<legis-type>AN ACT</legis-type> 
<official-title display="yes">To provide for the preservation of the historic confinement sites where Japanese Americans were detained during World War II, and for other purposes.</official-title>

<legis-body display-enacting-clause="yes-display-enacting-clause" style="OLC" id="H584DC9779F52411C8500722F8268AEB7"> 
<section id="H2AB832D99D4A45AEBF68298D36EEF7C1" section-type="section-one" display-inline="no-display-inline"><enum>1.</enum><header>Preservation of historic confinement sites</header> 
<subsection id="HCAEEF9B83A48490F97EA367D11B3F1B"><enum>(a)</enum><header>Preservation program</header><text>The Secretary shall create a program within the National Park Service to encourage, support, recognize, and work in partnership with citizens, Federal agencies, State, local, and tribal governments, other public entities, educational institutions, and private nonprofit organizations for the purpose of identifying, researching, evaluating, interpreting, protecting, restoring, repairing, and acquiring historic confinement sites in order that present and future generations may learn and gain inspiration from these sites and that these sites will demonstrate the Nation’s commitment to equal justice under the law. </text></subsection> 
<subsection id="HF366E99AD290423AA6583F516E9D5C5D"><enum>(b)</enum><header>Grants</header>
<paragraph id="HC4B20640A1E44783AF70318F9007F875"><enum>(1)</enum><header>Criteria</header><text display-inline="yes-display-inline">The Secretary, after consultation with State, local, and tribal governments, other public entities, educational institutions, and private nonprofit organizations (including organizations involved in the preservation of historic confinement sites), shall develop criteria for making grants under paragraph (2) to assist in carrying out subsection (a).</text></paragraph>
<paragraph id="H4831DC7A9F4A461CAF88A93F98D50919"><enum>(2)</enum><header>Provision of grants</header><text display-inline="yes-display-inline">Not later than 180 days after the date on which funds are made available to carry out this Act, the Secretary shall, subject to the availability of appropriations, make grants to the entities described in paragraph (1) only in accordance with the criteria developed under that paragraph.</text></paragraph></subsection> 
<subsection id="HDBACDAB9732243A18B73F2461D70DEBB"><enum>(c)</enum><header>Property acquisition</header> 
<paragraph id="HEA15A6A18EE6413E98DEC389225B095B"><enum>(1)</enum><header>Authority</header><text display-inline="yes-display-inline">Federal funds made available under this section may be used to acquire non-Federal property for the purposes of this section, in accordance with section 3, only if that property is within the areas described in paragraph (2).</text></paragraph> 
<paragraph id="HE51F8058BA024AE59EEB2A995768547"><enum>(2)</enum><header>Property descriptions</header><text>The property referred to in paragraph (2) is the following:</text> 
<subparagraph id="H21211A3335874B35B5B43FC4E07F6C8F"><enum>(A)</enum><text>Jerome, depicted in Figure 7.1 of the Site Document.</text></subparagraph> 
<subparagraph id="H516E9DADEC124DF3A6CE003B785D8175"><enum>(B)</enum><text display-inline="yes-display-inline">Rohwer, depicted in Figure 11.2 of the Site Document.</text></subparagraph> 
<subparagraph id="H34B4667AE61F4A279CF1301D8C4645F"><enum>(C)</enum><text display-inline="yes-display-inline">Topaz, depicted in Figure 12.2 of the Site Document.</text></subparagraph> 
<subparagraph id="HA4A1F5C95694406C90F5C3F005458FB"><enum>(D)</enum><text display-inline="yes-display-inline">Honouliuli, located on the southern part of the Island of Oahu, Hawaii, and within the land area bounded by H1 to the south, Route 750 (Kunia Road) to the east, the Honouliuli Forest Reserve to the west, and Kunia town and Schofield Barracks to the north.</text></subparagraph></paragraph> 
<paragraph id="H9713F319F4684763804C14AB24B4F106"><enum>(3)</enum><header>No effect on private property</header><text>The authority granted in this subsection shall not constitute a Federal designation or have any effect on private property ownership.</text></paragraph></subsection> 
<subsection id="H4DB2A331999D416AB7ADA2005B21F1AD"><enum>(d)</enum><header>Matching Fund Requirement</header><text display-inline="yes-display-inline">The Secretary shall require a 50 percent non-Federal match for funds provided under this section.</text></subsection> 
<subsection id="H146517A9AAD74216ACCC57CA3F7E956F"><enum>(e)</enum><header>Sunset of authority</header><text>This Act shall have no force or effect on and after the date that is 2 years after the disbursement to grantees under this section of the total amount of funds authorized to be appropriated under section 4.</text></subsection></section> 
<section id="H207EAB7A4A6D4BC3A98DF4F39B48E23F"><enum>2.</enum><header>Definitions</header><text display-inline="no-display-inline">For purposes of this Act the following definitions apply:</text> 
<paragraph id="H2CBC3C201C874BE3BBD9DCE701DDBA7D"><enum>(1)</enum><header>Historic confinement sites</header> 
<subparagraph id="HD47E252C5B574479A168300423E4C200" display-inline="yes-display-inline"><enum>(A)</enum><text>The term <term>historic confinement sites</term> means the 10 internment camp sites referred to as Gila River, Granada, Heart Mountain, Jerome, Manzanar, Minidoka, Poston, Rohwer, Topaz, and Tule Lake and depicted in Figures 4.1, 5.1, 6.1, 7.1, 8.4, 9.2, 10.6, 11.2, 12.2, and 13.2, respectively, of the Site Document; and</text></subparagraph> 
<subparagraph id="HDAC856B06047416F939E50B16F656FBB" indent="up1"><enum>(B)</enum><text>other historically significant locations, as determined by the Secretary, where Japanese Americans were detained during World War II.</text></subparagraph></paragraph> 
<paragraph id="H627FAB5964A040FFAABB71EC2C50042C"><enum>(2)</enum><header>Secretary</header><text>The term <term>Secretary</term> means the Secretary of the Interior.</text></paragraph> 
<paragraph id="HB74AA75B448E4610B6D4E6EC53C6128"><enum>(3)</enum><header>Site Document</header><text display-inline="yes-display-inline">The term <term>Site Document</term> means the document titled <quote>Confinement and Ethnicity: An Overview of World War II Japanese American Relocation Sites</quote>, published by the Western Archeological and Conservation Center, National Park Service, in 1999.</text></paragraph></section> 
<section id="H36657105046D4544BF52A792F39EF6DF"><enum>3.</enum><header>Private property protection</header><text display-inline="no-display-inline">No Federal funds made available to carry out this Act may be used to acquire any real property or any interest in any real property without the written consent of the owner or owners of that property or interest in property.</text></section> 
<section id="H38926F8224584496B8329CD909256CCB"><enum>4.</enum><header>Authorization of appropriations</header><text display-inline="no-display-inline">There are authorized to be appropriated to the Secretary $38,000,000 to carry out this Act. Such sums shall remain available until expended.</text></section>
