<official-title>To amend the Higher Education Act of 1965 to permit refinancing of student consolidation loans, increase Pell Grant maximum awards, and for other purposes.</official-title>

<section id="H205733AC4C1F4EF8BE0042AA32ED0007" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>College Loan Assistance Act of 2005</short-title></quote>.</text> </section> 
<section id="HC7C029CDFCC44F97859B8C596FAA1948"><enum>2.</enum><header>Removal of prohibition on refinancing consolidation loans</header> 
<subsection id="HA83AE38EBF7E4AEB84BF52E62833CABE"><enum>(a)</enum><header>Removal of prohibition</header><text>Section 428C(a)(3) the <act-name parsable-cite="HEA65">Higher Education Act of 1965</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/20/1078-3">20 U.S.C. 1078–3(a)(3)</external-xref>) is amended—</text> 
<paragraph id="H0235D921BB4E45E3BE08624483BD3C5"><enum>(1)</enum><text>by striking subparagraph (B);</text></paragraph> 
<paragraph id="H493C3B5EC7C94BE399E5694665BD1114"><enum>(2)</enum><text>in subparagraph (C), by striking <quote>subparagraphs (A) and (B)</quote> and inserting <quote>subparagraph (A)</quote>; and</text></paragraph> 
<paragraph id="HE85EA7777B494788B52244447F647474"><enum>(3)</enum><text>by redesignating subparagraph (C) as subparagraph (B).</text></paragraph></subsection> 
<subsection id="H85F3DFAACC8142AABB45B2E19D7CA96"><enum>(b)</enum><header>Reduction of cap on interest rate</header><text>Section 427A(<italic>l</italic>)(3) of such Act (20 U.S.C. 1077a(<italic>l</italic>)(3)) is amended by striking subparagraph (B) and inserting the following:</text>

<subparagraph id="HE9D2B47B802048BCB6A832C2376ED52C"><enum>(B)</enum><text>6.8 percent.</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection></section> 
<section id="HB3CD4B8CBC0F4F9BADB52F80EBC1ABC"><enum>3.</enum><header>Extension and increase of Pell Grant maximum amounts</header><text display-inline="no-display-inline">Section 401(b)(2)(A) of the <act-name parsable-cite="HEA65">Higher Education Act of 1965</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/20/1070a">20 U.S.C. 1070a(b)(2)(A)</external-xref>) is amended by striking <quote>shall be—</quote> and all that follows through <quote>less an amount</quote> and inserting <quote>shall be $7,000 for academic year 2006–2007 and each of the 4 succeeding academic years, less an amount</quote>.</text> </section> 
<section id="H106DE7F3B4E94097AC009EFE79E2B169"><enum>4.</enum><header>Elimination of loan fees to borrowers</header> 
<subsection id="H6E9E370B1AA2426595DA7E1E96DF37B6"><enum>(a)</enum><header>Federal family education loan program</header><text>Section 438(c) of the <act-name parsable-cite="HEA65">Higher Education Act of 1965</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/20/1087-1">20 U.S.C. 1087–1(c)</external-xref>) is amended by adding at the end the following new paragraph:</text> 
<quoted-block act-name="Higher Education Act of 1965" id="H6F370358C968457B9074FC06D7085912"> 
<paragraph id="H9ABC6A9F2A684DAF83372929A330E54E"><enum>(9)</enum><header>Origination fees terminated</header><text>Notwithstanding any other provision of this subsection, with respect to any loan made, insured, or guaranteed under this part on or after the first July 1 after the date of enactment of the <short-title>College Loan Assistance Act of 2005</short-title>—</text> 
<subparagraph id="H192156F0E6DD40E79BB2C70504E17D4"><enum>(A)</enum><text>no eligible lender may collect directly or indirectly from any borrower any origination fee with respect to such loan, or any other fee relating to the origination of a loan however described; and</text></subparagraph> 
<subparagraph id="H5C6E646E637E48299382A65B55F0D4DE"><enum>(B)</enum><text>the Secretary shall not collect any origination fee from the lender under this subsection.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection> 
<subsection id="H23B526C4BD294A28BAE8B2D7EB623F4D"><enum>(b)</enum><header>Federal direct loan program</header><text>Section 455(c) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/20/1087e">20 U.S.C. 1087e(c)</external-xref>) is amended to read as follows:</text>

<subsection id="H6AD1F1F6016C43A2B534D8A4922E5920"><enum>(c)</enum><header>Loan fee</header> 
<paragraph id="HAC89026683EC40379F8F2226B8A4707C"><enum>(1)</enum><header>Temporary provision</header><text>Subject to paragraph (2), the Secretary shall charge the borrower of a loan made under this part an origination fee of 4.0 percent of the principal amount of loan.</text></paragraph> 
<paragraph id="H9AC164B6BC9643638FBFE5E4688885C0"><enum>(2)</enum><header>Termination of origination fee</header><text>With respect to any loan made under this part on or after the first July 1 after the date of enactment of <short-title>College Loan Assistance Act of 2005</short-title>, the Secretary shall not collect directly or indirectly from any borrower any origination fee with respect to such loan, or any other fee relating to the origination of a loan however described.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection></section>
