<official-title>To amend the Defense Base Closure and Realignment Act of 1990 to require the 2005 base closure and realignment process to adhere to certain requirements regarding the preservation of military depot capabilities.</official-title>

<section id="HC9DB12F675B645A88F4725BA49260021" section-type="section-one"><enum>1.</enum><header> Adherence to certain authorities on preservation of military depot capabilities during 2005 round of base closures and realignments</header><text display-inline="no-display-inline">The Defense Base Closure and Realignment Act of 1990 (part A of title XXIX of <external-xref legal-doc="public-law" parsable-cite="pl/101/510">Public Law 101–510</external-xref>; <external-xref legal-doc="usc" parsable-cite="usc/10/2687">10 U.S.C. 2687</external-xref> note) is amended by adding at the end the following new section:</text>

<section id="H4C5B1E272C424418AB407100491E84D6"><enum>2915.</enum><header>Adherence to certain authorities on preservation of military depot capabilities during 2005 round of base closures and realignments</header> 
<subsection id="HC2F8C0B7C42943AC92EDCD64DEE5A2D6" display-inline="no-display-inline"><enum>(a)</enum><header>Adherence required</header><text display-inline="yes-display-inline">The base closure and realignment actions performed under section 2914, and any activities carried out to implement the closure or realignment of military installations as a result of such base closure and realignment actions, shall reflect a strict adherence to the provisions of title 10, United States Code, for the maintenance of government-owned, government-operated depot-level maintenance, repair, and logistics capabilities within the Department of Defense, including the provisions of chapter 146 of such title and other applicable provisions.</text></subsection> 
<subsection id="H5617278E9EF54973A97BA8DFBDFF1934" indent="up1"><enum>(b)</enum><header>No waivers authorized</header><text display-inline="yes-display-inline">Activities carried out to implement the closure or realignment of military installations as a result of base closure and realignment actions performed under section 2914 may not include a waiver authorized by paragraph (2) or (3) of section <external-xref legal-doc="usc" parsable-cite="usc/10/2464">2464(b)</external-xref> or section <external-xref legal-doc="usc" parsable-cite="usc/10/2466">2466(b)</external-xref> of title 10, United States Code.</text></subsection> 
<subsection id="H4EC44C135E70481EB9A62181B803EDFF"><enum>(c)</enum><header>Base closure and realignment actions defined</header><text>In this section, the term <term>base closure and realignment actions</term> means the following:</text> 
<paragraph id="H1394DE67F828452098C9A084BBFEBBCD"><enum>(1)</enum><text>The preparation by the Secretary of Defense of recommendations on installations for closure or realignment under this part or any subsequent base closure law.</text></paragraph> 
<paragraph id="HC42BD5C28A774B5ABBF697666B739DA"><enum>(2)</enum><text>The review by the Commission of the recommendations referred to in paragraph (1).</text></paragraph> 
<paragraph id="HB4B78468F09B4C5CAFBEDF46CC73CC3E"><enum>(3)</enum><text>The review by the President of the recommendations referred to in paragraphs (1) and (2).</text></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></section>
