<paragraph commented="no" display-inline="no-display-inline" id="HC5A083ADA1E1476CA0902796FF1EACAA"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">Section 1902 (<external-xref legal-doc="usc" parsable-cite="usc/42/1396a">42 U.S.C. 1396a</external-xref>) is amended—</text> 
<subparagraph commented="no" display-inline="no-display-inline" id="HB68774DB3190440FBF56D770B369AEAB"><enum>(A)</enum><text display-inline="yes-display-inline">in subsection (a)(10)(A)(ii)—</text> 
<clause commented="no" display-inline="no-display-inline" id="HB629774AB4554AEE991700B8AB4BF6DA"><enum>(i)</enum><text display-inline="yes-display-inline">by striking <quote>or</quote> at the end of subclause (XVII);</text></clause> 
<clause commented="no" display-inline="no-display-inline" id="HC2F7B48DE8994A1FBD63C84C83A2F6FB"><enum>(ii)</enum><text display-inline="yes-display-inline">by adding <quote>or</quote> at the end of subclause (XVIII); and</text></clause>

<subparagraph commented="no" display-inline="no-display-inline" id="HC6667278FCB148898553DAE7BEE5E81F"><enum>(B)</enum><text display-inline="yes-display-inline">by adding at the end the following new subsection:</text>

<subsection commented="no" display-inline="no-display-inline" id="H1E97C9314B1D4942A7C02CD4C0EC4152"><enum>(cc)</enum> 
<paragraph commented="no" display-inline="yes-display-inline" id="H2B1A4D30375649000064B6936D27A9B9"><enum>(1)</enum><text display-inline="yes-display-inline">Individuals described in this paragraph are individuals—</text> 
<subparagraph commented="no" display-inline="no-display-inline" id="HAAB4DA18DA65456BA8F1946C04AD8E2" indent="up1"><enum>(A)</enum><text display-inline="yes-display-inline">who are children who have not attained 19 years of age and are born—</text> 
<clause commented="no" display-inline="no-display-inline" id="HFFEE9CD15D1B4D11998050CF29CEAE6B"><enum>(i)</enum><text display-inline="yes-display-inline">on or after October 1, 1999 (or, at the option of a State, on or after an earlier date), in the case of fiscal year 2006;</text></clause> 
<clause commented="no" display-inline="no-display-inline" id="H72336E3F4DEA4B50B3641F65262F1299"><enum>(ii)</enum><text display-inline="yes-display-inline">on or after October 1, 1994 (or, at the option of a State, on or after an earlier date), in the case of fiscal year 2007; and</text></clause> 
<clause commented="no" display-inline="no-display-inline" id="H84502CB01AFF41B6854FFC7D78346C69"><enum>(iii)</enum><text display-inline="yes-display-inline">after October 1, 1988, in the case of fiscal year 2008 and any fiscal year thereafter;</text></clause></subparagraph> 
<subparagraph commented="no" display-inline="no-display-inline" id="HA3525C7E975F42B288003EB3D068C330" indent="up1"><enum>(B)</enum><text display-inline="yes-display-inline">who would be considered disabled under section 1614(a)(3)(C) but for having earnings or deemed income or resources (as determined under title XVI for children) that exceed the requirements for receipt of supplemental security income benefits; and</text></subparagraph> 
<subparagraph commented="no" display-inline="no-display-inline" id="HB8711E1B935F491C8E07B54CE1D8EF5E" indent="up1"><enum>(C)</enum><text display-inline="yes-display-inline">whose family income does not exceed such income level as the State establishes and does not exceed—</text> 
<clause commented="no" display-inline="no-display-inline" id="H09266766861F4DAFAE44562310E5DA"><enum>(i)</enum><text display-inline="yes-display-inline">300 percent of the poverty line (as defined in section 2110(c)(5)) applicable to a family of the size involved; or</text></clause> 
<clause commented="no" display-inline="no-display-inline" id="HB2C0DC8059164E5B90F4471E27B794BB"><enum>(ii)</enum><text display-inline="yes-display-inline">such higher percent of such poverty line as a State may establish, except that—</text> 
<subclause commented="no" display-inline="no-display-inline" id="H4DBE7C06D15E46EAB3544D006BDAF798"><enum>(I)</enum><text display-inline="yes-display-inline">any medical assistance provided to an individual whose family income exceeds 300 percent of such poverty line may only be provided with State funds; and</text></subclause> 
