<legis-type>A BILL</legis-type> 
<official-title>To amend the Foreign Intelligence Surveillance Act of 1978 and title 18, United States Code, to strengthen protections of civil liberties in the exercise of the foreign intelligence surveillance authorities under Federal law, and for other purposes.</official-title> 
</form> 
<legis-body id="HCBDD716DFECC4F3182E199E3985B00B0" style="OLC"> 
<section section-type="section-one" id="H2D5F1641169D4108ABEF1F10C54141FE" display-inline="no-display-inline"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Security and Freedom Ensured Act of 2005 (SAFE) Act</short-title></quote>.</text></section> 
<section id="H7050FB15FD04479087089F192220EEB"><enum>2.</enum><header>Limitation on roving wiretaps under Foreign Intelligence Surveillance Act of 1978</header><text display-inline="no-display-inline">Section 105(c) of the Foreign Intelligence Surveillance Act of 1978 (<external-xref legal-doc="usc" parsable-cite="usc/50/1805">50 U.S.C. 1805(c)</external-xref>) is amended—</text> 
<paragraph id="H7A3BC35EC72046E4A8967DA5C096AD5D"><enum>(1)</enum><text>in paragraph (1)—</text> 
<subparagraph id="HE12FCFDF48904D98A997003067E098E5"><enum>(A)</enum><text>in subparagraph (A), by inserting before the semicolon the following: <quote>, however, if the identity is unknown, the facilities and places shall be specified</quote>; and</text></subparagraph> 
<subparagraph id="H3AF7FD1A2CC7437BB97BAED8AF651CB6"><enum>(B)</enum><text>in subparagraph (B), by inserting before the semicolon the following: <quote>, however, if any of the facilities or places are unknown, the identity of the target shall be specified</quote>; and</text></subparagraph></paragraph> 
<paragraph id="HB68292FBAB374BF593877401BB4F99DB"><enum>(2)</enum><text>in paragraph (2)(A), by inserting before the semicolon the following: <quote>, and, in cases where the facility or place at which the surveillance is to be directed is not known at the time the order is issued, that the surveillance be conducted only when the presence of the target at a particular facility or place has been ascertained by the person conducting the surveillance</quote>.</text></paragraph></section> 
<section id="HE638DD59E52F453FA97CB31C353B674B"><enum>3.</enum><header>Limitation on authority to delay notice of search warrants</header><text display-inline="no-display-inline"><external-xref legal-doc="usc" parsable-cite="usc/18/3103a">Section 3103a</external-xref> of title 18, United States Code, is amended—</text> 
<paragraph id="H9142E3C846354FF3B66600734142233D"><enum>(1)</enum><text>in subsection (b)—</text> 
<subparagraph id="H6939C09CFC5F4E5400BFC53FF889876"><enum>(A)</enum><text>in paragraph (1), by striking <quote>may have an adverse result (as defined in section 2705)</quote> and inserting <quote>will endanger the life or physical safety of an individual, result in flight from prosecution or the intimidation of a potential witness, or result in the destruction of or tampering with the evidence sought under the warrant</quote>; and</text></subparagraph> 
<subparagraph id="HA8F7328A33704A72BBA642E10723FE"><enum>(B)</enum><text>in paragraph (3), by striking <quote>a reasonable period</quote> and all that follows and inserting <quote>seven calendar days, which period, upon application of the Attorney General, the Deputy Attorney General, or an Associate Attorney General, may thereafter be extended by the court for additional periods of up to 21 calendar days each if the court finds, for each application, reasonable cause to believe that notice of the execution of the warrant will endanger the life or physical safety of an individual, result in flight from prosecution, or result in the destruction of or tampering with the evidence sought under the warrant.</quote>; and</text></subparagraph></paragraph> 
<paragraph id="H52AF10EFCF4A4593849F3262612B14AA"><enum>(2)</enum><text>by adding at the end the following new subsection:</text> 
<quoted-block id="HE90C390F15034C4A9B48AE1633F7DFE9"> 
<subsection id="H62DCAE2217B4474C00B4D2C6D33EE01"><enum>(c)</enum><header>Reports</header> 
