<section id="H401AED8415644D4B9D865B6BB679E1CA"><enum>2.</enum><header>Findings</header><text display-inline="no-display-inline">The Congress finds as follows:</text> 
<paragraph id="H58AE858D367E40509C6D6689280488D8"><enum>(1)</enum><text display-inline="yes-display-inline">Methamphetamine, ecstasy, and other synthetic drugs are dangerous drugs distributed throughout the United States.</text></paragraph> 
<paragraph id="H879380D837244B4E8F4EA042ADF70039"><enum>(2)</enum><text display-inline="yes-display-inline">The manufacture, distribution, and use of methamphetamine and other synthetic drugs result in increased crime, damage to the environment, and hazardous waste that endanger the public, expensive cleanup costs often borne by Federal, State, and local government agencies, and broken families.</text></paragraph> 
<paragraph id="H67A8AF48E05A4BE9AE9060A152938B9F"><enum>(3)</enum><text display-inline="yes-display-inline">The Congress has acted many times to limit the availability of chemicals and equipment used in the manufacturing of methamphetamine and other synthetic drugs.</text></paragraph> 
<paragraph id="H666036A25BEF42A587DFA653A1BC0600"><enum>(4)</enum><text>Pseudoephedrine is one of the basic precursor chemicals used in the manufacture of methamphetamine.</text></paragraph> 
<paragraph id="HB401DC2E7E9D4F79AAA400EB4FBEC99E"><enum>(5)</enum><text>The Drug Enforcement Administration has indicated that methamphetamine manufacturers often obtain pseudoephedrine from retail and wholesale distributors, in both bottles and <quote>blister packs</quote>, and that the use of pseudoephedrine tablets in blister packs is pervasive in the illicit production of methamphetamine in both small and large clandestine methamphetamine laboratories.</text></paragraph> 
<paragraph id="H5B87E9BED22D4D5AA46FD6B29FE31C"><enum>(6)</enum><text>While current law establishes a retail sales limit of 9 grams for most pseudoephedrine products, including common cold medicine, there is no such limit on the sale of blister-packed pseudoephedrine products.</text></paragraph> 
<paragraph id="HB9547D7300B34921A5AFAE68EB2B43CE"><enum>(7)</enum><text>The 9 gram limit on bottled pseudoephedrine allows an individual to purchase approximately 366 thirty-milligram tablets per transaction, which is significantly more than a typical consumer would need for legitimate purposes.</text></paragraph> 
<paragraph id="H563C7CA992C74575B9C6AA69AA33641B"><enum>(8)</enum><text>Reducing the current 9 gram threshold to 6 grams would allow consumers to continue purchasing sufficient medication for legitimate purposes and would assist efforts to reduce illegal use of the pseudoephedrine products.</text></paragraph> 
<paragraph id="HE1F3E5FE29EB4D17B627ECE401B9992F"><enum>(9)</enum><text>The Drug Enforcement Administration recommended in March 2002 that retail distribution of pseudoephedrine tablets in blister packages should not be exempt from the general retail sales limit.</text></paragraph> 
<paragraph id="HCD01344C1E49418DAB73385919F755E7"><enum>(10)</enum><text>In recommending legislation to correct the current disparity in the law between bottled and blister-packed pseudoephedrine tablets, the Drug Enforcement Administration stated that <quote>The removal of this difference would significantly prevent illicit access to this methamphetamine precursor and would be easier for both the government and the industry to monitor and would increase compliance by retailers</quote>.</text></paragraph> 
<paragraph id="H7FD5B24ED8D24A3C957F6EE5807520E1"><enum>(11) </enum><text display-inline="yes-display-inline">In its October 2004 National Synthetic Drugs Action Plan, the Department of Justice and the Office of National Drug Control Policy also recommended that the manufacture, import, export, and distribution of pseudoephedrine and other synthetic drug precursor chemicals be subject to increased governmental oversight to reduce the danger of diversion to illegal drug production.</text></paragraph></section> 
<title id="HE8DC5996BA0E48B7B067243172668857"><enum>I</enum><header>Methamphetamine precursors</header> 
<subtitle id="HD4A0FB035B3A454EA17C6BF09B51C2B1"><enum>A</enum><header>Amendments to Controlled Substances Act</header> 
<section id="HF6DC9DA2081D4BB0A4D0F67E791B8183" display-inline="no-display-inline" section-type="subsequent-section"><enum>101.</enum><header>Regulated transactions in methamphetamine precursor chemical products</header> 
