<official-title>To provide for the research and development of advanced nuclear reactor, solar energy, and wind energy technologies for the production of hydrogen, and for other purposes.</official-title>

<section id="H486B9E301A25455E8BA997FE4080B0FF" section-type="section-one" display-inline="no-display-inline"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be referred to as the <quote><short-title>Hydrogen Liberty Act</short-title></quote>.</text></section> 
<section id="H96CFF1EC075A42448648CDE89001567"><enum>2.</enum><header>Hydrogen Production Programs</header> 
<subsection id="H4C24BA8E858E4FADB9704B8E49A2FB1D"><enum>(a)</enum><header>Advanced reactor hydrogen cogeneration project</header> 
<paragraph id="H63446429AC8944EC9591F416AEF38784" display-inline="no-display-inline"><enum>(1)</enum><header>Project establishment</header><text> The Secretary is directed to establish an Advanced Reactor Hydrogen Cogeneration Project.</text></paragraph> 
<paragraph id="H167F1E3C09014FA400835F14B68014A"><enum>(2)</enum><header>Project definition</header><text> The project shall consist of the research, development, design, construction, and operation of a hydrogen production cogeneration research facility that, relative to the current commercial reactors, enhances safety features, reduces waste production, enhances thermal efficiencies, increases proliferation resistance, and has the potential for improved economics and physical security in reactor siting. This facility shall be constructed so as to enable research and development on advanced reactors of the type selected and on alternative approaches for reactor-based production of hydrogen.</text></paragraph> 
<paragraph id="HC51518C333654BD1B72F03E08C51D2AF" display-inline="no-display-inline"><enum>(3)</enum><header>Project management</header> 
<subparagraph id="H9543A531B7BC4DA992E190A7277C990"><enum>(A)</enum><header>Management</header><text>The project shall be managed within the Department by the Office of Nuclear Energy, Science, and Technology.</text></subparagraph> 
<subparagraph id="H8F8D1E95C75747D19234F5DECE757E9B"><enum>(B)</enum><header>Lead laboratory</header><text>The lead laboratory for the project, providing the site for the reactor construction, shall be the Idaho National Laboratory (in this subsection referred to as <quote>INL</quote>).</text></subparagraph> 
<subparagraph id="HF989884B2EA64D5BA16F922227632EEE"><enum>(C)</enum><header>Steering committee</header><text>The Secretary shall establish a national steering committee with membership from the national laboratories, universities, and industry to provide advice to the Secretary and the Director of the Office of Nuclear Energy, Science, and Technology on technical and program management aspects of the project.</text></subparagraph> 
<subparagraph id="HD234650F30AC474583D9D8B3AEDB8C16"><enum>(D)</enum><header>Collaboration</header><text>Project activities shall be conducted at INL, other national laboratories, universities, domestic industry, and international partners.</text></subparagraph></paragraph> 
<paragraph id="H2554176C0FC94071B2B92364C3BDB830" display-inline="no-display-inline"><enum>(4)</enum><header>Project requirements</header> 
<subparagraph id="H15F0277E9265426688DC018726063F2E"><enum>(A)</enum><header>Research and development</header> 
<clause id="HA75562CDA2784357802E5DE906FE676"><enum>(i)</enum><header>In general</header><text>The project shall include planning, research and development, design, and construction of an advanced, next-generation, nuclear energy system suitable for enabling further research and development on advanced reactor technologies and alternative approaches for reactor-based generation of hydrogen.</text></clause> 
<clause id="H13BF45DC79E24CFF81A0BE00398984FB"><enum>(ii)</enum><header>Reactor test capabilities at INL</header><text>The project shall utilize, where appropriate, extensive reactor test capabilities resident at INL.</text></clause> 
<clause id="H891A6E06548E41B88CEBD7E784D99C52"><enum>(iii)</enum><header>Alternatives</header><text>The project shall be designed to explore technical, environmental, and economic feasibility of alternative approaches for reactor-based hydrogen production.</text></clause> 
<clause id="H9E83D9A3BBE1493FA7F300A5925E6C12"><enum>(iv)</enum><header>Industrial lead</header><text>The industrial lead for the project shall be a company incorporated in the United States.</text></clause></subparagraph> 
<subparagraph id="H196E979974C942AFBC70CCA8DB56E3AA"><enum>(B)</enum><header>International collaboration</header> 
<clause id="H21AE2894070F464ABCE893FC4D1F5996"><enum>(i)</enum><header>In general</header><text>The Secretary shall seek international cooperation, participation, and financial contribution in this project.</text></clause> 
