<official-title>To amend title 11 of the United States Code to limit the exemption for asset protection trusts.</official-title>

<section id="idB705FE76C89F40AB8DB8277D0204C8F5" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Billionaire's Loophole Elimination Act</short-title></quote>.</text> </section>
<section id="id2F0B9789488240BD85014F0566BB308B" section-type="subsequent-section"><enum>2.</enum><header>Asset protection trusts</header><text display-inline="no-display-inline"><external-xref legal-doc="usc" parsable-cite="usc/11/548">Section 548</external-xref> of title 11, United States Code, is amended by adding at the end the following:</text>

<subsection id="id7922B6AC8416430E9279EF0340ECA853"><enum>(e)</enum>
<paragraph commented="no" display-inline="yes-display-inline" id="idB1A242E9E44E46D8995151CDD33D3F57"><enum>(1)</enum><text>The trustee may avoid a transfer of an interest of the debtor in property made by an individual debtor within 10 years before the date of the filing of the petition to an asset protection trust if the amount of the transfer or the aggregate amount of all transfers to the asset protection trust within such 10-year period exceeds $125,000, to the extent that the debtor's beneficial interest in the trust does not become property of the estate by reason of section 541(c)(2).</text> </paragraph>
<paragraph id="idEFE80583DA3C4A50949C2EF95C1EAC43" indent="up1"><enum>(2)</enum><text>An asset protection trust is a trust settled by the debtor, in which the debtor has a direct or indirect beneficial interest or under which the trustee may distribute property to or for the benefit of the debtor, and as to which a restriction on the voluntary or involuntary transfer of the debtor's beneficial interest in the trust is enforceable under applicable nonbankruptcy law. For purposes of this subsection, the following are not asset protection trusts:</text> 
<subparagraph id="idCCF11867E5234E1E8D97DE9898BBA82A"><enum>(A)</enum><text>Retirement funds to the extent that those funds are in a fund or account that is exempt from taxation under section 401, 403, 408, 408A, 414, 457, or 501(a) of the Internal Revenue Code of 1986.</text> </subparagraph>
<subparagraph id="idF6A68CB7756C4E72944E98C6025129AA"><enum>(B)</enum><text>Charitable trusts.</text> </subparagraph>
<subparagraph id="id2DBF2CC2C50F4D26830A0F9196EEA3EE"><enum>(C)</enum><text>Qualified trusts under <external-xref legal-doc="usc" parsable-cite="usc/26/529">section 529</external-xref> of the Internal Revenue Code of 1986, and other educational trusts, funds, or accounts.</text> </subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block> </section>
