<section id="H8F441441ABCA4933AE356900843DB1FD"><enum>101.</enum><header>Response to environmental hazards associated with illegal manufacture of methamphetamine on Department of Agriculture and Department of the Interior lands</header> 
<subsection id="HD856A4853EEB42EF990162036F00F875"><enum>(a)</enum><header>Response activities</header><text>The Secretary of Agriculture and the Secretary of the Interior may carry out programs for the environmental clean up and remediation of National Forest System lands and other lands under the jurisdiction of the Department of Agriculture and National Park System lands and other lands under the jurisdiction of the Department of the Interior that are contaminated with any hazardous substance or pollutant associated with the illegal manufacture of methamphetamine.</text></subsection> 
<subsection id="H4A1DAF61541C45EB945F348CD84C239B"><enum>(b)</enum><header>Authorization of appropriations</header><text>There is authorized to be appropriated $15,000,000 to carry out the programs authorized in subsection (a).</text></subsection></section> 
<section id="H1B5BBBEDC3984ED30023918FF0F4DF13"><enum>102.</enum><header>Grant program to assist State and local government and private response to environmental hazards associated with illegal manufacture of methamphetamine on agricultural lands</header> 
<subsection id="H1A9971378B4649AB9E242956E86C5D36"><enum>(a)</enum><header>Grants authorized</header><text>The Secretary of Agriculture may make grants to State and local governments and to private persons to assist the efforts of State and local governments and private persons to clean up and remediate agricultural lands that are contaminated with any hazardous substance or pollutant associated with the illegal manufacture of methamphetamine. No grant may be made under this subsection to any person who is responsible for the contamination.</text></subsection> 
<subsection id="HA406479D771E40D7A0AD2BF35C05935D"><enum>(b)</enum><header>Authorization of appropriations</header><text>There is authorized to be appropriated to the Secretary of Agriculture $15,000,000 to make grants under subsection (a).</text></subsection></section> 
<section id="H2520C023FA6746A883D5139C2C4567AE"><enum>103.</enum><header>Designation of by-products of methamphetamine laboratories as hazardous materials and waste under Hazardous Materials Transportation Act and <act-name parsable-cite="SWDA">Solid Waste Disposal Act</act-name></header> 
<subsection id="H11CEC9E7480048BF959924B4F2941CF7"><enum>(a)</enum><header>Hazardous materials transportation Act</header><text>The Secretary of Transportation shall utilize the authority provided by <external-xref legal-doc="usc" parsable-cite="usc/49/5103">section 5103</external-xref> of title 49, United States Code, to designate certain by-products of the methamphetamine production process as hazardous materials for purposes of chapter 51 of such title to protect the environment from the environmental harm caused by certain by-products of illegal methamphetamine laboratories and to expand the civil and criminal penalties available against persons who operate such laboratories.</text></subsection> 
<subsection id="HD10F3A1416F64EE2B33EFCBAAB00CFB"><enum>(b)</enum><header><act-name parsable-cite="SWDA">Solid Waste Disposal Act</act-name></header><text>The Administrator of the Environmental Protection Agency shall utilize the authority provided by section 3001 of the <act-name parsable-cite="SWDA">Solid Waste Disposal Act</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/42/6921">42 U.S.C. 6921</external-xref>) to designate certain by-products of the methamphetamine production process as hazardous waste for purposes of such Act (<external-xref legal-doc="usc" parsable-cite="usc/42/6901">42 U.S.C. 6901 et seq.</external-xref>) to protect the environment from the environmental harm caused by certain by-products of illegal methamphetamine laboratories and to expand the civil and criminal penalties available against persons who operate such laboratories.</text></subsection> 
<subsection id="H8586D1308845435B842CC0016FDAFC"><enum>(c)</enum><header>Covered materials</header><text>Not later than 13 months after the date of the enactment of this Act, the Administrator of the Drug Enforcement Administration shall submit to the Secretary of Transportation and the Administrator of the Environmental Protection Agency a list of those by-products of the methamphetamine production process that, in the event of improper disposal and inadequate remediation, are likely to cause long-term harm to the environment. The Administrator of the Drug Enforcement Administration shall take into consideration the report required by section 106 in preparing the initial list and shall revise the list annually thereafter as necessary to reflect changes in the methamphetamine production process.</text></subsection> 
