<official-title>To amend the Public Health Service Act with respect to the National Vaccine Injury Compensation Program.</official-title>

<section section-type="section-one" id="H151CF7F089F74279BB061D09F3D7390" display-inline="no-display-inline"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>National Vaccine Injury Compensation Program Improvement Act of 2005</short-title></quote>.</text></section> 
<section id="H5F3D86938B8F4C17BB16253F83000723"><enum>2.</enum><header>Basis for calculating projected lost earnings</header><text display-inline="no-display-inline">Section 2115(a)(3)(B) of the <act-name parsable-cite="PHSA">Public Health Service Act</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/42/300aa-15">42 U.S.C. 300aa–15(a)(3)(B)</external-xref>) is amended by striking all that follows <quote>for loss of earnings</quote> and inserting the following: <quote>determined on the basis of the annual estimate of the average (mean) gross weekly earnings of full-time wage and salary workers age 18 and over in the private nonfarm sector (which includes all industries other than agricultural production of crops and livestock), as calculated annually by the Bureau of Labor Statistics from the quarter sample data of the Current Population Survey, or as calculated by such similar method as the Secretary may prescribe by regulation, less appropriate taxes and the average cost of a health insurance policy, as determined by the Secretary.</quote>.</text></section> 
<section id="H4AB59AA2E97E4ACFBD10733200F0AD7B"><enum>3.</enum><header>Increase of award in the case of a vaccine-related death</header><text display-inline="no-display-inline">Section 2115(a)(2) of the <act-name parsable-cite="PHSA">Public Health Service Act</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/42/300aa-15">42 U.S.C. 300aa–15(a)(2)</external-xref>) is amended by striking <quote>$250,000</quote> and inserting <quote>$300,000</quote>.</text></section> 
<section id="HB4F65426E08A4BDDAD00DD003E4F4CAB"><enum>4.</enum><header>Allowing compensation for family counseling expenses and expenses of establishing guardianship</header> 
<subsection id="HEE5D0D5630A2494CBAF28E492F93F4A0"><enum>(a)</enum><header>Family counseling expenses in post-1988 cases</header><text>Section 2115(a) of the <act-name parsable-cite="PHSA">Public Health Service Act</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/42/300aa-15">42 U.S.C. 300aa–15(a)</external-xref>) is amended by adding at the end the following:</text> 
<quoted-block act-name="Public Health Service Act" id="H09655AFA9C6547A3BFC9B7C63F79C192"> 
<paragraph id="HBA3DF82AF11A492781F12DFF6C9CE69"><enum>(5)</enum><text>Actual nonreimbursable expenses that have been or will be incurred for family counseling determined to be reasonably necessary and that result from the vaccine-related injury for which the petitioner seeks compensation.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection> 
<subsection id="HDF7C5F802E554FE4851EC09BB3C260BB"><enum>(b)</enum><header>Expenses of establishing guardianships in post-1988 cases</header><text>Section 2115(a) of the <act-name parsable-cite="PHSA">Public Health Service Act</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/42/300aa-15">42 U.S.C. 300aa–15(a)</external-xref>) is further amended by adding at the end the following paragraph:</text>

<paragraph id="HD53EA58A35C64CD48C70E526089ECF69"><enum>(6)</enum><text>Actual and nonreimbursable expenses that have been or will be incurred to establish and maintain a guardianship, conservatorship, or trust for an individual who has suffered a vaccine-related injury, including attorneys’ fees and other costs incurred in a proceeding to establish and maintain such a guardianship, conservatorship, or trust.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection> 
<subsection id="HD8C04D2066F84E86952505221DC29500"><enum>(c)</enum><header>Conforming amendment for cases from 1988 and earlier</header><text>Section 2115(b) of the <act-name parsable-cite="PHSA">Public Health Service Act</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/42/300aa-15">42 U.S.C. 300aa–15(b)</external-xref>) is amended—</text> 