<subclause commented="no" display-inline="no-display-inline" id="HD9709834760E4404A68FBAC1C7A8A700"><enum>(II)</enum><text display-inline="yes-display-inline">no Federal financial participation shall be provided under section 1903(a) for any medical assistance provided to such an individual.</text></subclause></clause></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph> 
<paragraph commented="no" display-inline="no-display-inline" id="H7FA2544FF061400DA2D4B5CB11025BAE"><enum>(2)</enum><header>Interaction with employer-sponsored family coverage</header><text display-inline="yes-display-inline">Section 1902(cc) (<external-xref legal-doc="usc" parsable-cite="usc/42/1396a">42 U.S.C. 1396a(cc)</external-xref>), as added by paragraph (1)(B), is amended by adding at the end the following new paragraph:</text> 
<quoted-block display-inline="no-display-inline" id="H610B5697F6464E68BF87D8B338CFDEEF" style="OLC"> 
<paragraph commented="no" display-inline="no-display-inline" id="H2A5AE28AF9BF4A8982DC057446FCFE73" indent="up1"><enum>(2)</enum> 
<subparagraph commented="no" display-inline="yes-display-inline" id="HCDE9DE0D5D934562BD0869E85C9390BF"><enum>(A)</enum><text display-inline="yes-display-inline">If an employer of a parent of an individual described in paragraph (1) offers family coverage under a group health plan (as defined in section 2791(a) of the <act-name parsable-cite="PHSA">Public Health Service Act</act-name>), the State shall—</text> 
<clause commented="no" display-inline="no-display-inline" id="HD42ECF78BB1F412C91296C0098B83252" indent="up1"><enum>(i)</enum><text display-inline="yes-display-inline">require such parent to apply for, enroll in, and pay premiums for such coverage as a condition of such parent’s child being or remaining eligible for medical assistance under subsection (a)(10)(A)(ii)(XIX) if the parent is determined eligible for such coverage and the employer contributes at least 50 percent of the total cost of annual premiums for such coverage; and</text></clause> 
<clause commented="no" display-inline="no-display-inline" id="H75ECC70D16124770BA5B09BA02DA0969" indent="up1"><enum>(ii)</enum><text display-inline="yes-display-inline">if such coverage is obtained—</text> 
<subclause commented="no" display-inline="no-display-inline" id="H9CB7FA0AA2834F6091627DABF00229BE"><enum>(I)</enum><text display-inline="yes-display-inline">subject to paragraph (2) of section 1916(h), reduce the premium imposed by the State under that section in an amount that reasonably reflects the premium contribution made by the parent for private coverage on behalf of a child with a disability; and</text></subclause> 
<subclause commented="no" display-inline="no-display-inline" id="H3E9BDC2C46404C9E9FD821222F007E55"><enum>(II)</enum><text display-inline="yes-display-inline">treat such coverage as a third party liability under subsection (a)(25).</text></subclause></clause></subparagraph> 
<subparagraph commented="no" display-inline="no-display-inline" id="H887C8CB97E92461C9DD025BEB8330063" indent="up1"><enum>(B)</enum><text display-inline="yes-display-inline">In the case of a parent to which subparagraph (A) applies, a State, subject to paragraph (1)(A)(iii)(II), may provide for payment of any portion of the annual premium for such family coverage that the parent is required to pay. Any payments made by the State under this subparagraph shall be considered, for purposes of section 1903(a), to be payments for medical assistance.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection> 
<subsection commented="no" display-inline="no-display-inline" id="HCDCD7FC0FC9D4D90806C7BB9DF233447"><enum>(b)</enum><header>State option To impose Income-Related premiums</header><text display-inline="yes-display-inline">Section 1916 (<external-xref legal-doc="usc" parsable-cite="usc/42/1396o">42 U.S.C. 1396o</external-xref>) is amended—</text> 