<subsection id="HA812B0C138A942B3B65486CAB9298011"><enum>(d)</enum><header>Time for designation</header><text>The designations required by subsections (a) and (b) shall be completed not later than 18 months after the date of the enactment of this Act. If the Administrator of the Drug Enforcement Administration revises the list referred to in subsection (c), the Secretary of Transportation and the Administrator of the Environmental Protection Agency shall complete additional designations to reflect the revisions made to the list not later than 18 months after the date of the submission of the revised list.</text></subsection></section> 
<section id="H5080B65072FD4C8EAE6240004296CBE1"><enum>104.</enum><header>Grant program to assist law enforcement agencies in the safe identification, cleanup, and disposal of methamphetamine laboratories</header> 
<subsection id="HA52A5E20926B42F88CDAA8CA880027DA"><enum>(a)</enum><header>Grants authorized</header><text>The Secretary of Labor, acting through the Occupational Safety and Health Administration, shall provide grants to State and local law enforcement agencies to be used for—</text> 
<paragraph id="H042CF8328FA34A81B76B45A3FA1C8F28"><enum>(1)</enum><text>the provision of training in safe procedures for identifying, cleaning up, and disposing of methamphetamine laboratories, and</text></paragraph> 
<paragraph id="H9441657D0B3343239C24DD538FA9F200"><enum>(2)</enum><text>the acquisition of equipment for the safe identification, cleanup, and disposal of methamphetamine laboratories.</text></paragraph></subsection> 
<subsection id="H0935A69DD4134428B5897B60E7D69562"><enum>(b)</enum><header>Included activities</header><text display-inline="yes-display-inline">Grant funds provided under subsection (a) may be used to cover costs associated with training and acquisition described in such subsection that is provided by public agencies or private organizations.</text> </subsection> 
<subsection id="HDB5305FF3BA44597823E019F70014BFE"><enum>(c)</enum><header>Rulemaking</header><text>The Secretary of Labor may prescribe rules to carry out this section.</text></subsection> 
<subsection id="H45126C0CFB6E4A7F92E21F063C5866BB"><enum>(d)</enum><header>Authorization of appropriations</header><text>There are authorized to be appropriated to carry out this section $20,000,000 for fiscal year 2006.</text></subsection></section> 
<section id="H9F8CAD9D7D5049E8A5B1F6218EA2F71B"><enum>105.</enum><header>Grant program to assist law enforcement agencies in meeting the costs of complying with Federal laws relating to methamphetamine laboratory cleanup and disposal</header> 
<subsection id="H97FB2694191D4B99909351669B7FCDEE"><enum>(a)</enum><header>Grants authorized</header><text>The Secretary of Labor shall provide grants to State and local law enforcement agencies to assist such agencies in meeting the costs of complying with Federal laws regarding the cleanup and disposal of methamphetamine laboratories.</text></subsection> 
<subsection id="H024D3BD54EA542F4A6D8F03F41451C7B"><enum>(b)</enum><header>Rulemaking</header><text>The Secretary of Labor may prescribe rules to carry out this section.</text></subsection> 
<subsection id="H13BD7669D7B249A6BA0084074FFF48D1"><enum>(c)</enum><header>Authorization of appropriations</header><text>There are authorized to be appropriated to carry out this section $10,000,000 for fiscal year 2006.</text></subsection></section> 
<section id="H5065E4E16138442BAC1997AB9541D062"><enum>106.</enum><header>Study of environmental impact</header> 
<subsection id="HE59ACF6E0DF34EBEA11DFEE637008C3F"><enum>(a)</enum><header>Study required</header><text>Not later than one year after the date of the enactment of this Act, the Administrator of the Environmental Protection Agency shall submit to Congress a study of the impact of the operation of laboratories for the manufacture of methamphetamines on the environment, including the impact on agriculture.</text></subsection> 
<subsection id="HAAF8C4688C95449A97A47E32E3E3B0F8"><enum>(b)</enum><header>Authorization of appropriations</header><text>There are authorized to be appropriated to the Administrator of the Environmental Protection Agency $1,000,000 for fiscal year 2006 to conduct the study required by subsection (a).</text></subsection></section></title> 
