<official-title>To provide the Secretary of the Army with additional and enhanced authority with respect to water resources projects, and for other purposes.</official-title>

<section id="H8203E8AA50BD43709FE8C9BDC6D27050" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Integrated Water Resources Management Act of 2005</short-title></quote>.</text> </section> 
<section id="H32CFB726766F4B3C8B00D216E9742C60"><enum>2.</enum><header>Support of State, tribal, interstate water resources organizations, and local government</header><text display-inline="no-display-inline">The Secretary of the Army shall include as a primary mission of the Army Corps of Engineers the provision of technical services and assistance to support planning, conservation, and responsible integrated management of water resources by State, tribal, interstate water resources organizations, and local governments.</text></section> 
<section id="HE14301EA8C2440A28432E67CF8B1FABE"><enum>3.</enum><header>Technical assistance</header><text display-inline="no-display-inline">Section 22 of Water Resources Development Act of 1974 (<external-xref legal-doc="usc" parsable-cite="usc/42/1962d-16">42 U.S.C. 1962d–16</external-xref>) is amended—</text> 
<paragraph id="H667AAA97F29E452983BA2E06F9F850AD"><enum>(1)</enum><text>in subsection (a) by striking <quote>The Secretary</quote> and inserting the following:</text>

<paragraph id="H739C5BF18D0C4E159C98AADA792CEA36"><enum>(2)</enum><header>Technical assistance</header><text>There is authorized to be appropriated $10,000,000 annually to carry out subsection (a)(2), of which not more than $2,000,000 annually may be used by the Secretary to enter into cooperative agreements with nonprofit organizations and State agencies to provide assistance to rural and small communities.</text></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph></paragraph> 
<paragraph id="HE838667A54454AE681195712CCFCA62"><enum>(6)</enum><text>by adding at the end the following:</text>

<subsection id="HA485604EF0254D85B7D5E3F9AE00B25B"><enum>(e)</enum><header>Annual submission</header><text>The Secretary shall provide a listing of the individual activities proposed for funding under subsection (a)(1), based on performance criteria developed by the Secretary.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section> 
<section id="H6EE4D46BCDE24F10A1F5F7AB00714656"><enum>4.</enum><header> Watershed and river basin assessments</header> 
<subsection id="H9AF3BC11E7FE4591B4CCD0C6D3152F1"><enum>(a)</enum><header>In general</header><text>Section 729 of the Water Resources Development Act of 1986 (<external-xref legal-doc="usc" parsable-cite="usc/33/2267a">33 U.S.C. 2267a</external-xref>; 114 Stat. 2587–2588; 100 Stat. 4164) is amended—</text> 
<paragraph id="H27D8A4A7F4474491AE732441E4008E7"><enum>(1)</enum><text>by striking paragraph (1) of subsection (f) and inserting the following:</text> 
<quoted-block id="H53A892BC709C44AF8492F78085453420" style="OLC"> 
<paragraph id="H39EAEDE92BA1464681441E6C7402E7F6"><enum>(1)</enum><header>Non-Federal share</header><text>The non-Federal share of the costs of an assessment carried out under this section on or after December 11, 2000, shall be 25 percent.</text></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block></paragraph> 
<paragraph id="H88043AF6DAA34FB6AAD317086D98143C"><enum>(2)</enum><text>by striking subsection (g).</text></paragraph></subsection> 
<subsection id="HF00952FC7B3C4E9886B6FE9D52417473"><enum>(b)</enum><header>Revision of partnership agreement</header><text>The Secretary of the Army shall revise the partnership agreement for any assessment being carried out under section 729 of the Water Resources Development Act of 1986 to take into account the change in non-Federal participation in the assessment as a result of the amendments made by subsection (a).</text></subsection></section> 
<section id="H9E9474119A8346C99EB256563B990777"><enum>5.</enum><header>Credit for materials and in-kind services</header> 
<subsection id="H485D9D5D79E044769863ED17E6DE8599"><enum>(a)</enum><header>In general</header><text>The Secretary of the Army is authorized to allow a non-Federal interest credit toward its share of the costs of any authorized water resources development project or study for the cost of materials and in-kind services, including planning (including data collection), design, management, and construction services, provided by the non-Federal interest for implementation of the project or study. The credit shall include the cost of materials and services provided prior to signing a partnership or feasibility cost sharing agreement for the project or study, including efforts on constructed elements incorporated into the project, and materials and services provided after the partnership or feasibility cost sharing agreement, subject to the limitations in subsection (b).</text></subsection> 