<paragraph commented="no" display-inline="no-display-inline" id="H47B093F94A304FB499071BB4A33CC070"><enum>(1)</enum><text display-inline="yes-display-inline">in subsection (a), by striking <quote>subsection (g)</quote> and inserting <quote>subsections (g) and (h)</quote>; and</text></paragraph> 
<paragraph commented="no" display-inline="no-display-inline" id="HA473DF7177C24AC3930037B12DED221E"><enum>(2)</enum><text display-inline="yes-display-inline">by adding at the end the following new subsection:</text> 
<quoted-block display-inline="no-display-inline" id="H74E9C213B2E94F8F9D00B23B0037369F" style="OLC"> 
<subsection commented="no" display-inline="no-display-inline" id="H5A8AF62FDD454562B7B7404B7011EB85"><enum>(h)</enum> 
<paragraph commented="no" display-inline="yes-display-inline" id="H2517E1218B784EABABABC4AFF3C2EED"><enum>(1)</enum><text display-inline="yes-display-inline">With respect to disabled children provided medical assistance under section 1902(a)(10)(A)(ii)(XIX), subject to paragraph (2), a State may (in a uniform manner for such children) require the families of such children to pay monthly premiums set on a sliding scale based on family income.</text></paragraph> 
<paragraph commented="no" display-inline="no-display-inline" id="H186CC16FD45A4DB4A65C684CE557C043" indent="up1"><enum>(2)</enum><text display-inline="yes-display-inline">A premium requirement imposed under paragraph (1) may only apply to the extent that—</text> 
<subparagraph commented="no" display-inline="no-display-inline" id="HFA5A5C5A99814981B1C8517614D679EE"><enum>(A)</enum><text display-inline="yes-display-inline">in the case of a disabled child described in that paragraph whose family income—</text> 
<clause commented="no" display-inline="no-display-inline" id="H1D8B7040802445D198C386AE8D12046E"><enum>(i)</enum><text display-inline="yes-display-inline">does not exceed 200 percent of the poverty line, the aggregate amount of such premium and any premium that the parent is required to pay for family coverage under section 1902(cc)(2)(A)(i) and other cost sharing charges do not exceed 5 percent of the family’s income; and</text></clause> 
<clause commented="no" display-inline="no-display-inline" id="HEEF51A1F0E674381B8E0C3419F88886F"><enum>(ii)</enum><text display-inline="yes-display-inline">exceeds 200, but does not exceed 300, percent of the poverty line, the aggregate amount of such premium and any premium that the parent is required to pay for family coverage under section 1902(cc)(2)(A)(i) and other cost sharing charges do not exceed 7.5 percent of the family’s income; and</text></clause></subparagraph> 
<subparagraph commented="no" display-inline="no-display-inline" id="HD7B5A378CCE74AE2B3F550BCEC36F7D0"><enum>(B)</enum><text display-inline="yes-display-inline">the requirement is imposed consistent with section 1902(cc)(2)(A)(ii)(I).</text></subparagraph></paragraph> 
<paragraph commented="no" display-inline="no-display-inline" id="H2C30E7A501A748DDA55C98F86658AF7D" indent="up1"><enum>(3)</enum><text display-inline="yes-display-inline">A State shall not require prepayment of a premium imposed pursuant to paragraph (1) and shall not terminate eligibility of a child under section 1902(a)(10)(A)(ii)(XIX) for medical assistance under this title on the basis of failure to pay any such premium until such failure continues for a period of at least 60 days from the date on which the premium became past due. The State may waive payment of any such premium in any case where the State determines that requiring such payment would create an undue hardship.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection> 
<subsection commented="no" display-inline="no-display-inline" id="H873F08800BF74BDEBFAA2DE6F488EDB"><enum>(c)</enum><header>Conforming amendments</header> 
<paragraph commented="no" display-inline="yes-display-inline" id="HF3A9A176E9A24AA68132531E4CE7367"><enum>(1)</enum><text display-inline="yes-display-inline">Section 1903(f)(4) (<external-xref legal-doc="usc" parsable-cite="usc/42/1396b">42 U.S.C. 1396b(f)(4)</external-xref>) is amended in the matter preceding subparagraph (A), by inserting <quote>1902(a)(10)(A)(ii)(XIX),</quote> after <quote>1902(a)(10)(A)(ii)(XVIII),</quote>.</text></paragraph> 
