<section id="HE19CF2DB9FFA426BA7B4DFCEF000DE7C" section-type="section-one"> <enum>1.</enum> <header>Short title</header> <text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Coastal Ocean Observation System Integration and Implementation Act of 2005</short-title> </quote>.</text> </section>
<section id="H1A746A0B5A484FFCA67F012E18F3F7C3"> <enum>2.</enum> <header>Purposes</header> <text display-inline="no-display-inline">The purposes of this Act are the following:</text> 
<paragraph id="HB485DB0999D44C628FAAA9DD5162506D"> <enum>(1)</enum> <text display-inline="yes-display-inline">To gain a better understanding of the marine environment and marine processes important to coastal and fishery management, marine operations, environmental prediction, and other appropriate activities.</text> </paragraph>
<paragraph id="H2A09EFE4054F45DFB39D794C752BDCF8"> <enum>(2)</enum> <text>To authorize the establishment of an observation system to collect data on environmental variables in coastal ocean waters of the United States to meet regional and national information requirements and support an integrated national ocean observing system.</text> </paragraph>
<paragraph id="HA41BA6B1FCE34DA3A7E77C3720002300"> <enum>(3)</enum> <text>To more effectively predict and mitigate impacts of natural hazards such as tsunamis, hurricanes, coastal erosion, and fluctuating water levels in the Great Lakes, and conserve healthy and restore degraded coastal ecosystems.</text> </paragraph>
<paragraph id="H8490B2E7D82B48F0A843C426D1001E00"> <enum>(4)</enum> <text>To enable the sustainable use of ocean and coastal resources.</text> </paragraph>
<paragraph id="H7DB431276C0641C7AF576D9BC9705CF5"> <enum>(5)</enum> <text>To ensure that a broad-based multisector constituency is included in the development of the System, including local, State, tribal, and Federal agencies, private companies, nongovernmental organizations, and academic institutions.</text> </paragraph></section>
<section id="HE570CA0E414E4E38AECB50EF524D67F5"> <enum>3.</enum> <header>Definitions</header> <text display-inline="no-display-inline">In this Act:</text> 
<paragraph id="HBCDE966E05EA4AACAAF1183A562ACCA"> <enum>(1)</enum> <header>Administration</header> <text>The term <quote>Administration</quote> means the National Oceanic and Atmospheric Administration.</text> </paragraph>
<paragraph id="H50005D06293D4C22871DEA8CD8158FD1"> <enum>(2)</enum> <header>Coastal waters of the United States</header> <text>The term <quote>coastal waters of the United States</quote> means waters of coastal and estuarine areas of United States, waters of the Great Lakes and the exclusive economic zone of the United States, including bays, lagoons, fjords, tidal wetlands, and other semienclosed bodies of water that are connected to ocean waters.</text> </paragraph>
<paragraph id="HB6FF0751724F4B6BB1D1C984B16EF941"> <enum>(3)</enum> <header>Council</header> <text>The term <quote>Council</quote> means the National Ocean Research Leadership Council.</text> </paragraph>
<paragraph id="H4C90049F1FA544B1BA5C79CBA6BBE759"> <enum>(4)</enum> <header>Panel</header> <text>The term <quote>Panel</quote> means the Ocean and Research Advisory Panel.</text> </paragraph>
<paragraph id="HE2B35A1F2D5349B8998D07C3F32E0068"> <enum>(5)</enum> <header>Secretary</header> <text>The term <quote>Secretary</quote> means the Secretary of Commerce, acting through the Administration.</text> </paragraph>
<paragraph id="HB30A726C1E194586BF8D35B317EBD718"> <enum>(6)</enum> <header>System</header> <text>The term <quote>System</quote> means the Coastal Ocean Observation System established by the Secretary under section 4.</text> </paragraph></section>
<section id="HF8E56FDC792A4467883BBE67C3CA1511"> <enum>4.</enum> <header>Establishment of Coastal Ocean Observation System</header> 
<subsection id="HB94F59C2A22E4DDF98C8ADE1ED26CC6B"> <enum>(a)</enum> <header>Requirement</header> <text display-inline="yes-display-inline">The Secretary, in consultation with the Council, shall establish within the Administration a Coastal Ocean Observation System to support coastal and fishery management activities and an integrated national ocean observation system.</text> </subsection>