<paragraph id="H6445F40D84134921A559668DF49D9488"><enum>(1)</enum><text>in paragraph (2), by striking <quote>and</quote> at the end of the paragraph;</text></paragraph> 
<paragraph id="HD3BE4D4AEE7C468F00BF239857DC438B"><enum>(2)</enum><text>by redesignating paragraph (3) as paragraph (5) and by inserting a closing parenthesis before the period in that paragraph; and</text></paragraph> 
<paragraph id="H27681CD862E04B4EB58CD90098759333"><enum>(3)</enum><text>by inserting after paragraph (2) the following paragraphs:</text>

<paragraph id="H97486E186ECC46FFA32C71269695CF1F"><enum>(3)</enum><text>family counseling expenses (as provided in paragraph (5) of subsection (a)),</text></paragraph> 
<paragraph id="HB3CDADD042FE46998FE41064D1BA69E"><enum>(4)</enum><text>expenses of establishing and maintaining guardianships, conservatorships, or trusts (as provided in paragraph (6) of subsection (a)), and</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection></section> 
<section id="HFA55D58A571C4A52AE27E618872C0146"><enum>5.</enum><header>Allowing payment of interim attorneys’ fees and costs</header><text display-inline="no-display-inline">Section 2115(e) of the <act-name parsable-cite="PHSA">Public Health Service Act</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/42/300aa-15">42 U.S.C. 300aa–15(e)</external-xref>) is amended by adding at the end the following:</text> 
<quoted-block act-name="Public Health Service Act" id="H6922795156784141AD5DD45EE48B3DE0"> 
<paragraph id="HE96B38DCC6A14482899E00EC00CE2C"><enum>(4)</enum><text>Upon completion of a conference required by Rule 5 of Appendix J of the Rules of the United States Court of Federal Claims, a special master may make an interim award of attorneys’ fees and costs if—</text> 
<subparagraph id="H42813E86C9AC4499AAC2C4B7E197989"><enum>(A)</enum><text>the case involves a vaccine administered on or after October 1, 1988,</text></subparagraph> 
<subparagraph id="H3A1A946BA42147F39070DAB308B9B784"><enum>(B)</enum><text>in tentative findings and conclusions, the special master determines that the petitioner’s claim has a reasonable basis,</text></subparagraph> 
<subparagraph id="H80C94324357043F9B78EE14C6DB097D3"><enum>(C)</enum><text>the award is limited to reasonable attorneys’ fees and other costs (within the meaning of paragraph (1)(B)) incurred in the proceeding, and</text></subparagraph> 
<subparagraph id="H0B45D309F80E4355B015A9416FCD87D"><enum>(D)</enum><text>the petitioner provides documentation verifying the expenditure of the amount for which compensation is sought.</text></subparagraph></paragraph> 
<paragraph id="H5C07337FC0C04C3BA46FCB9966F20053"><enum>(5)</enum><text>An interim award of attorneys’ fees and costs by a special master under paragraph (4) shall be promptly paid by the Secretary pursuant to the special master’s order and without need of a judgment. The special master’s order for interim attorneys’ fees and costs is not subject to review under sections 2112(e) and 2112(f) until after the special master has made a determination regarding an award of attorneys’ fees and costs under paragraph (1).</text></paragraph> 
<paragraph id="HE3D9E6C179CC454C9D6C53A33C3656FA"><enum>(6)</enum><text>The attorneys’ fees and costs awarded as compensation on a petition under paragraph (1) shall be for the total attorneys’ fees and costs incurred in any proceeding on such petition, less the amount awarded for interim attorneys’ fees and costs. In determining fees and costs under paragraph (1), a special master may reconsider and modify the amounts awarded for fees and costs under paragraph (4).</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></section> 
<section id="HEC8E1B9D2C244283B3EAA939E757F204"><enum>6.</enum><header>Procedure for paying attorneys’ fees</header><text display-inline="no-display-inline">Section 2115(e) of the <act-name parsable-cite="PHSA">Public Health Service Act</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/42/300aa-15">42 U.S.C. 300aa–15(e)</external-xref>), as amended by section 5, is amended by adding at the end the following:</text> 