<paragraph commented="no" display-inline="no-display-inline" id="H5FA41EFEAE2B4C20B56D8480335C5462" indent="up1"><enum>(2)</enum><text display-inline="yes-display-inline">Section 1905(u)(2)(B) (<external-xref legal-doc="usc" parsable-cite="usc/42/1396d">42 U.S.C. 1396d(u)(2)(B)</external-xref>) is amended by adding at the end the following sentence: <quote>Such term excludes any child eligible for medical assistance only by reason of section 1902(a)(10)(A)(ii)(XIX).</quote>.</text></paragraph></subsection> 
<subsection commented="no" display-inline="no-display-inline" id="H644800443DFF4CBCB9EEE66400462902"><enum>(d)</enum><header>Effective date</header><text display-inline="yes-display-inline">The amendments made by this section shall apply to medical assistance for items and services furnished on or after October 1, 2005.</text></subsection></section> 
<section commented="no" display-inline="no-display-inline" id="HD91176122E1F45EC8B7920D5E1B559ED" section-type="subsequent-section"><enum>4.</enum><header>Demonstration projects regarding home and community-based alternative to psychiatric residential treatment facilities for children</header> 
<subsection commented="no" display-inline="no-display-inline" id="HE4F298C9FC34424D9FF1897F7CDE00"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">The Secretary of Health and Human Services (in this section referred to as the <quote>Secretary</quote>) is authorized to conduct, during each of fiscal years 2006 through 2010, demonstration projects (each in the section referred to as a <quote>demonstration project</quote>) in accordance with this section under which up to 10 States (as defined for purposes of title XIX of the <act-name parsable-cite="SSA">Social Security Act</act-name>) are awarded grants, on a competitive basis, to test the effectiveness in improving or maintaining a child’s functional level and cost-effectiveness of providing coverage of home and community-based alternatives to psychiatric residential treatment for children enrolled in the medicaid program under title XIX of such Act.</text></subsection> 
<subsection commented="no" display-inline="no-display-inline" id="HFAD4B38048414402A62F5D6192A9492B"><enum>(b)</enum><header>Application of terms and conditions</header> 
<paragraph commented="no" display-inline="no-display-inline" id="H4D4F6027188044FEA52C5D3D7B0049ED"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">Subject to the provisions of this section, for the purposes of the demonstration projects, and only with respect to children enrolled under such demonstration projects, a psychiatric residential treatment facility (as defined in <external-xref legal-doc="usc" parsable-cite="usc/42/483">section 483.352</external-xref> of title 42 of the Code of Federal Regulations) shall be deemed to be a facility specified in section 1915(c) of the <act-name parsable-cite="SSA">Social Security Act</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/42/1396n">42 U.S.C. 1396n(c)</external-xref>), and to be included in each reference in such section 1915(c) to hospitals, nursing facilities, and intermediate care facilities for the mentally retarded.</text></paragraph> 
<paragraph commented="no" display-inline="no-display-inline" id="HA6385F1D5A5F4CFBB711F5BD965652DD"><enum>(2)</enum><header>State option to assure continuity of medicaid coverage</header><text display-inline="yes-display-inline">Upon the termination of a demonstration project under this section, the State that conducted the project may elect, only with respect to a child who is enrolled in such project on the termination date, to continue to provide medical assistance for coverage of home and community-based alternatives to psychiatric residential treatment for the child in accordance with section 1915(c) of the <act-name parsable-cite="SSA">Social Security Act</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/42/1396n">42 U.S.C. 1396n(c)</external-xref>), as modified through the application of paragraph (1). Expenditures incurred for providing such medical assistance shall be treated as a home and community-based waiver program under section 1915(c) of the <act-name parsable-cite="SSA">Social Security Act</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/42/1396n">42 U.S.C. 1396n(c)</external-xref>) for purposes of payment under section 1903 of such Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1396b">42 U.S.C. 1396b</external-xref>).</text></paragraph></subsection> 