<subsection id="H079392DC498443E5908BF4A16F19516D"><enum>(b)</enum><header>Limitations</header><text>Credit authorized under subsection (a)—</text> 
<paragraph id="HC5D14AE9A5D6487DA6EA9FE771E95DE7"><enum>(1)</enum><text>shall not exceed the non-Federal share of project costs;</text></paragraph> 
<paragraph id="H4C83DA1F40034EF3A074616533E7BBCC"><enum>(2)</enum><text>shall not alter any other requirements that require a non-Federal interest to provide lands, easements, rights-of-way, and dredged material disposal areas for the project;</text></paragraph> 
<paragraph id="H3296E988C010468EA39663E72C8300A8"><enum>(3)</enum><text>shall not exceed the actual and reasonable costs of the materials or in-kind services provided by the non-Federal interest, as determined by the Secretary; and</text></paragraph> 
<paragraph id="HB736E094A1B34633BAB4625607A8B83E"><enum>(4)</enum><text>shall be allowed unless the Secretary has determined that such materials or services, including activities on previously constructed elements, are not compatible with and necessary for the project.</text></paragraph></subsection></section> 
<section id="H3B3263F468F44C0F9C46B96097CFCA50"><enum>6.</enum><header>Improving water management at Corps of Engineers reservoirs</header> 
<subsection id="H149B5E580C7F434E95A4194BEF17F5D0"><enum>(a)</enum><header>Measures To Improve Water Management at Corps of Engineers Reservoirs</header><text display-inline="yes-display-inline">In addition to ongoing efforts to assess and address the water resources needs of the Nation, the Secretary of the Army shall undertake, as part of the operation and maintenance of all Corps of Engineers reservoirs, measures to more effectively and efficiently meet the current water resources needs of the areas impacted by the reservoirs. Such measures shall be undertaken in cooperation and coordination with State, tribal, and local governments and their ongoing initiatives and may include the following:</text> 
<paragraph id="HE86CF475542E460D9DB3001FB601AB70"><enum>(1)</enum><text>reallocation of storage at such reservoirs;</text></paragraph> 
<paragraph id="H90FDEFAB2A1449A700DCB3038EFB9434"><enum>(2)</enum><text>review of operational plans and implementation of changes to improve performance of such reservoirs in meeting current needs and priorities;</text></paragraph> 
<paragraph id="H34ACF77D708343EF881FBA86CFF0585"><enum>(3)</enum><text>improvements to data collection systems and forecast models that enhance operational performance of such reservoirs; and</text></paragraph> 
<paragraph id="HB2A1C0DBA503417BA000D498B316561B"><enum>(4)</enum><text>sediment studies and implementation of sediment management or removal measures that improve project operations.</text></paragraph></subsection> 
<subsection id="H0081793EDCEF49E092B37502A2ED8E05"><enum>(b)</enum><header>Costs of water supply storage</header><text>Storage charges for future contracts and contract renewals for water supply storage at existing Corps of Engineers reservoirs shall not exceed the net change in receipts or outlays, or both to the Treasury due to the reallocation of storage at such reservoirs.</text></subsection></section> 
<section id="H76563A561AAD409E98FCE4CEBF6B59D4"><enum>7.</enum><header>Access to water resources data</header> 
<subsection id="HC1E9B06E20E745ABACD887C028AD00F3"><enum>(a)</enum><header>General</header><text>The Secretary of the Army shall undertake a program to provide public access to water resources and related water quality data currently within the custody of the Corps of Engineers.</text></subsection> 
<subsection id="H530A8BC717BC48909FA88ED291B9171C"><enum>(b)</enum><header>Data</header><text>The date to which subsection (a) applies shall include, but not be limited to, data generated in water resources project development and regulation under section 404 of the Federal Water Pollution Act (<external-xref legal-doc="usc" parsable-cite="usc/33/1344">33 U.S.C. 1344</external-xref>), and the Secretary, in providing access to data under subsection (a), shall employ appropriately geographic information system technology and linkages to water resources models and analytical techniques.</text></subsection> 
<subsection id="H8E9B58823F3D4CF3B0FE84ADF6EF2DB3"><enum>(c)</enum><header>Partnerships</header><text>To the maximum extent possible, the Secretary shall integrate State, tribal, and local governments into activities that carry out this section.</text></subsection> 
<subsection id="HB09956CB5D614E118C956405F121262D"><enum>(d)</enum><header>Appropriations</header><text>There is authorized to be appropriated $5,000,000 per fiscal year to carry out this section.</text></subsection></section> 
<section id="H20F7A083D61A47E183D61EF719007405"><enum>8.</enum><header>Written agreement for water resources projects</header> 
<subsection id="HBAB0A2A8267C414599962FACF860FBE2"><enum>(a)</enum><header>Partnership agreements</header><text>Section 221 of the Flood Control Act of 1970 (42 U.S.C. 1962d-5b) is amended—</text> 