<subsection id="H79D94248E4CC430690FB628931F61307"><enum>(a)</enum><header>Reduction of retail sales threshold</header><text display-inline="yes-display-inline">Section 102(39)(A)(iv)(II) of the <act-name parsable-cite="CSA">Controlled Substances Act</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/21/802">21 U.S.C. 802(39)(A)(iv)(II)</external-xref>) is amended by striking <quote>shall be 9 grams</quote> and all that follows and inserting the following:</text> 
<quoted-block style="traditional" id="H381787B457F34294A019AF0952D8A354" display-inline="yes-display-inline"><text display-inline="yes-display-inline">shall be any quantity of pseudoephedrine over 6.0 grams in a single transaction, or any quantity of phenylpropanolamine over 6.0 grams in a single transaction, which quantity is—</text> 
<item id="HC1EB5141366B4DF4A467B43011A8B8A4"><enum>(aa) </enum><text display-inline="yes-display-inline">with respect to nonliquids, sold in package sizes of not more than 3.0 grams of pseudoephedrine base or 3.0 grams of phenylpropanolamine base, respectively, and packaged in blister packs, each blister containing not more than 2 dosage units, or where the use of blister packs is technically infeasible, packaged in unit dose packets or pouches; and</text></item> 
<item id="HFB8DE8757F724FF182D9188C297063E0"><enum>(bb)</enum><text>with respect to liquids, sold in package sizes of not more than 3.0 grams of pseudoephedrine base, or 3.0 grams of phenylpropanolamine base, respectively; or</text></item><after-quoted-block>.</after-quoted-block></quoted-block> </subsection>

<paragraph id="H9C740FA91FBB4F09B38156AD6DC267A4"><enum>(1)</enum><header>Regulated transaction</header><text>Section 102(39)(A)(iv)(I)(aa) of the <act-name parsable-cite="CSA">Controlled Substances Act</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/21/802">21 U.S.C. 802(39)(A)(iv)(I)(aa)</external-xref>) is amended by striking <quote>, except that</quote> and all that follows through <quote>1996)</quote>.</text></paragraph> 
<paragraph id="H5792DA8A1329423EA2CE4F800FC37D"><enum>(2)</enum><header>Definition</header><text display-inline="yes-display-inline">Section 102 of the <act-name parsable-cite="CSA">Controlled Substances Act</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/21/802">21 U.S.C. 802</external-xref>) is amended—</text>

<paragraph id="H8A072A0FA1BA4A8AA7EE44176E5F9158"><enum>(3)</enum><header>Rule of law</header><text>To the extent that there exists a conflict between the amendment made by paragraph (1) and section 401(d) of the Comprehensive Methamphetamine Control Act of 1996 (<external-xref legal-doc="usc" parsable-cite="usc/21/802">21 U.S.C. 802</external-xref> note), the amendment shall control.</text></paragraph></subsection> 
<subsection id="H06DBFB3356FD475BAAF1C6B64CB0143F"><enum>(c)</enum><header>Combinations involving derivatives</header><text>Section 102(39) of the <act-name parsable-cite="CSA">Controlled Substances Act</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/21/802">21 U.S.C. 802(39)</external-xref>) is amended—</text> 
<paragraph id="H69CBDFB13C27441FA0BCE720BC841B8F"><enum>(1)</enum><text> in subparagraph (A)(iv)(I)(aa), by striking <quote>the drug contains</quote> and all that follows through <quote>unless otherwise provided</quote> and inserting the following: <quote>the drug contains ephedrine, pseudoephedrine, or phenylpropanolamine unless otherwise provided</quote>; and</text></paragraph> 
<paragraph id="H3A85D7A8395B480A9DF7C77AA96662D"><enum>(2)</enum><text>by inserting after and below subparagraph (B) the following:</text>

<subtitle id="HB3EA8AAD2C83440AA5F4A36380729E48"><enum>B</enum><header>Amendments to Controlled Substances Import and Export Act</header> 
<section id="H36DC6999C38A48108C82009C1724CB26"><enum>111.</enum><header>Restrictions on importation; authority to permit imports for medical, scientific, or other legitimate purposes</header> <text display-inline="no-display-inline">Section 1002(a) of the <act-name parsable-cite="CSA">Controlled Substances Import and Export Act</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/21/952">21 U.S.C. 952(a)</external-xref>) is amended—</text> 
