<official-title>To amend the Controlled Substances Act and the Controlled Substances Import and Export Act with respect to penalties for powder cocaine and crack cocaine offenses.</official-title>

<section section-type="section-one" id="H5B29C89E0B7A435087F47E5F294774DD" display-inline="no-display-inline"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Powder-Crack Cocaine Penalty Equalization Act of 2005</short-title></quote>.</text></section>

<subsection id="H1BC4E4A060944075932965E1C2AE32FC"><enum>(a)</enum><header>50-Gram penalty</header><text>Section 401(b)(1)(A) of the <act-name parsable-cite="CSA">Controlled Substances Act</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/21/841">21 U.S.C. 841(b)(1)(A)</external-xref>) is amended—</text> 
<paragraph id="HAD6B9B53DFAC4E3ABDD7004B07029B2E"><enum>(1)</enum><text>in clause (ii), by striking <quote>5 kilograms</quote> and inserting <quote>50 grams</quote>; and</text></paragraph> 
<paragraph id="HA8969418FE8847D8A98370234C448586"><enum>(2)</enum><text>by striking clause (iii).</text></paragraph></subsection> 
<subsection id="H6160068C007C4BBFBB6F03C9CE6FD9AE"><enum>(b)</enum><header>5-Gram penalty</header><text>Section 401(b)(1)(B) of the <act-name parsable-cite="CSA">Controlled Substances Act</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/21/841">21 U.S.C. 841(b)(1)(B)</external-xref>) is amended—</text> 
<paragraph id="H2EA07542821E4B23B0DAE8D88921FACA"><enum>(1)</enum><text>in clause (ii), by striking <quote>500 grams</quote> and inserting <quote>5 grams</quote>; and</text></paragraph> 
<paragraph id="H8F6A38AE7FCA42A88833EDD6BBABF370"><enum>(2)</enum><text>by striking clause (iii).</text></paragraph></subsection></section> 
<section id="H8F56DD5CB632449891B23CAA597FE749"><enum>3.</enum><header>Possession</header><text display-inline="no-display-inline">Section 404(a) of the <act-name parsable-cite="CSA">Controlled Substances Act</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/21/844">21 U.S.C. 844(a)</external-xref>) is amended by striking <quote>cocaine base</quote> and inserting <quote>any controlled substance described in section 401(b)(1)(A)(ii)</quote>.</text></section>

<subsection id="H00106760C6384009B78DCD509739C94D"><enum>(a)</enum><header>50-Gram penalty</header><text>Section 1010(b)(1) of the Controlled Substances Import and Export Act (<external-xref legal-doc="usc" parsable-cite="usc/21/960">21 U.S.C. 960(b)(1)</external-xref>) is amended—</text> 
<paragraph id="HD9587164A7114FD9A9FE7E232681D5DD"><enum>(1)</enum><text>in subparagraph (B), by striking <quote>5 kilograms</quote> and inserting <quote>50 grams</quote>; and</text></paragraph>

<subsection id="HBE68CF5EDC404BAD92FABA3230E57390"><enum>(b)</enum><header>5-Gram penalty</header><text>Section 1010(b)(2) of the Controlled Substances Import and Export Act (<external-xref legal-doc="usc" parsable-cite="usc/21/960">21 U.S.C. 960(b)(2)</external-xref>) is amended—</text>