<subsection id="H8BFE07216862445D982D977EBB887151"> <enum>(b)</enum> <header>Components and functions</header> <text>The System shall—</text> 
<paragraph id="H0829A7268F974F3F80C0B0877F56863E"> <enum>(1)</enum> <text>consist of components of the Administration and other Federal agencies and non-Federal entities designated as units under section 5;</text> </paragraph>
<paragraph id="HAA60CCFBC92F4A80AAA3EA01B007BEF"> <enum>(2)</enum> <text>transmit such data to users including, as appropriate, in real time or near real time;</text> </paragraph>
<paragraph id="H0D91719933054ECE9D56856550C1542C"> <enum>(3)</enum> <text>produce forecasts and other appropriate products representing ocean conditions and processes; and</text> </paragraph>
<paragraph id="H6A6336340FAC42959732ED2E5609E3A9"> <enum>(4)</enum> <text>manage the collected data in accordance with best practices for archiving and future use.</text> </paragraph></subsection></section>
<section id="HB48307D0CA5D4258B38059738468291C"> <enum>5.</enum> <header>Designation of units and standards</header> 
<subsection id="H3FFBAEC8946D4EA1B0F2BE34C62F9901"> <enum>(a)</enum> <header>In general</header> <text>The Secretary may, in consultation with the Council, designate as a unit of the System to carry out the purposes of this Act any Federal agency or non-Federal entity that operates marine sensors and other devices that collect remotely sensed and in situ observation data in the ocean and coastal waters of the United States in a routine manner, including continuous observations.</text> </subsection>
<subsection id="HCB5A20CE2F75490AA9AB1C303FA14771"> <enum>(b)</enum> <header>Criteria for designation</header> <text>The Secretary may not designate an agency or other entity as a unit of the System unless the Secretary certifies, in consultation with the Council, that the entity has adequate technical expertise to operate and sustain the technology in the unit, and collect and distribute data in accordance with standards and protocols established under subsection (c).</text> </subsection>
<subsection id="H0BA15410BA5F4D0BAED20757376B06DD"> <enum>(c)</enum> <header>Data standards, protocols, and systems</header> <text>The Secretary shall—</text> 
<paragraph id="HA60738E1A0734ECF8DC69EED3BBCADA2"> <enum>(1)</enum> <text>establish, in consultation with the Council and the Panel, standards, and protocols for the collection, availability, and distribution by units of the System of data regarding coastal waters of the United States; and</text> </paragraph>
<paragraph id="H5733EAB89C0947379B543900004C2D67"> <enum>(2)</enum> <text>establish management, quality control, and assessment systems for such data collection, availability, and distribution.</text> </paragraph></subsection></section>
<section id="HCE2023AE12244F42BFFC9300B60320B8"> <enum>6.</enum> <header>Coordination and activities of the system</header> 
<subsection id="HAFC7484A20BC4EE09D9500D40054EC10"> <enum>(a)</enum> <header>In general</header> <text>The Secretary shall, in consultation with the Council, coordinate those observation activities of units of the System that are conducted with respect to the coastal waters of the United States, as necessary to collect data to carry out the purposes of this Act.</text> </subsection>
<subsection id="H25602A503269453FB01191BFAC17F497"> <enum>(b)</enum> <header>Included activities</header> <text>The Secretary shall, in consultation with the Council, ensure that—</text> 
<paragraph id="HA144663F7C4944AA8ECA1951E404418F"> <enum>(1)</enum> <text>data collection activities of the System include all of the relevant coastal ocean observations necessary to carry out the purposes of this Act; and</text> </paragraph>
<paragraph id="H1B0C2D7E3C2D4BFB972B01C4D8B2AD00"> <enum>(2)</enum> <text>data collected through the System is useful for developing forecast models to support coastal and fishery management, safe and efficient marine navigation, weather and climate prediction, and other appropriate activities.</text> </paragraph></subsection>
<subsection id="HB675B520E0804675AEF25DDCDA42BC4D"> <enum>(c)</enum> <header>Prevention competition with private sector and duplication of effort</header> <text>The Secretary shall ensure that data collection activities conducted through the System—</text> 