<paragraph id="HA7826121C66148879763D7E2C6EF6800"><enum>(1)</enum><text>in the matter preceding paragraph (1), by inserting <quote>or ephedrine, pseudoephedrine, or phenylpropanolamine,</quote> after <quote>schedule III, IV, or V of title II,</quote>;</text></paragraph>

<paragraph id="H6F6990015FAB4F529CCAA12177569400" display-inline="yes-display-inline"><enum>(1)</enum><text>With respect to a registrant under section 1008 who is authorized under subsection (a)(1) to import ephedrine, pseudoephedrine, or phenylpropanolamine, at any time during the year the registrant may apply for an increase in the amount of such chemical that the registrant is authorized to import, and the Attorney General may approve the application if the Attorney General determines that the approval is necessary to provide for medical, scientific, or other legitimate purposes regarding the chemical.</text></paragraph> 
<paragraph id="H18C2E34184CC4D0AB3037D283B08B8CC" indent="up1"><enum>(2)</enum><text>Not later than 60 days after receiving an application under paragraph (1), the Attorney General shall approve or deny the application. In approving such an application, the Attorney General shall specify the period of time for which the approval is in effect, or shall provide that the approval is effective until the registrant involved is notified by the Attorney General that the approval is terminated.</text></paragraph></subsection>

<subsection id="HA3B933E161F14A7C907078E101C6E1C"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Section 1018 of the <act-name parsable-cite="CSA">Controlled Substances Import and Export Act</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/21/971">21 U.S.C. 971</external-xref>) is amended—</text> 
<paragraph id="H67DB0C9F165248529646A04F1B209000"><enum>(1)</enum><text>by redesignating subsections (d) and (e) as subsections (e) and (f), respectively; and</text></paragraph>

<subparagraph id="H3425315810134824B201DEDEF1DC7BF8" display-inline="yes-display-inline"><enum>(A)</enum><text>Information provided in a notice under subsection (a) shall include the name of the person to whom the importer or exporter involved intends to transfer the listed chemical involved.</text></subparagraph> 
<subparagraph id="HD5ADB01BFBFA4ED49E89DB64E4D00062" indent="up2"><enum>(B)</enum><text>After a notice under subsection (a) is provided to the Attorney General, if circumstances change and the importer or exporter will not be transferring the listed chemical to the transferee identified in the notice, the importer or exporter may not transfer the listed chemical until after the expiration of the 15-day period beginning on the date on which the importer or exporter updates the notice to identify the most recent prospective transferee. The preceding sentence applies with respect to changing circumstances regarding a transferee identified in an update to the same extent and in the same manner as such sentence applies with respect to changing circumstances regarding a transferee identified in a notice under subsection (a).</text> </subparagraph> 
<subparagraph id="H19F9BE4BF2CD4C3BA67411D004B0F220" indent="up2"><enum>(C)</enum><text>If in reliance on subsection (b) an importer or exporter does not provide a notice under subsection (a) with respect to an importation or exportation, but circumstances change and the importer or exporter will not be transferring the listed chemical to a regular customer, the importer or exporter may not transfer the listed chemical until after the expiration of the 15-day period beginning on the date on which the importer or exporter notifies the Attorney General of the most recent prospective transferee. The preceding sentence applies with respect to changing circumstances regarding a transferee identified in a notice under such sentence to the same extent and in the same manner as such sentence applies with respect to the original changing circumstances in which the listed chemical was not transferred to a regular customer.</text></subparagraph> </paragraph> 
<paragraph id="H1DEF1D4731884DDDBF866610964080B8" indent="up1"><enum>(2)</enum><text display-inline="yes-display-inline">With respect to the transfer of a listed chemical by an importer or exporter:</text> 
