<section id="H47981862274443FAAA092B7C942412DB" section-type="section-one" display-inline="no-display-inline"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>No Child Left Behind Reform Act</short-title></quote>.</text></section> 
<section id="H800A8712C5184D9DBCB2DDF323277E76"><enum>2.</enum><header>Adequate yearly progress</header> 
<subsection id="H93F9F931BCC04F868F5EB557213040E3"><enum>(a)</enum><header>Definition of adequate yearly progress</header><text>Section 1111(b)(2) of the <act-name parsable-cite="ESEA">Elementary and Secondary Education Act of 1965</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/20/6311">20 U.S.C. 6311(b)(2)</external-xref>) is amended—</text> 
<paragraph id="HF86691EFCBC2448CA5B59F695B535FED"><enum>(1)</enum><text>in subparagraph (C)(vii)—</text> 
<subparagraph id="H14A0A841677A49C1AFD60098DF632FEA"><enum>(A)</enum><text>by striking <quote>such as</quote> and inserting <quote>such as measures of individual or cohort growth over time based on the academic assessments implemented in accordance with paragraph (3),</quote>; and</text></subparagraph> 
<subparagraph id="HA7FD486B7B5E4B2E9963D24CCCFE71B4"><enum>(B)</enum><text>by striking <quote>attendance rates,</quote>; and</text></subparagraph></paragraph> 
<paragraph id="HD5B0D9605DEA4BF18C3B4E8D38B09EC6"><enum>(2)</enum><text>in subparagraph (D)—</text> 
<subparagraph id="H4BDFB26D06AA4B718885E06970F7A928"><enum>(A)</enum><text>by striking clause (ii);</text></subparagraph> 
<subparagraph id="H0E11431C1E424C73AF7BAACAE7AEB8CA"><enum>(B)</enum><text>by striking <quote>the State</quote> and all that follows through <quote>ensure</quote> and inserting <quote>the State shall ensure</quote>; and</text></subparagraph> 
<subparagraph id="H815270F8D5734C2EBCC4FB9D321C9510"><enum>(C)</enum><text>by striking <quote>; and</quote> and inserting a period.</text></subparagraph></paragraph></subsection> 
<subsection id="H1F1B8FC702014D22B537D0F416EC6B16"><enum>(b)</enum><header>Academic assessment and local educational agency and school improvement</header><text>Section 1116(a)(1)(B) of the <act-name parsable-cite="ESEA">Elementary and Secondary Education Act of 1965</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/20/6316">20 U.S.C. 6316(a)(1)(B)</external-xref>) is amended by striking <quote>, except that</quote> and all that follows (except the semicolon at the end).</text></subsection></section> 
<section id="H9D0A02D70FB845B7BFF63E60F948C077"><enum>3.</enum><header>Grants for increasing data capacity for purposes of ayp</header><text display-inline="no-display-inline">Subpart 1 of part A of title I of the <act-name parsable-cite="ESEA">Elementary and Secondary Education Act of 1965</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/20/6311">20 U.S.C. 6311 et seq.</external-xref>) is amended by adding at the end the following:</text> 
<quoted-block act-name="Elementary and Secondary Education Act of 1965" id="H7424C94B9E7B4D9E90D1692248895C8"> 
<section id="H270C27A6B2634F73A2F2B77C25DF649"><enum>1120C.</enum><header>Grants for increasing data capacity for purposes of ayp</header> 
<subsection id="H30BE54D38A2141DFA35264A82253D988"><enum>(a)</enum><header>Grant authority</header><text>The Secretary may award grants, on a competitive basis, to State educational agencies to enable the State educational agencies—</text> 
<paragraph id="HF07567ABA50A4A4D973EA5FEDFBB4359"><enum>(1)</enum><text>to develop or increase the capacity of data systems for accountability purposes; and</text></paragraph> 
<paragraph id="HD619C00E364C49239555EEA9D293A6F9"><enum>(2)</enum><text>to award subgrants to increase the capacity of local educational agencies to upgrade, create, or manage information databases for the purpose of measuring adequate yearly progress.</text></paragraph></subsection> 
<subsection id="H602859D2C1FA4BBBAEFA93044EB4A26"><enum>(b)</enum><header>Priority</header><text>In awarding grants under this section, the Secretary shall give priority to State educational agencies that have created, or are in the process of creating, a growth model or proficiency index as part of their adequate yearly progress determination.</text></subsection> 
