<official-title>To amend title XVIII of the Social Security Act to authorize physical therapists to evaluate and treat Medicare beneficiaries without a requirement for a physician referral, and for other purposes.</official-title>

<section section-type="section-one" id="H7C6B5484F0724CF6A4A004994EE60213" display-inline="no-display-inline"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Medicare Patient Access to Physical Therapists Act of 2005</short-title></quote>.</text></section> 
<section id="HCE78A2C023294CF584B999025F2D62CC"><enum>2.</enum><header>Access to outpatient physical therapy services for medicare beneficiaries as authorized by State law</header> 
<subsection id="H85D597A1A17B4211A8476F27EFFD56C0"><enum>(a)</enum><header>In general</header> 
<paragraph id="HA207D960E8B1472595E2FBAFD8BB2822"><enum>(1)</enum><header>Elimination of required physician referral</header> 
<subparagraph id="HF3B2072F92444025AE9D00FA6460BF7B"><enum>(A)</enum><header>Definition of outpatient physical therapy services</header><text>Section 1861(p) of the <act-name parsable-cite="SSA">Social Security Act</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/42/1395x">42 U.S.C. 1395x(p)</external-xref>) is amended—</text> 
<clause id="HCE03916440174877925541B48298B230"><enum>(i)</enum><text>in the matter preceding paragraph (1), by striking <quote>as an outpatient</quote>;</text></clause> 
<clause id="H0CCD8DF8BAEE45FEAE27BAAC71975934"><enum>(ii)</enum><text>by amending paragraph (1) to read as follows:</text>

<subclause id="HFCAD3756074F4C30935881F59D4D27"><enum>(I)</enum><text>by striking <quote>physician (as so defined) or by a qualified physical therapist</quote> and inserting <quote>physician (as defined in paragraph (1), (3), or (4) of subsection (r)) or by a qualified physical therapist (as defined in section 1861(bbb))</quote>; and</text></subclause> 
<subclause id="H57615085B838407B8BD0EF2846BCA00"><enum>(II)</enum><text>by inserting <quote>or a qualified physical therapist (as so defined)</quote> after <quote>physician</quote> the second place it appears;</text></subclause></clause> 
<clause id="H3F6C8F422A9F4713B2205BF581A93F40"><enum>(iv)</enum><text>in paragraph (4)(A)(ii), by striking <quote>one or more</quote> and all that follows through <quote>agency) and</quote>; and</text></clause> 
<clause id="H98B13150F07D4F458765F6B43CB6B271"><enum>(v)</enum><text>by amending the fifth sentence to read as follows: “Nothing in this subsection shall be construed as authorizing the provision of services in a State that a qualified physical therapist is not authorized to provide in the State in accordance with State law (or the State regulatory mechanism provided by State law).</text></clause></subparagraph> 
<subparagraph id="H6F52565DB65E4322917F4DCB46D3005E"><enum>(B)</enum><header>Conforming amendments</header><text>Section 1835(a)(2) of the <act-name parsable-cite="SSA">Social Security Act</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/42/1395n">42 U.S.C. 1395n(a)(2)</external-xref>) is amended—</text> 
<clause id="HAB55E37F29D245C5A1FAF88209C0345"><enum>(i)</enum><text>in the matter preceding subparagraph (A), by inserting <quote>, or in the case of outpatient physical therapy services (as described in subparagraph (C)) and physical therapy services furnished as comprehensive outpatient rehabilitation facility services (described in subparagraph (E)), a qualified physical therapist,</quote> after <quote>a physician</quote>;</text></clause> 
<clause id="H9F343C6BE13A4D45A6759651665091FE"><enum>(ii)</enum><text>in subparagraph (C)—</text> 
<subclause id="H302F67D74B3644C00051151E9E9BFB59"><enum>(I)</enum><text>in the matter preceding clause (i), by striking <quote>or outpatient occupational therapy services</quote>;</text></subclause> 
<subclause id="HD9C3546B565441DB8277936763358C28"><enum>(II)</enum><text>in clause (i), by striking <quote>or occupational therapy services, respectively,</quote> and inserting <quote>, and</quote>;</text></subclause> 
<subclause id="H25122CC56DE14A559D1DF26D3B9B30E4"><enum>(III)</enum><text>in clause (ii), by striking <quote>or qualified occupational therapist, respectively,</quote>; and</text></subclause> 
