<official-title>To amend the Clean Air Act to reduce the proliferation of boutique fuels, and for other purposes.</official-title>

<section id="HA6677B7321E54EDEAC3800002E1D5F17" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Boutique Fuels Elimination Act of 2005</short-title></quote>.</text> </section> 
<section id="H6BEA9E5EB2694159A22C2C05ECC57DE1"><enum>2.</enum><header>Reducing the proliferation of boutique fuels</header> 
<subsection id="H5A4EE00CC74749949C9E37F08E6D3561" display-inline="no-display-inline"><enum>(a)</enum><header>Temporary waivers during supply emergencies</header> <text>Section 211(c)(4)(C) of the Clean Air Act (<external-xref legal-doc="usc" parsable-cite="usc/42/7545">42 U.S.C. 7545(c)(4)(C)</external-xref>) is amended by inserting <quote>(i)</quote> after <quote>(C)</quote> and by adding the following new clauses at the end thereof:</text> 
<quoted-block style="OLC" id="H3538397D59EB47FE93507E005880BB9E" display-inline="no-display-inline"> 
<clause id="HBA44AB5B4CCD48EBAA5B9CF8A663C7BB" indent="up3"><enum>(ii)</enum><text display-inline="yes-display-inline">The Administrator may temporarily waive a control or prohibition respecting the use of a fuel or fuel additive required or regulated by the Administrator pursuant to subsection (c), (h), (i), (k), or (m) of this section or prescribed in an applicable implementation plan under section 110 approved by the Administrator under clause (i) of this subparagraph if, after consultation with, and concurrence by, the Secretary of Energy, the Administrator determines that—</text> 
<subclause id="H176F991F891E40F29394DC5BC35CF1F2"><enum>(I)</enum><text display-inline="yes-display-inline">extreme and unusual fuel or fuel additive supply circumstances exist in a State or region of the Nation which prevent the distribution of an adequate supply of the fuel or fuel additive to consumers;</text></subclause> 
<subclause id="HDEA30AA1C41D49BD8463B2E33F4FE47"><enum>(II)</enum><text display-inline="yes-display-inline">such extreme and unusual fuel and fuel additive supply circumstances are the result of a natural disaster, an Act of God, a pipeline or refinery equipment failure, or another event that could not reasonably have been foreseen or prevented and not the lack of prudent planning on the part of the suppliers of the fuel or fuel additive to such State or region; and</text></subclause> 
<subclause id="H0F70323200EC4D73ABF99F982469658B"><enum>(III)</enum><text display-inline="yes-display-inline">it is in the public interest to grant the waiver (for example, when a waiver is necessary to meet projected temporary shortfalls in the supply of the fuel or fuel additive in a State or region of the Nation which cannot otherwise be compensated for).</text></subclause></clause> 
<clause id="H5A8C370A73F54B3D9D565970E796BABA" indent="up3"><enum>(iii)</enum><text display-inline="yes-display-inline">If the Administrator makes the determinations required under clause (ii), such a temporary extreme and unusual fuel and fuel additive supply circumstances waiver shall be permitted only if—</text> 
<subclause id="H01343E9EC2B24D7A8300C3F3CBBEBA00"><enum>(I)</enum><text display-inline="yes-display-inline">the waiver applies to the smallest geographic area necessary to address the extreme and unusual fuel and fuel additive supply circumstances;</text></subclause> 
<subclause id="H53165D0B51B046D8B0887CE07219FD80"><enum>(II)</enum><text display-inline="yes-display-inline">the waiver is effective for a period of 20 calendar days or, if the Administrator determines that a shorter waiver period is adequate, for the shortest practicable time period necessary to permit the correction of the extreme and unusual fuel and fuel additive supply circumstances and to mitigate impact on air quality;</text></subclause> 
<subclause id="HA534F81052214C67B0C85F156BE75638"><enum>(III)</enum><text>the waiver permits a transitional period, the exact duration of which shall be determined by the Administrator, after the termination of the temporary waiver to permit wholesalers and retailers to blend down their wholesale and retail inventory;</text></subclause> 
