<section section-type="section-one" id="H759E02FD26E44BBCBD28FB89D69764E" display-inline="no-display-inline"><enum>1.</enum><header>Short title; references</header> 
<subsection id="HC91E8AC994384FB1BE16AF73153173B0"><enum>(a)</enum><header>Short title</header><text>This Act may be cited as the <quote><short-title>Part-time Student Assistance Act</short-title></quote>.</text></subsection> 
<subsection id="H214F8DE74B7644F195C3DBC162777613"><enum>(b)</enum><header>References</header><text>Except as otherwise expressly provided, whenever in this Act an amendment or repeal is expressed in terms of an amendment to, or repeal of, a section or other provision, the reference shall be considered to be made to a section or other provision of the <act-name parsable-cite="HEA65">Higher Education Act of 1965</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/20/1001">20 U.S.C. 1001 et seq.</external-xref>).</text></subsection></section> 
<section id="HC1C56B82DB3A44A5BA94594126FB69E4"><enum>2.</enum><header>Support for working students: increases in income protection allowances</header> 
<subsection id="HF91106BE61EB49C1ACE05DD910E8FF1"><enum>(a)</enum><header>Dependent students</header><text>Section 475(g)(2) (<external-xref legal-doc="usc" parsable-cite="usc/20/1087oo">20 U.S.C. 1087oo(g)(2)</external-xref>) is amended by striking subparagraph (D) and inserting the following:</text>

<subsection id="H5DE5A1876B544AC6B9E8FAA134F6D1B5"><enum>(d)</enum><header>Conforming amendments</header><text>Section 478 (<external-xref legal-doc="usc" parsable-cite="usc/20/1087rr">20 U.S.C. 1087rr</external-xref>) is amended—</text> 
<paragraph id="HA7B66307C5F046F48BE5B3446801D47D"><enum>(1)</enum><text>by striking subsection (b) and inserting the following:</text>

<subsection id="H3D07C36C0D5441FE9350954F4810DE27"><enum>(b)</enum><header>Income protection allowance</header><text>For each academic year after academic year 1993–1994, the Secretary shall publish in the Federal Register a revised table of income protection allowances for the purpose of section 475(c)(4). Such revised table shall be developed by increasing each of the dollar amounts contained in the table in such section by a percentage equal to the estimated percentage increase in the Consumer Price Index (as determined by the Secretary) between December 1992 and the December next preceding the beginning of such academic year, and rounding the result to the nearest $10.</text></subsection><after-quoted-block>; and</after-quoted-block></quoted-block></paragraph> 
<paragraph id="H98F2EB617C834B078D7B697400E75511"><enum>(2)</enum><text>in subsection (h)—</text> 
<subparagraph id="HDCD9193CF1154EF1827B46A286C9F8DA"><enum>(A)</enum><text>in the first sentence, by striking <quote>477(b)(5)</quote> and inserting <quote>477(b)(4)</quote>; and</text></subparagraph> 
<subparagraph id="HA3C05FB69CC143FEB6FCD39B9FFC611"><enum>(B)</enum><text>in the second sentence—</text> 
<clause id="HEBC3F26675A749FAA41060328B55B5F"><enum>(i)</enum><text>by striking <quote>477(b)(5)(A)</quote> and inserting <quote>477(b)(4)(A)</quote>; and</text></clause>

<section id="HEF5ECF69BF3141CE8CBE74DCE8CEBA87"><enum>3.</enum><header>Exempting earned income credits from the calculation of income</header><text display-inline="no-display-inline">Section 480(a)(2) (<external-xref legal-doc="usc" parsable-cite="usc/20/1087vv">20 U.S.C. 1087vv(a)(2)</external-xref>) is amended by inserting <quote>or section 32</quote> after <quote>section 25A</quote>.</text></section> 
<section id="H10BB4B3C49164DDC8677AD63EFE25484"><enum>4.</enum><header>Child care means parents in school</header> 
<subsection id="HFE1D68A6A5084E5982D1B3161CECFD90"><enum>(a)</enum><header>Minimum grant</header><text>Section 419N(b)(2)(B) (<external-xref legal-doc="usc" parsable-cite="usc/20/1070e">20 U.S.C. 1070e(b)(2)(B)</external-xref>) is amended by striking <quote>$10,000</quote> and inserting <quote>$30,000</quote>.</text></subsection> 
<subsection id="H25CF088DA5DC4A08A4575DCA0754E084"><enum>(b)</enum><header>Eligible institutions</header><text>Section 419N(b)(4) is amended by striking <quote>$350,000</quote> and inserting <quote>$250,000</quote>.</text></subsection> 
<subsection id="H83F2D8EBB3F14DA897ECBD2BA31490B9"><enum>(c)</enum><header>Income eligibility</header><text>Section 419N(b)(7) is amended by striking <quote>who is eligible to receive</quote> and inserting <quote>whose income qualifies for eligibility for</quote>.</text></subsection> 
<subsection id="HC5B40868FB73447600FA1900FCFA3737"><enum>(d)</enum><header>Publicity</header><text>Section 419N(b) is further amended by adding at the end the following new paragraph:</text>

