<official-title>To provide loan forgiveness to social workers who work for child protective agencies.</official-title>

<section section-type="section-one" id="HA6F7661AC5E84664855FD0C653DF72B2" display-inline="no-display-inline"><enum>1.</enum><header>Findings</header><text display-inline="no-display-inline">Congress makes the following findings:</text>
<paragraph id="HC0B00CAF7A8641C499EA58C2BAA8983C"><enum>(1)</enum><text>Approximately 3,000,000 reports of child abuse and neglect must be investigated each year.</text></paragraph>
<paragraph id="H7850EE9D2C674BD3B6E6001E2B295100"><enum>(2)</enum><text>Approximately 1,000,000 of these reports are confirmed and require ongoing intervention.</text></paragraph>
<paragraph id="H9F18C381DBAD4715B1D4C7D777F37ED0"><enum>(3)</enum><text>On any given day in the United States, more than 500,000 children are being served outside their homes by the child welfare system.</text></paragraph>
<paragraph id="HB8474CB2F86C4F718288FEC38143069E"><enum>(4)</enum><text>These children are served in more than 150,000 foster homes and more than 5,000 residential programs.</text></paragraph>
<paragraph id="H035881F37C18475E8CABCC3FCED3DA6E"><enum>(5)</enum><text>The child welfare workforce crisis has developed as the result of the following 3 major factors:</text>
<subparagraph id="H4A5B69D6FD9D480C96AF9676048B10F3"><enum>(A)</enum><text>Overall low levels of unemployment and the resulting increase in competition for workers in all sectors of the economy.</text></subparagraph>
<subparagraph id="H2C04D98F5BE7434E85294542B5152E83"><enum>(B)</enum><text>The increasing numbers of children and families needing service coupled with the decreasing numbers of workers in the employment pool.</text></subparagraph>
<subparagraph id="H3628CC298B2242958EB76892E47966AD"><enum>(C)</enum><text>The relatively low pay and difficult working conditions that exist in many child welfare agencies.</text></subparagraph></paragraph>
<paragraph id="H3517E738AD6B433F9087E2A868E6A6D"><enum>(6)</enum><text>The vacancy rate in State child welfare agencies is 8.1 percent, and 14.3 percent for private agencies.</text></paragraph>
<paragraph id="H98035EDAE04B42C5A0DD768F4F7D75D1"><enum>(7)</enum><text>The overall turnover rate in child welfare agencies has doubled since 1991, to 13.9 percent in public agencies and to 46.5 percent in private agencies.</text></paragraph>
<paragraph id="H121BC330591040F7BFF86C504F977894"><enum>(8)</enum><text>The child welfare workforce crisis is real and is already compromising the ability of the child welfare system to effectively provide essential services to its children and families. In addition, analysis of trends indicates that the situation will worsen over the next decade. It is clear that steps must be taken now to encourage more workers to enter the child welfare services field and to improve the salaries, working conditions, and training of workers who provide these critically important services.</text></paragraph></section>
<section id="H9B0559BE0F6B47FDAB52F44E23481F00"><enum>2.</enum><header>Loan forgiveness for child welfare workers</header><text display-inline="no-display-inline">Part B of title IV of the <act-name parsable-cite="HEA65">Higher Education Act of 1965</act-name> is amended by inserting after section 428K (<external-xref legal-doc="usc" parsable-cite="usc/20/1078-11">20 U.S.C. 1078–11</external-xref>) the following:</text>

<section id="HFE39F6FA974643A49B6807B9688ED45B"><enum>428L.</enum><header>Loan forgiveness for child welfare workers</header>
<subsection id="H5387144806014403850090E3CFC88114"><enum>(a)</enum><header>Purpose</header><text>It is the purpose of this section—</text>
<paragraph id="HAA455C036F6647D088FD3FD8324008D8"><enum>(1)</enum><text>to bring more highly trained individuals into the child welfare profession; and</text></paragraph>
<paragraph id="H789828DF6018480BA3CE96FB2F7300C"><enum>(2)</enum><text>to keep more highly trained child welfare workers in the child welfare field for longer periods of time.</text></paragraph></subsection>
<subsection id="HD7881CBCAAF140679D2CAB13CA115381"><enum>(b)</enum><header>Definitions</header><text>In this section:</text>
<paragraph id="HB3DC1BCCD55942DE8C599689CDE0F5FA"><enum>(1)</enum><header>Child welfare services</header><text>The term <term>child welfare services</term> has the meaning given the term in section 425 of the <act-name parsable-cite="SSA">Social Security Act</act-name>.</text></paragraph>
<paragraph id="HD9672C8341F74C728DB222542C1F8FD2"><enum>(2)</enum><header>Child welfare agency</header><text>The term <term>child welfare agency</term> means the State agency responsible for administering subpart 1 of part B of title IV of the <act-name parsable-cite="SSA">Social Security Act</act-name> and any public or private agency under contract with the State agency to provide child welfare services.</text></paragraph>
