<official-title>To amend the Federal Election Campaign Act of 1971 to repeal the limit on the aggregate amount of campaign contributions that may be made by individuals during an election cycle, to repeal the limit on the amount of expenditures political parties may make on behalf of their candidates in general elections for Federal office, to allow State and local parties to make certain expenditures using nonfederal funds, to restore certain rights to exempt organizations under the Internal Revenue Code of 1986, and for other purposes.</official-title>

<section id="HB10D5E597C21489283925FA922163E38" section-type="subsequent-section"><enum>2.</enum><header>Repeal of Aggregate Limit on Contributions by Individuals</header> 
<subsection id="H350EF3CE94924B97BD3C20D532A200B5"><enum>(a)</enum><header>Repeal of Limit</header><text>Section 315(a) of the Federal Election Campaign Act of 1971 (<external-xref legal-doc="usc" parsable-cite="usc/2/441a">2 U.S.C. 441a(a)</external-xref>) is amended by striking paragraph (3).</text></subsection> 
<subsection id="H3A98CD1BD8184B16B033C62779046E1F"><enum>(b)</enum><header>Conforming Amendments</header> 
<paragraph id="H038BE552A5CC438BA9B571A54B00FECD"><enum>(1)</enum><header>Indexing</header><text>Section 315(c) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/2/441a">2 U.S.C. 441a(c)</external-xref>) is amended by striking <quote>(a)(3),</quote> each place it appears in paragraphs (1)(B)(i), (1)(C), and (2)(B)(ii).</text></paragraph> 
<paragraph id="H5BA75058277946C28F71B1FDF2465B29"><enum>(2)</enum><header>Increase in limits for Senate candidates facing wealthy opponents</header><text>Section 315(i)(1)(C) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/2/441a">2 U.S.C. 441a(i)(1)(C)</external-xref>) is amended—</text> 
<subparagraph id="H3F5AAF38A8CD4DF100DD698BECDFBA18"><enum>(A)</enum><text>by amending clause (i) to read as follows:</text>

<subsection id="HB6BA191E0F6B4DC0B29F31485F65061C"><enum>(a)</enum><header>Repeal of Limit</header><text>Section 315(d) of the Federal Election Campaign Act of 1971 (<external-xref legal-doc="usc" parsable-cite="usc/2/441a">2 U.S.C. 441a(d)</external-xref>) is amended—</text> 
<paragraph id="H1F79F18EEDBF4689BEA5A1B33444BB9F"><enum>(1)</enum><text>in paragraph (1)—</text> 
<subparagraph id="H02A44F1A81B54CAFB71FD604AAFAC630"><enum>(A)</enum><text>by striking <quote>(1) Notwithstanding</quote> and inserting <quote>Notwithstanding</quote>,</text></subparagraph> 
<subparagraph id="H88AF3B29678A489DA996E8EEEDA0F41D"><enum>(B)</enum><text>by striking <quote>expenditures or limitations on</quote> and inserting <quote>amounts of expenditures or</quote>, and</text></subparagraph>