<paragraph id="H76FFE4486DDA406B91001D5DAF03FD5"><enum>(8)</enum><header>Publicity</header><text>The Secretary shall publicize the availability of grants under this section in appropriate periodicals in addition to publication in the Federal Register, and shall inform appropriate educational organizations of such availability.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection> 
<subsection id="H2ECA804B9A634789AA847988B8CE7369"><enum>(e)</enum><header>Authorization of appropriations</header><text>Section 419N(g) is amended by striking <quote>$45,000,000 for fiscal year 1999</quote> and inserting <quote>$75,000,000 for fiscal year 2006</quote>.</text></subsection></section> 
<section id="HEBFE1A5F6E7A4E2E8C6050C91F5DC089"><enum>5.</enum><header>Year-round Pell grants</header><text display-inline="no-display-inline">Section 401 (<external-xref legal-doc="usc" parsable-cite="usc/20/1070a">20 U.S.C. 1070a</external-xref>) is amended by adding at the end the following new subsection:</text>

<subsection id="H3EFC5E3569094849B09DFEA014953B31"><enum>(k)</enum><header>Year-round Pell grants</header> 
<paragraph id="H413F1C77AFAF4A639666038FC48552B8"><enum>(1)</enum><header>Pilot program established</header><text>The Secretary shall establish in accordance with this subsection a year-round Pell grant pilot program. Any institution of higher education that desires to participate in the program under this subsection shall submit an application to the Secretary at such time and containing or accompanied by such information and assurances as the Secretary may require. The Secretary may select not more than 200 institutions of higher education for participation in the program. The Secretary shall give preference in such selection to those associate’s and bachelor’s degree-granting institutions that, as determined under paragraph (3), have the highest completion and graduation rates, respectively.</text></paragraph> 
<paragraph id="H746646FF1C094F3BBC947C10B945006C"><enum>(2)</enum><header>Program elements</header><text>With respect to students enrolled in institutions participating in the program under this subsection, the Secretary is authorized—</text> 
<subparagraph id="H032FFA4537F247B1B500FBFAB9E9651"><enum>(A)</enum><text>to award such students two Pell grants in one calendar year to permit such students to accelerating progress towards their degree or certificate objectives by enrolling in academic programs for 12 rather than 9 months of the year at participating institutions; and</text></subparagraph> 
<subparagraph id="HD8B6DF2DE6F244E995F8E2A801C80B6"><enum>(B)</enum><text>to award such two Pell grants to such students in a total amount up to 133 percent of the maximum Pell under subsection (b)(2)(A) that is applicable for the academic year.</text></subparagraph></paragraph> 
<paragraph id="H6936E6A7166E408AA23508A91EB67678"><enum>(3)</enum><header>Limitation</header><text>The Secretary shall limit the awarding of additional Pell grants under this subsection in a single calendar year to students who attend associate’s and bachelor’s degree-granting institutions with the following characteristics:</text> 
<subparagraph id="H1284D02F04AE4B9FAFF54E7BBF378747"><enum>(A)</enum><text>In the case of an associate’s degree-granting institution, the completion rate for the institution of higher education reported by the Integrated Postsecondary Education Data System for the preceding 3 academic years has improved by a total of at least 10 percent.</text></subparagraph> 
<subparagraph id="HE9224874F6A041FE0000B84CF6001BB1"><enum>(B)</enum><text>In the case of a bachelor’s degree-granting institution—</text> 
<clause id="H5B3EC58E3F9C411381E11765BF4CAAA"><enum>(i)</enum><text>the graduation rate for the institution of higher education reported by the Integrated Postsecondary Education Data System for the preceding 5 academic years is at least 50 percent; and</text></clause> 
<clause id="H02C96387F3BD420F8790ADFDC601105"><enum>(ii)</enum><text>the average time of enrollment required to complete a degree at the institution among students who enter as freshman and earn bachelor’s degrees is 14 or fewer quarters, or 9 or fewer semesters or the equivalent.</text></clause></subparagraph></paragraph> 
<paragraph id="HCBA157BAA2A64D5FA15CC8EA12DFC14"><enum>(4)</enum><header>Termination; evaluation</header><text>The authority of the Secretary under this subsection shall cease to be effective on October 1, 2009. Not later than October 1, 2008, the Secretary shall conduct an evaluation of the program under this subsection and submit to the Congress a report on the results of such evaluation.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></section> 