<subclause id="HFABE4252CD3B48089C2869DEBEFB3FCB"><enum>(IV)</enum><text>beginning in clause (ii), by striking <quote>by a physician, and (iii)</quote> and all that follows and inserting <quote>by a physician or a qualified physical therapist;</quote>;</text></subclause></clause> 
<clause id="H2069772986E847A48BBA06121FF8B21D"><enum>(iii)</enum><text>in subparagraph (D)—</text> 
<subclause id="HE46719E810AA4426A2AC5DC2CAC65EE1"><enum>(I)</enum><text>in the matter preceding clause (i), by striking <quote>outpatient speech pathology services</quote> and inserting <quote>outpatient occupational therapy services or outpatient speech-language pathology services</quote>;</text></subclause> 
<subclause id="H322E6A877A154B4AA26CA701F29B94FA"><enum>(II)</enum><text>in clause (i), by striking <quote>needed speech pathology services</quote> and inserting <quote>needed occupational therapy services or speech-language pathology services, respectively</quote>; and</text></subclause> 
<subclause id="H52D6A6D9C83D4FCFA5D13CE600BEFC4F"><enum>(III)</enum><text>in clause (ii), by striking <quote>speech pathologist</quote> and inserting <quote>occupational therapist or speech-language pathologist, respectively,</quote>; and</text></subclause></clause> 
<clause id="HF667EBCB88E14179A72EAF59E2F98151"><enum>(iv)</enum><text>in subparagraph (E)—</text> 
<subclause id="H8D177E311456485A838F538C3EBC7200"><enum>(I)</enum><text>in clause (ii), by inserting <quote>(or, in the case of comprehensive outpatient rehabilitation facility services consisting of physical therapy services, by a qualified physical therapist)</quote> after <quote>physician</quote>; and</text></subclause> 
<subclause id="H069FBDE7C5B84AE69D7900B8D325B4E0"><enum>(II)</enum><text>in clause (iii), by inserting <quote>in the case of comprehensive outpatient rehabilitation facility services not consisting of physical therapy services,</quote> before <quote>such services</quote>.</text></subclause></clause></subparagraph></paragraph> 
<paragraph id="H9BCA9892CF6E44E58654B133D543D2FF"><enum>(2)</enum><header>Definition of qualified physical therapist</header><text>Section 1861 of the <act-name parsable-cite="SSA">Social Security Act</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/42/1395x">42 U.S.C. 1395x</external-xref>) is amended by adding at the end the following new subsection:</text> 
<quoted-block style="other" other-style="archaic" act-name="Social Security Act" id="H7EA70F2973134E1782FAB07FE6424800"> 
<subsection id="H70F43419C5644B11B7D8C472954EF051"><enum>(bbb)</enum><header>Qualified physical therapist</header><text>The term <term>qualified physical therapist</term> means an individual who is licensed as a physical therapist by the State in which such individual is practicing and who meets the applicable requirements under paragraph (1) or (2):</text> 
<paragraph id="HFA96B1408662485B9B124164D6007178"><enum>(1)</enum><text>With respect to individuals graduating from a professional physical therapy education program on or after January 1, 2003, the individual—</text> 
<subparagraph id="HF6D30399FB2E40FC9390DEAF8E09615D"><enum>(A)</enum><text>has received a master’s or doctoral degree from a professional physical therapy education program that has been accredited by a national physical therapy education accreditation agency recognized by the Secretary of Education; or</text></subparagraph> 
<subparagraph id="H0821811EBD5242B395600070F12D5620"><enum>(B)</enum><text>has graduated from a professional physical therapy education program outside the United States with a curriculum that is substantially equivalent (as determined by an accreditation agency described in subparagraph (A)) to the curricula of programs for professional physical therapy education programs in the United States that are accredited by such an accreditation agency.</text></subparagraph></paragraph> 
<paragraph id="H76ACE5D1BEAD4CA1AE005C83127E8BA0"><enum>(2)</enum><text>With respect to individuals licensed as physical therapists by a State before 2003, the individual was, or upon application to the Secretary could have been, qualified under regulations of the Secretary in effect before such date to furnish physical therapy services under this title, as determined by the Secretary.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection> 
