<official-title>To amend the Internal Revenue Code of 1986 to allow employers to claim a work opportunity credit for hiring military service personnel returning from service in Iraq or Afghanistan and for hiring their dependents and dependents of deceased personnel.</official-title>

<section id="HC9B189EC5F104C179B7632DFC988C43F" section-type="section-one" display-inline="no-display-inline"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Veterans Employment and Respect Act of 2005</short-title></quote>.</text></section> 
<section id="HB768EB0720D54AF4A589791606837F80"><enum>2.</enum><header>Work opportunity credit allowable for hiring military service personnel returning from service in Afghanistan or Iraq and for hiring dependents of Afghanistan and Iraq-era veterans</header> 
<subsection id="H7049DB57F9DD4C6CAFAE29817BC6BAC7"><enum>(a)</enum><header>In general</header><text>Paragraph (1) of <external-xref legal-doc="usc" parsable-cite="usc/26/51">section 51(d)</external-xref> of the Internal Revenue Code of 1986 (relating to members of targeted groups) is amended by striking <quote>or</quote> at the end of subparagraph (G), by striking the period at the end of subparagraph (H) and inserting a comma, and by adding at the end the following new subparagraphs:</text> 
<quoted-block style="OLC" id="H029F5E3D9A894E23BF0001D7D979F800" display-inline="no-display-inline"> 
<subparagraph id="H49B034D0C7AF41FE006FA537FDD0A3AC"><enum>(I)</enum><text>a qualified veteran of Afghanistan or Iraq, or</text></subparagraph> 
<subparagraph id="H027BB4E99D904C08B52E44F4091662F4"><enum>(J)</enum><text>a qualified dependent of an Afghanistan or Iraq-era veteran.</text></subparagraph><after-quoted-block> .</after-quoted-block></quoted-block></subsection> 
<subsection id="HDC8240E8789941ED9000534E501C00AB"><enum>(b)</enum><header>Definitions</header><text display-inline="yes-display-inline">Subsection (d) of section 51 of such Code is amended by redesignating paragraphs (10) through (12) as paragraphs (11) through (13), respectively, and by inserting after paragraph (9) the following new paragraph:</text>

<paragraph id="HA9E3E06A614E4C56B9273C00CEC7A53C"><enum>(10)</enum><header>Qualified afghanistan or iraq veterans, etc</header> 
<subparagraph id="H09DBFA1A9463457F00AA4480EE48B656"><enum>(A)</enum><header>Qualified veteran of afghanistan or iraq</header><text>The term <quote>qualified veteran of Afghanistan or Iraq</quote> means any veteran (as defined in paragraph (3)(B)) who is certified by the designated local agency—</text> 
<clause id="HAE58F45F85044D459B56FC3DF111DC85"><enum>(i)</enum><text>as having performed services—</text> 
<subclause id="H497053A191F74D8B95204C003400B184"><enum>(I)</enum><text display-inline="yes-display-inline">in an area designated by the President pursuant to the subparagraph as the <quote>Operation Iraqi Freedom Area</quote> or as the <quote>Operation Enduring Freedom Area</quote>, and </text> </subclause> 
<subclause id="H56088C38869347FA8605CBC10062F525"><enum>(II)</enum><text display-inline="yes-display-inline">during the period after October 6, 2001, before the date that the President specifies as the termination of United States combatant activities in such area, respectively, and</text></subclause> </clause> 
<clause id="HDDAFF3C3A0D84463AE43510000B6AF82"><enum>(ii)</enum><text display-inline="yes-display-inline">as having a hiring date which is not more than 2 years after the date that the veteran is discharged or released from active duty in the Armed Forces of the United States .</text></clause></subparagraph> 
<subparagraph id="HCBB49285C66E40D186F23922A1DA1F38"><enum>(B)</enum><header>Qualified dependent of afghasistan or iraq-era veteran</header><text>The term <quote>qualified dependent of an Afghanistan or Iraq-era veteran</quote> means any individual who is certified by the designated local agency—</text> 
<clause id="HA2A745358E1F4482B79E20A5BFFE7E53"><enum>(i)</enum><text>as being a dependent (as defined in <external-xref legal-doc="usc" parsable-cite="usc/37/401">section 401</external-xref> of title 37, United States Code) of—</text> 
<subclause id="HECDD2AEA8BF84D2FA0FB38A9CFF57321"><enum>(I)</enum><text>a member of the Armed Forces of the United States at the time such member died as a result of wounds or injuries sustained while performing services described in subparagraph (A)(i), or</text></subclause> 
<subclause id="H2C1EC1DC2A4342D68330BBA308B6CB32"><enum>(II)</enum><text display-inline="yes-display-inline">a member of a reserve component of the Armed Forces of the United States at the time such member was called or ordered to active duty if—</text> 
<item id="HA028D336B7834716007657206F7E65B0"><enum>(aa)</enum><text>such call or order was for a period in excess of 180 days or for an indefinite period, and</text></item> 
<item id="HEF97F3015333448799C5001FE490B774"><enum>(bb)</enum><text>such call or order is during the period described in subparagraph (A)(i), and</text></item></subclause></clause> 
<clause id="HB162DE273A584386B5F872926B5C5CB"><enum>(ii)</enum><text>as having a hiring date—</text> 
<subclause id="H5E4728243D6F41908275C62176A9357C"><enum>(I)</enum><text>in a case to which clause (i)(I) applies, which is not more than 2 years after the member’s date of death, and</text></subclause> 
<subclause id="H50F86198B2A94D6DB30032B8A2C2D0A7"><enum>(II)</enum><text>in a case to which clause (i)(II) applies, which is during the period of the member’s active duty.</text></subclause></clause></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection> 
<subsection id="H29E3FD103E6F445C008DA7A9A95268FD"><enum>(c)</enum><header>Effective date</header><text>The amendments made by this section shall apply to individuals beginning work for the employer after October 6, 2001.</text></subsection></section>