<title id="H6028A19A795148D784FF1C45C838FC38"><enum>II</enum><header>Education, prevention, and treatment</header> 
<section id="HA6CC918E14C646C684CC45A76F656584"><enum>201.</enum><header>Study regarding health effects of exposure to process of unlawful manufacture of methamphetamine</header> 
<subsection id="H8D5F10B80F454D80B83349FC7D39E6BE"><enum>(a)</enum><header>In general</header><text>With respect to the unlawful manufacturing of methamphetamine, the Secretary of Health and Human Services shall conduct a study for the purpose of determining—</text> 
<paragraph id="H180D400065F645810018E49F5484AE83"><enum>(1)</enum><text>to what extent food, water, air, soil, equipment, or other matter becomes contaminated with methamphetamine or other harmful substances as a result of the proximity of the matter to the process of such manufacturing; and</text></paragraph> 
<paragraph id="H8A975EA69DCB44DBB435DA507CE63613"><enum>(2)</enum><text>whether any adverse health conditions result from the exposure of individuals to such process or to contaminated matter within the meaning of paragraph (1).</text></paragraph></subsection> 
<subsection id="HFCDAD263CC6743DAAA723F9DD040F588"><enum>(b)</enum><header>Report to Congress</header><text>Not later than one year after the date of the enactment of this Act, the Secretary of Health and Human Services shall complete the study under subsection (a) and submit to the Congress a report describing the findings of the study.</text></subsection></section> 
<section id="HB1D34147158C48C1ACECA6E20448488C"><enum>202.</enum><header>Grants for educational programs on prevention and treatment of methamphetamine abuse</header><text display-inline="no-display-inline">Part A of title IV of the <act-name parsable-cite="ESEA">Elementary and Secondary Education Act of 1965</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/20/7101">20 U.S.C. 7101 et seq.</external-xref>) is amended—</text> 
<paragraph id="H31DC036CA531490B85A0F87D71B0F52F"><enum>(1)</enum><text>in section 4003—</text> 
<subparagraph id="HEADD660618A04F979203C8349FA239DE"><enum>(A)</enum><text>at the end of paragraph (1), by striking <quote>and</quote>;</text></subparagraph> 
<subparagraph id="H5A9F86D55FDD4E76896F77EB5FBD4363"><enum>(B)</enum><text>at the end of paragraph (2), by striking the period and inserting <quote>; and</quote>; and</text></subparagraph> 
<subparagraph id="HA02DCCB4CCE749DDB6D664E6AFBEC403"><enum>(C)</enum><text>at the end of the section, by adding the following:</text>

<paragraph id="HC8CCD46423E84931BD891728FAB488B8"><enum>(3)</enum><text>$20,000,000 for fiscal year 2006, for grants under subpart 4.</text></paragraph><after-quoted-block>;</after-quoted-block></quoted-block></subparagraph></paragraph> 
<paragraph id="HD732116220FD4E1FB54EC1A67E3E5575"><enum>(2)</enum><text>by redesignating subpart 4 as subpart 5; and</text></paragraph> 
<paragraph id="H3C22A15C67914E6BAC1403B425A96FA6"><enum>(3)</enum><text>by inserting after subpart 3 the following:</text>

<subpart id="H98C0A6894E99442889A57F936BE16B5F"><enum>4</enum><header>Education on prevention and treatment of methamphetamine abuse</header> 
<section id="H0E49D43F115442E5BAE3F932AA005C30"><enum>4146.</enum><header>Grant program</header> 
<subsection id="HBA054FD664C9499E87E2B200DE913EA3"><enum>(a)</enum><header>Grants</header><text>From funds made available to carry out this subpart under section 4003(3), the Secretary may make grants on a competitive basis to State agencies, local educational agencies, and nonprofit organizations to carry out programs to educate students on prevention and treatment of methamphetamine abuse.</text></subsection> 
<subsection id="HB8517F042AEF44579E92D00037F75DC0"><enum>(b)</enum><header>Applications</header><text>To receive a grant under this section, an applicant shall submit an application to the Secretary at such time, in such manner, and containing such information as the Secretary may require.</text></subsection></section></subpart><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section> 
<section id="H7FC0BB1010824AECBBFA8F12E2BE71C"><enum>203.</enum><header>Local grants for treatment of methamphetamine abuse and related conditions</header><text display-inline="no-display-inline">Subpart 1 of part B of title V of the <act-name parsable-cite="PHSA">Public Health Service Act</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/42/290bb">42 U.S.C. 290bb et seq.</external-xref>) is amended—</text> 