<subsection id="HE434DAADD4644D1087CC7610F4575477"><enum>(b)</enum><header>Preserving existing law for outpatient occupational therapy services</header> 
<paragraph id="H61F51DA2C9F14108002DCD4D1CF3222C"><enum>(1)</enum><header>Definition</header><text>Section 1861(g) of the <act-name parsable-cite="SSA">Social Security Act</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/42/1395x">42 U.S.C. 1395x(g)</external-xref>) is amended to read as follows:</text> 
<quoted-block style="other" other-style="archaic" act-name="Social Security Act" id="H7A18F7164FDF48C1A6A9843FF1158547"> 
<subsection id="H821E04B28A5C45FE87242FE9691E4EC4"><enum>(g)</enum><header>Outpatient occupational therapy services</header><text>The term <term>outpatient occupational therapy services</term> means occupational therapy services furnished by a provider of services, a clinic, a rehabilitation agency, or a public health agency, or by others under an arrangement with, and under the supervision of, such a provider, clinic, rehabilitation agency, or public health agency to an individual as an outpatient—</text> 
<paragraph id="HD7A311F907EA416CA1C4508E2EFB2902"><enum>(1)</enum><text>who is under the care of a physician (as defined in paragraph (1), (3), or (4) of subsection (r));</text></paragraph> 
<paragraph id="HEAB8E8FA6D974952A3B4C287930064D7"><enum>(2)</enum><text>with respect to whom a plan prescribing the type, amount, and duration of occupational therapy services that are furnished to such individual has been established by a physician (as so defined) or by an occupational therapist and is periodically reviewed by a physician (as so defined);</text></paragraph><continuation-text continuation-text-level="subsection">excluding, however—</continuation-text> 
<paragraph id="HEF089482BB70470A9408049669532FBA"><enum>(3)</enum><text>any item or service if it would not be included under subsection (b) if furnished to an inpatient of a hospital; and</text></paragraph> 
<paragraph id="H70BBF393D115476BB63303926C82C29F"><enum>(4)</enum><text>any such service—</text> 
<subparagraph id="H05AF342403DB43B991E600C0B5861832"><enum>(A)</enum><text>if furnished by a clinic, rehabilitation agency, or by others under arrangements with such clinic or agency, unless such clinic or rehabilitation agency—</text> 
<clause id="HBBEB475A640C4CE1894BF9BE077D366"><enum>(i)</enum><text>provides an adequate program of occupational therapy services for outpatients and has the facilities and personnel required for such program or required for the supervision of such a program, in accordance with such requirements as the Secretary may specify;</text></clause> 
<clause id="HD8967B06D4C44FD88D4734E019774F89"><enum>(ii)</enum><text>has policies, established by a group of professional personnel, including one or more occupational therapists, to govern the services (referred to in clause (i)) it provides;</text></clause> 
<clause id="H5A5676C10B994D48B15D809E63FCFD1F"><enum>(iii)</enum><text>maintains clinical records on all patients;</text></clause> 
<clause id="H2737DA8405D142DDB59F00A4A7437B70"><enum>(iv)</enum><text>if such clinic or agency is situated in a State in which State or applicable local law provides for the licensing of institutions of this nature—</text> 
<subclause id="HA9EE341099994E789F3C8CA62481C86C"><enum>(I)</enum><text>is licensed pursuant to such law, or</text></subclause> 
<subclause id="HCABE37A9210B4B0197958F96C545C8CA"><enum>(II)</enum><text>is approved by the agency of such State or locality responsible for licensing institutions of this nature, as meeting the standards established for such licensing; and</text></subclause></clause> 
<clause id="H8A914FB168424653BFEB6D4CE1985D0"><enum>(v)</enum><text>meets such other conditions relating to the health and safety of individuals who are furnished services by such clinic or agency on an outpatient basis, as the Secretary may find necessary, and provides the Secretary on a continuing basis with a surety bond that is not less than $50,000; or</text></clause></subparagraph> 