<clause id="HDE721DC5801E46D8929FC100D5DED506"><enum>(ii)</enum><header>Assistance from international partners</header><text>The Secretary may contract for assistance from specialists or facilities from member countries of the Generation IV International Forum, the Russian Federation, or other international partners where such specialists or facilities provide access to cost-effective and relevant skills or test capabilities.</text></clause> 
<clause id="H6767FBB62CC14427A300BE24D72CEDB"><enum>(iii)</enum><header>Generation iv international forum</header><text>International activities shall be coordinated with the Generation IV International Forum.</text></clause> 
<clause id="HF5C0A12D49B146CF94FE57777DED3BD9"><enum>(iv)</enum><header>Generation iv nuclear energy systems program</header><text>The Secretary may combine this project with the Generation IV Nuclear Energy Systems Program.</text></clause></subparagraph> 
<subparagraph id="HBF998A9D4C8E4DE49BB186B55109E154"><enum>(C)</enum><header>Demonstration</header><text>The overall project, which may involve demonstration of selected project objectives in a partner nation, must demonstrate both electricity and hydrogen production and may provide flexibility, where technically and economically feasible in the design and construction, to enable tests of alternative reactor core and cooling configurations.</text></subparagraph> 
<subparagraph id="H46A9DA53C92B424083AB0005132D1CF8"><enum>(D)</enum><header>Partnerships</header><text>The Secretary shall establish cost-shared partnerships with domestic industry or international participants for the research, development, design, construction, and operation of the research facility, and preference in determining the final project structure shall be given to an overall project which retains United States leadership while maximizing cost sharing opportunities and minimizing Federal funding responsibilities.</text></subparagraph> 
<subparagraph id="H28D76D0C26D94A79B299AA3D92EBEE97"><enum>(E)</enum><header>Target date</header><text>The Secretary shall select technologies and develop the project to provide initial testing of either hydrogen production or electricity generation by 2011, or provide a report to Congress explaining why this date is not feasible.</text></subparagraph> 
<subparagraph id="H515F8A61D3ED4A99A1A4EC798978809"><enum>(F)</enum><header>Waiver of construction timelines</header><text>The Secretary is authorized to conduct the Advanced Reactor Hydrogen Cogeneration Project without the constraints of DOE Order 413.3, relating to program and project management for the acquisition of capital assets, as necessary to meet the specified operational date.</text></subparagraph> 
<subparagraph id="H83BD6F4ABEBD42B6A5A4057454DDB3D4"><enum>(G)</enum><header>Competition</header><text>The Secretary may fund up to 2 teams for up to 1 year to develop detailed proposals for competitive evaluation and selection of a single proposal and concept for further progress. The Secretary shall define the format of the competitive evaluation of proposals.</text></subparagraph> 
<subparagraph id="H4BEEAC6FB5DF4DEFB909860074F665F"><enum>(H)</enum><header>Use of facilities</header><text>Research facilities in industry, national laboratories, or universities either within the United States or with cooperating international partners may be used to develop the enabling technologies for the research facility. Utilization of domestic university-based facilities shall be encouraged to provide educational opportunities for student development.</text></subparagraph> 
<subparagraph id="H0069EDFFD465493E975412002C176E90"><enum>(I)</enum><header>Role of nuclear regulatory commission</header> 
<clause id="HC9E851BCA3054A91A638FE1700A9D006"><enum>(i)</enum><header>In general</header><text>The Nuclear Regulatory Commission shall have licensing and regulatory authority for any reactor authorized under this subsection, pursuant to section 202 of the Energy Reorganization Act of 1974 (<external-xref legal-doc="usc" parsable-cite="usc/42/5842">42 U.S.C. 5842</external-xref>).</text></clause> 
<clause id="HE8AA114EDCBE4AEBBFCF30BF28AD80B"><enum>(ii)</enum><header>Risk-based criteria</header><text>The Secretary shall seek active participation of the Nuclear Regulatory Commission throughout the project to develop risk-based criteria for any future commercial development of a similar reactor architecture.</text></clause></subparagraph> 
<subparagraph id="H064E7E07291D4BF7ADB4E1A671FEFA2C"><enum>(J)</enum><header>Report</header><text>The Secretary shall develop and transmit to Congress a comprehensive project plan not later than 3 months after the date of enactment of this Act. The project plan shall be updated annually with each annual budget submission.</text></subparagraph></paragraph></subsection> 
