<official-title>To amend part D of title XVIII of the Social Security Act to improve the coordination of prescription drug coverage provided under retiree plans and State pharmaceutical assistance programs with the prescription drug benefit provided under the Medicare Program, and for other purposes.</official-title>

<section section-type="section-one" id="H2744E5C5EE324821931CBCE3522AC3" display-inline="no-display-inline"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Preserving Access to Affordable Drugs Act of 2005</short-title></quote>.</text></section> 
<section id="H5C0C9C93FA70432594DA469EB99271A"><enum>2.</enum><header>Elimination of discriminatory treatment of employer plans</header> 
<subsection id="HCC234D69B9D44896B04DCC9D4F3C58B4"><enum>(a)</enum><header>Elimination of true out-of-pocket limitation</header><text>Section 1860D–2(b)(4)(C) of the <act-name parsable-cite="SSA">Social Security Act</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/42/1395w-102">42 U.S.C. 1395w–102(b)(4)(C)</external-xref>) is amended to read as follows:</text> 
<quoted-block act-name="Social Security Act" id="H8DAFD8B77BEE493DBE4BE1D6354E117"> 
<subparagraph id="H9FC87603C65E48259350776FAA2EBCF6"><enum>(C)</enum><header>Application</header><text>In applying subparagraph (A), incurred costs shall only include costs incurred with respect to covered part D drugs for the annual deductible described in paragraph (1), for cost-sharing described in paragraph (2), and for amounts for which benefits are not provided because of the application of the initial coverage limit described in paragraph (3).</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection> 
<subsection id="HCCF095DA3F2C4BBEAD5C3861FA25DA94"><enum>(b)</enum><header>Equalization of subsidies</header><text>Notwithstanding any other provision of law, the Secretary of Health and Human Services shall provide for such increase in the special subsidy payment amounts under section 1860D–22(a)(3) of the <act-name parsable-cite="SSA">Social Security Act</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/42/1395w-132">42 U.S.C. 1395w–132(a)(3)</external-xref>) as may be appropriate to provide for payments in the aggregate equivalent to the payments that would have been made under section 1860D–15 of such Act if the individuals were not enrolled in a qualified retiree prescription drug plan. In making such computation, the Secretary shall not take into account the application of the amendments made by section 1202 of the Medicare Prescription Drug, Improvement, and Modernization Act of 2003 (<external-xref legal-doc="public-law" parsable-cite="pl/108/173">Public Law 108–173</external-xref>; 117 Stat. 2480).</text></subsection></section> 
<section id="H60B51A94150A43A8BE65FCD545184862"><enum>3.</enum><header>Direct subsidy for certain State Pharmaceutical Assistance Programs</header><text display-inline="no-display-inline">Part D of title XVIII of the <act-name parsable-cite="SSA">Social Security Act</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/42/1395w-101">42 U.S.C. 1395w–101 et seq.</external-xref>) is amended by inserting after section 1860D–23 the following new section:</text>