<paragraph id="H4EFA822CA9DC4EB18D84EED6376028C7"><enum>(3)</enum><header>Institution of higher education</header><text>The term <term>institution of higher education</term> has the meaning given the term in section 101.</text></paragraph>
<paragraph id="HD23A41295C8A46CCA45D1C056DCBCED4"><enum>(4)</enum><header>State</header><text>The term <term>State</term> has the meaning given the term in section 1101(a)(1) of the <act-name parsable-cite="SSA">Social Security Act</act-name> for purposes of title IV of such Act, and includes an Indian tribe.</text></paragraph></subsection>
<subsection id="H1323B046059443B4BE5633E3D4557148"><enum>(c)</enum><header>Demonstration program</header>
<paragraph id="H0E7C190A411D470C8E6F0657A20048C8"><enum>(1)</enum><header>In general</header><text>The Secretary may carry out a demonstration program of assuming the obligation to repay, pursuant to subsection (d), a loan made, insured, or guaranteed under this part or part D (excluding loans made under sections 428B and 428C, or comparable loans made under part D) for any new borrower after the date of enactment of this section, who—</text>
<subparagraph id="H477ADC968C1B4C5ABBB759C400DBDEFA"><enum>(A)</enum><text>obtains a bachelor’s or master’s degree in social work;</text></subparagraph>
<subparagraph id="HCF522408AB134A699C449300E64E6C5D"><enum>(B)</enum><text>obtains employment in public or private child welfare services; and</text></subparagraph>
<subparagraph id="H7CDA331C1C7B4F3187E4A416392C45EC"><enum>(C)</enum><text>has worked full time as a social worker for 2 consecutive years preceding the year for which the determination is made.</text></subparagraph></paragraph>
<paragraph id="H46AD3499796840D59B391BA0B9BBD3A9"><enum>(2)</enum><header>Award basis; priority</header>
<subparagraph id="H923F617B2C6B4953AFD5D8141C8645E0"><enum>(A)</enum><header>Award basis</header><text>Subject to subparagraph (B), loan repayment under this section shall be on a first-come, first-served basis and subject to the availability of appropriations.</text></subparagraph>
<subparagraph id="HF5A35C2BFE894F73A8ED2700FA8128FB"><enum>(B)</enum><header>Priority</header><text>The Secretary shall give priority in providing loan repayment under this section for a fiscal year to student borrowers who received loan repayment under this section for the preceding fiscal year.</text></subparagraph></paragraph>
<paragraph id="HD4FE3574BA464409B1B303E4DA27578"><enum>(3)</enum><header>Outreach</header><text>The Secretary shall post a notice on a Department Internet web site regarding the availability of loan repayment under this section, and shall notify institutions of higher education regarding the availability of loan repayment under this section.</text></paragraph>
<paragraph id="HCE85511CEEC4427998080942000958CB"><enum>(4)</enum><header>Regulations</header><text>The Secretary is authorized to prescribe such regulations as may be necessary to carry out the provisions of this section.</text></paragraph></subsection>
<subsection id="H01AF026A0C2143FDA81DB8701748C8B3"><enum>(d)</enum><header>Loan repayment</header>
<paragraph id="H8B0972F1B7E94325B6BEC2A1BD350027"><enum>(1)</enum><header>In general</header><text>The Secretary shall assume the obligation to repay—</text>
<subparagraph id="HB3757A7F78B3471F8BD3ABD41903F0B0"><enum>(A)</enum><text>after the third consecutive year of employment described in subsection (c)(1)(C), 20 percent of the total amount of all loans made under this part or part D (excluding loans made under section 428B or 428C, or comparable loans made under part D) for any new borrower after the date of enactment of this section;</text></subparagraph>
<subparagraph id="H965A4B1EED7243F48E697E21952C93A"><enum>(B)</enum><text>after the fourth consecutive year of such employment, 30 percent of the total amount of such loans; and</text></subparagraph>
<subparagraph id="H0C7B5D04CE714FBD98964811A9F9C826"><enum>(C)</enum><text>after the fifth consecutive year of such employment, 50 percent of the total amount of such loans.</text></subparagraph></paragraph>
<paragraph id="HCB274CCF3F7243A08C115168F6FFD314"><enum>(2)</enum><header>Construction</header><text>Nothing in this section shall be construed to authorize the refunding of any repayment of a loan made under this part or part D.</text></paragraph>
<paragraph id="H72BA7DE6B66B48A493A8F8B7ECAEAD00"><enum>(3)</enum><header>Interest</header><text>If a portion of a loan is repaid by the Secretary under this section for any year, the proportionate amount of interest on such loan which accrues for such year shall be repaid by the Secretary.</text></paragraph>
