<official-title>To amend the National Labor Relations Act to ensure that certain prevailing parties receive attorneys’ fees.</official-title>

<section section-type="section-one" id="HAF45B0E9D6E5435F8EC1B50088AEDAD" display-inline="no-display-inline"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Working Families Access to Justice Act of 2005</short-title></quote>.</text></section> 
<section id="H2185BB7679184BD188958F25C2D0E8D0"><enum>2.</enum><header>Amendment to National Labor Relations Act</header><text display-inline="no-display-inline">The National Labor Relations Act (29 U.S.C. 151 and following) is amended by adding at the end the following:</text>

<section id="HEF9D2E296511430489FBBF98B791CDDC"><enum>20.</enum><header>Awards of attorneys’ fees and costs</header> 
<subsection id="H069AB8FC69CF406FA3FB371C64D03351"><enum>(a)</enum><header>Administrative proceedings</header><text>An employer who, or a labor organization that—</text> 
<paragraph id="HEF863A5955CD4592B003940566F79D00"><enum>(1)</enum><text>is the prevailing party in an adversary adjudication conducted by the Board under this or any other Act, and</text></paragraph> 
<paragraph id="H6700D4C1DFA04B678E8F08462B542FD1"><enum>(2)</enum><text>had not more than 100 employees and a net worth of not more than $7,000,000 at the time the adversary adjudication was initiated,</text></paragraph><continuation-text continuation-text-level="subsection">shall be awarded fees and other expenses as a prevailing party under <external-xref legal-doc="usc" parsable-cite="usc/5/504">section 504</external-xref> of title 5, United States Code, in accordance with the provisions of that section, but without regard to whether the position of the Board was substantially justified or special circumstances make an award unjust. For purposes of this subsection, the term <quote>adversary adjudication</quote> has the meaning given that term in <external-xref legal-doc="usc" parsable-cite="usc/5/504">section 504(b)(1)(C)</external-xref> of title 5, United States Code.</continuation-text></subsection> 
<subsection id="H2E93A9F0E4BB4D40982DD272FC58C4A1"><enum>(b)</enum><header>Court proceedings</header><text>An employer who, or a labor organization that—</text> 
<paragraph id="H8C314493B3504964BD5DFC447BBF6913"><enum>(1)</enum><text>is the prevailing party in a civil action, including proceedings for judicial review of agency action by the Board, brought by or against the Board, and</text></paragraph> 
<paragraph id="HD2A5044753D64265ADD78813D75B8104"><enum>(2)</enum><text>had not more than 100 employees and a net worth of not more than $7,000,000 at the time the civil action was filed,</text></paragraph><continuation-text continuation-text-level="subsection">shall be awarded fees and other expenses as a prevailing party under <external-xref legal-doc="usc" parsable-cite="usc/28/2412">section 2412(d)</external-xref> of title 28, United States Code, in accordance with the provisions of that section, but without regard to whether the position of the United States was substantially justified or special circumstances make an award unjust. Any appeal of a determination of fees pursuant to subsection (a) or this subsection shall be determined without regard to whether the position of the United States was substantially justified or special circumstances make an award unjust.</continuation-text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></section> 
<section id="H10CFEC7DD0F647C7ADE038520091E2CD"><enum>3.</enum><header>Applicability</header> 
<subsection id="HFB8B924A404349329D30A8A799568E68"><enum>(a)</enum><header>Agency proceedings</header><text>Subsection (a) of section 20 of the National Labor Relations Act, as added by section 2 of this Act, applies to agency proceedings commenced on or after the date of the enactment of this Act.</text></subsection> 
<subsection id="H61F9A5C4EC974A6C8CE741FBCB5E00BD"><enum>(b)</enum><header>Court proceedings</header><text>Subsection (b) of section 20 of the National Labor Relations Act, as added by section 2 of this Act, applies to civil actions commenced on or after the date of the enactment of this Act.</text></subsection></section>
