<official-title>To enable a Bureau of Reclamation partnership with the North Bay Water Reuse Authority and other regional partners to achieve water supply, water quality, and environmental restoration objectives.</official-title>

<section id="H52FD17CFD4FA440C8908A6D1D7FFFB7E" section-type="section-one" display-inline="no-display-inline"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>North Bay Water Reuse Program Act of 2005</short-title></quote>.</text></section> 
<section id="H6E0ADCD20D64443BA9348168714BA3AA"><enum>2.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text> 
<paragraph id="HB1A5C768D4F04E6C92372B5CB6004DA2"><enum>(1)</enum><header>Eligible Entity</header><text>The term <quote>eligible entity</quote> means each of—</text> 
<subparagraph id="H2C012DA57546463DA3B29B372169752F"><enum>(A)</enum><text>the Sonoma Valley County Sanitation District, Sonoma, California;</text></subparagraph> 
<subparagraph id="H705D6B9BE8FA440C92F9D20C25C0744"><enum>(B)</enum><text>the Napa Sanitation District, Napa, California;</text></subparagraph> 
<subparagraph id="HC73DD147595E4A1094C8851702331EB7"><enum>(C)</enum><text>the City of American Canyon, California;</text></subparagraph> 
<subparagraph id="H7851A378CD654C6389809542764444ED"><enum>(D)</enum><text>the Las Gallinas Valley Sanitary District, San Rafael, California;</text></subparagraph> 
<subparagraph id="H810DD1EF6DD449D300942965EF3D31FF"><enum>(E)</enum><text>the Novato Sanitary District, Novato, California;</text></subparagraph> 
<subparagraph id="HADBE53F025F04CFE966E63A93C74F100"><enum>(F)</enum><text>the City of Petaluma, California; and</text></subparagraph>
<subparagraph id="HD2C1E572D879410EAAF3C84079BF3AA"><enum>(G)</enum><text>the Sonoma County Water Agency.</text></subparagraph></paragraph> 
<paragraph id="H6D53CFC671B24754B40000A658D3AF5B"><enum>(2)</enum><header>Secretary</header><text>The term <quote>Secretary</quote> means the Secretary of the Interior.</text></paragraph></section> 
<section id="HB84221E500664BF5A0AE30C06581A0C"><enum>3.</enum><header>North Bay Water Reuse Program</header><text display-inline="yes-display-inline"></text> 
<subsection id="H80EB3F3049B04114A28396B6E4F903C3"><enum>(a)</enum><header>In General</header><text>The Secretary may, through a cooperative agreement with the State of California or a subdivision thereof, participate in the planning, design, and construction of water reclamation and reuse projects including water quality improvement, waste water treatment, water reclamation and reuse, groundwater recharge and protection, surface water augmentation, and other improvements with eligible entities in the North San Pablo Bay watershed in Napa, Sonoma, Marin, and Solano Counties, California.</text></subsection> 
<subsection id="H8FA8DA5170394034B49D4421C46C024F"><enum>(b)</enum><header>Coordination with other Federal agencies</header><text>In carrying out this section, the Secretary shall, to the greatest degree practicable, build upon the design work and environmental evaluation undertaken by non-Federal entities and by the Corps of Engineers in the San Pablo Bay Watershed, California.</text></subsection> 
<subsection id="H8473EE814CDE455E8300B2843065D600"><enum>(c)</enum><header>Cooperative agreements</header><text>All planning, design, and construction of a recycled water project authorized by this Act shall be undertaken in accordance with a cooperative agreement between the Secretary and the eligible entity for the project. Such cooperative agreement shall set forth in a manner acceptable to the Secretary the responsibilities of the eligible entity for—</text> 
<paragraph id="HEE72B326E9AE440D91A156F2FDA5ADC5"><enum>(1)</enum><text display-inline="yes-display-inline">needs assessment;</text></paragraph> 
<paragraph id="H0E64C0A56D4742E0AFAB8151D66BC17C"><enum>(2)</enum><text>feasibility and reconnaissance studies;</text></paragraph> 
<paragraph id="H95E2AA7F136542A2924DF1B625F8ABBB"><enum>(3)</enum><text>environmental review;</text></paragraph> 
<paragraph id="HE57E9754507C49278DFBD3E2B16E2419"><enum>(4)</enum><text>engineering and design;</text></paragraph> 
<paragraph id="HE2F7A93BD92F403DAC227742981CEB2B"><enum>(5)</enum><text>construction; and</text></paragraph> 
<paragraph id="H437E797B88B14813A2C628F6F62E289B"><enum>(6)</enum><text>the administration of contracts pertaining to any of the foregoing.</text></paragraph></subsection> 