<subparagraph id="HE1BC80D831AB4EF59418D677E78D424D"><enum>(B)</enum><text>if furnished by a public health agency, unless such agency meets such other conditions relating to the safety of individuals who are furnished services by such agency on an outpatient basis, as the Secretary may find necessary.</text></subparagraph></paragraph><continuation-text continuation-text-level="subsection">The term <term>outpatient occupational therapy services</term> also includes occupational therapy services furnished an individual by an occupational therapist (in the office of the occupational therapist or in such individual’s home) who meets licensing and other standards prescribed by the Secretary in regulations, otherwise than under an arrangement with and under the supervision of a provider of services, clinic, rehabilitation agency, or public health agency, if the furnishing of such services meets such conditions relating to health and safety as the Secretary may find necessary. In addition, such term includes occupational therapy services that meet the requirements of the first sentence of this subsection except that they are furnished to an inpatient of a hospital or extended care facility. Nothing in this subsection shall be construed as requiring, with respect to outpatients who are not entitled to benefits under this title, an occupational therapist to provide outpatient occupational therapy services only to outpatients who are under the care of a physician or pursuant to a plan of care established by a physician. The Secretary may waive the requirement of a surety bond under paragraph (4)(A)(v) in the case of a clinic or agency that provides a comparable surety bond under State law.</continuation-text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph> 
<paragraph id="HB1F80D670165418AA6F520B7846473B8"><enum>(2)</enum><header>Conforming amendments</header> 
<subparagraph id="H32F555B74C4645408C95FF00848D9C55"><enum>(A)</enum><header>Scope of benefits</header><text>Section 1832(a)(2)(C) of the <act-name parsable-cite="SSA">Social Security Act</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/42/1395k">42 U.S.C. 1395k(a)(2)(C)</external-xref>) is amended by striking <quote>such sentence applies through the operation of section 1861(g))</quote> and inserting <quote>the second sentence of section 1861(g) applies)</quote>.</text></subparagraph> 
<subparagraph id="H8008DEB4EC6D41A78B9313B6CF892900"><enum>(B)</enum><header>Payment of benefits</header><text>Section 1833(g)(3) of the <act-name parsable-cite="SSA">Social Security Act</act-name> (42 U.S.C. 1395<italic>l</italic>(g)(3)) is amended by striking <quote>section 1861(p)</quote> and all that follows through <quote>section 1861(g)</quote> and inserting <quote>section 1861(g) (but not described in subsection (a)(8)(B))</quote>.</text></subparagraph> 
<subparagraph id="HF65F004EEFE4438FA7CC28E410839019"><enum>(C)</enum><header>Provider claims procedures</header><text>The second sentence of section 1835(a) of the <act-name parsable-cite="SSA">Social Security Act</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/42/1395n">42 U.S.C. 1395n(a)</external-xref>) is amended—</text> 
<clause id="HEC20157725824684BD00CC5BE1ED5C37"><enum>(i)</enum><text>by striking <quote>section 1861(p)(4)(A) (or meets the requirements of such section through the operation of section 1861(g))</quote> and inserting <quote>section 1861(p)(4)(A) or section 1861(g)(4)(A)</quote>;</text></clause> 
<clause id="HBB24B48F0B5E4237B66D73B8F968A520"><enum>(ii)</enum><text>by striking <quote>section 1861(p)(4)(B) (or meets the requirements of such section through the operation of section 1861(g))</quote> and inserting <quote>section 1861(p)(4)(B) or section 1861(g)(4)(B)</quote>; and</text></clause>

<subparagraph id="H7628021C8C52462ABF49568151B06BFC"><enum>(D)</enum><header>Agreements with providers</header><text>Section 1866(e)(1) of the <act-name parsable-cite="SSA">Social Security Act</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/42/1395cc">42 U.S.C. 1395cc(e)(1)</external-xref>) is amended—</text> 
<clause id="H7BBB74BAB1D1423AB49BDE3747DD0309"><enum>(i)</enum><text>by striking <quote>section 1861(p)(4)(A) (or meets the requirements of such section through the operation of section 1861(g))</quote> and inserting <quote>section 1861(p)(4)(A) or section 1861(g)(4)(A)</quote>;</text></clause>