<subsection commented="no" display-inline="no-display-inline" id="HE92C50ADCF9342B4A9943CF90021866D"><enum>(c)</enum><header>Terms of demonstration projects</header> 
<paragraph commented="no" display-inline="no-display-inline" id="H443B7D0E61324D469350BA6BD7074F91"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">Except as otherwise provided in this section, a demonstration project shall be subject to the same terms and conditions as apply to a waiver under section 1915(c) of the <act-name parsable-cite="SSA">Social Security Act</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/42/1396n">42 U.S.C. 1396n(c)</external-xref>), including the waiver of certain requirements under the first sentence of paragraph (3) of such section but not applying the second sentence of such paragraph.</text></paragraph> 
<paragraph commented="no" display-inline="no-display-inline" id="HBD03B4EDCF264EC28564BBAD90F43956"><enum>(2)</enum><header>Budget neutrality</header><text display-inline="yes-display-inline">In conducting the demonstration projects under this section, the Secretary shall ensure that the aggregate payments made by the Secretary under title XIX of the <act-name parsable-cite="SSA">Social Security Act</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/42/1396">42 U.S.C. 1396 et seq.</external-xref>) do not exceed the amount by which the Secretary estimates would have been paid under that title if the demonstration projects under this section had not been implemented.</text></paragraph> 
<paragraph commented="no" display-inline="no-display-inline" id="HE8310B88FFCF44459F86540860BF8E99"><enum>(3)</enum><header>Evaluation</header><text display-inline="yes-display-inline">The application for a demonstration project shall include an undertaking to provide for such interim and final evaluations of the demonstration project by independent third parties, and for such interim and final reports to the Secretary, as the Secretary may require.</text></paragraph></subsection> 
<subsection commented="no" display-inline="no-display-inline" id="H09BB56DB2A8442958284C1AF851E52B0"><enum>(d)</enum><header>Payments to States; limitations to scope and funding</header> 
<paragraph commented="no" display-inline="no-display-inline" id="H2AB16AB9B02A47E3BBEA6BFEEB9CC32"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">Subject to paragraph (2), a demonstration project approved by the Secretary under this section shall be treated as a home and community-based waiver program under section 1915(c) of the <act-name parsable-cite="SSA">Social Security Act</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/42/1396n">42 U.S.C. 1396n(c)</external-xref>) for purposes of payment under section 1903 of such Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1396b">42 U.S.C. 1396b</external-xref>).</text></paragraph> 
<paragraph commented="no" display-inline="no-display-inline" id="H665B043A44F14F1B84BF4F53745625CE"><enum>(2)</enum><header>Limitation</header><text display-inline="yes-display-inline">In no case may the amount of payments made by the Secretary under this section for State demonstration projects for a fiscal year exceed the amount available under subsection (f)(2)(A) for such fiscal year.</text></paragraph></subsection> 
<subsection commented="no" display-inline="no-display-inline" id="HE6A800CA79EC4DBE8081F354B20ED9C"><enum>(e)</enum><header>Secretary’s evaluation and report</header><text display-inline="yes-display-inline">The Secretary shall conduct an interim and final evaluation of State demonstration projects under this section and shall report to the President and Congress the conclusions of such evaluations within 12 months of completing such evaluations.</text></subsection> 