<subclause id="H2C6C6ADEAF1345C38C076D84B6F1922E"><enum>(IV)</enum><text>the waiver applies to all persons in the motor fuel distribution system; and</text></subclause> 
<subclause id="HAE63B34CDFF6403D968FD2EEF4AD4BAE"><enum>(V)</enum><text>the Administrator has given public notice to all parties in the motor fuel distribution system, local and State regulators, public interest groups, and consumers in the State or region to be covered by the waiver.</text></subclause> <continuation-text continuation-text-level="clause">The term <quote>motor fuel distribution system</quote> as used in this clause shall be defined by the Administrator through rulemaking.</continuation-text></clause> 
<clause id="HA50C6CC14BE643A999CDD6290028F487" indent="up3"><enum>(iv)</enum><text>Within 180 days of the date of enactment of this clause, the Administrator shall promulgate regulations to implement clauses (ii) and (iii).</text></clause> 
<clause id="H52B525803B28449CA044ED01D070D307" indent="up3"><enum>(v)</enum><text>Nothing in this subparagraph shall—</text> 
<subclause id="H6BCA4C19323F40E997E472B0000016ED"><enum>(I)</enum><text display-inline="yes-display-inline">limit or otherwise affect the application of any other waiver authority of the Administrator pursuant to this section or pursuant to a regulation promulgated pursuant to this section; and</text></subclause> 
<subclause id="H34475B488FFE41EB95BCA6D8D1421481"><enum>(II)</enum><text display-inline="yes-display-inline">subject any State or person to an enforcement action, penalties, or liability solely arising from actions taken pursuant to the issuance of a waiver under this subparagraph.</text></subclause></clause><after-quoted-block>.</after-quoted-block></quoted-block></subsection> 
<subsection id="H0DEDEDAAD4F841AF8422AC00F887EA97"><enum>(b)</enum><header>Limit on number of boutique fuels</header><text display-inline="yes-display-inline">Section 211(c)(4)(C) of the Clean Air Act (<external-xref legal-doc="usc" parsable-cite="usc/42/7545">42 U.S.C. 7545(c)(4)</external-xref>), as amended by subsection (a), is further amended by adding at the end the following: </text> 
<quoted-block style="OLC" display-inline="no-display-inline" id="H90066CCBFEC244079803B86FA8D1C5C"> 
<clause id="HCC54B735712E4C02B221AE29B05DC72E"><enum>(v)</enum> 
<subclause id="H5C4CE78BF3D04C75961006CCAF7F3D38" display-inline="yes-display-inline"><enum>(I)</enum><text display-inline="yes-display-inline">The Administrator shall have no authority, when considering a State implementation plan or a State implementation plan revision, to approve under this paragraph any fuel included in such plan or revision if the effect of such approval would be to increase the total number of fuels approved under this paragraph as of September 1, 2004 in all State implementation plans;</text></subclause> 
<subclause id="H00FC516D88654BA0B6F2D600012B5BA" indent="up1"><enum>(II)</enum><text display-inline="yes-display-inline">The Administrator, in consultation with the Secretary of Energy, shall determine the total number of fuels approved under this paragraph as of September 1, 2004, in all State implementation plans and shall publish a list of such fuels, including the states and Petroleum Administration for Defense District in which they are used, in the Federal Register for public review and comment no later than 90 days after enactment.</text></subclause> 
<subclause id="H790B24F45A0245FE8C49326FC40044B5" indent="up1"><enum>(III)</enum><text display-inline="yes-display-inline">The Administrator shall remove a fuel from the list published under subclause (II) if a fuel ceases to be included in a State implementation plan or if a fuel in a State implementation plan is identical to a Federal fuel formulation implemented by the Administrator, but the Administrator shall not reduce the total number of fuels authorized under the list published under subclause (II).</text></subclause> 
<subclause id="H7B0008CE9E0F4F1BAD6814E9A58FCB43" indent="up1"><enum>(IV)</enum><text display-inline="yes-display-inline">Subclause (I) shall not limit the Administrator’s authority to approve a control or prohibition respecting any new fuel under this paragraph in a State implementation plan or revision to a State implementation plan if such new fuel: </text> 