<paragraph display-inline="yes-display-inline" id="H22F69B4810E847ED843F91ACF8B0BF97"><enum>(1)</enum><text>On a semiannual basis, the Attorney General shall transmit to Congress and make public a report concerning all requests for delays of notice, and for extensions of delays of notice, with respect to warrants under subsection (b).</text></paragraph> 
<paragraph indent="up1" id="H6A7C3D19EF004B6CA3D7CCD540CDEF26"><enum>(2)</enum><text>Each report under paragraph (1) shall include, with respect to the preceding six-month period—</text> 
<subparagraph id="H9A7D32E896F34781AA3458DE004CACBC"><enum>(A)</enum><text>the total number of requests for delays of notice with respect to warrants under subsection (b);</text></subparagraph> 
<subparagraph id="H5F669602998645BB9C00983324F63B8F"><enum>(B)</enum><text>the total number of such requests granted or denied; and</text></subparagraph> 
<subparagraph id="H54CC4EA3F8B74F2FB00020C2C4E2AFFD"><enum>(C)</enum><text>for each request for delayed notice that was granted, the total number of applications for extensions of the delay of notice and the total number of such extensions granted or denied.</text></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section> 
<section id="H911CE02C8E894E55BB40C28DD526F37F"><enum>4.</enum><header>Privacy protections for library, bookseller, and other personal records under Foreign Intelligence Surveillance Act of 1978</header> 
<subsection id="H536BD4344F2D4D6E9EEA3B9F864C8E20"><enum>(a)</enum><header>Applications for orders</header><text>Subsection (b) of section 501 of the Foreign Intelligence Surveillance Act of 1978 (<external-xref legal-doc="usc" parsable-cite="usc/50/1861">50 U.S.C. 1861</external-xref>) is amended—</text> 
<paragraph id="HB3419442D093444389E04CDE58C9E96"><enum>(1)</enum><text>in paragraph (1), by striking <quote>and</quote> at the end;</text></paragraph> 
<paragraph id="H2AC081718A4A43EDB3B0B8DC258ECAE1"><enum>(2)</enum><text>in paragraph (2), by striking the period at the end and inserting <quote>; and</quote>; and</text></paragraph> 
<paragraph id="HF4957B08C5FA40A680A9F72CE2C0746D"><enum>(3)</enum><text>by adding at the end the following new paragraph:</text> 
<quoted-block id="H31D23E4F869E4783BABCB343C65C40A3"> 
<paragraph id="HA675765D14FB4472A4D82913675573BC"><enum>(3)</enum><text>shall specify that there are specific and articulable facts giving reason to believe that the person to whom the records pertain is a foreign power or an agent of a foreign power.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection> 
<subsection id="HF48EB1DB42684924B99C00EA00FA8BAF"><enum>(b)</enum><header>Orders</header><text>Subsection (c)(1) of that section is amended by striking <quote>finds</quote> and all that follows and inserting</text> 
<quoted-block display-inline="yes-display-inline" id="HFE271C641B604129ABF480B75B07644B"><text>finds that—</text> 
<subparagraph indent="up1" id="H30B5C0C9B40B46218F9C2DCE52EB6074"><enum>(A)</enum><text>there are specific and articulable facts giving reason to believe that the person to whom the records pertain is a foreign power or an agent of a foreign power; and</text></subparagraph> 
<subparagraph indent="up1" id="HF64238CFB633414880ABD5F573AE498"><enum>(B)</enum><text>the application meets the other requirements of this section.</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection> 
<subsection id="HB74B3C42969A487DA967FFAE07F8036"><enum>(c)</enum><header>Oversight of requests for production of records</header><text>Section 502 of that Act (<external-xref legal-doc="usc" parsable-cite="usc/50/1862">50 U.S.C. 1862</external-xref>) is amended—</text> 
<paragraph id="H4230EFE6B4BA48999F47CB020339E44"><enum>(1)</enum><text>in subsection (a), by striking <quote>the Permanent</quote> and all that follows through <quote>the Senate</quote> and inserting <quote>the Permanent Select Committee on Intelligence and the Committee on the Judiciary of the House of Representatives and the Select Committee on Intelligence and the Committee on the Judiciary of the Senate</quote>; and</text></paragraph> 
