<official-title>To amend the Clean Air Act to reduce emissions from electric powerplants, and for other purposes.</official-title>

<section section-type="section-one" id="HE6C93ED4288B4BC3B2847DB73DF00D7" display-inline="no-display-inline"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Clean Smokestacks Act of 2005</short-title></quote>.</text></section> 
<section id="HA2D627F7CC114AB88F478D6091B0C377"><enum>2.</enum><header>Reduction of emissions from powerplants</header><text display-inline="no-display-inline">Part A of title I of the <act-name parsable-cite="CAA">Clean Air Act</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/42/7401">42 U.S.C. 7401 et seq.</external-xref>) is amended by adding at the end the following:</text>

<section id="HA663B13D1E1B4FABA8CE56DB667995BD"><enum>132.</enum><header>Reduction of emissions from powerplants</header> 
<subsection id="H35D6C68C946742EE90DC11A4EFCBE8DE"><enum>(a)</enum><header>Emission reduction objectives</header><text>The emission reduction objectives of this section are to reduce, not later than January 1, 2010:</text> 
<paragraph id="H6403C26F88754378A9AC40EAAFEF8F5"><enum>(1)</enum><text>aggregate sulfur dioxide emissions from powerplants by 75 percent from the levels allowed under full implementation of the Phase II sulfur dioxide requirements under title IV (relating to acid deposition control);</text></paragraph> 
<paragraph id="HA9A64C442CE64B1E8879E2C3D809445B"><enum>(2)</enum><text>aggregate nitrogen oxide emissions from powerplants by 75 percent from 1997 levels;</text></paragraph> 
<paragraph id="H07A895A14D164154B0497999B35D2BFA"><enum>(3)</enum><text>aggregate carbon dioxide emissions from powerplants to the level of carbon dioxide emissions from powerplants in 1990; and</text></paragraph> 
<paragraph id="H5797C77E596F41C88BD000463D183F47"><enum>(4)</enum><text>aggregate mercury emissions from powerplants by 90 percent from the 1999 levels.</text></paragraph></subsection> 
<subsection id="H3D8497EC700B4287BB1D96FBB935A975"><enum>(b)</enum><header>Agency action</header> 
<paragraph id="H3F393C570E90463D93FB5E59EC46106"><enum>(1)</enum><header>Regulations</header> 
<subparagraph id="HF5FC5DD5C73440CDAB3FC902FC9B4EA9"><enum>(A)</enum><header>In general</header><text>Not later than 2 years after the date of enactment of this section, the Administrator shall promulgate regulations to achieve the emission reduction objectives specified in subsection (a).</text></subparagraph> 
<subparagraph id="H6881E4C4904840FB8B638253FFB8B14E"><enum>(B)</enum><header>Elements</header><text>The regulations promulgated under subparagraph (A)—</text> 
<clause id="H839104478DDF4A0F9D727047485FB575"><enum>(i)</enum><text>shall achieve the objectives in a manner that the Administrator determines will allocate required emission reductions equitably, taking into account emission reductions achieved before the date of enactment of this section and other relevant factors;</text></clause> 
<clause id="HEAFB623874D046B38E318ECBE3D068D"><enum>(ii)</enum><text>may include, except in the case of mercury, market-oriented mechanisms (such as emissions trading based on generation performance standards, auctions, or other allocation methods);</text></clause> 
<clause id="HF7A695D4695340299B53ADC2783982F"><enum>(iii)</enum><text>shall prevent localized adverse effects on public health and the environment and ensure that significant emission reductions are achieved in both the Eastern and Western regions of the United States;</text></clause> 
<clause id="HA07F263C51C142B88D386213B0683100"><enum>(iv)</enum><text>shall ensure that any captured or recovered mercury is not rereleased into the environment; and</text></clause> 
<clause id="H166EB5F5158842DF8817729E64E73685"><enum>(v)</enum><text>shall include, consistent with achieving the objectives set forth in subsection (a), incentives for renewable energy.</text></clause></subparagraph></paragraph> 
<paragraph id="H6C4BE0DF81464AB3B4624DE61A87798"><enum>(2)</enum><header>Interagency coordination to minimize costs and maximize gains</header><text>To minimize the economic costs and maximize the economic gains of achieving the emission reduction objectives specified in subsection (a), the Administrator shall coordinate with other departments and agencies of Federal and State government to increase energy efficiency, to increase the use of renewable energy, and to implement cost saving advanced demand and supply side policies, such as those described in the report prepared by the Interlaboratory Working Group of the Department of Energy entitled <quote>Scenarios for a Clean Energy Future</quote>, dated November 2000.</text></paragraph></subsection> 
<subsection id="HF881DB5313964D1992DD592A6C9D4B7"><enum>(c)</enum><header>Additional reductions</header><text>The regulations promulgated under subsection (b) may require additional reductions in emissions from powerplants if the Administrator determines that the emission levels necessary to achieve the emission reduction objectives specified in subsection (a) are not reasonably anticipated to protect public health or welfare.</text></subsection> 
<subsection id="HD39841BAA53D45F69DF63E19C63E9448"><enum>(d)</enum><header>Modernization of outdated powerplants</header> 
<paragraph id="H4B08587F31C2442595956C6EE5FA8C18"><enum>(1)</enum><header>In general</header><text>On the later of the date that is 30 years after a powerplant commenced operation or the date that is 5 years after the date of enactment of this section, it shall comply with—</text> 
<subparagraph id="HA79206852E9B4595ABA3569500B86D9E"><enum>(A)</enum><text>the most recent new source performance standards promulgated under section 111; and</text></subparagraph> 
<subparagraph id="H3271AD2E7BAC40F0A9FCA0FEE86198F4"><enum>(B)</enum><text>the requirements under parts C and D that are applicable to modified sources.</text></subparagraph></paragraph> 
<paragraph id="H0616ADC4F3FC4969A637588B20C81154"><enum>(2)</enum><header>Additional requirements</header><text>The requirements of this subsection shall be in addition to the requirements of the regulations promulgated under subsection (b).</text></paragraph></subsection> 
<subsection id="HF6697B76343E48DFADCBECB5BAEBCEBD"><enum>(e)</enum><header>Other requirements</header><text>The requirements of this section shall be in addition to, and not in lieu of, any other requirement of this Act.</text></subsection> 
<subsection id="HFD294189A7294BD7BB67625FF703AD59"><enum>(f)</enum><header>Definition</header><text>In this section, the term <term>powerplant</term> means an electric generation facility with a nameplate capacity of 15 megawatts or more that uses a combustion device to generate electricity for sale.</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></section>