<paragraph id="H8E32DC96CA7641ACBBCF53F7E6558DB"> <enum>(1)</enum> <text>do not compete with private sector activities; and</text> </paragraph>
<paragraph id="H07CD7B4DB164402A859C2D00CB3BE077"> <enum>(2)</enum> <text>minimize duplication of effort.</text> </paragraph></subsection></section>
<section id="HE841458F604E44E8A2AB69C4B6FC264B"> <enum>7.</enum> <header>Civil liability</header> <text display-inline="no-display-inline">For purposes of determining civil liability under <external-xref legal-doc="usc" parsable-cite="usc/28/2671">section 2671</external-xref> of title 28, United States Code, any unit of the System that is designated by the Secretary under section 5, and any employee thereof, shall be treated as an instrumentality of the United States with respect to any act or omission committed by any such unit or employee in fulfilling the purposes of this Act.</text> </section>
<section id="HDA628D666AB9423FA76FACDCE1F647F5"> <enum>8.</enum> <header>Data availability and products</header> <text display-inline="no-display-inline">The Secretary shall—</text> 
<paragraph id="HBBAD30511ECC4ED8B8B24D9600A7AEB7"> <enum>(1)</enum> <text display-inline="yes-display-inline">work with the Panel and user groups to ensure the development of viable end-use products of the System to support coastal and fishery management activities and other appropriate activities;</text> </paragraph>
<paragraph id="H55CB02989EA44EE18F6057B180AE94F"> <enum>(2)</enum> <text>in consultation with the Council, develop a data management and communication system by which all data collected by the System regarding coastal waters of the United States are integrated and available; and</text> </paragraph>
<paragraph id="HFF592BEAA6E54B5895B5A9F137ECFD08"> <enum>(3)</enum> <text>in conjunction with Federal, State, and local agencies, and academic institutions, use data collected by the System to develop forecast models to support and improve coastal and fishery management, safe and efficient marine navigation, weather and climate prediction, and other appropriate activities.</text> </paragraph></section>
<section id="HE0FCA14D7A4C4BB180F5147BB9347AB"> <enum>9.</enum> <header>Pilot projects</header> 
<subsection id="HBB40C05C04B54EBDBAA72E9D89E7C411"> <enum>(a)</enum> <header>Requirement</header> <text>The Secretary, in consultation with the Council, shall carry out pilot projects to determine the effectiveness of collecting and integrating coastal ocean observation data to support the Coastal Ocean Observation System established under this Act.</text> </subsection>
<subsection id="H50B679784D1844B2AE9EAE8649EEEAE6"> <enum>(b)</enum> <header>Included projects</header> <text>The pilot projects shall—</text> 
<paragraph id="H3DB9F2987E2546F7B6923D4EAAB02D27"> <enum>(1)</enum> <text>test the integration of data among multiple Federal agencies and non-Federal entities that operate marine sensors and other devices to collect or use coastal ocean observation data;</text> </paragraph>
<paragraph id="HACA2B0D78007476FB27145EE76560079"> <enum>(2)</enum> <text>produce operational applications relevant to the purposes of this Act;</text> </paragraph>
<paragraph id="HD73B66822F9A4232971FA369B5BD2B3"> <enum>(3)</enum> <text>demonstrate potential economic and societal benefits of the System; and</text> </paragraph>
<paragraph id="HA74B80ABF7454BA0AC44E771AD6E003B"> <enum>(4)</enum> <text>advance research and development of useful technologies and applications.</text> </paragraph></subsection></section>
<section id="HEB358099DDB24B5DA629D43719558DA3"> <enum>10.</enum> <header>Process for transition from research to operation</header> <text display-inline="no-display-inline">The Secretary, in consultation with the Council, shall formulate a process by which—</text> 
<paragraph id="H58F43DD39FA549C3B7BF0229872CAE6D"> <enum>(1)</enum> <text>funding is made available for research on new technologies for collecting data regarding coastal waters of the United States;</text> </paragraph>
<paragraph id="HE6727AADCCF34E51894F5D5FA1347827"> <enum>(2)</enum> <text>such technologies are tested in pilot projects, including—</text> 