<paragraph id="H41734D6903ED4F489255EE7848D3ACCF"><enum>(2)</enum><text>in subsection (b), by striking <quote>On a semiannual basis,</quote> and all that follows through <quote>a report setting forth</quote> and inserting <quote>The report of the Attorney General to the Permanent Select Committee on Intelligence and the Committee on the Judiciary of the House of Representatives and the Select Committee on Intelligence and the Committee on the Judiciary of the Senate under subsection (a) shall set forth</quote>.</text></paragraph></subsection></section> 
<section id="HD36599582532422C890009ABDB5DBF06"><enum>5.</enum><header>Privacy protections for computer users at libraries under national security authority</header><text display-inline="no-display-inline"><external-xref legal-doc="usc" parsable-cite="usc/18/2709">Section 2709</external-xref> of title 18, United States Code, is amended—</text> 
<paragraph id="H7A70084B462D47D598257CD8C34DA732"><enum>(1)</enum><text>in subsection (a)—</text> 
<subparagraph id="H7EC7DB2EBF794A6DB4F090FD137908B8"><enum>(A)</enum><text>by inserting <quote>(1)</quote> before <quote>A wire or electronic communication service provider</quote>; and</text></subparagraph> 
<subparagraph id="H82C5EA5D169E4CB395F6C3DB265EAD84"><enum>(B)</enum><text>by adding at the end the following new paragraph:</text> 
<quoted-block id="H7022B91475B4464D9E47D2C39569FD4E"> 
<paragraph id="H9EB15ED68E3C4312B8231278FF2E487E"><enum>(2)</enum><text>A library shall not be treated as a wire or electronic communication service provider for purposes of this section.</text></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph></paragraph> 
<paragraph id="HE9EF5994DFE2459D8926004B959E08B2"><enum>(2)</enum><text>by adding at the end the following new subsection:</text>

<subsection id="H8ABD2C53802543EDB5EE94EC80C89DAE"><enum>(f)</enum><header>Library defined</header><text>In this section, the term <term>library</term> means a library (as that term is defined in section 213(2) of the Library Services and Technology Act (<external-xref legal-doc="usc" parsable-cite="usc/20/9122">20 U.S.C. 9122(2)</external-xref>) whose services include access to the Internet, books, journals, magazines, newspapers, or other similar forms of communication in print or digitally to patrons for their use, review, examination, or circulation.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section> 
<section id="H3F3BD515F29F4F5791069EB5CC865D2F"><enum>6.</enum><header>Modification of definition of domestic terrorism</header> 
<subsection id="H7052A36256E34525940066F844B489F9"><enum>(a)</enum><header>Modification</header><text><external-xref legal-doc="usc" parsable-cite="usc/18/2331">Section 2331(5)</external-xref> of title 18, United States Code, is amended—</text> 
<paragraph id="H8CA34BDD0CBC4EB7896C55B9EEC8C341"><enum>(1)</enum><text>by striking subparagraphs (A) and (B) and inserting the following new subparagraph (A):</text> 
<quoted-block id="H5566D832FC464E57AEC4361418397805"> 
<subparagraph id="H23F9F13F319D4BE38BE35B873059778"><enum>(A)</enum><text>involve acts dangerous to human life that constitute a Federal crime of terrorism (as that term is defined in section 2332b(g)(5) of this title); and</text></subparagraph><after-quoted-block>; and</after-quoted-block></quoted-block></paragraph> 
<paragraph id="H4F3C9E3F7D03469786195494D69D1313"><enum>(2)</enum><text>by redesignating subparagraph (C) as subparagraph (B).</text></paragraph></subsection> 
<subsection id="H0C162CF9BF5B447783693DDC649CD068"><enum>(b)</enum><header>Construction</header><text>Nothing in <external-xref legal-doc="usc" parsable-cite="usc/18/2331">section 2331</external-xref> of title 18, United States Code, shall be construed to prohibit a State from enforcing the laws of the State relating to terrorism.</text></subsection></section> 
<section id="H6BD5B94261F24FFD965474772FD16912"><enum>7.</enum><header>Extension of patriot sunset provision</header><text display-inline="no-display-inline">Section 224(a) of the USA PATRIOT ACT of 2001 (<external-xref legal-doc="public-law" parsable-cite="pl/107/56">Public Law 107–56</external-xref>; 115 Stat. 295) is amended—</text> 
<paragraph id="H4627345BFB294D4788BE2C2165A796D"><enum>(1)</enum><text>by striking <quote>213, 216, 219,</quote>; and</text></paragraph> 
<paragraph id="HA644E657794C4A4DBCD59153B57BAC1B"><enum>(2)</enum><text>by inserting <quote>and section 505</quote> after <quote>by those sections)</quote>.</text></paragraph></section>