<subparagraph id="H5DEE8F381A98499AB84800DEA17EC5A"><enum>(A)</enum><text>The Attorney General may, in accordance with the same procedures as apply under subsection (c)(2), order the suspension of a transfer of the listed chemical by the importer or exporter, other than a transfer to a regular customer of the importer or exporter, on the ground that the chemical may be diverted to the illegal or clandestine manufacture of a controlled substance, subject to the Attorney General ordering such suspension before the expiration of the 15-day period that applies with respect to the importation or exportation under subparagraph (B) or (C) of paragraph (1), as the case may be.</text></subparagraph> 
<subparagraph id="H8AE737F0B2A740069EF53E77553818D8"><enum>(B)</enum><text display-inline="yes-display-inline">From and after the time when the Attorney General provides written notice of the order under subparagraph (A) (including a statement of the legal and factual basis for the order) to the importer or exporter, the importer or exporter may not carry out the transfer.</text></subparagraph></paragraph> 
<paragraph id="HF76712671A2341D382F3BC3BDDFE87D2" indent="up1"><enum>(3)</enum><text>For purposes of this subsection:</text> 
<subparagraph id="H066EE1BA38C74CB8B3FEBE5FF8EB6930"><enum>(A)</enum><text>The terms <quote>importer</quote> and <quote>exporter</quote> mean a regulated person who imports or exports a listed chemical, respectively.</text></subparagraph> 
<subparagraph id="H2C1C53C46C6D4B22B7703BCA436E6489"><enum>(B)</enum><text>The term <quote>transfer</quote>, with respect to a listed chemical, includes the sale of the chemical.</text> </subparagraph> 
<subparagraph id="H81B27F624C024BAEB35FFBCBEAC3DCF5"><enum>(C)</enum><text>The term <quote>transferee</quote> means a person to whom an importer or exporter transfers a listed chemical.</text></subparagraph> </paragraph> </subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection> 
<subsection id="H11A35D0749CB40EB84BC1553A84B9D9B"><enum>(b)</enum><header>Conforming amendment</header><text display-inline="yes-display-inline">Section 1010(d)(5) of the <act-name parsable-cite="CSA">Controlled Substances Import and Export Act</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/21/960">21 U.S.C. 960(d)(5)</external-xref>) is amended by striking <quote>section 1018(e)(2) or (3)</quote> and inserting <quote>paragraph (2) or (3) of section 1018(f)</quote>. </text> </subsection></section></subtitle> 
<subtitle id="H6E8A35D00622421DAB4B8F0756FA81E7"><enum>C</enum><header>General provisions</header> 
<section id="HB73283CDAD554DA1B145115B3F59049C"><enum>121.</enum><header>Report by Director of Office of National Drug Control Policy regarding regulation of list I chemicals</header><text display-inline="no-display-inline">Not later than one year after the date of the enactment of this Act, the Director of the Office of National Drug Control Policy, in consultation with the Attorney General, shall submit to the Congress a report that—</text> 
<paragraph id="H28BF6A46DE6148369CFECEEFBE00F866"><enum>(1)</enum><text>provides a recommendation by the Director of whether some or all list I chemicals should be included in schedule V of the schedules of controlled substances; and</text></paragraph> 
<paragraph id="HBD86AD6D8D50472C922108667F53F356"><enum>(2)</enum><text>provides such additional recommendations regarding the regulation of list I chemicals as the Director elects to provide to the Congress.</text></paragraph></section></subtitle></title> 
<title id="H76541B7E25114B599090533D1CF79C95"><enum>II</enum><header>Resources for enforcement</header> 
<section id="HD406BC9E17224925A63139F14600CB15"><enum>201.</enum><header>Authorization of appropriations relating to COPS grants</header> 
<subsection id="H8178AE27EABC413A832FA200A6951D64"><enum>(a)</enum><header>In general</header><text>In addition to any other funds authorized to be appropriated for fiscal year 2006 for grants under part Q of title I of the <act-name parsable-cite="OCCSS">Omnibus Crime Control and Safe Streets Act of 1968</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/42/3796dd">42 U.S.C. 3796dd et seq.</external-xref>), commonly known as the COPS program, there are authorized to be appropriated $15,000,000 for such purpose to provide training to State and local prosecutors and law enforcement agents for the investigation and prosecution of methamphetamine offenses.</text></subsection> 
<subsection id="H5C022A297EC043B184EECE6E394CFC0"><enum>(b)</enum><header>Rural Set-Aside</header><text>Of amounts made available under subsection (a), $3,000,000 shall be available only for prosecutors and law enforcement agents for rural communities.</text></subsection></section> 
