<official-title>To amend title XVIII of the Social Security Act to provide for the public disclosure of prices for hospital and ambulatory surgical center procedures and drugs.</official-title>

<section id="HE6F3DAB6D14F49CC83FA0700D7BF55FB" section-type="section-one" display-inline="no-display-inline"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Hospital Price Disclosure Act of 2005</short-title></quote>.</text></section> 
<section id="H75C7D75D0CD640808D67026C6E90A46B"><enum>2.</enum><header>Public disclosure of hospital and ambulatory surgical center data</header> 
<subsection id="H39C2509F709046798B17579C6525BF0"><enum>(a)</enum><header>Requirement</header> 
<paragraph id="HEEC5F648F6724CA4B95200C0B29E4486"><enum>(1)</enum><header>Hospitals</header><text>Subsection (a)(1) of section 1866 of the Social Security Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395cc">42 U.S.C. 1395cc</external-xref>) is amended—</text> 
<subparagraph id="H6600E5A461174FDA00448F25EF945134"><enum>(A)</enum><text>in subparagraph (U), by striking <quote>and</quote> at the end;</text></subparagraph> 
<subparagraph id="HD89B87B2AA134CC38CF7EABC637FC044"><enum>(B)</enum><text>in subparagraph (V), by striking the period at the end and inserting <quote>, and</quote>; and</text></subparagraph> 
<subparagraph id="HFCA1CD5213EC4DE39B908242E0C80039"><enum>(C)</enum><text>by inserting after subparagraph (V) the following new subparagraph:</text>

<subparagraph id="HD3EEEA836312473A93C5FB04FEC63B8B" indent="up1"><enum>(W)</enum><text>in the case of a hospital, to report to the Secretary data in accordance with subsection (k)(1) and to post notice regarding such data in accordance with subsection (k)(2)(B).</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph> 
<paragraph id="HB5F16E23AB214496917D953EB9ED9C8C"><enum>(2)</enum><header>Ambulatory surgical centers</header><text>Section 1832(a)(2)(F)(i) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395k">42 U.S.C. 1395k(a)(2)(F)(i)</external-xref>) is amended by inserting after <quote>other standards</quote> the following: <quote>, including the reporting to the Secretary of data in accordance with section 1866(k)(1) and the posting of notice regarding such data in accordance with section 1866(k)(2)(B)</quote>. </text></paragraph> </subsection> 
<subsection id="H8071DE1C868E4984B000AC7B53AEBB73"><enum>(b)</enum><header>Data reporting by hospitals and ambulatory surgical centers for certain inpatient and outpatient procedures and inpatient drugs</header><text>Section 1866 of such Act (<external-xref legal-doc="usc" parsable-cite="usc/42/1395cc">42 U.S.C. 1395cc</external-xref>) is further amended by adding at the end the following new subsection:</text>