<paragraph id="HDDA602B0F91E45C48281C628C75E5579"><enum>(1)</enum><text>by redesignating the section 514 that relates to methamphetamine and appears after section 514A as section 514B; and</text></paragraph> 
<paragraph id="H6826A99F15064476A900CA0197713050"><enum>(2)</enum><text>by inserting after section 514B (as so redesignated) the following section:</text>

<section id="H3F51284424E44D3596C4C83CEBFF2308"><enum>514C.</enum><header>Local grants for treatment of methamphetamine abuse and related conditions</header> 
<subsection display-inline="no-display-inline" id="HA8C09501694E414E00B6841FE9FF8CE"><enum>(a)</enum><header>In general</header><text>The Secretary may make grants to political subdivisions of States and to nonprofit private entities for the purpose of providing treatment for methamphetamine abuse, subject to subsection (b).</text></subsection> 
<subsection id="H564CCE74180E45D9A3CB78EA2D0939D6"><enum>(b)</enum><header>Certain services for children</header><text>In addition to the purpose described in subsection (a), a grant under such subsection may be expended to treat children for any adverse health condition resulting from a qualifying methamphetamine-related exposure.</text></subsection> 
<subsection id="H9E0B606B9FED458AA71CBD7309DD513"><enum>(c)</enum><header>Definitions</header><text>For purposes of this section:</text> 
<paragraph id="HCC130758F3044E70A91B7F08513379D1"><enum>(1)</enum><text>The term <term>children</term> means individuals who are under the age of 18.</text></paragraph> 
<paragraph id="H5EAE27B99D7B4FD59CF14BB9D738B3CC"><enum>(2)</enum> 
<subparagraph display-inline="yes-display-inline" id="H2C4A9EDF75A8469F86C92D008C48306F"><enum>(A)</enum><text>The term <term>qualifying methamphetamine-related exposure</term>, with respect to children, means exposure to methamphetamine or other harmful substances as a result of the proximity of the children to the process of manufacturing methamphetamine or the proximity of the children to associated contaminated matter.</text></subparagraph> 
<subparagraph indent="up1" id="H29F049F9591142308B27EC498F41BFA5"><enum>(B)</enum><text>The term <term>associated contaminated matter</term>, with respect to the process of manufacturing methamphetamine, means food, water, air, soil, equipment, or other matter that is contaminated with methamphetamine or other harmful substances as a result of the proximity of the matter to such process.</text></subparagraph></paragraph></subsection> 
<subsection id="H5739598A3E5745929800F8A2971BF518"><enum>(d)</enum><header>Funding</header> 
<paragraph id="HDCC8EB566FAD4D9092FE23F7834F5E46"><enum>(1)</enum><header>Authorization of appropriations</header><text>For the purpose of carrying out this section, there is authorized to be appropriated $10,000,000 for fiscal year 2006.</text></paragraph> 
<paragraph id="HF1CF060B511A4E9A8DE980D94CD41F96"><enum>(2)</enum><header>Allocation for children</header><text>Of the amount appropriated under paragraph (1) for a fiscal year, not less than $2,500,000 shall be reserved for carrying out this section with respect to children.</text></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section></title> 
<title id="H27AC46C48A3948DAAAD4A1DDB6306C20"><enum>III</enum><header>Enforcement</header> 
<section id="H705BBDED28BA4551916CFEA67F56FF1C"><enum>301.</enum><header>Authorization of appropriations relating to methamphetamine laboratory seizure statistics</header><text display-inline="no-display-inline">In addition to any other funds authorized to be appropriated for fiscal year 2006 for the collection, aggregation, and dissemination of methamphetamine laboratory seizure statistics by the El Paso Intelligence Center (EPIC) of the Department of Justice, there is authorized to be appropriated $2,000,000 for such purpose.</text></section> 
<section id="HC218F091DA924EA1A3EB72F7FA235AA"><enum>302.</enum><header>Authorization of appropriations relating to COPS grants</header> 
<subsection id="HEB038C9899D44B66844E88F19D013047"><enum>(a)</enum><header>In general</header><text>In addition to any other funds authorized to be appropriated for fiscal year 2006 for grants under part Q of title I of the <act-name parsable-cite="OCCSS">Omnibus Crime Control and Safe Streets Act of 1968</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/42/3796dd">42 U.S.C. 3796dd et seq.</external-xref>), known as the COPS program, there is authorized to be appropriated $20,000,000 for such purpose to provide training to State and local prosecutors and law enforcement agents for prosecution of methamphetamine offenses.</text></subsection> 
