<official-title>To amend the Internal Revenue Code of 1986 to repeal the 1993 income tax increase on Social Security benefits.</official-title>

<section section-type="section-one" id="H99DEA5343CF748D2B25E7251114375A0" display-inline="no-display-inline"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Social Security Benefits Tax Relief Act of 2005</short-title></quote>.</text></section> 
<section id="HDA9585F0129A4034BFC068F8268881C9"><enum>2.</enum><header>Repeal of 1993 income tax increase on Social Security benefits</header> 
<subsection id="HEBEC699237914E788DD54F60DBC61BAB"><enum>(a)</enum><header>Restoration of prior law formula</header><text>Subsection (a) of <external-xref legal-doc="usc" parsable-cite="usc/26/86">section 86</external-xref> of the Internal Revenue Code of 1986 is amended to read as follows:</text> 
<quoted-block id="H87721327CDFF4CA1B70300C1A07B6B6D"> 
<subsection id="HC3A1ECD342C249FF92CE4275C8222F82"><enum>(a)</enum><header>In general</header><text>Gross income for the taxable year of any taxpayer described in subsection (b) (notwithstanding section 207 of the <act-name parsable-cite="SSA">Social Security Act</act-name>) includes Social Security benefits in an amount equal to the lesser of—</text> 
<paragraph id="HBF9BB09F7B624D1DBB79E7540775C42C"><enum>(1)</enum><text>one-half of the Social Security benefits received during the taxable year, or</text></paragraph> 
<paragraph id="H5CC40A48336B4496BA8D5B46AED3E5E7"><enum>(2)</enum><text>one-half of the excess described in subsection (b)(1).</text></paragraph></subsection><after-quoted-block></after-quoted-block></quoted-block></subsection> 
<subsection id="HDCADF63E27444E309669743D3094F4EE"><enum>(b)</enum><header>Repeal of adjusted base amount</header><text>Subsection (c) of section 86 of such Code is amended to read as follows:</text>

<subsection id="H59B7A2A6419740FFA8793B7BC6CCD8E4"><enum>(c)</enum><header>Base amount</header><text>For purposes of this section, the term <term>base amount</term> means—</text> 
<paragraph id="H928637EE46AC476088D600B6449D5FDC"><enum>(1)</enum><text>except as otherwise provided in this subsection, $25,000,</text></paragraph> 
<paragraph id="HDD0D674AAA734582BEE58132B1799E8"><enum>(2)</enum><text>$32,000 in the case of a joint return, and</text></paragraph> 
<paragraph id="H9E912AC3B9D24287AD595CEC98C6BFE"><enum>(3)</enum><text>zero in the case of a taxpayer who—</text> 
<subparagraph id="H61C4F0BA25974199AAD71E2576B89945"><enum>(A)</enum><text>is married as of the close of the taxable year (within the meaning of section 7703) but does not file a joint return for such year, and</text></subparagraph> 
<subparagraph id="H5A55B7C6F4074EFFB7AD018DAEB92132"><enum>(B)</enum><text>does not live apart from his spouse at all times during the taxable year.</text></subparagraph></paragraph></subsection><after-quoted-block></after-quoted-block></quoted-block></subsection> 
<subsection id="H75E8EB740303446B9F66AE78CC707B1"><enum>(c)</enum><header>Conforming amendments</header> 
<paragraph id="HE31EFF8625F946E10093D7F7796B57D5"><enum>(1)</enum><text>Subparagraph (A) of section 871(a)(3) of such Code is amended by striking <quote>85 percent</quote> and inserting <quote>50 percent</quote>.</text></paragraph> 
<paragraph id="H1EDA1902A8EF4639971B00E3C717E230"><enum>(2)</enum> 
<subparagraph display-inline="yes-display-inline" id="H9EC219C49A33437C97109B736F66075D"><enum>(A)</enum><text>Subparagraph (A) of section 121(e)(1) of the Social Security Amendments of 1983 (<external-xref legal-doc="public-law" parsable-cite="pl/98/21">Public Law 98–21</external-xref>) is amended—</text> 
<clause indent="up1" id="HEF22CA7C9007454B84794B993DC0B570"><enum>(i)</enum><text>by striking <quote>(A) There</quote> and inserting <quote>There</quote>;</text></clause> 
<clause indent="up1" id="H05408FD4212449D8A000A44EDA428B63"><enum>(ii)</enum><text>by striking <quote>(i)</quote> immediately following <quote>amounts equivalent to</quote>; and</text></clause> 
<clause indent="up1" id="HFD27EBE6C45749E6A8E932D0ACCCBB73"><enum>(iii)</enum><text>by striking <quote>, less (ii)</quote> and all that follows and inserting a period.</text></clause></subparagraph> 
<subparagraph indent="up1" id="H158F839172C7447A915699D7D84D54AA"><enum>(B)</enum><text>Paragraph (1) of section 121(e) of such Act is amended by striking subparagraph (B).</text></subparagraph> 
<subparagraph indent="up1" id="H1960B263F8764B0BB631DAE490E0BC86"><enum>(C)</enum><text>Paragraph (3) of section 121(e) of such Act is amended by striking subparagraph (B) and by redesignating subparagraph (C) as subparagraph (B).</text></subparagraph> 
<subparagraph indent="up1" id="HB6288C135A3F4D29B68690AAA756D282"><enum>(D)</enum><text>Paragraph (2) of section 121(e) of such Act is amended in the first sentence by striking <quote>paragraph (1)(A)</quote> and inserting <quote>paragraph (1)</quote>.</text></subparagraph></paragraph></subsection> 
<subsection id="H2804A839598D44AB839EE0406EBD3338"><enum>(d)</enum><header>Effective dates</header> 
<paragraph id="HFAF26D523EC84D07BF7CFC00967800BE"><enum>(1)</enum><header>In general</header><text>Except as otherwise provided in this subsection, the amendments made by this section shall apply to taxable years beginning after December 31, 2004.</text></paragraph> 
<paragraph id="H1F5E8EFB24D248EF8DAEF0036A7AE3F"><enum>(2)</enum><header>Subsection (c)(1)</header><text>The amendment made by subsection (c)(1) shall apply to benefits paid after December 31, 2004.</text></paragraph> 
<paragraph id="HCADFBF380D274F148180A87869FCD57F"><enum>(3)</enum><header>Subsection (c)(2)</header><text>The amendments made by subsection (c)(2) shall apply to tax liabilities for taxable years beginning after December 31, 2004.</text></paragraph></subsection></section> 
<section id="HFC39CE17C2AE48C9983C1099007C7FA7"><enum>3.</enum><header>Maintenance of transfers to Hospital Insurance Trust Fund</header> 
<subsection id="HAA85463AE4D64641868C19489B72DCB3"><enum>(a)</enum><header>In general</header><text>There are hereby appropriated to the Hospital Insurance Trust Fund established under section 1817 of the <act-name parsable-cite="SSA">Social Security Act</act-name> amounts equal to the reduction in revenues to the Treasury by reason of the enactment of this Act. Amounts appropriated by the preceding sentence shall be transferred from the general fund at such times and in such manner as to replicate to the extent possible the transfers which would have occurred to such Trust Fund had this Act not been enacted.</text></subsection> 
<subsection id="HA39C2F246B264DECB8E151BC00B62D34"><enum>(b)</enum><header>Reports</header><text>The Secretary of the Treasury or the Secretary’s delegate shall annually report to the Committee on Ways and Means of the House of Representatives and the Committee on Finance of the Senate the amounts and timing of the transfers under this section.</text></subsection></section>