<subsection commented="no" display-inline="no-display-inline" id="H4B648F3259CF4283AF35A083B2066949"><enum>(f)</enum><header>Funding</header> 
<paragraph commented="no" display-inline="no-display-inline" id="H99D6EACC185F4158B8D02BC1EB763E1B"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">For the purpose of carrying out this section, there are appropriated, from amounts in the Treasury not otherwise appropriated, for fiscal years 2006 through 2010 a total of $218,000,000, of which—</text> 
<subparagraph commented="no" display-inline="no-display-inline" id="HA4F3BE2477E14459A52F001B9F003CE9"><enum>(A)</enum><text display-inline="yes-display-inline">the amount specified in paragraph (2) shall be available for each of fiscal years 2006 through 2010; and</text></subparagraph> 
<subparagraph commented="no" display-inline="no-display-inline" id="HE35FCD45523F418889F4C01402DECF59"><enum>(B)</enum><text display-inline="yes-display-inline">a total of $1,000,000 shall be available to the Secretary for the evaluations and report under subsection (f).</text></subparagraph></paragraph> 
<paragraph commented="no" display-inline="no-display-inline" id="H82CF7AC37492465D861C14AC776148"><enum>(2)</enum><header>Fiscal year limit</header> 
<subparagraph commented="no" display-inline="no-display-inline" id="HB34554F705114D5F8B20BE60FE52431F"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">For purposes of paragraph (1), the amount specified in this paragraph for a fiscal year is the amount specified in subparagraph (B) for the fiscal year plus the difference, if any, between the total amount available under this paragraph for prior fiscal years and the total amount previously expended under paragraph (1)(A) for such prior fiscal years.</text></subparagraph> 
<subparagraph commented="no" display-inline="no-display-inline" id="H72FA170F41DD4C2D87A278D1D419CC"><enum>(B)</enum><header>Fiscal year amounts</header><text display-inline="yes-display-inline">The amount specified in this subparagraph for—</text> 
<clause commented="no" display-inline="no-display-inline" id="H5FE2154A2D2F4E29BB3779A744085438"><enum>(i)</enum><text display-inline="yes-display-inline">fiscal year 2006 is $21,000,000;</text></clause> 
<clause commented="no" display-inline="no-display-inline" id="H9460C39BE3AF4739A600CBC000816995"><enum>(ii)</enum><text display-inline="yes-display-inline">fiscal year 2007 is $37,000,000;</text></clause> 
<clause commented="no" display-inline="no-display-inline" id="H4EF73C5BA9404B92B0D0C3BCEA804944"><enum>(iii)</enum><text display-inline="yes-display-inline">fiscal year 2008 is $49,000,000;</text></clause> 
<clause commented="no" display-inline="no-display-inline" id="HD4D2E4AFEE634EC8A2A40002488D8439"><enum>(iv)</enum><text display-inline="yes-display-inline">fiscal year 2009 is $53,000,000; and</text></clause> 
<clause commented="no" display-inline="no-display-inline" id="H30C5BB3314CB45C882F625572DD5169"><enum>(v)</enum><text display-inline="yes-display-inline">fiscal year 2010 is $57,000,000.</text></clause></subparagraph></paragraph></subsection></section> 
<section commented="no" display-inline="no-display-inline" id="H7CD81FE1F9B845CE007D22AA5243585D" section-type="subsequent-section"><enum>5.</enum><header>Development and support of family-to-family health information centers</header><text display-inline="no-display-inline">Section 501 (<external-xref legal-doc="usc" parsable-cite="usc/42/701">42 U.S.C. 701</external-xref>) is amended by adding at the end the following new subsection:</text>

<subsection commented="no" display-inline="no-display-inline" id="H2BD3A1368FDB42B1A432E2A26C8CA9DC"><enum>(c)</enum> 
<paragraph commented="no" display-inline="yes-display-inline" id="HE5CB35498FCD4B20A400B7DB43EBD91F"><enum>(1)</enum> 