<quoted-block act-name="Public Health Service Act" id="HF47BD2490CCA4B499BD4453614FE4321"> 
<paragraph id="HC9EC01B5B40E4572BC74DFB96697B81C"><enum>(7)</enum><text>When a special master or court awards attorneys’ fees or costs under paragraph (1) or (4), it may order that such fees and costs be payable solely to the petitioner’s attorney if—</text> 
<subparagraph id="HAB1DFEC167AC4F9D952EC168223CDA23"><enum>(A)</enum><text>the petitioner expressly consents, or</text></subparagraph> 
<subparagraph id="HA9B1A8210208491AA21FF05648CC7C84"><enum>(B)</enum><text>the special master or court, after affording to the Secretary and all interested persons the opportunity to submit relevant information, determines that—</text> 
<clause id="H20225EDD1A7F4562A2936971EC3CA209"><enum>(i)</enum><text>the petitioner cannot be located or refuses to respond to a request by the special master or court for information, and there is no practical alternative means to ensure that the attorney will be reimbursed for such fees and costs expeditiously, or</text></clause> 
<clause id="HBB279088DF684E87A312C77D99B58D80"><enum>(ii)</enum><text>there are other exceptional circumstances and good cause for paying such fees and costs solely to the petitioner’s attorney.</text></clause></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></section> 
<section id="H91CC177C7EFA48AB8D5DF308BBB15545"><enum>7.</enum><header>Extension of statute of limitations</header> 
<subsection id="H29D6454C1F7E422AA89FB4CB2DFA82C0"><enum>(a)</enum><header>General Rule</header><text>Section 2116(a) of the <act-name parsable-cite="PHSA">Public Health Service Act</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/42/300aa-16">42 U.S.C. 300aa–16(a)</external-xref>) is amended—</text> 
<paragraph id="HBB79EDA845764D7B8BC73F5E62FFA0C6"><enum>(1)</enum><text>in paragraph (2), by striking <quote>36 months</quote> and inserting <quote>6 years</quote>; and</text></paragraph> 
<paragraph id="H340F8BD1799F4D2CA59461BF08DCC68E"><enum>(2)</enum><text>in paragraph (3)—</text> 
<subparagraph id="H4457A0A820724998875E035B2B156266"><enum>(A)</enum><text>by striking <quote>24 months</quote> and inserting <quote>6 years</quote>; and</text></subparagraph> 
<subparagraph id="H2BA569426B90422EBB986C04B296E0E9"><enum>(B)</enum><text>by striking <quote>48 months</quote> and inserting <quote>6 years</quote>.</text></subparagraph></paragraph></subsection> 
<subsection id="HC4ED1A87C9444E4B8C6358D3EDD99202"><enum>(b)</enum><header>Additional extension</header> 
<paragraph id="HF7B383DDAD004AAC8CD13D4BFC6074B9"><enum>(1)</enum><header>Limitation period</header><text>Notwithstanding section 2116(a) of the <act-name parsable-cite="PHSA">Public Health Service Act</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/42/300aa-16">42 U.S.C. 300aa–16(a)</external-xref>), in the case of a vaccine set forth in the Vaccine Injury Table that is administered after September 30, 1988, and before the date of the enactment of this Act, if a vaccine-related injury or death occurred as a result of the administration of such vaccine, the end of the limitation period for filing a petition is the later of—</text> 
<subparagraph id="H7DD6AC305D60453990606F4906B92626"><enum>(A)</enum><text>the applicable date under section 2116(a) of the <act-name parsable-cite="PHSA">Public Health Service Act</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/42/300aa-16">42 U.S.C. 300aa–16(a)</external-xref>); or</text></subparagraph> 
<subparagraph id="HC13F53E86EBF478996DA73F33FE27E12"><enum>(B)</enum><text>the date that is 2 years after the date of the enactment of this Act.</text></subparagraph></paragraph> 
