<official-title>To authorize the Secretary of Education to enter into a partnership with a qualified local educational agency to conduct a model school-to-work program, and for other purposes.</official-title>

<section section-type="section-one" id="H0E266B5E3DEC4A27A67D4B12FA484EED" display-inline="no-display-inline"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Vocational Opportunities and Instruction through Cooperative Education Act of 2005</short-title></quote> or the <quote><short-title>VOICE Act of 2005</short-title></quote>.</text></section> 
<section id="HDBA4310022504FCAADFEC8D51DF95B0"><enum>2.</enum><header>Model school-to-work program</header> 
<subsection id="HFEBF6BB350964F3E001500D2DEDB42B1"><enum>(a)</enum><header>Partnership</header><text>The Secretary of Education may enter into a partnership with a qualified local educational agency to conduct a model school-to-work program described in subsection (b) for the purpose of determining whether such a program should be incorporated into public secondary schools on a nationwide basis.</text></subsection> 
<subsection id="HF384023280C64D1F96B588038F833FCA"><enum>(b)</enum><header>Model school-to-work program</header> 
<paragraph id="H7B107C99B6D84553833400753C455643"><enum>(1)</enum><header>In general</header><text>The model school-to-work program under this section shall provide course credits to secondary school students who participate in work-based learning experiences in the public or private sector.</text></paragraph> 
<paragraph id="HD551B272807241BDA3E4A9EC4CDE9C36"><enum>(2)</enum><header>Student eligibility</header><text>To participate in the model school-to-work program under this section, a student—</text> 
<subparagraph id="HAE322DEE375947029FC88CBA0091FC05"><enum>(A)</enum><text>must have no criminal background;</text></subparagraph> 
<subparagraph id="H4EBC6D456ABB43E4BE85006C2DE62FEB"><enum>(B)</enum><text>must have a grade point average of 2.0 or higher; and</text></subparagraph> 
<subparagraph id="H69B0056BBEBE4B2DBD967C6B0056455B"><enum>(C)</enum><text>must have a record of school attendance that is deemed satisfactory by the qualified local educational agency.</text></subparagraph></paragraph> 
<paragraph id="HF2BDB9CFC81F42AEB71D95F98DB35C55"><enum>(3)</enum><header>Minimum wage</header><text>The model school-to-work program under this section shall ensure that students are paid at least the minimum wage under the Fair Labor Standards Act of 1938 (<external-xref legal-doc="usc" parsable-cite="usc/29/201">29 U.S.C. 201 et seq.</external-xref>) for work performed in connection with such program.</text></paragraph> 
<paragraph id="H9B467E5C4D2F41E195349D7000126645"><enum>(4)</enum><header>Maximum hours</header><text>The model school-to-work program under this section shall not require, or provide course credits for, any work experience in excess of a total of 20 hours for any week.</text></paragraph></subsection> 
<subsection id="H09E1D343F93B4DA7B5EBD436A1301E84"><enum>(c)</enum><header>Report</header><text>Not later than 2 years after the date of the enactment of this Act, the Secretary of Education shall submit a report to the Congress on the results of the model school-to-work program under this section, including recommendations on whether such a program should be incorporated into public secondary schools on a nationwide basis.</text></subsection> 
<subsection id="H2D609B89088E4555AA1005B8B53AA19"><enum>(d)</enum><header>Definitions</header><text>For purposes of this section:</text> 
<paragraph id="H0AC2C0616FDC4BFFA8BE4CFBF6B7939F"><enum>(1)</enum><text>The term <term>qualified local educational agency</term> means a local educational agency that—</text> 
<subparagraph id="HDB6BCB56B7FE4ABFA4FA00E76D56F58"><enum>(A)</enum><text>is located in a Midwestern urban district; and</text></subparagraph> 
<subparagraph id="H05E9C24077634063982F1DA6CD6F426B"><enum>(B)</enum><text>serves at least 400,000 students, of whom at least 70 percent are eligible for free or reduced-price lunches under the Richard B. Russell <act-name parsable-cite="NSLA">National School Lunch Act</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/42/1751">42 U.S.C. 1751 et seq.</external-xref>).</text></subparagraph></paragraph> 
<paragraph id="H008AC244B3514215A200C2B995BA2FD5"><enum>(2)</enum><text>The terms <term>local educational agency</term> and <term>secondary school</term> have the meanings give to those terms in section 9101 of the <act-name parsable-cite="ESEA">Elementary and Secondary Education Act of 1965</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/20/7801">20 U.S.C. 7801</external-xref>).</text></paragraph></subsection></section>