<subparagraph commented="no" display-inline="yes-display-inline" id="HFE79EC67175745D38FA57BFBF8DEB64"><enum>(A)</enum><text display-inline="yes-display-inline">For the purpose of enabling the Secretary (through grants, contracts, or otherwise) to provide for special projects of regional and national significance for the development and support of family-to-family health information centers described in paragraph (2)—</text> 
<clause commented="no" display-inline="no-display-inline" id="HBED8791B71D34F3D83008503B817C04C" indent="up2"><enum>(i)</enum><text display-inline="yes-display-inline">there is appropriated to the Secretary, out of any money in the Treasury not otherwise appropriated—</text> 
<subclause commented="no" display-inline="no-display-inline" id="H781373BB3DF443D8B8BE6CC8F49C3D45"><enum>(I)</enum><text display-inline="yes-display-inline">$3,000,000 for fiscal year 2006;</text></subclause> 
<subclause commented="no" display-inline="no-display-inline" id="H3EEA461F64F14FE59805FCAB6782BE86"><enum>(II)</enum><text display-inline="yes-display-inline">$4,000,000 for fiscal year 2007; and</text></subclause> 
<subclause commented="no" display-inline="no-display-inline" id="H578D8DC3D7484442ADF6DEBCA7BD319E"><enum>(III)</enum><text display-inline="yes-display-inline">$5,000,000 for fiscal year 2008; and</text></subclause></clause> 
<clause commented="no" display-inline="no-display-inline" id="HDCB1864E93BB4CA6B4FB9BBE37B01388" indent="up2"><enum>(ii)</enum><text display-inline="yes-display-inline">there is authorized to be appropriated to the Secretary, $5,000,000 for each of fiscal years 2009 and 2010.</text></clause></subparagraph> 
<subparagraph commented="no" display-inline="no-display-inline" id="HDA266BF3D2814B48B8683C00098415C4" indent="up2"><enum>(B)</enum><text display-inline="yes-display-inline">Funds appropriated or authorized to be appropriated under subparagraph (A) shall—</text> 
<clause commented="no" display-inline="no-display-inline" id="H9E2C761150DC44C3B79C5286C4F23361"><enum>(i)</enum><text display-inline="yes-display-inline">be in addition to amounts appropriated under subsection (a) and retained under section 502(a)(1) for the purpose of carrying out activities described in subsection (a)(2); and</text></clause> 
<clause commented="no" display-inline="no-display-inline" id="HFA931A335FDE4B3E87D600C8DE14E97C"><enum>(ii)</enum><text display-inline="yes-display-inline">remain available until expended.</text></clause></subparagraph></paragraph> 
<paragraph commented="no" display-inline="no-display-inline" id="H38661E393C224D26BB0137E9AB2F1DC5" indent="up1"><enum>(2)</enum><text display-inline="yes-display-inline">The family-to-family health information centers described in this paragraph are centers that—</text> 
<subparagraph commented="no" display-inline="no-display-inline" id="H9114689E89DB452C9139F3C3E18C7477"><enum>(A)</enum><text display-inline="yes-display-inline">assist families of children with disabilities or special health care needs to make informed choices about health care in order to promote good treatment decisions, cost-effectiveness, and improved health outcomes for such children;</text></subparagraph> 
<subparagraph commented="no" display-inline="no-display-inline" id="H7873BD12CE0F4A5CB3186E35D11F8EDE"><enum>(B)</enum><text display-inline="yes-display-inline">provide information regarding the health care needs of, and resources available for, such children;</text></subparagraph> 
<subparagraph commented="no" display-inline="no-display-inline" id="HF3B26D78BF5E407986ECD4A00AF9BD6"><enum>(C)</enum><text display-inline="yes-display-inline">identify successful health delivery models for such children;</text></subparagraph> 
<subparagraph commented="no" display-inline="no-display-inline" id="H900E6CF4ED6E4E109EBE0678B40735B0"><enum>(D)</enum><text display-inline="yes-display-inline">develop with representatives of health care providers, managed care organizations, health care purchasers, and appropriate State agencies a model for collaboration between families of such children and health professionals;</text></subparagraph> 