<paragraph id="HF842FD3F61C24F08B4CE47453D4F3812"><enum>(4)</enum><header>Special rule</header><text>In the case of a student borrower not participating in loan repayment pursuant to this section who returns to an institution of higher education after graduation from an institution of higher education for the purpose of obtaining a degree described in subsection (c)(1)(A), the Secretary is authorized to assume the obligation to repay the total amount of loans made under this part or part D incurred for a maximum of 2 academic years in returning to an institution of higher education for the purpose of obtaining such a degree. Such loans shall only be repaid for borrowers who qualify for loan repayment pursuant to the provisions of this section, and shall be repaid in accordance with the provisions of paragraph (1).</text></paragraph>
<paragraph id="H7D69475812BB45A3B2039D8BF92D1F96"><enum>(5)</enum><header>Ineligibility of national service award recipients</header><text>No student borrower may, for the same service, receive a benefit under both this section and subtitle D of title I of the National and Community Service Act of 1990 (<external-xref legal-doc="usc" parsable-cite="usc/42/12601">42 U.S.C. 12601 et seq.</external-xref>).</text></paragraph></subsection>
<subsection id="H4959F381684646B3A0A1DA2CAFB7C12"><enum>(e)</enum><header>Repayment to eligible lenders</header><text>The Secretary shall pay to each eligible lender or holder for each fiscal year an amount equal to the aggregate amount of loans which are subject to repayment pursuant to this section for such year.</text></subsection>
<subsection id="H4F80ECD6269A48DF9BCB1986FA4854F0"><enum>(f)</enum><header>Application for repayment</header>
<paragraph id="HB14113667F9A49128D672983D4BD2F47"><enum>(1)</enum><header>In general</header><text>Each eligible individual desiring loan repayment under this section shall submit a complete and accurate application to the Secretary at such time, in such manner, and containing such information as the Secretary may require.</text></paragraph>
<paragraph id="HB53354ADF8C044B9A26EF866F7DE3521"><enum>(2)</enum><header>Conditions</header><text>An eligible individual may apply for loan repayment under this section after completing each year of qualifying employment. The borrower shall receive forbearance while engaged in qualifying employment unless the borrower is in deferment while so engaged.</text></paragraph></subsection>
<subsection id="H9A21A094B1F24FC296D0007E3088B8E3"><enum>(g)</enum><header>Evaluation</header>
<paragraph id="H60B002553F2A45A4BBD7ED791BBDAD6"><enum>(1)</enum><header>In general</header><text>The Secretary shall conduct, by grant or contract, an independent national evaluation of the impact of the demonstration program assisted under this section on the field of child welfare services.</text></paragraph>
<paragraph id="HD2BF9D5C46644C45B5E3C95C1E261655"><enum>(2)</enum><header>Competitive basis</header><text>The grant or contract described in paragraph (1) shall be awarded on a competitive basis.</text></paragraph>
<paragraph id="HFF6CB13C89C3485BAB13665D6505209D"><enum>(3)</enum><header>Contents</header><text>The evaluation described in this subsection shall determine—</text>
<subparagraph id="H8DB8CDC65622482F8E90EC42CAC95C40"><enum>(A)</enum><text>whether the loan forgiveness program has increased child welfare workers’ education in the areas covered by loan forgiveness;</text></subparagraph>
<subparagraph id="H2D6E1222E0EF4B9FB1CBF3E9D53CC9E5"><enum>(B)</enum><text>whether the loan forgiveness program has contributed to increased time on the job for child welfare workers as measured by—</text>
<clause id="H9AE0E1EB53564D5EACFBCBC66F357932"><enum>(i)</enum><text>the length of time child welfare workers receiving loan forgiveness have worked in the child welfare field; and</text></clause>
<clause id="H5B52C7738B8242C6B1FDDCB9FC6C055E"><enum>(ii)</enum><text>the length of time such workers continue to work in such field after the workers meet the requirements for loan forgiveness under this section; and</text></clause></subparagraph>
<subparagraph id="H6D6BDF4562A444B7A38BA59D23E2B6B"><enum>(C)</enum><text>whether the loan forgiveness program has increased the experience and the quality of child welfare workers and has contributed to increased performance in the outcomes of child welfare services in terms of child well-being, permanency, and safety, as determined after consultation with the Secretary of Health and Human Services.</text></subparagraph></paragraph>
<paragraph id="H454DFB6EDE3E4333B379F4BF300429E3"><enum>(4)</enum><header>Interim and final evaluation reports</header><text>The Secretary shall prepare and submit to the President and Congress such interim reports regarding the evaluation described in this subsection as the Secretary determines appropriate, and shall prepare and so submit a final report regarding the evaluation by September 30, 2005.</text></paragraph></subsection>
<subsection id="H2E3B12F3154747E788C3FDD62AB3F86"><enum>(h)</enum><header>Authorization of appropriations</header><text>There are authorized to be appropriated to carry out this section $20,000,000 for fiscal year 2006, and such sums as may be necessary for each of the 4 succeeding fiscal years.</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></section>
