<official-title>To amend the Internal Revenue Code of 1986 to deny all deductions for business expenses associated with the use of a club that discriminates on the basis of sex, race, or color.</official-title>

<section section-type="section-one" id="H8B10C51AB78F44689E5BCE99897BD705" display-inline="no-display-inline"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Ending Tax Breaks for Discrimination Act of 2005</short-title></quote>.</text></section> 
<section id="HEE2332C93EF144AE95885D02D7765EBA"><enum>2.</enum><header>Denial of deduction for business expenses for use of club that discriminates on basis of sex, race, or color</header> 
<subsection id="HD4ABD454C9964E34B6A9E470505BDB91"><enum>(a)</enum><header>In general</header><text><external-xref legal-doc="usc" parsable-cite="usc/26/162">Section 162</external-xref> of the Internal Revenue Code of 1986 (relating to trade or business expenses) is amended by redesignating subsection (q) as subsection (r) and by inserting after subsection (p) the following new subsection:</text>

<subsection id="H88FE3BE7AA5347D08B63C468480081E5"><enum>(q)</enum><header>Denial of deduction for use of club that discriminates on basis of sex, race, or color; denial of deduction for certain advertising expenses</header> 
<paragraph id="HBD75CB4180084239B5ED61F7BF7C0020"><enum>(1)</enum><header>In general</header><text>No deduction shall be allowed under this section for any amount paid or incurred—</text> 
<subparagraph id="HEF083C0F15A9405CAD02C1BF9875CA9"><enum>(A)</enum><text>to any private discriminatory club,</text></subparagraph> 
<subparagraph id="H57E3503BE4184F95993F92C800FFF0A6"><enum>(B)</enum><text>for the use of services or facilities of any private discriminatory club, or</text></subparagraph> 
<subparagraph id="HCFA1FF052B3842B086FE14C0D93E3975"><enum>(C)</enum><text>for transportation, meals, lodging, and other traveling expenses (not described in subparagraph (A) or (B)) incurred in connection with such use.</text></subparagraph></paragraph> 
<paragraph id="H0CA442DBE089488D97089856D9376C33"><enum>(2)</enum><header>Advertising expenses</header><text>No deduction shall be allowed under this section for any amount paid or incurred for—</text> 
<subparagraph id="HE8E421029C0140BBA61788DC121CA637"><enum>(A)</enum><text>advertising of any event held at any facility of a discriminatory club, or</text></subparagraph> 
<subparagraph id="HB4D0E7A2B00E46788E71590086F1BA18"><enum>(B)</enum><text>advertising for any product or service if the advertising occurs on any broadcast media during, or in association with, such media’s coverage of any such an event.</text></subparagraph></paragraph> 
<paragraph id="H44152A53650A4C00ACAA7B1EC05B4EDF"><enum>(3)</enum><header>Private discriminatory club</header><text>For purposes of this subsection, the term <term>private discriminatory club</term> means any club organized for business, pleasure, recreation, or other social purpose if such club restricts its membership or the use of its services or facilities on the basis of sex, race, or color.</text></paragraph> 
<paragraph id="HC29A0792818D4EABA50064009B685241"><enum>(4)</enum><header>Receipts to State nondeductibility of expenses</header><text>All receipts for any expense which is not allowed as a deduction under this section by reason of subsection (a) shall include the following statement: <quote>The expenditures covered by this receipt are nondeductible for Federal income tax purposes.</quote> </text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection> 
<subsection id="H1D74FC6A1C554340BE0780F4EB9464B3"><enum>(b)</enum><header>Effective date</header><text>The amendments made by this section shall apply to amounts paid or incurred after the date of the enactment of this Act.</text></subsection></section>