<section id="H4C49B1346416464CAAA7066945E26F6" display-inline="no-display-inline"><enum>1860D–23A.</enum><header>Direct subsidies for certain State Pharmaceutical Assistance Programs</header> 
<subsection display-inline="yes-display-inline" id="HBBD37E4ED3154882B000EE7164460302"><enum>(a)</enum><header>Direct subsidy</header> 
<paragraph id="H5A7459751C1A4564944F004CDC4E553" display-inline="no-display-inline"><enum>(1)</enum><header>In general</header><text>The Secretary shall provide for the payment to a State offering a State pharmaceutical assistance program described in section 1860D–23(b)(1) for each individual who is eligible for, but not enrolled in, a prescription drug plan or MA–PD plan under this part, and who is enrolled in such program for each month for which such individual is so enrolled.</text></paragraph> 
<paragraph id="H8CD1418CF8A6402E8711E5F3C637F59F"><enum>(2)</enum><header>Amount of payment</header> 
<subparagraph id="H383DED82720345639E059F61716325AF" display-inline="yes-display-inline"><enum></enum><text>The amount of the payment under paragraph (1) shall be an amount equal to the special subsidy payment amount determined under section 1860D–22(a)(3) for a qualifying covered retiree for a coverage year enrolled with the sponsor of a qualified retiree prescription drug plan.</text></subparagraph></paragraph></subsection> 
<subsection id="H7C0BEBE9481E45029779AF447839572D"><enum>(b)</enum><header>Additional subsidy</header> 
<paragraph id="H966AE421ED0B49C5AF9C99EC3BF8EBE3"><enum>(1)</enum><header>In general</header><text>The Secretary shall provide for the payment to a State offering a State pharmaceutical assistance program described in section 1860D–23(b)(1) for each applicable low-income individual enrolled in the program for each month for which such individual is so enrolled.</text></paragraph> 
<paragraph id="HA3E82FFEBD7D476ABEE32484644DF9C"><enum>(2)</enum><header>Amount of payment</header> 
<subparagraph id="H28E458723ED94F149B2441D5A91DEEFE"><enum>(A)</enum><header>In general</header><text>The amount of the payment under paragraph (1) shall be the amount the Secretary estimates would have been made to a prescription drug plan or MA–PD plan under section 1860D–14 with respect to the applicable low-income individual if such individual was enrolled in such a plan.</text></subparagraph> 
<subparagraph id="H9A52DAAE78DC496B9E5D1E282278B2B9"><enum>(B)</enum><header>Maximum payments</header><text>In no case may the amount of the payment determined under subparagraph (A) with respect to an applicable low-income individual exceed, as estimated by the Secretary, the average amount paid in a year under section 1860D–14 on behalf of a subsidy eligible individual (as defined in section 1860D–14(a)(3)(A)) with income that is the same as the income of the applicable low-income individual.</text></subparagraph></paragraph> 
<paragraph id="H68ACF7FAE02643208372FCEC0096B882"><enum>(3)</enum><header>Applicable low-income individual</header><text>For purposes of this subsection, the term <term>applicable low-income individual</term> means an individual who—</text> 
<subparagraph id="H577570394A16425F8E02F176E2E55C0"><enum>(A)</enum><text>is eligible for, but not enrolled in, a prescription drug plan or MA–PD plan under this part, and who is enrolled in a State pharmaceutical assistance program described in section 1860D–23(b)(1); and</text></subparagraph> 
<subparagraph id="H8E8A7A0A84D74B89896CD203511697E4"><enum>(B)</enum><text>would be a subsidy eligible individual (as defined in section 1860D–14(a)(3)(A)) if the individual were enrolled in such a plan.</text></subparagraph></paragraph></subsection> 
<subsection id="H9FF2FF2460B4451886E08730BCA7EA10"><enum>(c)</enum><header>Payment methods</header> 
<paragraph id="HB51E7A93F86D490288F851009D13DAC4"><enum>(1)</enum><header>In general</header><text>Payments under this section shall be based on such a method as the Secretary determines. The Secretary may establish a payment method by which interim payments of amounts under this section are made during a year based on the Secretary’s best estimate of amounts that will be payable after obtaining all of the information.</text></paragraph> 
<paragraph id="HA942AF8CAD7E4FFDAE72ED2BFCF6E17"><enum>(2)</enum><header>Source of payments</header><text>Payments under this section shall be made from the Medicare Prescription Drug Account.</text></paragraph></subsection> 
<subsection id="HC9178E643C674055AE3669952BFAA5B"><enum>(d)</enum><header>Construction</header><text>Nothing in this section, section 1860D–23, or section 1860D–24 shall be construed as requiring a prescription drug plan or MA–PD plan to coordinate coverage provided under such plan with coverage provided under a State pharmaceutical assistance program described in section 1860D–23(b)(1) that is operated by a State which receives a payment under this section.</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></section> 
<section id="HC7694BA6526E42B1AD35883ED45B8901"><enum>4.</enum><header>Facilitation of coordination</header><text display-inline="no-display-inline">Section 1860D–24(c)(1) of the <act-name parsable-cite="SSA">Social Security Act</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/42/1395w-134">42 U.S.C. 1395w–134(c)(1)</external-xref>) is amended by striking <quote>all methods of operation</quote> and inserting <quote>its own methods of operation, except that a PDP sponsor or MA organization may not require a State Pharmaceutical Assistance Program or an RX plan described in subsection (b) to apply such tools when coordinating benefits</quote>.</text></section> 
<section id="H264CEBEB5B174E9B84EFA9856DF2F396"><enum>5.</enum><header>Allowing medicaid wrap</header><text display-inline="no-display-inline">Section 1935 of the <act-name parsable-cite="SSA">Social Security Act</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/42/1396u-5">42 U.S.C. 1396u–5</external-xref>) is amended by striking subsection (d).</text></section> 
<section id="H95BEE5C366CE45E897DDEEC87F3BFC94"><enum>6.</enum><header>Repeal of comparative cost adjustment program</header><text display-inline="no-display-inline">Subtitle E of title II of of the Medicare Prescription Drug, Improvement, and Modernization Act of 2003 (<external-xref legal-doc="public-law" parsable-cite="pl/108/173">Public Law 108–173</external-xref>) is repealed and any provisions of law amended by such subtitle are restored as if such subtitle had not been enacted.</text></section> 
<section id="H73AAAC4A82E142F3ABFBBC6B3EB84353"><enum>7.</enum><header>Provision of wrap-around prescription drug coverage through medigap</header><text display-inline="no-display-inline">Section 1882(v) of the <act-name parsable-cite="SSA">Social Security Act</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/42/1395ss">42 U.S.C. 1395ss(v)</external-xref>) is amended as follows:</text> 
<paragraph id="H00D3441A86644D8893BD0032DC409D94"><enum>(1)</enum><text>In paragraph (1)(A), by inserting <quote>, other than such a policy that provides wrap-around prescription drug coverage included within a range of such coverage approved under subparagraph (D)(ii),</quote> after <quote>paragraph (6)(A))</quote>.</text></paragraph> 
<paragraph id="H3ABADAA471F141B2831EA37373B1FC9D"><enum>(2)</enum><text>Add at the end of paragraph (1) the following new subparagraph:</text>

<subparagraph id="H882234E54CC9473E9259220787D154FB"><enum>(D)</enum><header>Wrap-around prescription drug coverage</header> 
<clause id="H76A4DF4249D74D4B928EE595484F7834"><enum>(i)</enum><header>In general</header><text>Notwithstanding any other provision of this subsection, a medigap Rx policy that provides wrap-around prescription drug coverage included within a range of such coverage approved by the Secretary under clause (ii) may be offered to part D enrollees.</text></clause> 
<clause id="HCFEBCD86529744D3A22C65DE18087013"><enum>(ii)</enum><header>Development of standards</header><text>The Secretary shall approve a range of wrap-around prescription drug coverage that may be offered under this subparagraph to part D enrollees.</text></clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section> 
<section id="HE256A300AF8C49909B53DDB901CFBFDF"><enum>8.</enum><header>Effective date</header><text display-inline="no-display-inline">The amendments made by this Act, and the repeal made by section 6, shall take effect as if included in the enactment of the Medicare Prescription Drug, Improvement, and Modernization Act of 2003 (<external-xref legal-doc="public-law" parsable-cite="pl/108/173">Public Law 108–173</external-xref>).</text></section>