<section id="H87E4A3B4567740AFA94E6304C8C955B9"><enum>202.</enum><header>Expansion of methamphetamine hot spots program to include personnel and equipment for enforcement, prosecution, and cleanup</header><text display-inline="no-display-inline">Section 1701(d) of the <act-name parsable-cite="OCCSS">Omnibus Crime Control and Safe Streets Act of 1968</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/42/3796dd">42 U.S.C. 3796dd(d)</external-xref>) is amended—</text> 
<paragraph id="HF26E8FF4DF0C4E57A66F8F5D49D53B79"><enum>(1)</enum><text>in paragraph (11) by striking <quote>and</quote> at the end;</text></paragraph> 
<paragraph id="H974F8C80A34F4041B0190972F36D3DD2"><enum>(2)</enum><text>in paragraph (12) by striking the period at the end and inserting <quote>; and</quote>; and</text></paragraph>

<section changed="not-changed" commented="no" id="HA13FB6911B694A8CB63DB279765B6015"><enum>203.</enum><header>Special United States attorneys' program</header> 
<subsection changed="not-changed" commented="no" id="HFEA9242484B94C288EF97F5200A53973"><enum>(a)</enum><header>In general</header><text>The Attorney General shall allocate any amounts appropriated pursuant to the authorization under subsection (c) for the hiring and training of special assistant United States attorneys.</text></subsection> 
<subsection changed="not-changed" commented="no" id="HCBF2A8FE897F4510A7C9BEFCB8A854D9"><enum>(b)</enum><header>Use of funds</header><text>The funds allocated under subsection (a) shall be used to—</text> 
<paragraph changed="not-changed" commented="no" id="HFA4097828C184A8F9F3CDE01A753FF68"><enum>(1)</enum><text>train local prosecutors in techniques used to prosecute methamphetamine cases, including the presentation of evidence related to the manufacture of methamphetamine;</text></paragraph> 
<paragraph changed="not-changed" commented="no" id="H0FF9FE93AC8340B28F6C994301FDB037"><enum>(2)</enum><text>train local prosecutors in Federal and State laws involving methamphetamine manufacture or distribution;</text></paragraph> 
<paragraph changed="not-changed" commented="no" id="H679ECF4A73FD4D588E003C81C9D3188E"><enum>(3)</enum><text>cross-designate local prosecutors as special assistant United States attorneys; and</text></paragraph> 
<paragraph changed="not-changed" commented="no" id="H6706C7D54A8A4EEEB0A16328AC66165F"><enum>(4)</enum><text>hire additional local prosecutors who—</text> 
<subparagraph changed="not-changed" commented="no" id="HBA287F1F4535419F9437EAED7DBE0538"><enum>(A)</enum><text>with the approval of the United States attorney, shall be cross-designated to prosecute both Federal and State methamphetamine cases; and</text></subparagraph> 
<subparagraph changed="not-changed" commented="no" id="HAF9BC7F1AB2146B3AE4083828952CE98"><enum>(B)</enum><text>shall be assigned a caseload, whether in State court or Federal court, that gives the highest priority to cases in which—</text> 
<clause changed="not-changed" commented="no" id="HA0E016A545D94404973671F432894BAC"><enum>(i)</enum><text>charges related to methamphetamine manufacture or distribution are submitted by law enforcement for consideration; and</text></clause> 
<clause changed="not-changed" commented="no" id="HC931E253AE0E43CD85C3FC7C368CBE82"><enum>(ii)</enum><text>the defendant has been previously convicted of a crime related to methamphetamine manufacture or distribution.</text></clause></subparagraph></paragraph></subsection> 
<subsection changed="not-changed" commented="no" id="H9FB364031FC34FFA935FE2E3072EFC73"><enum>(c)</enum><header>Authorization of appropriations</header><text>There are authorized to be appropriated $5,000,000 for each of the fiscal years 2006 and 2007 to carry out the provisions of this section.</text></subsection></section></title> 
<title id="HA65057880DE944AC80F7F1B20811ECC5"><enum>III</enum><header>Grant programs</header> 
<subtitle id="HE7D3767EBC8A4B8C9D61FFB7451154E9"><enum>A</enum><header>Public Health Service Act</header> 
<section id="H6F9B43C8B3DC4A80B1F39322B8878592"><enum>301.</enum><header>Grants for services for children of substance abusers</header><text display-inline="no-display-inline">Section 519 of the Public Health Service Act (<external-xref legal-doc="usc" parsable-cite="usc/42/290bb-25">42 U.S.C. 290bb–25</external-xref>) is amended—</text> 