<subparagraph id="H65B38D5B382C4441B1003E1CABC599B6"> <enum>(A)</enum> <text>accelerated research into biological and chemical sensing techniques and satellite sensors for collecting such data; and</text> </subparagraph>
<subparagraph id="HF20AA6BC6F4E400092EBE95D51B327F"> <enum>(B)</enum> <text>developing technologies to improve all aspects of the System, especially the timeliness and accuracy of its predictive models and the usefulness of its information products; and</text> </subparagraph></paragraph>
<paragraph id="H52605D84B0554E9ABAD2091C375E531E"> <enum>(3)</enum> <text>technology that has been demonstrated to be useful for the System is incorporated into use by the System.</text> </paragraph></section>
<section id="H9E0E20FA23FA4DB4B4ED07BF9C868602"> <enum>11.</enum> <header>Contracts and grants</header> <text display-inline="no-display-inline">The Secretary may enter into contracts or cooperative agreements with, or make grants to, units of the System to carry out observation activities with respect to coastal waters of the United States.</text> </section>
<section id="HA81F0C8CA0234CF0A9789B06A40039D6"> <enum>12.</enum> <header>Implementation plan</header> <text display-inline="no-display-inline">Not later than 12 months after the date of the enactment of this Act, the Secretary shall submit to the Congress and the Council a plan for implementation of this Act, including for—</text> 
<paragraph id="HEDE58EB096154C6E9212A3CDF9CB645E"> <enum>(1)</enum> <text>coordinating activities of the Secretary under this Act with other Federal agencies; and</text> </paragraph>
<paragraph id="HED52B4E24F734F92B487FEEC0091EBFC"> <enum>(2)</enum> <text>distributing, to units of the System, funds available to carry out this Act.</text> </paragraph></section>
<section id="H001A2A9BD81A447D82018BF231704DBF"> <enum>13.</enum> <header>Report to Congress</header> 
<subsection id="H8F8DCCD3C87342B39BF5009BFA29F29E"> <enum>(a)</enum> <header>Requirement</header> <text>Not later than two years after the date of the enactment of this Act and every two years thereafter, the Secretary shall transmit to the Congress a report on progress made in implementing this Act.</text> </subsection>
<subsection id="H1BDD9A6FE4894D83AC935E526173F781"> <enum>(b)</enum> <header>Contents</header> <text>The report shall include the following:</text> 
<paragraph id="HA253846380E84D71B426AC605ED1946B"> <enum>(1)</enum> <text>A description of activities carried out under this Act.</text> </paragraph>
<paragraph id="H37D20215BE8E46CDAEAB4EBFC179452B"> <enum>(2)</enum> <text display-inline="yes-display-inline">An evaluation of the effectiveness of the System.</text> </paragraph>
<paragraph id="H85C77D015EFE4516AF9748EAB2D5D271"> <enum>(3)</enum> <text>Benefits of the System to users of data products resulting from the System (including the general public, industry, scientists, resource managers, emergency responders, policy makers, and educators).</text> </paragraph>
<paragraph id="H010E845060934A6E942297CFBB12B4F7"> <enum>(4)</enum> <text>Recommendations concerning—</text> 
<subparagraph id="HE47C1A1F421D49EE8443B28DCCDE6192"> <enum>(A)</enum> <text>modifications to the System; and</text> </subparagraph>
<subparagraph id="H81017557159943AC8DE3EC13797F16"> <enum>(B)</enum> <text>funding levels for the System in subsequent fiscal years.</text> </subparagraph></paragraph></subsection></section>
<section id="H253699F2B6D2419F923F8CF94264F5BE"> <enum>14.</enum> <header>Authorization of appropriations</header> <text display-inline="no-display-inline">To carry out this Act there are authorized to be appropriated to the Secretary—</text> 
<paragraph id="H301D671AD44746AB97DFBBC2038B89FA"> <enum>(1)</enum> <text>$25,000,000 for fiscal year 2005;</text> </paragraph>
<paragraph id="HBF4703502D894C9B92FEA3F16D24300"> <enum>(2)</enum> <text>$30,000,000 for fiscal year 2006;</text> </paragraph>
<paragraph id="H564978540C78406AA7BFC8BC6BD0C2B1"> <enum>(3)</enum> <text>$35,000,000 for fiscal year 2007; and</text> </paragraph>
<paragraph id="H18973A13DB734D03B15DCC66005F6020"> <enum>(4)</enum> <text>$40,000,000 for fiscal year 2008.</text> </paragraph></section>