<paragraph id="HC7404FAE41334F04B250F004B19F2C5E"><enum>(3)</enum><header>Increase in limits for House candidates facing wealthy opponents</header><text>Section 315A(a) of such Act (2 U.S.C. 441a—1(a)) is amended—</text> 
<subparagraph id="H58F9985EE0644EDF9F8800E58E8EB2F3"><enum>(A)</enum><text>in paragraph (1), as amended by section 2(b)(3), by striking <quote>exceeds $350,000—</quote> and all that follows and inserting the following: <quote>exceeds $350,000, the limit under subsection (a)(1)(A) with respect to the candidate shall be tripled.</quote>;</text></subparagraph> 
<subparagraph id="H33A04DF5CAE443DDA7EFFE001CB1AA78"><enum>(B)</enum><text display-inline="yes-display-inline">in paragraph (3)(A) in the matter preceding clause (i), by striking <quote>, and a party committee shall not make any expenditure,</quote>;</text></subparagraph> 
<subparagraph id="H2CEA12493EED4F4AB342E48819A363B5"><enum>(C)</enum><text display-inline="yes-display-inline">in paragraph (3)(A)(ii), by striking <quote>and party expenditures previously made</quote>; and</text></subparagraph> 
<subparagraph id="HF27987FDAD52408CB4B8E9B26CC30000"><enum>(D)</enum><text display-inline="yes-display-inline">in paragraph (3)(B), by striking <quote>and a party shall not make any expenditure</quote>.</text></subparagraph></paragraph></subsection></section> 
<section id="HCC836EE774604595B1CD5940DF1E5EE3"><enum>4.</enum><header>Increase in Contribution Limits for Political Committees</header> 
<subsection id="H3EB0CEFB4006428F9884F52C00B144BB"><enum>(a)</enum><header>Contributions to Political Committees</header><text>Section 315(a)(1)(C) of the Federal Election Campaign Act of 1971 (<external-xref legal-doc="usc" parsable-cite="usc/2/441a">2 U.S.C. 441a(a)(1)(C)</external-xref>) is amended by striking <quote>$5,000</quote> and inserting <quote>$7,500</quote>.</text></subsection> 
<subsection id="HCEC0652F21A54C4A8D92E400C7517B14"><enum>(b)</enum><header>Contributions Made by Multicandidate Committees</header><text>Section 315(a)(2) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/2/441a">2 U.S.C. 441a(a)(2)</external-xref>) is amended—</text> 
<paragraph id="HAD7BBEE8AB1E4E5EBB8E7D66DB689F03"><enum>(1)</enum><text>in subparagraph (A), by striking <quote>$5,000</quote> and inserting <quote>$7,500</quote>;</text></paragraph> 
<paragraph id="H266C75BEA8DE48138542038EEE006DAA"><enum>(2)</enum><text>in subparagraph (B), by striking <quote>$15,000</quote> and inserting <quote>$25,000</quote>; and</text></paragraph> 
<paragraph id="H14390AD8E92649F681C3D0518288DF7D"><enum>(3)</enum><text>in subparagraph (C), by striking <quote>$5,000</quote> and inserting <quote>$7,500</quote>. </text></paragraph></subsection></section> 
<section id="HC7BFB90287224045AA6BA089D49E6964"><enum>5.</enum><header>Indexing of all Contribution Limits</header> 
<subsection id="H1019BC964F05433DBA9431DBB2F1B356"><enum>(a)</enum><header>In General</header><text>Section 315(c)(1)(B) of the Federal Election Campaign Act of 1971 (<external-xref legal-doc="usc" parsable-cite="usc/2/441a">2 U.S.C. 441a(c)(1)(B)</external-xref>) is amended to read as follows:</text> 
<quoted-block style="OLC" id="HAA431EB31517451195AF2E1DD48615CB" display-inline="no-display-inline"> 
<subparagraph id="HC69F7F144016426681BAD4A628FA3CC" indent="up2"><enum>(B)</enum><text>Except as provided in subparagraph (C)—</text> 
<clause id="HB408A2B16E974BDA9E9264FB861FD7F3"><enum>(i)</enum><text>in any calendar year after 2002—</text> 
<subclause id="H005805793EDB4630BAD8922100C177CF"><enum>(I)</enum><text>a limitation established by subsection (a)(1)(A), (a)(1)(B), (b), or (h) shall be increased by the percent difference under subparagraph (A),</text></subclause>

<subclause id="H64EA85A1D7724D53965375BAEC895321"><enum>(III)</enum><text>if any amount after the adjustment made under subclause (I) is not a multiple of $100, such amount shall be rounded to the nearest multiple of $100; and</text></subclause></clause>

<subclause id="H8F62C89105984855A9F2F2A352D217C"><enum>(I)</enum><text display-inline="yes-display-inline">a limitation established by subsection (a)(1)(C), (a)(1)(D), or (a)(2) shall be increased by the percent difference under subparagraph (A),</text></subclause>

<subsection id="HBDD80D05E9CD4E71B61353D3466C4166"><enum>(c)</enum><header>Determination of Base Year</header><text>Section 315(c)(2)(B) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/2/441a">2 U.S.C. 441a(c)(2)(B)</external-xref>) is amended—</text> 
<paragraph id="H495A48E61C774527B0D36B307B2B5D52"><enum>(1)</enum><text>by striking <quote>and</quote> at the end of clause (i);</text></paragraph> 
<paragraph id="HEF74AC7F7D0643719BB6076C5728B418"><enum>(2)</enum><text>by striking the period at the end of clause (ii) and inserting <quote>; and</quote>; and</text></paragraph>

