<official-title>To amend title XVIII of the Social Security Act to provide for the coverage of marriage and family therapist services under part B of the Medicare Program, and for other purposes.</official-title>

<section section-type="section-one" id="HD6542ACD5BD343BF893DBAD1901EDC00" display-inline="no-display-inline"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Seniors Mental Health Access Improvement Act of 2005</short-title></quote>.</text></section> 
<section id="H90D114980A744E448FF5195E9F5B28A9"><enum>2.</enum><header>Coverage of marriage and family therapist services under part b</header> 
<subsection id="HA5DD849476E2438AA6D059CBAD9D457"><enum>(a)</enum><header>Coverage of services</header><text>Section 1861(s)(2) of the <act-name parsable-cite="SSA">Social Security Act</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/42/1395x">42 U.S.C. 1395x(s)(2)</external-xref>) is amended—</text> 
<paragraph id="H80E2842E805A409FA07BDFCBDE3B66A1"><enum>(1)</enum><text>in subparagraph (Y), by striking <quote>and</quote> at the end;</text></paragraph> 
<paragraph id="HB3FDD0B5FCF04A58A3CD114D045B5F4"><enum>(2)</enum><text>in subparagraph (Z), by striking the period at the end and inserting <quote>; and</quote>; and</text></paragraph> 
<paragraph id="H082A1F06B3E74FB28B00E446F2B9DD61"><enum>(3)</enum><text>by adding at the end the following new subparagraph:</text>

<subparagraph id="H8C575DC710A44417BB8187C6031672A"><enum>(AA)</enum><text>marriage and family therapist services (as defined in subsection (bbb)(1));</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection> 
<subsection id="H0C73019858A74352BD6ED9651CBF64AF"><enum>(b)</enum><header>Definition</header><text>Section 1861 of such Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395x">42 U.S.C. 1395x</external-xref>) is amended by adding at the end thereof the following new subsection:</text>

<subsection id="H7B53B3D50BC64173B58FFD2E5F12FDDB"><enum>(bbb)</enum><header>Marriage and family therapist services</header> 
<paragraph display-inline="yes-display-inline" id="H5BE5C517E64F4074A675C9AEA72598AF"><enum>(1)</enum><text>The term <term>marriage and family therapist services</term> means services performed by a marriage and family therapist (as defined in paragraph (2)) for the diagnosis and treatment of mental illnesses, which the marriage and family therapist is legally authorized to perform under State law (or the State regulatory mechanism provided by State law) of the State in which such services are performed, as would otherwise be covered if furnished by a physician or as an incident to a physician’s professional service, but only if no facility or other provider charges or is paid any amounts with respect to the furnishing of such services.</text></paragraph> 
<paragraph indent="up1" id="HDDA1355B58674848AEF27113E8A4E332"><enum>(2)</enum><text>The term <term>marriage and family therapist</term> means an individual who—</text> 
<subparagraph id="H11710925A0494B28BE2B0082AFEF55E6"><enum>(A)</enum><text>possesses a master’s or doctoral degree which qualifies for licensure or certification as a marriage and family therapist pursuant to State law;</text></subparagraph> 
<subparagraph id="H82F946D63BA34FB9A680D25B0086001D"><enum>(B)</enum><text>after obtaining such degree has performed at least two years of clinical supervised experience in marriage and family therapy; and</text></subparagraph> 
<subparagraph id="HC78E56FE7312400690221EA73175D500"><enum>(C)</enum><text>in the case of an individual performing services in a State that provides for licensure or certification of marriage or family therapists, is licensed or certified as a marriage and family therapist in such State.</text></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection> 
<subsection id="H42B22123DCCD4A57BA3385DFBF2A0BC"><enum>(c)</enum><header>Provision for payment under part b</header><text>Section 1832(a)(2)(B) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395k">42 U.S.C. 1395k(a)(2)(B)</external-xref>) is amended by adding at the end the following new clause:</text>