<subsection id="HCCCAB19F2B614D83AE553B4FA7229786"><enum>(d)</enum><header>Financial assistance</header><text>Upon execution of a cooperative agreement under this section, the Secretary may provide to the eligible entity, on the basis described in section 4, the funds authorized, through direct loans, loan guarantees, or grants.</text></subsection></section> 
<section id="H0825B1AE2B30488E8E000053F38BF1B7"><enum>4.</enum><header>Cost sharing</header><text display-inline="yes-display-inline"></text> 
<subsection id="HE6F6394BC9C241F4BBDF965D2D145900"><enum>(a)</enum><header>Federal assistance</header><text>The Federal share of a project funded under this Act shall not exceed 65 percent of the total cost for planning, environmental evaluation, and construction of the project.</text></subsection> 
<subsection id="HA7F8AB4E84974B648F80F1AC2DAEB0B6"><enum>(b)</enum><header>Non-federal Cost Share</header><text></text> 
<paragraph id="H6B6D708E5D6D4DC7A8C8A350F7790400"><enum>(1)</enum><header>In General</header><text>Except as provided in subsection (c), the non-Federal cost share of the costs of a project funded under this Act shall be no less than 35 percent total cost for planning, environmental evaluation, and construction of the project.</text></paragraph> 
<paragraph id="H90507BDAF35C419EBE4690CF4B244865"><enum>(2)</enum><header>Credit for Non-Federal work</header><text>The non-Federal interests with respect to a project funded under this Act shall receive credit toward the non-Federal share of the cost of the project—</text> 
<subparagraph id="HD6A0953FFA4D4B25A8CCB8AEC9ACC1D9"><enum>(A)</enum><text>for reasonable costs incurred by the non-Federal interests as a result of participation in the planning, design, and construction of the project; and</text></subparagraph> 
<subparagraph id="H9224F836E6E9415BA4731F2D8513466B"><enum>(B)</enum><text>for the fair-market value of lands utilized for project facilities and owned by eligible entities.</text></subparagraph></paragraph></subsection> 
<subsection id="H26E0F9DBEFAA41F8AEB6001F61005568"><enum>(c)</enum><header>Operation and Maintenance</header><text>The non-Federal share of operation and maintenance costs of a project funded under this Act shall be 100 percent.</text></subsection> 
<subsection id="H22B9BEFB7E544BA7BF3011D800AC225D"><enum>(d)</enum><header>Federal Assistance for Environmental Improvement and Enhancement</header> 
<paragraph id="H7A098E8A29CC4F60B09B8859A16BF0D4"><enum>(1)</enum><header>Initial development</header><text>The Secretary shall make grants and other funds available to eligible entities for the initial development of environmental improvement and enhancement components of the North Bay Water Reuse Program.</text></paragraph> 
<paragraph id="H5CF9356BBFD6482EA29051D300CB7B9C"><enum>(2)</enum><header>Nonreimbursable</header><text>Grants provided under this Act shall be nonreimbursable and not subject to repayment.</text></paragraph></subsection></section> 
<section id="HF0D7CC49060B458594D75E1C39F2B2E2"><enum>5.</enum><header>Water rights</header><text display-inline="no-display-inline">Nothing in this Act—</text> 
<paragraph id="H7B037120D5374F2FB2784CFF3BEE651B"><enum>(1)</enum><text>invalidates or preempts State water law or any interstate compact governing water;</text></paragraph> 
<paragraph id="H2EBA4E04E1DB4317B8DB978348ED98F1"><enum>(2)</enum><text>alters the rights of any State to any appropriated share of the waters of any body of surface or groundwater, whether determined by past or future interstate compacts or final judicial allocations;</text></paragraph> 
<paragraph id="H7E8039379E6D44A7AF765164ECC6BFC0"><enum>(3)</enum><text>preempts or modifies any State or Federal law, or interstate compact, governing water quality or disposal; or</text></paragraph> 
<paragraph id="H29964689F3F74BC3A9EC3733BAB42E9E"><enum>(4)</enum><text>confers on any non-Federal entity the ability to exercise any Federal right to the waters of any stream or to any groundwater resource.</text></paragraph></section> 
<section id="H8C709664651F4769B0EB67B4B7690070"><enum>6.</enum><header>Authorization of appropriations</header><text display-inline="no-display-inline">There is authorized to be appropriated to the Secretary to carry out this Act $65,000,000, to remain available until expended.</text></section>