<subsection id="H594904687B87464A8915184991C3BD64"><enum>(b)</enum><header>Advanced nuclear reactor technologies</header><text>The Secretary shall—</text> 
<paragraph id="H13C154CA64664BD49E13D95B009076F0"><enum>(1)</enum><text>prepare a detailed roadmap for carrying out the provisions in this Act related to advanced nuclear reactor technologies and for implementing the recommendations related to advanced nuclear reactor technologies that are included in the report transmitted under subsection (f); and</text></paragraph> 
<paragraph id="H18CAB09B543C40F2AC8CE823C5D7F9E6"><enum>(2)</enum><text>provide for the establishment of 5 projects in geographic areas that are regionally and climatically diverse to demonstrate the commercial production of hydrogen at existing nuclear power plants, including one demonstration project at a national laboratory or institution of higher education using an advanced gas-cooled reactor.</text></paragraph></subsection> 
<subsection id="H72AC9565E8DC419685B911FCDACD622"><enum>(c)</enum><header>Collocation with hydrogen production facility</header><text display-inline="yes-display-inline">Section 103 of the Atomic Energy Act of 1954 (<external-xref legal-doc="usc" parsable-cite="usc/42/2011">42 U.S.C. 2011</external-xref>) is amended by adding at the end the following new subsection: </text> 
<quoted-block style="other" id="H18E9C5AD4AE748529E3EEC03D900D788" display-inline="no-display-inline" other-style="nuclear"> 
<subsection id="H5BE83D5635264860B549C506D001CA8"><enum>g.</enum><text>The Commission shall give priority to the licensing of a utilization facility that is collocated with a hydrogen production facility. The Commission shall issue a final decision approving or disapproving the issuance of a license to construct and operate a utilization facility not later than the expiration of 2 years after the date of the submission of such application, if the application references a Commission-certified design and an early site permit, unless the Commission determines that the applicant has proposed material and substantial changes to the design or the site design parameters.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection> 
<subsection id="H3AF60620AB2B4BF7B9BC85DA2240026"><enum>(d)</enum><header>Solar energy technologies</header><text>The Secretary shall—</text> 
<paragraph id="HD1C031F4CF174756A3E1FEC700E11B94"><enum>(1)</enum><text>prepare a detailed roadmap for carrying out the provisions in this Act related to solar energy technologies and for implementing the recommendations related to solar energy technologies that are included in the report transmitted under subsection (f);</text></paragraph> 
<paragraph id="H84600750D63040E6BCACA43F02E96639"><enum>(2)</enum><text>provide for the establishment of 5 projects in geographic areas that are regionally and climatically diverse to demonstrate the production of hydrogen at solar energy facilities, including one demonstration project at a national laboratory or institution of higher education; </text></paragraph> 
<paragraph id="HDCF2821AD5BE46F697F800823967D79D"><enum>(3)</enum><text>establish a research and development program—</text> 
<subparagraph id="HC99DFD5B33F84B37B5503CE83202C3D3"><enum>(A)</enum><text>to develop optimized concentrating solar power devices that may be used for the production of both electricity and hydrogen; and</text></subparagraph> 
<subparagraph id="HE70EE7E76BF940D095F03C001411A0EB"><enum>(B)</enum><text>to evaluate the use of thermochemical cycles for hydrogen production at the temperatures attainable with concentrating solar power devices; </text></subparagraph></paragraph> 
<paragraph id="HB6891FFEEFC44EC7A5B4D3C73592A2A4"><enum>(4)</enum><text>coordinate with activities sponsored by the Department of Energy’s Office of Nuclear Energy, Science, and Technology on high-temperature materials, thermochemical cycles, and economic issues related to solar energy; </text></paragraph> 
<paragraph id="H2BACF0A4F61B42AC86B7B99FC50074BD"><enum>(5)</enum><text>provide for the construction and operation of new concentrating solar power devices or solar power cogeneration facilities that produce hydrogen either concurrently with, or independently of, the production of electricity; </text></paragraph> 
<paragraph id="H594D364147214DF09DFFEAB880825155"><enum>(6)</enum><text>support existing facilities and research programs dedicated to the development and advancement of concentrating solar power devices; and</text></paragraph> 
<paragraph id="HBA07130995FE461F93FB929B6B2173DF"><enum>(7)</enum><text>establish a program—</text> 