<paragraph id="HFB031F8DE276491D874BE472371803B0"><enum>(1)</enum><text>in subsection (a)—</text> 
<subparagraph id="HB54185DBEFE8403F92001E9C5300B108"><enum>(A)</enum><text>by striking <quote>under the provisions</quote> and all that follows through <quote>under any other</quote> and inserting <quote>under any</quote>;</text></subparagraph> 
<subparagraph id="H83B65728E1C94A11BF5BFFF2FBB7DC00"><enum>(B)</enum><text>by inserting <quote>partnership</quote> after <quote>written</quote>;</text></subparagraph> 
<subparagraph id="HD10101FEF53D421090A2255E39938231"><enum>(C)</enum><text>by striking <quote>Secretary of the Army to furnish its required cooperation for</quote> and inserting <quote>district engineer for the district of the Corps of Engineers in which the project will be carried out under which each party agrees to carry out its responsibilities and requirements for implementation or construction of</quote>;</text></subparagraph> 
<subparagraph id="H26799667D80D413899F746E870B44252"><enum>(D)</enum><text>by striking <quote>if the Secretary</quote> and inserting <quote>if the Secretary of the Army</quote>; and</text></subparagraph> 
<subparagraph id="H4AFBC6B7C30C4A3683F732A14350CC45"><enum>(E)</enum><text>by inserting after <quote>$25,000.</quote> the following: <quote>Such agreement may include a provision for liquidated damages in the event of a failure of one or more parties to perform.</quote>;</text></subparagraph></paragraph> 
<paragraph id="HC7846986D31941AABF345C6EF8C22CB"><enum>(2)</enum><text>by redesignating subsection (e) as subsection (f); and</text></paragraph> 
<paragraph id="H25A4141E9F42414BA535D1CFA7E696F7"><enum>(3)</enum><text>by inserting after subsection (d) the following:</text> 
<quoted-block id="H77AC1577FB4D42DCBDD22383FD88279C" style="OLC"> 
<subsection id="H94B3211BD378438782F0CC54FFA19183"><enum>(e)</enum><header>Limitation</header><text>Nothing in subsection (a) shall be construed as limiting the authority of the Secretary to ensure that a partnership agreement meets all requirements of law and policies of the Secretary in effect on the date of entry into the partnership agreement.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection> 
<subsection id="H45D3DED77F7B41CFA62574080080A3E"><enum>(b)</enum><header>Local cooperation</header><text>Section 912(b) of the Water Resources Development Act of 1986 (42 U.S.C. 1962d–5b; 101 Stat. 4190) is amended—</text> 
<paragraph id="H881E5AD6397D499B8E7991C95100A46F"><enum>(1)</enum><text>in paragraph (2)—</text> 
<subparagraph id="H874AEF1C8E2A42ADAA96C249AC9BD42"><enum>(A)</enum><text>by striking <quote>shall</quote> the first place it appears and inserting <quote>may</quote>; and</text></subparagraph> 
<subparagraph id="HC3F22D6DD6DF4C9DA168F3D5BD9957C1"><enum>(B)</enum><text>by striking the last sentence; and</text></subparagraph></paragraph> 
<paragraph id="H36B8FB7068B444EABF318F9F2814B62C"><enum>(2)</enum><text>in paragraph (4)—</text> 
<subparagraph id="H973A2DB787544D6A8B1504BB67008F1D"><enum>(A)</enum><text>by inserting after <quote>injunction, for</quote> the following: <quote>payment of liquidated damages under a partnership agreement entered into by a district engineer of the Corps of Engineers or, for</quote>;</text></subparagraph> 
<subparagraph id="H3C8CC1517BA54AF48E3DF3E61FFC17A0"><enum>(B)</enum><text>by striking <quote>to collect a civil penalty imposed under this section,</quote>; and</text></subparagraph> 
<subparagraph id="H505BCBE6D95B44A4B405003DDD23D02"><enum>(C)</enum><text>by striking <quote>any civil penalty imposed under this section,</quote> and inserting <quote>any liquidated damages,</quote>.</text></subparagraph></paragraph></subsection> 
<subsection id="H23D1B4027BD24B2CB733F0A483FE94F"><enum>(c)</enum><header>Applicability</header><text>The amendments made by subsections (a) and (b) only apply to partnership agreements entered into after the date of enactment of this Act; except that at the request of a non-Federal interest for a project the district engineer for the district of the Corps of Engineers in which the project is located may amend a project partnership agreement entered into on or before such date and under which construction on the project has not been initiated as of such date of enactment for the purpose of incorporating such amendments.</text></subsection> 
<subsection id="HD63CFD52B5A0488BAFAA1C25C310D0C9"><enum>(d)</enum><header>References</header> 
<paragraph id="HBD378FBA04914AFEA116E434D28826D"><enum>(1)</enum><header>To cooperation agreements</header><text>Any reference in a law, regulation, document, or other paper of the United States to a cooperation agreement or project cooperation agreement shall be treated to be a reference to a partnership agreement or a project partnership agreement, respectively.</text></paragraph> 