<subsection id="HBC9AD991949D457584D23684E000008B"><enum>(c)</enum><header>State use of funds</header><text>Each State that receives a grant under this section shall use—</text> 
<paragraph id="H60B003E37E404412AA367FF4148E0A9"><enum>(1)</enum><text>not more than 20 percent of the grant funds for the purpose of increasing the capacity of, or creating, State databases to collect information related to adequate yearly progress; and</text></paragraph> 
<paragraph id="H6CB008EF935543D7A8D54FAB8610AAEF"><enum>(2)</enum><text>not less than 80 percent of the grant funds to award subgrants to local educational agencies within the State to enable the local educational agencies to carry out the authorized activities described in subsection (d).</text></paragraph></subsection> 
<subsection id="HC4920C420606427D95CFA250F0FF4DB8"><enum>(d)</enum><header>Authorized activities</header><text>Each local educational agency that receives a subgrant under this section shall use the subgrant funds to increase the capacity of the local educational agency to upgrade databases or create unique student identifiers for the purpose of measuring adequate yearly progress, by—</text> 
<paragraph id="H7D294348786746F5A49FD26D69E7822"><enum>(1)</enum><text>purchasing database software or hardware;</text></paragraph> 
<paragraph id="HDF776ED0DB9747AFBBAA22E0C483D9A0"><enum>(2)</enum><text>hiring additional staff for the purpose of managing such data;</text></paragraph> 
<paragraph id="H921999C1F5434205B8877C6C9500CFBD"><enum>(3)</enum><text>providing professional development or additional training for such staff; and</text></paragraph> 
<paragraph id="H4BCA1FD06AA244E7B213D922E164F700"><enum>(4)</enum><text>providing professional development or training for principals and teachers on how to effectively use such data to implement instructional strategies to improve student achievement.</text></paragraph></subsection> 
<subsection id="HFFA2620AE5D041B5864E23E5FA9E6659"><enum>(e)</enum><header>State application</header><text>Each State educational agency desiring a grant under this section shall submit an application to the Secretary at such time, in such manner, and containing such information as the Secretary may require.</text></subsection> 
<subsection id="H27CED1C4CBD5458C9C1D0040736B894C"><enum>(f)</enum><header>LEA application</header><text>Each local educational agency desiring a subgrant under this section shall submit an application to the State educational agency at such time, in such manner, and containing such information as the State educational agency may require. Each such application shall include, at a minimum, a demonstration of the local educational agency’s ability to put such a database in place.</text></subsection> 
<subsection id="H7002B4C500D345F9A638A9AE4C2EB84E"><enum>(g)</enum><header>Authorization of appropriations</header><text>There is authorized to be appropriated to carry out this section $80,000,000 for each of fiscal years 2006, 2007, and 2008.</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></section> 
<section id="H2DAD75A297834207941700007C0041F6"><enum>4.</enum><header>Targeting transfer options and supplemental services</header> 
<subsection id="HAA9BA73DB25F469D975559218D501EB4"><enum>(a)</enum><header>Targeting transfer options and supplemental services</header><text>Section 1116 of the <act-name parsable-cite="ESEA">Elementary and Secondary Education Act of 1965</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/20/6316">20 U.S.C. 6316</external-xref>) is amended—</text> 
<paragraph id="HC0F474A8F4B343ED00A1F45023A6ED76"><enum>(1)</enum><text>in paragraphs (1)(E)(i), (5)(A), (7)(C)(i), and (8)(A)(i) of subsection (b), by striking the term <term>all students enrolled in the school</term> each place such term appears and inserting <quote>all students enrolled in the school, who are members of a group described in section 1111(b)(2)(C)(v) that fails to make adequate yearly progress as defined in the State’s plan under section 1111(b)(2),</quote>;</text></paragraph> 
<paragraph id="H180BE8E683DE402BBBE05C51E086DD9"><enum>(2)</enum><text>in subsection (b)(1), by adding at the end the following:</text> 
<quoted-block id="H2CF6F9410163401684C6160790E62CF"> 