<subparagraph id="HA7825294CD984433BD694CDB50016FD0"><enum>(A)</enum><text>to research and develop methods that use electricity from photovoltaic devices for the onsite production of hydrogen, such that no intermediate transmission or distribution infrastructure is required or used and future demand growth may be accommodated;</text></subparagraph> 
<subparagraph id="H80542029871E448DB4494455D33CDBED"><enum>(B)</enum><text>to evaluate the economics of small-scale electrolysis for hydrogen production; and</text></subparagraph> 
<subparagraph id="H2305D4A7816349F192EE90BD63ABE0E5"><enum>(C)</enum><text>to research the potential of modular photovoltaic devices for the development of a hydrogen infrastructure, the security implications of a hydrogen infrastructure, and the benefits potentially derived from a hydrogen infrastructure.</text></subparagraph></paragraph></subsection> 
<subsection id="HCD4EA687608F433B99A595FABDDFAF5E"><enum>(e)</enum><header>Wind energy technologies</header><text>The Secretary shall—</text> 
<paragraph id="HAD8C75CF8F4747189765F6E4E101ECE"><enum>(1)</enum><text>prepare a detailed roadmap for carrying out the provisions in this Act related to wind energy technologies and for implementing the recommendations related to wind energy technologies that are included in the report transmitted under subsection (f); and</text></paragraph> 
<paragraph id="H923E53934E444FEF88EDD9F4469108F9"><enum>(2)</enum><text>provide for the establishment of 5 projects in geographic areas that are regionally and climatically diverse to demonstrate the production of hydrogen at existing wind energy facilities, including one demonstration project at a national laboratory or institution of higher education. </text></paragraph></subsection> 
<subsection id="H7A6F5B17B7274118B941605729F0868"><enum>(f)</enum><header>Report</header><text>The Secretary shall transmit to the Congress not later than 120 days after the date of enactment of this Act a report containing detailed summaries of the roadmaps prepared under subsections (b)(1), (d)(1), and (e)(1), descriptions of the Secretary’s progress in establishing the projects and other programs required under this section, and recommendations for promoting the availability of advanced nuclear reactor energy technologies, solar energy technologies, and wind energy technologies for the production of hydrogen. </text></subsection></section> 
<section id="H80506AD4A19E4B118389F1D4055C03D9"><enum>3.</enum><header>Hydrogen production research</header> 
<subsection id="H08DCA84241064EEA8F07F00113ABEB3E"><enum>(a)</enum><header>Program support</header><text>The Secretary shall support research programs at institutions of higher education for the development of advanced nuclear reactor energy technologies, solar energy technologies, and wind energy technologies for the production of hydrogen. The research programs supported under this section shall—</text> 
<paragraph id="H182AB310AB1649648B13065C797026F3"><enum>(1)</enum><text>enhance fellowship and faculty assistance programs; </text></paragraph> 
<paragraph id="H61D27673BC8E444D8417256C43F71C56"><enum>(2)</enum><text>provide support for fundamental research; </text></paragraph> 
<paragraph id="HCAF875FEDFF148778CE35CDCBE2D8050"><enum>(3)</enum><text>encourage collaborative research among industry, national laboratories, and institutions of higher education; </text></paragraph> 
<paragraph id="H8FBD0C96E29E4E1C84ED5C9D636F9EE9"><enum>(4)</enum><text>support communication and outreach; and</text></paragraph> 
<paragraph id="H0A0752A8AB324A2CB4E0BA99B76C3226"><enum>(5)</enum><text display-inline="yes-display-inline">to the greatest extent possible—</text> 
<subparagraph id="HEE8CAF089CE64F1AA831FD9913D94C1E"><enum>(A)</enum><text>be located in geographic areas that are regionally and climatically diverse; and</text></subparagraph> 
<subparagraph id="H7737F4DAEE764E69A88EDB76B09821C6"><enum>(B)</enum><text>be located at part B institutions, minority institutions, and institutions of higher education located in States participating in the Experimental Program to Stimulate Competitive Research of the Department of Energy. </text></subparagraph></paragraph></subsection> 
<subsection id="H51B71F3522174F31B104024591F93372"><enum>(b)</enum><header>Nuclear Reactor Research Programs</header><text>Research programs supported under this section that are related to advanced nuclear reactor technologies— </text> 
<paragraph id="H0F86DC20A9DB4FA7908034D8245424B"><enum>(1)</enum><text>shall be programs that research designs for nuclear reactors capable of producing hydrogen from a variety of feedstocks; </text></paragraph> 
<paragraph id="H7DB763C9F9884154A6315D36001DE8FC"><enum>(2)</enum><text>may provide technical assistance, in collaboration with the United States civilian nuclear industry, to relicense and upgrade research nuclear reactors at institutions of higher education involved in such programs;</text></paragraph> 