<clause id="H09D2543A29844FE6A27678886738C2E2"><enum>(v)</enum><text>marriage and family therapist services;</text></clause><after-quoted-block>.</after-quoted-block></quoted-block></subsection> 
<subsection id="HB8E59257D2A5445385B8854FC68CCE55"><enum>(d)</enum><header>Amount of payment</header><text>Section 1833(a)(1) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/42/13951">42 U.S.C. 13951(a)(1)</external-xref>) is amended—</text> 
<paragraph id="HF1016309800947BDB2A0BAF4ECFAC974"><enum>(1)</enum><text>by striking <quote>and (V)</quote> and inserting <quote>(V)</quote>; and</text></paragraph> 
<paragraph id="HAD708467979C4D638DF457CC9CBF4658"><enum>(2)</enum><text>by inserting before the semicolon at the end the following: <quote>, and (W) with respect to marriage and family therapist services under section 1861(s)(2)(AA), the amounts paid shall be 80 percent of the lesser of the actual charge for the services or 75 percent of the amount determined for payment of a psychologist under clause (L)</quote>.</text></paragraph></subsection> 
<subsection id="H020B26F665714B22BD5DB5474F3D6874"><enum>(e)</enum><header>Exclusion of marriage and family therapist services from skilled nursing facility prospective payment system</header><text>Section 1888(e)(2)(A)(ii) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395yy">42 U.S.C. 1395yy(e)(2)(A)(ii)</external-xref>) is amended by inserting <quote>marriage and family therapist services,</quote> after <quote>qualified psychologist services,</quote>.</text></subsection> 
<subsection id="HDA738BEC29FB4F24BCB900F442B29BFA"><enum>(f)</enum><header>Inclusion of marriage and family therapists as practitioners for assignment of claims</header><text>Section 1842(b)(18)(C) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395u">42 U.S.C. 1395u(b)(18)(C)</external-xref>) is amended by adding at the end the following new clause:</text>

<clause indent="up2" id="H6FD33730F0BE45D7B6F75DFF247ACA"><enum>(vii)</enum><text>A marriage and family therapist (as defined in section 1861(bbb)(2)).</text></clause><after-quoted-block>.</after-quoted-block></quoted-block></subsection></section> 
<section id="H482BDB26D0404D25857DCEBEAD88056E"><enum>3.</enum><header>Coverage of marriage and family therapist services provided in certain settings</header> 
<subsection id="H1C0B5B4F5782442AB2C72667DC48F93B"><enum>(a)</enum><header>Rural health clinics</header><text>Section 1861(aa)(1)(B) of the <act-name parsable-cite="SSA">Social Security Act</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/42/1395x">42 U.S.C. 1395x(aa)(1)(B)</external-xref>) is amended by inserting <quote>, by a marriage and family therapist (as defined in subsection (bbb)(2)),</quote> after <quote>by a clinical psychologist (as defined by the Secretary)</quote>.</text></subsection> 
<subsection id="HF59F3AEF5B3E4270A887165D5639BB9"><enum>(b)</enum><header>Hospice programs</header><text>Section 1861(dd)(2)(B)(i)(III) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395x">42 U.S.C. 1395x(dd)(2)(B)(i)(III)</external-xref>) is amended by inserting <quote>or marriage and family therapist (as defined in subsection (bbb)(2))</quote> after <quote>social worker</quote>.</text></subsection></section> 
<section id="H85C30FEE9CB84608A1BDD41710AA0029"><enum>4.</enum><header>Authorization of marriage and family therapists to develop discharge plans for post-hospital services</header><text display-inline="no-display-inline">Section 1861(ee)(2)(G) of the <act-name parsable-cite="SSA">Social Security Act</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/42/1395x">42 U.S.C. 1395x(ee)(2)(G)</external-xref>) is amended by inserting <quote>marriage and family therapist (as defined in subsection (bbb)(2)),</quote> after <quote>social worker,</quote>.</text></section> 
<section id="H7DAE933073324015BB2743B07B08A199"><enum>5.</enum><header>Effective date</header><text display-inline="no-display-inline">The amendments made by this Act apply with respect to services furnished on or after January 1, 2006.</text></section>