<subsection id="H3D2730DEFB6544D18E9B603D6EA1B5CB"><enum>(k)</enum><header>Data reporting by hospitals and ambulatory surgical centers and public posting</header> 
<paragraph id="H6E1468513162472CABB60F20624E500"><enum>(1)</enum><header>Quarterly reporting requirement</header><text display-inline="yes-display-inline">Not later than 45 days after the end of each calendar quarter (beginning more than one year after the date of the enactment of this subsection), a hospital shall report to the Secretary, for each procedure or drug selected under paragraph (3), and an ambulatory surgical center shall report to the Secretary, for each procedure selected under paragraph (3)(A)(ii), the following data: </text> 
<subparagraph id="H4E8B130EEB0E40058151F9006770ECE1" commented="no"><enum>(A)</enum><text display-inline="yes-display-inline">The frequency with which the hospital performed the procedure, or administered the drug in an inpatient setting, or the center performed the procedure during such quarter.</text> </subparagraph> 
<subparagraph id="H97B2B64739E4404DBA4F35C976B84359"><enum>(B)</enum><text>If the procedure was performed or the drug was so administered during such quarter, the average and the median of the price charged by the hospital or center for such procedure or drug during such quarter. </text></subparagraph> </paragraph> 
<paragraph id="H407C60C7FE594825B0A4554B16F58370" commented="no"><enum>(2)</enum><header>Public availability of data</header> 
<subparagraph id="HCF63CBA7F2AC4591A88195AFE3214BFD"><enum>(A)</enum><header>Public posting of data</header><text display-inline="yes-display-inline">The Secretary shall promptly post, on the official public Internet site of the Department of Health and Human Services, the data reported under paragraph (1). Such data shall be set forth in a manner that promotes price comparison among hospitals and ambulatory surgical centers.</text></subparagraph> 
<subparagraph id="HA499C847640941249CFFF1429C213F46"><enum>(B)</enum><header>Notice of availability</header><text display-inline="yes-display-inline">A hospital and ambulatory surgical center shall prominently post at each admission site of the hospital or center a notice of the availability of the data reported under paragraph (1) on the official public Internet site under subparagraph (A).</text></subparagraph></paragraph> 
<paragraph id="HC5A6D0EF52FE4B2BB734385C1CA127FA"><enum>(3)</enum><header>Selection of procedures and drugs</header> 
<subparagraph id="H7531EF935A4647E9A263022FFE20D18F"><enum>(A)</enum><header>Initial selection</header><text>Based on national data, the Secretary shall select the following:</text> 
<clause id="H6B8E454F1482486896226F94EC28F09"><enum>(i)</enum><text>The 25 most frequently performed hospital inpatient procedures.</text></clause> 
<clause id="HBCDEF3A8AF4A46C595B161976D605F14"><enum>(ii)</enum><text>The 25 most frequently performed hospital outpatient procedures.</text></clause> 
<clause id="H0BC45B60661D44178D7CE4132F522871"><enum>(iii)</enum><text>The 50 most frequently administered drugs in a hospital inpatient setting.</text></clause></subparagraph> 
<subparagraph id="HDFCF7078468D4B7FB09D4EBF10CAB521"><enum>(B)</enum><header>Updating selection</header><text>The Secretary shall periodically update the procedures and drugs selected under subparagraph (A).</text></subparagraph></paragraph> 
<paragraph id="HBEEC3B08528642CA82184C00E68983F9" commented="no"><enum>(4)</enum><header>Civil money penalty</header><text>The Secretary may impose a civil money penalty of not more than $10,000 for each knowing violation of the provisions of paragraph (1) or (2)(B) by a hospital or ambulatory surgical center. A civil money penalty under this paragraph shall be imposed and collected in the same manner as a civil money penalty under subsection (a) of section 1128A is imposed and collected under that section.</text></paragraph> 
<paragraph id="H2EBF6EA904C2487B00C513984C71BD36"><enum>(5)</enum><header>Administrative provisions</header> 
<subparagraph id="HB5DC46F51EEF45BBBED825FA1DE44CD5"><enum>(A)</enum><header>Classification of procedures</header><text display-inline="yes-display-inline">For purposes of this subsection, the Secretary shall establish rules for the classification of different procedures and for the assignment of items and services to those procedures.</text></subparagraph> 
<subparagraph id="H39FA1D2A4E7944BA88EE37954650261B"><enum>(B)</enum><header>Computation of average and median prices</header><text display-inline="yes-display-inline">For purposes of paragraph (1), the computation of an average and median price for a procedure or drug shall be in accordance with a methodology prescribed by the Secretary. Such methodology may provide for reporting by the hospital or ambulatory surgical center of unit prices for specific items and services included in a procedure, including appropriate per diem prices, and a method of converting such unit prices for a procedure to an average and median price for such procedure.</text></subparagraph> 
<subparagraph id="HEAEF0F60D4DE46AD8C1D5E121DAB027B"><enum>(C)</enum><header>Form of report and notice</header><text display-inline="yes-display-inline">The Secretary shall specify the electronic form and manner by which a hospital or ambulatory surgical center shall report data under paragraph (1) and the form for posting of notices under paragraph (2)(B).</text></subparagraph></paragraph> 
<paragraph id="H10FC97B9C5C443BAA0B5A925A36BFD6E" commented="no"><enum>(6)</enum><header>Non-preemption of State laws</header><text display-inline="yes-display-inline">Nothing in this subsection shall be construed as preempting or otherwise affecting any provision of State law relating to the disclosure of price or other information for a hospital or ambulatory surgical center.</text></paragraph> 
<paragraph id="HDB3797FE213845F1A65068BFDE3912"><enum>(7)</enum><header>Drug defined</header><text>For purposes of this subsection, the term <term>drug</term> includes a biological and a non-prescription drug, such as an ointment. </text> </paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection> </section>