<item id="HB6A4FB80E7FA4BC3A74CD757B9578EF7"><enum>(aa)</enum><text display-inline="yes-display-inline">completely replaces a fuel on the list published under subclause (II); or</text></item> 
<item id="H757921EEE44E4CA7BEC5CA9006002BF9"><enum>(bb)</enum><text display-inline="yes-display-inline">does not increase the total number of fuels on the list published under paragraph (II) as of September 1, 2004.</text></item><continuation-text continuation-text-level="subclause">In the event that the total number of fuels on the list published under subclause (II) at the time of the Administrator's consideration of a control or prohibition respecting a new fuel is lower than the total number of fuels on such list as of September 1, 2004, the Administrator may approve a control or prohibition respecting a new fuel under this subclause if the Administrator, after consultation with the Secretary of Energy, publishes in the Federal Register, after notice and comment, a finding that, in the Administrator’s judgment, such control or prohibition respecting a new fuel will not cause fuel supply or distribution interruptions or have a significant adverse impact on fuel producibility in the affected area or contiguous areas.</continuation-text></subclause> 
<subclause id="H0ECE0235E0EF44859FB6F3EC00E466A7" indent="up1"><enum>(V)</enum><text display-inline="yes-display-inline">Except for a fuel with a summertime Reid Vapor Pressure of 7.0 pounds per square inch, the Administrator shall have no authority under this paragraph, when considering any particular State’s implementation plan or a revision to that State’s implementation plan, to approve any fuel unless that fuel was, as of the date of such consideration, approved in at least one State implementation plan in the applicable Petroleum Administration for Defense District. </text></subclause> 
<subclause id="H6095E1B8AF6A4126B325AC0637A37E00" indent="up1"><enum>(VI)</enum><text display-inline="yes-display-inline">Nothing in this clause shall be construed to prohibit a State from requiring the use of an alcohol or bio-diesel fuel additive registered in accordance with subsection (b), including any alcohol or bio-diesel fuel additive registered after the enactment of this subclause; however, this clause shall be construed to prohibit a State from requiring the use of any other fuel additive registered in accordance with subsection (b), including any other fuel additive registered after the enactment of this subclause.</text></subclause></clause><after-quoted-block>.</after-quoted-block></quoted-block></subsection> 
<subsection id="H1D99686F0FF04C68ADF71041F2297434"><enum>(c)</enum><header>Sense of the Congress</header><text display-inline="yes-display-inline">It is the sense of the Congress that States should seek to maximize the environmental benefits available from the fuels authorized under subsection (b).</text></subsection> 
<subsection id="HDA097C005E7B4401A7CDB12EAD7FA1D2"><enum>(d)</enum><header>Study and report to Congress on boutique fuels</header> 
<paragraph id="HEDABDDCD9C1F4E8A9DEFC9BE8BA7BD52"><enum>(1)</enum><header>Joint study</header><text display-inline="yes-display-inline">The Administrator of the Environmental Protection Agency and the Secretary of Energy shall undertake a study of the effects on air quality, on the number of fuel blends, on fuel availability, on fuel fungibility, and on fuel costs of the State plan provisions adopted pursuant to section 211(c)(4)(C) of the Clean Air Act (<external-xref legal-doc="usc" parsable-cite="usc/42/7545">42 U.S.C. 7545(c)(4)(C)</external-xref>).</text></paragraph> 
<paragraph id="H5409ABA3E45F4E2698F7B42E2CD44C00"><enum>(2)</enum><header>Focus of study</header><text display-inline="yes-display-inline">The primary focus of the study required under paragraph (1) shall be to determine how to develop a Federal fuels system that maximizes motor fuel fungibility and supply, preserves air quality standards, and reduces motor fuel price volatility that results from the proliferation of boutique fuels, and to recommend to Congress such legislative changes as are necessary to implement such a system. The study should include the impacts on overall energy supply, distribution, and use as a result of the legislative changes recommended. In addition, the study shall examine the need for additional, cleaner motor fuel reformulations to assist states in complying with the ozone National Ambient Air Quality Standard. </text></paragraph> 
