<official-title>To prevent abuse of the special allowance subsidies under the Federal Family Education Loan Program.</official-title>

<section id="H6013567ED4C34D88A047943EC2998955" section-type="section-one" display-inline="no-display-inline"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline"> This Act may be cited as the <quote><short-title>Emergency Loan Abuse Prevention Act of 2005</short-title></quote>.</text></section> 
<section id="HFE5AEF43D32747E3A50048CDEEA3BDA"><enum>2.</enum><header>Termination of excessive allowances</header><text display-inline="no-display-inline"> Section 438(b)(2)(B) of the Higher Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/1087-1">20 U.S.C. 1087–1(b)(2)(B)</external-xref>) is amended by striking clause (v) and inserting the following:</text>

<clause id="H99E53672E28F4C5D8264AF34530049AB"><enum>(v)</enum><text>This subparagraph shall not apply to—</text> 
<subclause id="HC24654BEF49542D100DA8CCB1F6900D3"><enum>(I)</enum><text>any loan made or purchased after the date of enactment of the Emergency Loan Abuse Prevention Act of 2004;</text></subclause> 
<subclause id="HD057555F18D344EBBF604685ACE63F14"><enum>(II)</enum><text>any loan that had not qualified before such date of enactment for receipt of a special allowance payment determined under this subparagraph; or</text></subclause> 
<subclause id="H8630377BE854417F8000B0CB28F83B6F"><enum>(III)</enum><text>any loan made or purchased before such date of enactment with funds described in the first or second sentence of clause (i) if—</text> 
<item id="H6D748301D2744EC2BD48FC5C73561B43"><enum>(aa)</enum><text>the obligation described in the first such sentence has, after such date of enactment, matured, or been retired or defeased; or</text></item> 
<item id="H3D688899245449EC963B1545B887C8B8"><enum>(bb)</enum><text>the maturity date or the date of retirement of the obligation described in the first such sentence has, after such date of enactment, been extended.</text></item></subclause></clause><after-quoted-block>.</after-quoted-block></quoted-block></section> 
<section id="H04C533907BC345B7802C59A400F58D52"><enum>3.</enum><header>Expenditure of savings on increased pell grants</header><text display-inline="no-display-inline">From any amounts in the Treasury not otherwise appropriated, there is appropriated for each of the fiscal years beginning after the date of enactment of this Act an additional amount for the purposes of increasing the maximum Pell grant in each Act providing annual appropriations for the Pell grant program under subpart 1 of part A of title IV of the Higher Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/1070a">20 U.S.C. 1070a</external-xref>) that is equal to the amount that is determined annually by the Congressional Budget Office to be the amount by which expenditures under section 438 of such Act (<external-xref legal-doc="usc" parsable-cite="usc/20/1087-1">20 U.S.C. 1087–1</external-xref>) are reduced for such fiscal year by the enactment of section 2 of this Act.</text></section>