<subparagraph id="H29EDD046D5D54836B6BC161491A74200"><enum>(G)</enum><header>Maintenance of least restrictive environment</header><text>A student who is eligible to receive services under the Individuals with Disabilities Education Act and who uses the option to transfer under subparagraph (E), paragraph (5)(A), (7)(C)(i), or (8)(A)(i), or subsection (c)(10)(C)(vii), shall be placed and served in the least restrictive environment appropriate, in accordance with the Individuals with Disabilities Education Act.</text></subparagraph><after-quoted-block>;</after-quoted-block></quoted-block></paragraph> 
<paragraph id="H161706F6C7FC4267B000361CA18794C5"><enum>(3)</enum><text>in clause (vii) of subsection (c)(10)(C), by inserting <quote>, who are members of a group described in section 1111(b)(2)(C)(v) that fails to make adequate yearly progress as defined in the State’s plan under section 1111(b)(2),</quote> after <quote>Authorizing students</quote>; and</text></paragraph> 
<paragraph id="H3B081F4414D346A3A998D11FC30508DF"><enum>(4)</enum><text>in subparagraph (A) of subsection (e)(12), by inserting <quote>, who is a member of a group described in section 1111(b)(2)(C)(v) that fails to make adequate yearly progress as defined in the State’s plan under section 1111(b)(2)</quote> after <quote>under section 1113(c)(1)</quote>.</text></paragraph></subsection> 
<subsection id="H6BAF0A16E1E540FCA287C50049A89CEC"><enum>(b)</enum><header>Student already transferred</header><text>A student who transfers to another public school pursuant to section 1116(b) of the <act-name parsable-cite="ESEA">Elementary and Secondary Education Act of 1965</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/20/6316">20 U.S.C. 6316(b)</external-xref>) before the effective date of this section and the amendments made by this section, may continue enrollment in such public school after the effective date of this section and the amendments made by this section.</text></subsection> 
<subsection id="HCD0533B5AE894BC5A10067969494FB1"><enum>(c)</enum><header>Effective date</header><text>This section and the amendments made by this section shall be effective for each fiscal year for which the amount appropriated to carry out title I of the <act-name parsable-cite="ESEA">Elementary and Secondary Education Act of 1965</act-name> for the fiscal year, is less than the amount authorized to be appropriated to carry out such title for the fiscal year.</text></subsection></section> 
<section id="HD2E64580210E4A1E84A0E9E9028F25BB"><enum>5.</enum><header>Definition of highly qualified teachers</header><text display-inline="no-display-inline">Section 9101(23)(B)(ii) of the Elementary and Secondary Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/7801">20 U.S.C. 7801(23)(B)(ii)</external-xref>) is amended—</text> 
<paragraph id="HD12AF5EE61F94C1DB2809B75AEA4CBB7"><enum>(1)</enum><text>in subclause (I), by striking <quote>or</quote> after the semicolon;</text></paragraph> 
<paragraph id="H9C26D72C660A457DA66FA56D00DA11F1"><enum>(2)</enum><text>in subclause (II), by striking <quote>and</quote> after the semicolon; and</text></paragraph> 
<paragraph id="H60F798487FEA4937964F24F870BA73C2"><enum>(3)</enum><text>by adding at the end the following:</text> 
<quoted-block id="HF5B588D91F9540AA825C9E325C10183B"> 
<subclause id="HC0A4E711AE2E4560BFFC2D8F205DD4F8"><enum>(III)</enum><text>in the case of a middle school teacher, passing a State approved middle school generalist exam when the teacher receives the teacher’s license to teach middle school in the State;</text></subclause> 
<subclause id="H374DB9D32AF04675BFD3732FC5D5F81E"><enum>(IV)</enum><text>obtaining a State social studies certificate that qualifies the teacher to teach history, geography, economics, and civics in middle or secondary schools, respectively, in the State; or</text></subclause> 
<subclause id="HA7F01FEFC282479C9FB77BD300034800"><enum>(V)</enum><text>obtaining a State science certificate that qualifies the teacher to teach earth science, biology, chemistry, and physics in middle or secondary schools, respectively, in the State; and</text></subclause><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section>