<section id="HD70B3B3CDA4049898DB7760418D145AF"><enum>6.</enum><header>Permitting Transfers Between Leadership Committees and National Party Committees</header><text display-inline="no-display-inline">Section 315(a)(4) of the Federal Election Campaign Act of 1971 (<external-xref legal-doc="usc" parsable-cite="usc/2/441a">2 U.S.C. 441a(a)(4)</external-xref>) is amended—</text> 
<paragraph id="H7555F0A1EB00410F85DE5936C61E45A6"><enum>(1)</enum><text>by striking <quote>(4)</quote> and inserting <quote>(4)(A)</quote>; and</text></paragraph> 
<paragraph id="HFD120149D2F24A649F5D00E96FC09278"><enum>(2)</enum><text>by adding at the end the following new subparagraph:</text> 
<quoted-block style="OLC" id="H37F00FCD7E0D42588F1FB8DC0084FB6D" display-inline="no-display-inline"> 
<subparagraph id="H6B99C175612042BBBB7D1064C1714B29" indent="up2"><enum>(B)</enum><text>The limitations on contributions contained in paragraphs (1) and (2) do not apply to transfers between a leadership committee of an individual holding Federal office and political committees established and maintained by a national political party. For purposes of the previous sentence, the term <quote>leadership committee</quote> means, with respect to an individual holding Federal office, an unauthorized political committee which is associated with such individual but which is not affiliated with any authorized committee of such individual.</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section> 
<section id="H822F5FDF7C34485AB1FB5CF694362900"><enum>7.</enum><header>Increase in Threshold of Contributions and Expenditures Required For Determining Treatment as Political Committee</header> 
<subsection id="H7F345230D55245788914DAC500867784"><enum>(a)</enum><header>In General</header><text>Section 301(4)(A) of the Federal Election Campaign Act of 1971 (<external-xref legal-doc="usc" parsable-cite="usc/2/431">2 U.S.C. 431(4)(A)</external-xref>) is amended by striking <quote>$1,000</quote> each place it appears and inserting <quote>$10,000</quote>.</text></subsection> 
<subsection id="HB90251C0F5E04340B306A3286ED5DD00"><enum>(b)</enum><header>Local Political Party Committees</header>

<section id="H414F01D67D96457C93307EE0042EF406"><enum>9.</enum><header>Requiring Section 527 Organizations to Submit Reports Under Federal Election Campaign Act of 1971</header><text display-inline="no-display-inline">Section 304(a) of the Federal Election Campaign Act of 1971 (<external-xref legal-doc="usc" parsable-cite="usc/2/434">2 U.S.C. 434(a)</external-xref>) is amended by adding at the end the following new paragraph:</text>

<paragraph id="HF7936A7E7F7C49DFA8657B9F005B519C" indent="up1"><enum>(13)(A)</enum><text>Except as provided in subparagraph (B), each organization described in <external-xref legal-doc="usc" parsable-cite="usc/26/527">section 527</external-xref> of the Internal Revenue Code of 1986 shall submit a report under this section in the same manner, under the same terms and conditions, and at the same times applicable to a political committee which is not an authorized committee of a candidate or a national committee of a political party.</text></paragraph>

<subsection id="H916312BE985F4C51A3C8CF3902050554"><enum>(a)</enum><header>Types of Communications Permitted</header><text>Section 316(b)(4)(B) of the Federal Election Campaign Act of 1971 (<external-xref legal-doc="usc" parsable-cite="usc/2/441b">2 U.S.C. 441b(b)(4)(B)</external-xref>) is amended by striking <quote>only by mail addressed</quote> and inserting <quote>only by communications addressed or otherwise delivered</quote>.</text></subsection> 
<subsection id="HA047C503484B42A48B66B171367F79DF"><enum>(b)</enum><header>Solicitations by Trade Associations</header><text>Section 316(b)(4)(D) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/2/441b">2 U.S.C. 441b(b)(4)(D)</external-xref>) is amended by striking <quote>to the extent that</quote> and all that follows and inserting a period.</text></subsection></section> 
<section id="HEAC8593FDF1A4C90B102E73D2430E0B6"><enum>12.</enum><header>Permitting State and Local Political Parties to Use Nonfederal Funds for Voter Registration and Sample Ballots</header>