<paragraph id="HF6830279ABE34F42B7D2343812CB00EA"><enum>(3)</enum><header>Responsibility of Administrator</header><text display-inline="yes-display-inline">In carrying out the study required by this section, the Administrator shall coordinate obtaining comments from affected parties interested in the air quality impact assessment portion of the study. The Administrator shall use sound and objective science practices, shall consider the best available science, and shall consider and include a description of the weight of the scientific evidence.</text></paragraph> 
<paragraph id="H36CF77F1020741BC974046C105B85FF9"><enum>(4)</enum><header>Responsibility of Secretary</header><text display-inline="yes-display-inline">In carrying out the study required by this section, the Secretary shall coordinate obtaining comments from affected parties interested in the fuel availability, number of fuel blends, fuel fungibility and fuel costs portion of the study.</text></paragraph> 
<paragraph id="HC2857F1CBC264EE991C222AEDDF9374"><enum>(5)</enum><header>Public participation</header><text display-inline="yes-display-inline">The Administrator and the Secretary shall appoint a task force of interested parties, including but not limited to representatives of Federal, State and local governments, fuel manufacturers, suppliers, and marketers and public interest groups, to provide information to the Administrator and the Secretary and to assist in the development of the recommendations to be included in the report to Congress under paragraph (5).</text></paragraph> 
<paragraph id="HD3A00815D17841A8BDE745AF2796F224"><enum>(6)</enum><header>Report to Congress</header><text display-inline="yes-display-inline">The Administrator and the Secretary jointly shall submit the results of the study required by this section in a report to the Congress not later than 12 months after the date of the enactment of this Act, together with any recommended regulatory and legislative changes. Such report shall be submitted to the Committee on Energy and Commerce of the House of Representatives and the Committee on Environment and Public Works of the Senate.</text></paragraph> 
<paragraph id="H73E9540DFA764869AA6060C7ECFF6C2D"><enum>(7)</enum><header>Authorization of appropriations</header><text display-inline="yes-display-inline">There is authorized to be appropriated jointly to the Administrator and the Secretary $500,000 for the completion of the study required under this subsection.</text></paragraph></subsection> 
<subsection id="H2891D7AF71E644DBB134B17D001864DB"><enum>(e)</enum><header>Definitions</header><text>In this section:</text> 
<paragraph id="H6117DEA75BCD4EE6A9A0C00EDE5F77"><enum>(1)</enum><text display-inline="yes-display-inline">The term <quote>Administrator</quote> means the Administrator of the Environmental Protection Agency. </text></paragraph> 
<paragraph id="H95C6FAE09DD14A6BBB00877371F3A000"><enum>(2)</enum><text display-inline="yes-display-inline">The term <quote>Secretary</quote> means the Secretary of Energy.</text></paragraph> 
<paragraph id="HFA9BE4D954714C3184DE1E2FA800509B"><enum>(3)</enum><text display-inline="yes-display-inline">The term <quote>fuel</quote> means gasoline, diesel fuel, and any other liquid petroleum product commercially known as gasoline and diesel fuel for use in highway and non-road motor vehicles. </text></paragraph> 
<paragraph id="HDDC638ECDB144124A443F57B5D97D038"><enum>(4)</enum><text display-inline="yes-display-inline">The term <quote>a control or prohibition respecting a new fuel</quote> means a control or prohibition on the formulation, composition, or emissions characteristics of a fuel that would require the increase or decrease of a constituent in gasoline or diesel fuel.</text></paragraph></subsection></section>