<paragraph id="HF073D586104948FEBC57688DFEBAF9B5"><enum>(1)</enum><header>Scope of benefits</header><text>Section 1832(a)(2)(C) of the <act-name parsable-cite="SSA">Social Security Act</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/42/1395k">42 U.S.C. 1395k(a)(2)(C)</external-xref>), as amended by subsection (b)(2)(A), is amended—</text> 
<subparagraph id="HC6EE22726C024802A06EBBF4A9EAF09"><enum>(A)</enum><text>by striking <quote>and outpatient</quote> and inserting <quote>, outpatient</quote>; and</text></subparagraph> 
<subparagraph id="H7DD6573A51F041B1A664544F10019EC8"><enum>(B)</enum><text>by inserting before the semicolon the following: <quote>, and outpatient speech-language pathology services</quote>.</text></subparagraph></paragraph> 
<paragraph id="HF6EF8F8C4C9B4824AE5DF5D258964EC"><enum>(2)</enum><header>Payment of benefits</header><text>Section 1833 of the <act-name parsable-cite="SSA">Social Security Act</act-name> (42 U.S.C. 1395<italic>l</italic>) is amended—</text> 
<subparagraph id="H4BE1EDCD4A5D4EF2B246281CA7E59BA4"><enum>(A)</enum><text>in subparagraphs (A) and (B) of subsection (a)(8), by striking <quote>services, (which includes outpatient speech-language pathology services) and outpatient occupational therapy services</quote> each place it appears and inserting <quote>services, outpatient occupational therapy services, and outpatient speech-language pathology services</quote>; and</text></subparagraph> 
<subparagraph id="HA2C0E34DAC8B4ACC8B4D8D989F1B3950"><enum>(B)</enum><text>in subsection (g)—</text> 
<clause id="H5A503EBF1A4D4BF1999EF07CF0FCFCC9"><enum>(i)</enum><text>in paragraphs (1) and (3), by striking <quote>paragraph (4)</quote> each place it appears and inserting <quote>paragraph (5)</quote>; and</text></clause> 
<clause id="H020E3E296E7D428F9EE11BD503E76142"><enum>(ii)</enum><text>by redesignating paragraph (4) as paragraph (5) and inserting after paragraph (3) the following new paragraph:</text>

<paragraph id="H8961F7E0EFA349B3A2436FC97461AF5"><enum>(3)</enum><header>Provider claims procedures</header><text>The second sentence of section 1835(a) of the <act-name parsable-cite="SSA">Social Security Act</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/42/1395n">42 U.S.C. 1395n(a)</external-xref>), as amended by subsection (b)(2)(C), is amended—</text> 
<subparagraph id="H646932CC7E394C9C8B8731E060FFCEB8"><enum>(A)</enum><text>by striking <quote>or section 1861(g)(4)(A)</quote> and inserting <quote>, section 1861(g)(4)(A), or section 1861(ll)(5)(A)</quote>;</text></subparagraph> 
<subparagraph id="H7707D19CC53748E78DA4E21C5213BE58"><enum>(B)</enum><text>by striking <quote>or section 1861(g)(4)(B)</quote> and inserting <quote>, section 1861(g)(4)(B), or section 1861(ll)(4)(B)(ii)(II)</quote>; and</text></subparagraph>

<subparagraph id="HB8A4544E95594FD9BD261FBD9EBC951"><enum>(C)</enum><text>in subsection (ll), by adding at the end the following new paragraphs:</text>

<paragraph indent="up1" id="H191632F678C64D8D932BD90521465F48"><enum>(4)</enum> 
<subparagraph display-inline="yes-display-inline" id="H875E5804B74C4C11BAC3948E405BBBE2"><enum>(A)</enum><text>Subject to subparagraph (B), the term <term>outpatient speech-language pathology services</term> means speech-language pathology services that are furnished by a provider of services, a clinic, a rehabilitation agency, or a public health agency, or by others under an arrangement with, and under the supervision of, such provider, clinic, rehabilitation agency, or public health agency to an individual as an outpatient—</text> 
<clause indent="up1" id="H71571FD3A3EB4BFEA4AEFA2E154B5C56"><enum>(i)</enum><text>who is under the care of a physician (as defined in paragraph (1), (3), or (4) of subsection (r)); and</text></clause> 
<clause indent="up1" id="H056CA1D862E84BA48BB548224EA5A17D"><enum>(ii)</enum><text>with respect to whom a plan prescribing the type, amount, and duration of speech-language pathology services that are furnished to such individual has been established by a physician (as so defined) or by a qualified speech-language pathologist and is periodically reviewed by a physician (as so defined).</text></clause></subparagraph> 