<section id="H88C5B91817F04B95887EA4F960110917"><enum>14.</enum><header>Modification of Definition of Public Communication</header> 
<subsection id="H5A369318DCB145C9A000AED4F3A8B2A0"><enum>(a)</enum><header>In General</header><text>Section 301(22) of the Federal Election Campaign Act of 1971 (<external-xref legal-doc="usc" parsable-cite="usc/2/431">2 U.S.C. 431(22)</external-xref>) is amended by adding at the end the following new sentence: <quote>Such term shall not include communications over the Internet.</quote>.</text></subsection> 
<subsection id="HE42E56E35E9B4328B1A43B60901C3E35"><enum>(b)</enum><header>Effective Date</header><text>The amendment made by subsection (a) shall take effect on the date of the enactment of this Act.</text></subsection></section> 
<section id="H3CC852782BFD4B33A2867C72AA7546AE" section-type="subsequent-section" display-inline="no-display-inline"><enum>15.</enum><header>Treatment of Candidate Communications Containing Endorsement by Federal Candidate or Officeholder</header> 
<subsection id="HF33C0AAA191647D39F5078C8D7AE6F1B"><enum>(a)</enum><header>In General</header><text>Section 315(a) of the Federal Election Campaign Act of 1971 (<external-xref legal-doc="usc" parsable-cite="usc/2/441a">2 U.S.C. 441a(a)</external-xref>) is amended by adding at the end the following new paragraph:</text> 
<quoted-block style="traditional" id="HC0427426253D434BB20099AEEFBEB233" display-inline="no-display-inline"> 
<paragraph id="H2583B284673D4AAB81FF7B7160352C6" indent="up1"><enum>(9)(A)</enum><text>For purposes of paragraph (7)(C), a disbursement for an electioneering communication which refers to a candidate for Federal office shall not be treated as a disbursement which is coordinated with such candidate solely on the ground that the communication contains a State or local endorsement or (in the case of a communication containing a State or local endorsement) that the candidate reviewed, approved, or otherwise participated in the preparation and dissemination of the communication.</text></paragraph> 
<paragraph id="H1493A58294CD46FEA3FD40487FE25072" indent="up1"><enum>(B)</enum><text>In subparagraph (A), the term <quote>State or local endorsement</quote> means, with respect to a candidate for Federal office—</text> 
<subparagraph id="H1935F703E0B745579CF99FFD04ECF846"><enum>(i)</enum><text display-inline="yes-display-inline">an endorsement by such candidate of a candidate for State or local office or of another candidate for Federal office; or</text></subparagraph> 
<subparagraph id="H62F58C16D7584B8BBC12B6D883EF5033"><enum>(ii)</enum><text display-inline="yes-display-inline">a statement of the position of such candidate on a State or local ballot initiative or referendum.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection> 
<subsection id="HAAB01B28350C4EB0A6339EAE2DAFEB7"><enum>(b)</enum><header>Conforming Amendment</header><text>Section 315(a)(7)(C)(ii) of such Act (<external-xref legal-doc="usc" parsable-cite="usc/2/441a">2 U.S.C. 441a(a)(7)(C)(ii)</external-xref>) is amended by striking <quote>such disbursement</quote> and inserting <quote>subject to paragraph (9), such disbursement</quote>.</text></subsection> 
<subsection id="H10CF537EC5C24E93B0E6088F9174B66E"><enum>(c)</enum><header>Effective Date</header><text>The amendments made by this section shall apply with respect to elections occurring on or after the date of the enactment of this Act.</text></subsection></section> 
<section id="HEDD73B3E2EBE4EDC9D74A4D62BF721D"><enum>16.</enum><header>Severability</header><text display-inline="no-display-inline">If any provision of this Act or any amendment made by this Act, or the application of a provision or amendment to any person or circumstance, is held to be unconstitutional, the remainder of this Act and the amendments made by this Act, and the application of the provisions and amendments to any person or circumstance, shall not be affected by the holding.</text></section> 
<section id="HE64DBE126B1A4BD6A2C2B0F13BF958A3"><enum>17.</enum><header>Effective Date</header><text display-inline="no-display-inline">Except as otherwise provided, the amendments made by this Act shall take effect January 1, 2006.</text></section>