<paragraph id="H825AD254221847D4A6404B785760D5D6"><enum>(2)</enum><header>Effect of previous dismissal</header><text>Notwithstanding section 2111(b)(2) of the <act-name parsable-cite="PHSA">Public Health Service Act</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/42/300aa-11">42 U.S.C. 300aa–11(b)(2)</external-xref>), if a petition is filed within the limitation period applicable under paragraph (1), the petition may not be dismissed on the basis of a previous dismissal for untimely filing.</text></paragraph></subsection> 
<subsection id="H0B589B867E67464FB28F41DB3E2D5F02"><enum>(c)</enum><header>Claims based on revisions to table</header><text>Section 2116(b) of the <act-name parsable-cite="PHSA">Public Health Service Act</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/42/300aa-16">42 U.S.C. 300aa–16(b)</external-xref>) is amended by striking all that follows <quote>file a petition for such compensation</quote> and inserting the following:</text> 
<quoted-block act-name="Public Health Service Act" display-inline="yes-display-inline" id="H8298D94487A54843B8A044309E02DE5D"><text>if—</text> 
<paragraph id="H79045E6B377844CAB134378F98B8E3AD"><enum>(1)</enum><text>the vaccine-related death or injury with respect to which the petition is filed occurred no more than 8 years before the effective date of the revision of the table; and</text></paragraph> 
<paragraph id="H6FA68A95FEE440EC00FE3944174CAA63"><enum>(2)</enum> 
<subparagraph display-inline="yes-display-inline" id="HE7AD261728E14886A1439BA5F506D573"><enum>(A)</enum><text>the petition satisfies the conditions stated in subsection (a); or</text></subparagraph> 
<subparagraph indent="up1" id="H89C4EFCEEC764C27A9964344956200DA"><enum>(B)</enum><text>the date of occurrence of the first symptom or manifestation of onset of injury occurred more than 4 years before the petition is filed, and the petition is filed no more than 2 years after the effective date of the revision of the table.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection> 
<subsection id="H2DE6CC6952D749689ED2DB4659F4E27"><enum>(d)</enum><header>Reports</header> 
<paragraph id="HB85E7CB6DD2D4691B7723D3291B853D3"><enum>(1)</enum><header>Transmission</header><text>The Secretary of Health and Human Services shall transmit to the Congress 2 annual reports that shall each include the following:</text> 
<subparagraph id="H3BE2C2E8FC6948B8A25059AE713906A6"><enum>(A)</enum><text>Identification of the number of petitions filed for compensation under the National Vaccine Injury Compensation Program that would have been time-barred absent the limitation period provided by subsection (b).</text></subparagraph> 
<subparagraph id="H62333D65976643DC83A1162D344F2C27"><enum>(B)</enum><text>Describe the effects of subsection (b) on the ability of the Secretary to administer the National Vaccine Injury Compensation Program and adjudicate petitions under such Program in a timely manner.</text></subparagraph></paragraph> 
<paragraph id="H09E0442687B44A5D9501006871F792C7"><enum>(2)</enum><header>Dates of submission</header><text>In carrying out this subsection, the Secretary of Health and Human Services shall transmit—</text> 
<subparagraph id="H53DB88AF9A6E48CF9DA2C7593A06298"><enum>(A)</enum><text>the first report not later than 1 year after the date of the enactment of this Act; and</text></subparagraph> 
<subparagraph id="H48F8F29E2B424D0FA2DBAA1CC1191C3"><enum>(B)</enum><text>the second report not later than 2 years after the date of the enactment of this Act.</text></subparagraph></paragraph></subsection></section> 
<section id="H6CD93A1DA7E84502B45D23D9E5383889"><enum>8.</enum><header>Advisory commission on childhood vaccines</header> 
<subsection id="HC1E5FF41F150495AA2A203408F9C5005"><enum>(a)</enum><header>Selection of individuals injured by vaccines as public members</header><text>Section 2119(a)(1)(B) of the <act-name parsable-cite="PHSA">Public Health Service Act</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/42/300aa-19">42 U.S.C. 300aa–19(a)(1)(B)</external-xref>) is amended by striking all that follows the comma and inserting the following: <quote>of whom 1 shall be the legal representative of a child who has suffered a vaccine-related injury or death, and at least 1 other shall be either the legal representative of a child who has suffered a vaccine-related injury or death or an individual who has personally suffered a vaccine-related injury.</quote>.</text></subsection> 