<subparagraph indent="up1" id="H4A61D57B3AD941F7A29D38195F06ED65"><enum>(B)</enum><text>Such term does not include—</text> 
<clause id="H64181BB3E54245AEB22F7C9284CDBF67"><enum>(i)</enum><text>any item or service if it would not be included under subsection (b) if furnished to an inpatient of a hospital; or</text></clause> 
<clause id="HDA1D732A46B84D1EBEA00049FF13E7D9"><enum>(ii)</enum><text>any item or service—</text> 
<subclause id="H9AE3941565854CA4A0BF680072CE2F99"><enum>(I)</enum><text>if furnished by a clinic, rehabilitation agency, or by others under arrangements with such clinic or agency, unless such clinic or rehabilitation agency meets the requirements of paragraph (5); and</text></subclause> 
<subclause id="H850555398153459E8E08E0009D73E831"><enum>(II)</enum><text>if furnished by a public health agency, unless such agency meets such other conditions relating to the safety of individuals who are furnished services by such agency on an outpatient basis, as the Secretary may find necessary.</text></subclause></clause></subparagraph> 
<subparagraph indent="up1" id="H4CEA8976D3544620B118764ECB44001E"><enum>(C)</enum><text>Such term also includes speech-language pathology services that meet the requirements of the preceding sentence except that they are furnished to an inpatient of a hospital or extended care facility. Nothing in this subsection shall be construed as requiring, with respect to outpatients who are not entitled to benefits under this title, a speech-language pathologist to provide outpatient speech-language pathology services only to outpatients who are under the care of a physician or pursuant to a plan of care established by a physician. The Secretary may waive the requirement of a surety bond under paragraph (5)(E) in the case of a clinic or agency that provides a comparable surety bond under State law.</text></subparagraph></paragraph> 
<paragraph indent="up1" id="H7546F7C720764085AA9585750230DBB8"><enum>(5)</enum><text>A clinic or rehabilitation agency meets the requirements of this paragraph if it—</text> 
<subparagraph id="H24ECA6E545384D70A9C7E6B9EF2EF210"><enum>(A)</enum><text>provides an adequate program of speech-language pathology services for outpatients and has the facilities and personnel required for such program or required for the supervision of such a program, in accordance with such requirements as the Secretary may specify;</text></subparagraph> 
<subparagraph id="H0CDDF5B61CC640E08B8595A15FD875AC"><enum>(B)</enum><text>has policies, established by a group of professional personnel, including one or more speech-language pathologists, to govern the services (referred to in subparagraph (A)) it provides;</text></subparagraph> 
<subparagraph id="HEC1214B9AD0641D19E90176218C27F6F"><enum>(C)</enum><text>maintains clinical records on all patients;</text></subparagraph> 
<subparagraph id="HA36187C9B2CB477289B001CE4EA88DC0"><enum>(D)</enum><text>in the case of a clinic or agency that is situated in a State in which State or applicable local law provides for the licensing of institutions of this nature—</text> 
<clause id="HD8E50F2F5404453FBB01268800A9451D"><enum>(i)</enum><text>is licensed pursuant to such law, or</text></clause> 
<clause id="H5FD9DEED247B4EE100C2DED252D10038"><enum>(ii)</enum><text>is approved by the agency of such State or locality responsible for licensing institutions of this nature, as meeting the standards established for such licensing; and</text></clause></subparagraph> 
<subparagraph id="HC286BFB0EDAC40C0A8BBD610CC49275D"><enum>(E)</enum><text>meets such other conditions relating to the health and safety of individuals who are furnished services by such clinic or agency on an outpatient basis, as the Secretary may find necessary, and provides the Secretary on a continuing basis with a surety bond that is not less than $50,000.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph></subsection> 
<subsection id="H0EFC6016C3D246FF9F4D419700CBDE24"><enum>(d)</enum><header>Effective date</header><text>The amendments made by this section shall apply to items and services furnished on or after January 1, 2006.</text></subsection></section>