<paragraph id="H3BBF46F5B214492A8D228FC4C7DF0649"><enum>(1)</enum><text display-inline="yes-display-inline">in subsection (b), by inserting after paragraph (8) the following:</text>

<section id="H35C757BCD94145E4BAEE261FFD62FD6C"><enum>302.</enum><header>Local grants for treatment of methamphetamine abuse and related conditions</header><text display-inline="no-display-inline">Subpart 1 of part B of title V of the <act-name parsable-cite="PHSA">Public Health Service Act</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/42/290bb">42 U.S.C. 290bb et seq.</external-xref>) is amended—</text> 
<paragraph id="HF57FD11DCB46491EAB50FFDA26096769"><enum>(1)</enum><text>by redesignating the section 514 that relates to methamphetamine and appears after section 514A as section 514B;</text></paragraph> 
<paragraph id="H506699C8E4964900A0347F27A9C0E6F9"><enum>(2)</enum><text>in section 514B, as redesignated—</text> 
<subparagraph id="HC90B5BDBA418420E8400EE89487D1625"><enum>(A)</enum><text>by amending subsection (a)(1) to read as follows:</text>

<subsection id="H993A10E9AA7C41F98F0015B566794E98"><enum>(b)</enum><header>Priority for rural areas</header><text>In awarding grants under subsection (a), the Secretary shall give priority to entities that will serve rural areas experiencing an increase in methamphetamine abuse.</text></subsection><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph> 
<subparagraph id="H6BC15A822AB74197B93C2CED668BEA51"><enum>(C)</enum><text>in subsection (d)(1), by striking <quote>2000</quote> and all that follows and inserting <quote>2005 and such sums as may be necessary for each of fiscal years 2006 through 2009</quote>; and</text></subparagraph></paragraph> 
<paragraph id="HC95D1C8078DF48E2B006359F98BA7ED0"><enum>(3)</enum><text>by inserting after section 514B, as redesignated, the following:</text>

<subsection id="HE83E8A8F75084FE7BDD942BB2FC731E1"><enum>(a)</enum><header>Program authorized</header><text>The Secretary, acting through the Administrator, and in consultation with the Director of the National Institutes of Health, shall award grants to, or enter into contracts with, public or private, nonprofit entities to establish a research, training, and technical assistance center to carry out the activities described in subsection (d).</text></subsection> 
<subsection id="H162D39AAD2694144B3E5AE1131EA3BEF"><enum>(b)</enum><header>Application</header><text>A public or private, nonprofit entity seeking a grant or contract under subsection (a) shall submit an application to the Secretary at such time, in such manner, and containing such information as the Secretary may require.</text></subsection> 
<subsection id="HE1F1AF6491264334A5005769C2DC3850"><enum>(c)</enum><header>Condition</header><text>In awarding grants or entering into contracts under subsection (a), the Secretary shall ensure that not less than 1 of the centers will focus on methamphetamine abuse in rural areas.</text></subsection> 
<subsection id="H29B12AAE24E5475A8D658D3D6E1BE37F"><enum>(d)</enum><header>Authorized activities</header><text>Each center established under this section shall—</text> 
<paragraph id="H64E31597CC0F44CE9FB59CCF3D30DCD6"><enum>(1)</enum><text>engage in research and evaluation of the effectiveness of treatment modalities for the treatment of methamphetamine abuse;</text></paragraph> 
<paragraph id="HD643CC3227544A7500A2B15DE294EB4"><enum>(2)</enum><text>disseminate information to public and private entities on effective treatments for methamphetamine abuse;</text></paragraph> 
<paragraph id="H8D30308373734230970200697D30A0DD"><enum>(3)</enum><text>provide direct technical assistance to States, political subdivisions of States, and private entities on how to improve the treatment of methamphetamine abuse; and</text></paragraph> 
<paragraph id="HCE3182759F3C4248B0065C009CFA7C1C"><enum>(4)</enum><text>provide training on the effects of methamphetamine use and on effective ways of treating methamphetamine abuse to substance abuse treatment professionals and community leaders.</text></paragraph></subsection> 
<subsection id="HAA3C4DBABFF14BE7A6285E37B38DF5AA"><enum>(e)</enum><header>Reports</header><text>Each grantee or contractor under this section shall annually submit a report to the Administrator that contains—</text> 