<subsection id="H7311E2AD939B4A76B6836EA526D2839C"><enum>(b)</enum><header>Mandatory meeting schedule eliminated</header><text>Section 2119(c) of the <act-name parsable-cite="PHSA">Public Health Service Act</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/42/300aa-19">42 U.S.C. 300aa–19(c)</external-xref>) is amended by striking <quote>not less often than four times per year and</quote>.</text></subsection></section> 
<section id="HD2FCCB9D7AB64B6300279D7F6C8FCA31"><enum>9.</enum><header>Conforming amendment to Trust Fund provision</header><text display-inline="no-display-inline"><external-xref legal-doc="usc" parsable-cite="usc/26/9510">Section 9510(c)(1)(A)</external-xref> of the Internal Revenue Code of 1986 is amended by striking <quote>(as in effect</quote> and all that follows through <quote>for vaccine-related injury or death</quote> and inserting <quote>(as in effect on the effective date of the <short-title>National Vaccine Injury Compensation Program Improvement Act of 2005</short-title>) for vaccine-related injury or death</quote>.</text></section> 
<section id="H2DF6F2682395465E99CC77384FB0A8DC"><enum>10.</enum><header>Increase in limit on administrative expenses</header> 
<subsection id="H7EC32CB417D940E8B35009F489431439"><enum>(a)</enum><header>Increase in limit on administrative expenses</header><text><external-xref legal-doc="usc" parsable-cite="usc/26/9510">Section 9510(c)(1)(B)</external-xref> of the Internal Revenue Code of 1986 is amended by striking <quote>(but not in excess of $9,500,000 for any fiscal year)</quote> and inserting <quote>(but not in excess of $10,000,000 for any fiscal year)</quote>.</text></subsection> 
<subsection id="HCDD2B0071B8147588CC79C03FBE217E"><enum>(b)</enum><header>Administrative expenses of bureau of public debt</header><text><external-xref legal-doc="usc" parsable-cite="usc/26/9510">Section 9510(c)(1)</external-xref> of the Internal Revenue Code of 1986, as amended by section 9 and subsection (a), is further amended—</text> 
<paragraph id="HEB79C1B879E24D9199E3D06EC0A737CC"><enum>(1)</enum><text>in subparagraph (A)(ii), by striking <quote>or</quote> at the end;</text></paragraph> 
<paragraph id="H07070321886D404CB98764B9B421CC62"><enum>(2)</enum><text>in subparagraph (B), by striking the period at the end and inserting <quote>, and</quote>; and</text></paragraph> 
<paragraph id="HF0EB64E6CADC49D593DC007E44AE65AB"><enum>(3)</enum><text>by adding at the end the following:</text> 
<quoted-block id="H3F0002392C0049A0AA00433D5CBD11EA"> 
<subparagraph id="H3D538C6DEED246DCAC2900F8EF49F27B"><enum>(C)</enum><text>the payment of administrative and personnel expenses that the Bureau of the Public Debt incurs for financial services for the Trust Fund.</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection></section> 
<section id="HA55D0D2A6E924EDFAB1CFEAA784218CB"><enum>11.</enum><header>Public service announcement campaign</header><text display-inline="no-display-inline">Section 2110(c) of the <act-name parsable-cite="PHSA">Public Health Service Act</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/42/300aa-10">42 U.S.C. 300aa–10(c)</external-xref>) is amended by striking the period at the end and inserting <quote>, including by conducting a public service announcement campaign.</quote>.</text></section> 
<section id="H77B14A6071DB40AFB347E958560875A4"><enum>12.</enum><header>Application</header><text display-inline="no-display-inline">The provisions of and amendments made by sections 2, 3, 4, 5, 6, 7, and 9 apply to a petition filed under section 2111 of the <act-name parsable-cite="PHSA">Public Health Service Act</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/42/300aa-11">42 U.S.C. 300aa–11</external-xref>) if the petition is pending on or filed after the date of the enactment of this Act.</text></section>