<paragraph id="HBE2C3AA5DCEC41CF00D2AA2B598CF338"><enum>(3)</enum><text>may use funding authorized under subsection (d)(1) for improvements of research nuclear reactors at institutions of higher education involved in such programs as part of a focused effort that emphasizes research, training, and education; and</text></paragraph> 
<paragraph id="H0B3A1345B07A4841AC4439A507EAAB2C"><enum>(4)</enum><text>may use funding authorized under subsection (d)(1) to offset a portion of the operating and maintenance costs of a research nuclear reactor at an institution of higher education involved in one of such programs. </text></paragraph></subsection> 
<subsection id="H31144889424548FBA952022FCCD88B23"><enum>(c)</enum><header>Institutions of higher education and national laboratory interactions</header><text>In conjunction with the programs supported under this section, the Secretary shall develop sabbatical, fellowship, and visiting scientist programs to encourage national laboratories and institutions of higher education to share and exchange personnel.</text></subsection> 
<subsection id="HBB554852D8F74A1A9223F7E7BDE160F8"><enum>(d)</enum><header>Authorization of appropriations</header><text></text> 
<paragraph id="HF7DF590A1E964839994E15B72790B1F9"><enum>(1)</enum><header>Advanced nuclear reactor technologies research programs</header><text>For the purpose of supporting research programs related to the development of advanced nuclear reactor technologies under this section, there are authorized to be appropriated to the Secretary—</text> 
<subparagraph id="H8C4A4BAFFAD24BE79CD53021EC319535"><enum>(A)</enum><text>$65,000,000 for fiscal year 2006;</text></subparagraph> 
<subparagraph id="H21059BD69F4843188BA1C40968DE5262"><enum>(B)</enum><text>$74,750,000 for fiscal year 2007;</text></subparagraph> 
<subparagraph id="HA346B4EA4D104F178221A5ABD55C9A5"><enum>(C)</enum><text>$85,962,500 for fiscal year 2008;</text></subparagraph>

<section id="HAC92BB2A97BE405CA1927500E573CB35"><enum>4.</enum><header>Definitions</header><text display-inline="no-display-inline">For purposes of this Act—</text> 
<paragraph id="H64C978650D5E4E7BB5041C26D500F7B6"><enum>(1)</enum><text>the term <quote>advanced nuclear reactor technologies</quote> means—</text> 
<subparagraph id="H99C4477F7EDB40668B006B8EB251A64C"><enum>(A)</enum><text>technologies related to advanced light water reactors that may be commercially available in the near-term, including mid-sized reactors with passive safety features, for the generation of electric power from nuclear fission and the production of hydrogen; and </text></subparagraph> 
<subparagraph id="HCDF1D6EB68254B9088DB401C632FD340"><enum>(B)</enum><text>technologies related to other nuclear reactors that may require prototype demonstration prior to availability in the mid-term or long-term, including high-temperature, gas-cooled reactors and liquid metal reactors, for the generation of electric power from nuclear fission and the production of hydrogen;</text></subparagraph></paragraph> 
<paragraph id="H6F4ECD5AAE7E4D3C8CCDF704370087E4"><enum>(2)</enum><text>the term <quote>concentrating solar power devices</quote> means devices that concentrate the power of the sun by reflection or refraction to improve the efficiency of a photovoltaic or thermal generation process;</text></paragraph> 
<paragraph id="H2EAE08FED38E4A69B6DCAD0014216CC9"><enum>(3)</enum><text>the term <quote>institution of higher education</quote> has the meaning given to that term in section 101(a) of the Higher Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/1001">20 U.S.C. 1001(a)</external-xref>);</text></paragraph> 
<paragraph id="H41B64A3609D74459BA1C2FA4B4FAC818"><enum>(4)</enum><text>the term <quote>minority institution</quote> has the meaning given to that term in section 365 of the Higher Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/1067k">20 U.S.C. 1067k</external-xref>); </text></paragraph> 
<paragraph id="H31928AACC2414CF587371732D96DE000"><enum>(5)</enum><text>the term <quote>part B institution</quote> has the meaning given to that term in section 322 of the Higher Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/1061">20 U.S.C. 1061</external-xref>); </text></paragraph> 
<paragraph id="HEE955B71AC814937B7026FC192FB1170"><enum>(6)</enum><text display-inline="yes-display-inline">the term <quote>photovoltaic devices</quote> means devices that convert light directly into electricity through a solid-state, semiconductor process; and</text></paragraph> 
<paragraph id="H8B6D68C5FB864EF88072972887EF628F"><enum>(7)</enum><text>the term <quote>Secretary</quote> means the Secretary of Energy.</text></paragraph></section>