<paragraph id="HEF7D6F9A9F0F4FFD8E126683E17BD93E"><enum>(1)</enum><text>a description of the previous year's activities of the center established under this section;</text></paragraph> 
<paragraph id="H29E3EDEF2F584108AA7B468B1DF08EFD"><enum>(2)</enum><text>effective treatment modalities undertaken by the center; and</text></paragraph> 
<paragraph id="H77680619999A4D80B4061546CB467B8D"><enum>(3)</enum><text>evidence to demonstrate that such treatment modalities were successful.</text></paragraph></subsection> 
<subsection id="H7B7DD53706174897B47D7F3E4DE02E96"><enum>(f)</enum><header>Authorization of appropriations</header><text>There are authorized to be appropriated to carry out this section $3,000,000 for fiscal year 2006 and such sums as may be necessary for each of fiscal years 2007 and 2008.</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section> </subtitle> 
<subtitle id="H1051D54394D041B4B118D9D2E5A5A406"><enum>B</enum><header>Bureau of Justice</header> 
<section id="H1F47851E27954C93A020FF4BD0CA993F"><enum>303.</enum><header>Methamphetamine precursor monitoring grants</header> 
<subsection id="H295384A043AD458B8452E86D5200B0D"><enum>(a)</enum><header>Grants authorized</header><text>The Attorney General, acting through the Bureau of Justice Assistance, may award grants to States to establish methamphetamine precursor monitoring programs.</text></subsection> 
<subsection id="H59A33E8DCB464041859DECD9946B045C"><enum>(b)</enum><header>Purpose</header><text>The purpose of the grant program established under this section is to—</text> 
<paragraph id="H8741DD7D1986412EBE01CA8CA0384D77"><enum>(1)</enum><text>prevent the sale of methamphetamine precursors, such as pseudoephedrine, to individuals in quantities so large that the only reasonable purpose of the purchase would be to manufacture methamphetamine;</text></paragraph> 
<paragraph id="H7617D91627574BB3BE5BFBAC98761387"><enum>(2)</enum><text>educate businesses that legally sell methamphetamine precursors of the need to balance the legitimate need for lawful access to medication with the risk that those substances may be used to manufacture methamphetamine; and</text></paragraph> 
<paragraph id="H53B429A495B7410CAA96F8DB44118E4"><enum>(3)</enum><text>recalibrate existing prescription drug monitoring programs designed to track the sale of controlled substances to also track the sale of pseudoephedrine in any amount greater than 6 grams.</text></paragraph></subsection> 
<subsection id="H01E8D2ABA4964D68A6F0750000A072F8"><enum>(c)</enum><header>Use of grant funds</header><text>Grant funds awarded to States under this section may be used to—</text> 
<paragraph id="H16095C03F1FB40E09B49659879CAF5F9"><enum>(1)</enum><text>implement a methamphetamine precursor monitoring program, including hiring personnel and purchasing computer hardware and software designed to monitor methamphetamine precursor purchases;</text></paragraph> 
<paragraph id="HAF3AB01639D04BC6B3509B36DB645F02"><enum>(2)</enum><text>expand existing methamphetamine precursor or prescription drug monitoring programs to accomplish the purposes described in subsection (b);</text></paragraph> 
<paragraph id="H3FBED58D2CE246ED98C1034DB413C11"><enum>(3)</enum><text>pay for training and technical assistance for law enforcement personnel and employees of businesses that lawfully sell substances, which may be used as methamphetamine precursors;</text></paragraph> 
<paragraph id="H4E1EE8A0DDCB445E9D396D0043E53E68"><enum>(4)</enum><text>improve information sharing between adjacent States through enhanced connectivity; or</text></paragraph> 
<paragraph id="H005977E70F2A4E9C99D1046DC25BB79C"><enum>(5)</enum><text>make grants to subdivisions of the State to implement methamphetamine precursor monitoring programs.</text></paragraph></subsection> 
<subsection id="H34364D6AB5F54A12A1908B34BBEE34F6"><enum>(d)</enum><header>Application</header><text>Any State seeking a grant under this section shall submit an application to the Attorney General at such time, in such manner, and containing such information as the Attorney General may require.</text></subsection> 
<subsection id="H7EB44F50AB4346B0B24B42703ED0525"><enum>(e)</enum><header>Authorization of appropriations</header><text>There are authorized to be appropriated $5,000,000 for each of the fiscal years 2006 and 2007 to carry out the provisions of this section.</text></subsection></section></subtitle></title>