<subparagraph commented="no" display-inline="no-display-inline" id="H45EDFEB18650449E008240DD0054E5ED"><enum>(E)</enum><text display-inline="yes-display-inline">provide training and guidance regarding caring for such children;</text></subparagraph> 
<subparagraph commented="no" display-inline="no-display-inline" id="HAE9311E6F46E4986BEAD3C19A8135F10"><enum>(F)</enum><text display-inline="yes-display-inline">conduct outreach activities to the families of such children, health professionals, schools, and other appropriate entities and individuals; and</text></subparagraph> 
<subparagraph commented="no" display-inline="no-display-inline" id="H46DF9ED0B3364A40BAC5F65B00288CB7"><enum>(G)</enum><text display-inline="yes-display-inline">are staffed—</text> 
<clause commented="no" display-inline="no-display-inline" id="H1EFF6350CCCB49B08EBBB6BB323F1B7"><enum>(i)</enum><text display-inline="yes-display-inline">by such families who have expertise in Federal and State public and private health care systems; and</text></clause> 
<clause commented="no" display-inline="no-display-inline" id="H212E53717BA841E2A900518300618D70"><enum>(ii)</enum><text display-inline="yes-display-inline">by health professionals.</text></clause></subparagraph></paragraph> 
<paragraph commented="no" display-inline="no-display-inline" id="HF7D5AD9C855A4A59B10000632082F234" indent="up1"><enum>(3)</enum><text display-inline="yes-display-inline">The Secretary shall develop family-to-family health information centers described in paragraph (2) in accordance with the following:</text> 
<subparagraph commented="no" display-inline="no-display-inline" id="HA852AEF80C9C48EC9459D4D8150000FC"><enum>(A)</enum><text display-inline="yes-display-inline">With respect to fiscal year 2006, such centers shall be developed in not less than 25 States.</text></subparagraph> 
<subparagraph commented="no" display-inline="no-display-inline" id="HF1EA7CFD2BF546D7A9A09908985ED2E8"><enum>(B)</enum><text display-inline="yes-display-inline">With respect to fiscal year 2007, such centers shall be developed in not less than 40 States.</text></subparagraph> 
<subparagraph commented="no" display-inline="no-display-inline" id="H89FFB53FD0564C10B798BAB1C6EC814E"><enum>(C)</enum><text display-inline="yes-display-inline">With respect to fiscal year 2008, such centers shall be developed in all States.</text></subparagraph></paragraph> 
<paragraph commented="no" display-inline="no-display-inline" id="HCCB8ED51DF3B4433BAE557524E8D93DB" indent="up1"><enum>(4)</enum><text display-inline="yes-display-inline">The provisions of this title that are applicable to the funds made available to the Secretary under section 502(a)(1) apply in the same manner to funds made available to the Secretary under paragraph (1)(A).</text></paragraph> 
<paragraph commented="no" display-inline="no-display-inline" id="HD56720E051B74CB4006F542CD9DD1781" indent="up1"><enum>(5)</enum><text display-inline="yes-display-inline">For purposes of this subsection, the term <term>State</term> means each of the 50 States and the District of Columbia.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></section>

<subsection commented="no" display-inline="no-display-inline" id="H2CA6AFE7763949E095B4EBE916ED1D8"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Section 1902(a)(10)(A)(i)(II) (<external-xref legal-doc="usc" parsable-cite="usc/42/1396a">42 U.S.C. 1396a(a)(10)(A)(i)(II)</external-xref>) is amended—</text> 
<paragraph commented="no" display-inline="no-display-inline" id="H161934DC3A8A4D32BDE1897024EB16C6"><enum>(1)</enum><text display-inline="yes-display-inline">by inserting <quote>(aa)</quote> after <quote>(II)</quote>;</text></paragraph>

<subsection commented="no" display-inline="no-display-inline" id="H9C00E6BE5D8B4EDA9C51C09E9D6DCCB7"><enum>(b)</enum><header>Effective date</header><text display-inline="yes-display-inline">The amendments made by subsection (a) shall apply to medical assistance for items and services furnished on or after January 1, 2006.</text></subsection></section>
