secretary of State.</text> </section>
<section id="H911125D4B2254FCD9C4354B89008991B"><enum>203.</enum><header>Monitoring of assistance</header>
<subsection id="H5059F7B80CE840BC9FAD2E93326BCAA9"><enum>(a)</enum><header>General authorities</header>
<paragraph id="H1209AC964B604F62A63E1E2BD8F98EA"><enum>(1)</enum><header>Comptroller General</header><text>The Comptroller General of the United States shall monitor the provision of assistance under this Act.</text></paragraph>
<paragraph id="H33F507ED9BEF429B8F7DD9466D096752"><enum>(2)</enum><header>Inspector General of usaid</header><text display-inline="yes-display-inline">The Inspector General of the United States Agency for International Development shall conduct audits, inspections, and other activities, as appropriate, associated with the expenditure of funds by the Agency—</text>
<subparagraph id="H0D6D469189284959ABF54FCEDDD729D4"><enum>(A)</enum><text display-inline="yes-display-inline">before the date of the enactment of this Act for assistance for the relief and recovery of victims of the Indian Ocean tsunami and for the reconstruction of tsunami-affected countries; and </text></subparagraph>
<subparagraph id="H315CCDFFA8B048109798F2713387EA34"><enum>(B)</enum><text>to carry out title I of this Act.</text></subparagraph></paragraph>
<paragraph id="HF7E903D0522F4BDCBFAA36438085BE62"><enum>(3)</enum><header>Inspector General of department of defense</header><text display-inline="yes-display-inline">The Inspector General of the Department of Defense shall conduct audits, inspections, and other activities, as appropriate, associated with the expenditure of funds by the Department of Defense before the date of the enactment of this Act for the relief and recovery of victims of the Indian Ocean tsunami.</text></paragraph></subsection>
<subsection id="H3538603C80894C328E42960097F8D25"><enum>(b)</enum><header>Transparency and monitoring mechanism</header>
<paragraph id="HAD17FB6BC3E84E39A740157B94E4A7D2"><enum>(1)</enum><header>In general</header><text>In order to ensure that assistance provided under title I of this Act is implemented in a transparent, efficient, and effective manner, and targets those people and communities who are most in need, the Secretary of State is authorized to establish a transparency and monitoring mechanism that meets the requirements of paragraph (2).</text></paragraph>
<paragraph id="H255187DFD21B4BA09536C88B685961A8"><enum>(2)</enum><header>Requirements</header><text>The requirements referred to in subsection (a) are the following:</text>
<subparagraph id="HE163CCC83F964B5C9656027879E2605B"><enum>(A)</enum><text display-inline="yes-display-inline">The mechanism shall monitor the coordination and integration of United States assistance with assistance from the international donor community. </text></subparagraph>
<subparagraph id="H4BBFDD9EB23249448B83FDC8F600B7CA"><enum>(B)</enum><text display-inline="yes-display-inline">The mechanism shall assess the implementation of assistance by the United Nations and international financial institutions.</text></subparagraph>
<subparagraph id="HE7A122F621D34A31A7F600BDFDC7DCE0"><enum>(C)</enum><text display-inline="yes-display-inline">The mechanism shall assess the efforts of the governments of tsunami-affected countries to ensure assistance adequately reaches affected communities. </text></subparagraph></paragraph></subsection> </section>
<section id="HE115146957324816A9D3E3ECE7DD816C"><enum>204.</enum><header>Relationship to other authorities</header><text display-inline="no-display-inline">The President is authorized to use authorities contained in other provisions of law to carry out the purposes of this Act, including chapter 1 of part I of the Foreign Assistance Act of 1961 (<external-xref legal-doc="usc" parsable-cite="usc/22/2151">22 U.S.C. 2151 et seq.</external-xref>), title II of the Agricultural Trade Development and Assistance Act of 1954 (<external-xref legal-doc="usc" parsable-cite="usc/7/1721">7 U.S.C. 1721 et seq.</external-xref>), the Food for Progress Act of 1985 (<external-xref legal-doc="usc" parsable-cite="usc/7/1736o">7 U.S.C. 1736o</external-xref>), and, with respect to United States military assistance, sections <external-xref legal-doc="usc" parsable-cite="usc/10/402">402</external-xref> and <external-xref legal-doc="usc" parsable-cite="usc/10/404">404</external-xref> of title 10, United States Code.</text></section>
<section id="HF76C209330294E9BA52EB8F4F6971649"><enum>205.</enum><header>Report</header>
<subsection id="HE303DA79FDCA4372B546B9F038869B65"><enum>(a)</enum><header>Report</header><text display-inline="yes-display-inline">Not later than 45 days after the date of enactment of this Act, and every 6 months thereafter until all amounts available to carry out this Act are obligated and expended, the President shall transmit to the Committee on International Relations of the House of Representatives and the Committee on Foreign Relations of the Senate a report on the implementation of this Act.</text></subsection>
<subsection id="H1507BBB17FFA4C4F81598DD34D1CD9B8"><enum>(b)</enum><header>Contents</header><text>The report shall include the following:</text>
<paragraph id="HEEA2CFE6DCC541FB84C4D98432B7250"><enum>(1)</enum><text>A description of the distribution of duties and responsibilities regarding activities authorized by this Act among departments and agencies of the United States Government, including the Department of State, the United States Agency for International Development, and the Department of Defense.</text></paragraph>
<paragraph id="H387342701E2B400C9EE9797C8366366F"><enum>(2)</enum><text display-inline="yes-display-inline">A detailed plan that describes the roles and responsibilities of foreign governments and international organizations, including the United Nations, in carrying out activities related to the relief and recovery of victims of the Indian Ocean tsunami and for the reconstruction of tsunami-affected countries.</text></paragraph>
<paragraph id="H691102CEE95F4B0E9945DEDC7D985EDD"><enum>(3)</enum><text>A strategy for the coordination of activities described in paragraphs (1) and (2) among the United States Government, foreign governments, and international organizations, including the United Nations.</text></paragraph>
<paragraph id="HFB52AE523BA74C79BAA570A705A7C4D"><enum>(4)</enum><text>An initial and revised estimates of the costs expected to be associated with such activities.</text></paragraph>
<paragraph id="H9B64D5FDAE0A46E69CCE0200E2A488FD"><enum>(5)</enum><text>A strategy for the distribution of the responsibility for paying costs associated with such activities among the United States Government, foreign governments, and international organizations, including the United Nations.</text></paragraph></subsection></section>
<section id="H3ED8CC9891984E94BA217BE3C3E9B86B"><enum>206.</enum><header>Authorization of appropriations</header>
<subsection id="HDFF333014A41450C8D2E6BCBD646C1E1"><enum>(a)</enum><header>In general</header><text>There is authorized to be appropriated to the President to carry out this Act $950,000,000 for fiscal year 2006.</text></subsection>
<subsection id="H3BE1F9BA781C4863AB522660EDDE27FE"><enum>(b)</enum><header>Availability</header><text display-inline="yes-display-inline">Amounts appropriated pursuant to the authorization of appropriations under subsection (a) are authorized to remain available until expended.</text></subsection></section>