<paragraph id="H4498812BB1324E8C816FD3EB700B090"><enum>(2)</enum><header>To partnership agreements</header><text>Any reference to a partnership agreement or project partnership agreement in this Act (other than this section) shall be treated as a reference to a cooperation agreement or a project cooperation agreement, respectively.</text></paragraph></subsection></section> 
<section id="H22E5E0B73F51404FBE19935B8D407278"><enum>9.</enum><header>Environmental infrastructure</header><text display-inline="no-display-inline">Section 219 of the Water Resources Development Act of 1992 (106 Stat. 4835–4836; 110 Stat. 3957; 113 Stat. 334) is amended—</text> 
<paragraph id="HAD9D6A8EFBDA4193941FB55B741D7970"><enum>(1)</enum><text>in subsection (b)—</text> 
<subparagraph id="HD0DBCB90321C439C82D47DFBD3A64823"><enum>(A)</enum><text>by striking <quote>(b) <header-in-text level="subsection">Non-Federal share.—</header-in-text>The</quote> and inserting the following: </text>

<section id="HFD9DE3B65759419184DF2805B8521F1F"><enum>10.</enum><header>Texas Environmental Infrastructure Program</header> 
<subsection id="HBAF7F01D6C9A4E969B79F484A9F7F73"><enum>(a)</enum><header>Establishment of program</header><text>The Secretary of the Army shall establish a program to provide environmental assistance to non-Federal interests in the State of Texas.</text></subsection> 
<subsection id="H41E563812CCA494DA4F5D973F771149D"><enum>(b)</enum><header>Form of assistance</header><text>Assistance under this section may be in the form of planning, design, and construction assistance for water-related environmental infrastructure and resource protection and development projects in the State of Texas, including projects for water supply, storage, treatment and related facilities, water quality protection, wastewater treatment and related facilities, environmental restoration, and surface water resource protection and development as identified by the Texas Water Development Board.</text></subsection> 
<subsection id="HB02B46291EC04602B0112633164DD68C"><enum>(c)</enum><header>Public ownership requirement</header><text>The Secretary may provide assistance for a project under this section only if the project is publicly owned.</text></subsection> 
<subsection id="H1CD5EFC11BB14BDD89929500B2B2EA7"><enum>(d)</enum><header>Partnership agreements</header><text>Before providing assistance under this section, the Secretary shall enter into a partnership agreement with a non-Federal interest.</text></subsection> 
<subsection id="H2A031D5DC3E5476480A5D1BDD8D31604"><enum>(e)</enum><header>Cost sharing</header> 
<paragraph id="H946317CCD6554B8584D6A121EC950328"><enum>(1)</enum><header>In general</header><text>The Federal share of project costs under each agreement entered into under this section shall be 75 percent. The Federal share may be in the form of grants or reimbursements of project costs.</text></paragraph> 
<paragraph id="H356DA6B165684214B3FF5F5737530845"><enum>(2)</enum><header>In-kind services</header><text>The non-Federal share may be provided in the form of materials and in-kind services, including planning, design, construction, and management services, that the Secretary has determined are compatible with and necessary for the project.</text></paragraph> 
<paragraph id="H81A848ED774A430881C1A98D9E60801D"><enum>(3)</enum><header>Credit for design work</header><text>The non-Federal interest shall receive credit for the reasonable costs of planning, design, construction work completed by the non-Federal interest before entering into a partnership agreement with the Secretary.</text></paragraph> 
<paragraph id="HC90D5511873C450B82966F540983252B"><enum>(4)</enum><header>Lands, easements, rights-of-way and relocations</header><text>The non-Federal interest shall receive credit for lands, easements, rights-of-way, and relocations provided by the non-Federal interest toward the non-Federal share of project costs.</text></paragraph> 
<paragraph id="H27F4D570B5884760916D739402002300"><enum>(5)</enum><header>Operation and maintenance</header><text>The non-Federal share of operation and maintenance costs for projects constructed under an agreement entered into under this section shall be 100 percent.</text></paragraph></subsection> 
<subsection id="H5D436064FA8F4141964FFC8944931CD8"><enum>(f)</enum><header>Applicability of other federal and state laws</header><text>Nothing in this section shall be construed as waiving, limiting, or otherwise affecting the applicability of any provision of Federal or State law that would otherwise apply to a project to be carried out with assistance provided under this section.</text></subsection> 
<subsection id="H18A17BF1138F4CDBB092F15E9D2D37E"><enum>(g)</enum><header>Authorization of appropriations</header><text display-inline="yes-display-inline">There is authorized to be appropriated to carry out this section $40,000,000.</text></subsection></section>