<section id="H7E66AFB4C7D649ECBB1F6E6C5D00FEC6"><enum>6.</enum><header>Additional fipse program</header> 
<subsection id="HAFA05DF903C545F4AC5800718D69FEE1"><enum>(a)</enum><header>Purpose</header><text>It is the purpose of this section—</text> 
<paragraph id="H780367C1000349B2983FB0DADE52C3AF"><enum>(1)</enum><text>to allow a demonstration program that is strictly monitored by the Department of Education to test creative measure for improving the availability of higher education for part-time students;</text></paragraph> 
<paragraph id="HAF74A4AB50B14CEB845C08007643258B"><enum>(2)</enum><text>to provide for increased access for part-time students; and</text></paragraph> 
<paragraph id="H27A001BA9C754728AD1168CF0988C151"><enum>(3)</enum><text>to help determine the most effective assistance for part-time students.</text></paragraph></subsection> 
<subsection id="HE465A9269BA2418A8E7BDD93E9FE4460"><enum>(b)</enum><header>New program authorized</header><text>Section 741(a) (<external-xref legal-doc="usc" parsable-cite="usc/20/1138">20 U.S.C. 1138(a)</external-xref>) is amended—</text> 
<paragraph id="H30C7975E6BC14502BE8F008D87E2B1FC"><enum>(1)</enum><text>by striking <quote>and</quote> at the end of paragraph (7);</text></paragraph> 
<paragraph id="H8DC716198A044B838D89E76136438943"><enum>(2)</enum><text>by striking the period at the end of paragraph (8); and</text></paragraph> 
<paragraph id="H23FD41A876324FC18707A06DF0D52DB4"><enum>(3)</enum><text>by adding at the end the following new paragraph:</text> 
<quoted-block id="HD9F37FD15BFD435A8552F65651A526B9"> 
<paragraph id="HA80E830B2CC943339961A9AFE60039D7"><enum>(9)</enum><text>creating a program to create a holistic approach to addressing the needs of part-time students at not more than 150 associates and bachelors degree-granting institutions that would include grants, leveraging funds from non-Federal sources, comprehensive child care, and better tailored remedial course programs.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection> 
<subsection id="H86E20863EFB24A32B8BDD27089138200"><enum>(c)</enum><header>Notification and reports</header><text>Section 743 (<external-xref legal-doc="usc" parsable-cite="usc/20/1138b">20 U.S.C. 1138b</external-xref>) is amended by adding at the end the following new subsections:</text> 
<quoted-block id="H0CA4AFE08E854154B9FB571BB759471D"> 
<subsection id="H67F62E115B4345969EB8B4E1003D859D"><enum>(c)</enum><header>Procedures and authorization for part-time student program</header> 
<paragraph id="H0606D6E995B64BECAD4037079F93CFFC"><enum>(1)</enum><header>Application</header><text>An eligible entity that desires to receive a grant under subsection (b)(9) shall submit an application to the Secretary in such manner and form, containing such information and assurances, as the Secretary may reasonably require.</text></paragraph> 
<paragraph id="H18B1839385D64E509408EF3CBB8F8FE7"><enum>(2)</enum><header>Selection procedures</header><text>The Secretary shall by regulation develop a formal procedure for the submissions of applications for grants under subsection (b)(9) and shall publish in the Federal Register an announcement of that procedure and the availability of funds under such part.</text></paragraph> 
<paragraph id="HEF009DCD1BB440A790B8452F4BEEA0F2"><enum>(3)</enum><header>Evaluation</header><text>The Secretary shall evaluate the program authorized under subsection (b)(9) on an annual basis. Such evaluations specifically shall review —</text> 
<subparagraph id="H8719734E506649609FBBF820CD0F7C7"><enum>(A)</enum><text>the extent to which the institution has met the goals set forth in its application to the Secretary;</text></subparagraph> 
<subparagraph id="HBF9FC300FCD9478C81764196A034A086"><enum>(B)</enum><text>the number of students participating in the programs offered, including the progress of such students toward recognized certificates or degrees; and</text></subparagraph> 
<subparagraph id="HDD5859F168D54E519CB259039E4FD019"><enum>(C)</enum><text>what changes, if any, in law would facilitate both the participation of part-time students in higher education and increased graduation rates amongst these students.</text></subparagraph></paragraph> 
<paragraph id="H5CCBEFA9048B4AB4B600C03440DAD35F"><enum>(4)</enum><header>Separate authorizations of appropriations</header><text>There are authorized to be appropriated to carry out the program authorized by subsection (b)(9), $100,000,000 for fiscal year 2006 and such sums as may be necessary for each of the five succeeding fiscal years.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection></section>