<subsection id="H699F3078FAA24885BEA8CEB031385C5D"><enum>(b)</enum><header>Rural Set-Aside</header><text>Of amounts made available pursuant to subsection (a), $5,000,000 shall be available only for prosecutors and law enforcement agents for rural communities.</text></subsection> 
<subsection id="HB469F10E41134CD48BC46554A83D2CFF"><enum>(c)</enum><header>DEA reimbursement</header><text>Of amounts made available pursuant to subsection (a), $2,000,000 shall be available only to reimburse the Drug Enforcement Administration for existing training expenses.</text></subsection></section> 
<section id="HC59E7B166FB64E889E56106053EE4043"><enum>303.</enum><header>Expansion of methamphetamine Hot Spots program to include personnel and equipment for enforcement, prosecution, and environmental cleanup</header><text display-inline="no-display-inline">Section 1701(d) of the <act-name parsable-cite="OCCSS">Omnibus Crime Control and Safe Streets Act of 1968</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/42/3796dd">42 U.S.C. 3796dd(d)</external-xref>) is amended—</text> 
<paragraph id="HF19C4AEE1CC74A10AD6357966C2D659D"><enum>(1)</enum><text>in paragraph (11) by striking <quote>and</quote> at the end;</text></paragraph> 
<paragraph id="H8DB00456AD6245AD8800E78E4E802448"><enum>(2)</enum><text>in paragraph (12) by striking the period at the end and inserting <quote>; and</quote>; and</text></paragraph> 
<paragraph id="HFB7808A46706413C908881E0E5D81077"><enum>(3)</enum><text>by adding at the end the following new paragraph:</text>

<section id="HA7C4E16456E143729BC71773207912F"><enum>304.</enum><header>Authorization of appropriations relating to the clandestine laboratory training</header><text display-inline="no-display-inline">In addition to any other funds authorized to be appropriated for fiscal year 2006 for the facilities and personnel used to operate the Clandestine Laboratory Training Facility of the Drug Enforcement Administration, located in Quantico, Virginia, there is authorized to be appropriated $10,000,000 for such purpose (but to include not more than 20 additional fulltime positions) to provide training to law enforcement personnel of all the States, the District of Columbia, the Commonwealth of Puerto Rico, and the territories and possessions of the United States.</text></section> 
<section id="HBA6CA0E97F9145C1A35F9F6100BCED19"><enum>305.</enum><header>Statement of Congress regarding availability and illegal importation of pseudoephedrine from Canada</header> 
<subsection id="HB5A5E95AE90C485200E24B30887C746D"><enum>(a)</enum><header>Findings</header><text>The Congress finds that—</text> 
<paragraph id="H86B1BDCB178B4BF6A9F5D1AD16D837D1"><enum>(1)</enum><text>pseudoephedrine is one of the basic precursor chemicals used in the manufacture of the dangerous narcotic methamphetamine;</text></paragraph> 
<paragraph id="H652A3F100D95494A862D38F76955B609"><enum>(2)</enum><text>the Federal Government, working in cooperation with narcotics agents of State and local governments and the private sector, has tightened the control of pseudoephedrine in the United States in recent years;</text></paragraph> 
<paragraph id="HD96A9A66DBE841BBBBF900FB7F1240C2"><enum>(3)</enum><text>pseudoephedrine can only be purchased in the United States in small quantity bottles or blister packs; however, the widespread presence of large containers of pseudoephedrine from Canada at methamphetamine laboratories and dumpsites in the United States, despite efforts of law enforcement agencies to stem the flow of these containers into the United States, demonstrates the strength of the demand for, and the inherent difficulties in stemming the flow of, these containers from neighboring Canada; and</text></paragraph> 
<paragraph id="H16C8E1FBC4AC452FBCA555433D5672EB"><enum>(4)</enum><text>Canada lacks a comprehensive legislative framework for addressing the pseudoephedrine trafficking problem.</text></paragraph></subsection> 
<subsection id="H6220611B801443A9BFA13B98B31D9900"><enum>(b)</enum><header>Call for action by Canada</header><text>The Congress strongly urges the President to seek commitments from the Government of Canada to begin immediately to take effective measures to stem the widespread and increasing availability in Canada and the illegal importation into the United States of pseudoephedrine.</text></subsection></section></title>
