<official-title>To amend the Public Works and Economic Development Act of 1965 to provide assistance to communities for the redevelopment of brownfield sites.</official-title>

<section id="H7E0200B344374919B01D5248006E1700" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Brownfield Redevelopment Assistance Act of 2005</short-title></quote>.</text></section> 
<section id="H40FF93C2032C4D50ACBC6509FB4D69F"><enum>2.</enum><header>Purposes</header><text display-inline="no-display-inline">Consistent with section 2 of the Public Works and Economic Development Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/42/3121">42 U.S.C. 3121</external-xref>), the purposes of this Act are—</text> 
<paragraph id="H927763204EF24B6EA5862300AA0004CF"><enum>(1)</enum><text>to provide targeted assistance, including planning assistance, for projects that promote—</text> 
<subparagraph id="H5F11BC9286394103A0C285CC61E9E1CC"><enum>(A)</enum><text>the redevelopment, restoration, and economic recovery of brownfield sites; and</text></subparagraph> 
<subparagraph id="HFF41B3F3A2E244B4AF1ED19E3013D343"><enum>(B)</enum><text>eco-industrial development; and</text></subparagraph></paragraph> 
<paragraph id="H0C3C595123DB478399CC1635A1814693"><enum>(2)</enum><text>through such assistance, to further the goals of restoring the employment and tax bases of, and bringing new income and private investment to, distressed communities that have not participated fully in the economic growth of the United States because of a lack of an adequate private sector tax base to support essential public services and facilities.</text></paragraph></section> 
<section id="H6E63CCFE8E3E4586B9BD9E8C85E8D548"><enum>3.</enum><header>Definitions</header><text display-inline="no-display-inline">Section 3 of the Public Works and Economic Development Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/42/3122">42 U.S.C. 3122</external-xref>) is amended—</text> 
<paragraph id="H460527CC185141EE88A7D800FF451E46"><enum>(1)</enum><text>by redesignating paragraphs (1), (2), and (3) through (12) as paragraphs (2), (3), and (5) through (14), respectively;</text></paragraph> 
<paragraph id="HDA410621D51F49EC9757EDA83205D69"><enum>(2)</enum><text>by inserting before paragraph (2) (as so redesignated) the following:</text>

<paragraph id="H62C9EF742D9F41C88F45791891CCC64E"><enum>(1)</enum><header>Brownfield site</header><text>The term <quote>brownfield site</quote> means a brownfield site (as defined in section 101 of the Comprehensive Environmental Response, Compensation, and Liability Act of 1980 (<external-xref legal-doc="usc" parsable-cite="usc/42/9601">42 U.S.C. 9601</external-xref>)) with respect to which an entity has received, or is eligible to receive, funding under section 104(k) of that Act (<external-xref legal-doc="usc" parsable-cite="usc/42/9604">42 U.S.C. 9604(k)</external-xref>) for site characterization, assessment, or remediation.</text></paragraph><after-quoted-block>;</after-quoted-block></quoted-block></paragraph> 
<paragraph id="HC1398AC4376D4D78BB469EDD64E47332"><enum>(3)</enum><text>by inserting after paragraph (3) (as redesignated by paragraph (1)) the following:</text> 
<quoted-block id="HD4DB6D27E0F44CEE9605F257E200126" style="OLC"> 
<paragraph id="H91DB183C35A8447EB1EF42E779082320"><enum>(4)</enum><header>Eco-industrial development</header><text>The term <quote>eco-industrial development</quote> means development conducted in a manner in which businesses cooperate with each other and the local community to efficiently share resources (such as information, materials, water, energy infrastructure, and natural habitat) with the goals of—</text> 
<subparagraph id="H9304C21223C54B70B808981DE0AC6003"><enum>(A)</enum><text>economic gains;</text></subparagraph> 
<subparagraph id="H4050D5D3A4694E4D952FF43EB69CE4D7"><enum>(B)</enum><text>improved environmental quality; and</text></subparagraph> 
<subparagraph id="HDC90617E37EC43FEBD8276EC2BBD2BE7"><enum>(C)</enum><text>equitable enhancement of human resources in businesses and local communities.</text></subparagraph></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block></paragraph> 
<paragraph id="H1866F828F8164C258299E001522FB149"><enum>(4)</enum><text>by adding at the end the following:</text> 
<quoted-block id="HB361E55E93B94537A4619E1E45A64076" style="OLC"> 
<paragraph id="HED78453E2B8546B095F2F86C8BCBD218"><enum>(15)</enum><header>Unused land</header><text>The term <quote>unused land</quote> means any publicly-owned or privately-owned unused, underused, or abandoned land that is not contributing to the quality of life or economic well-being of the community in which the land is located.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section> 
<section id="HFC20E6E8B26C4F18000493124B1E4773"><enum>4.</enum><header>Coordination</header><text display-inline="no-display-inline">Section 103 of the Public Works and Economic Development Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/42/3132">42 U.S.C. 3132</external-xref>) is amended by adding at the end the following:</text>

<subsection id="H5F251628F83D4565A92481F1156F9F22"><enum>(c)</enum><header>Brownfield site redevelopment</header><text>The Secretary shall coordinate activities relating to the redevelopment of brownfield sites and the promotion of eco-industrial development under this Act with other Federal agencies, States, local governments, consortia of local governments, Indian tribes, nonprofit organizations, and public-private partnerships.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block> </section> 
<section id="H74EDDE03B09B4D2300301BA55DE4668C"><enum>5.</enum><header>Grants for brownfield site redevelopment</header> 
<subsection id="HDE8706ECAB2D4276BC0033D8B95935DE"><enum>(a)</enum><header>In general</header><text>Title II of the Public Works and Economic Development Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/42/3141">42 U.S.C. 3141 et seq.</external-xref>) is amended by adding at the end the following:</text> 
<quoted-block id="H4355A90BF6D84CBD934CBDC3F200AD82" style="OLC"> 
<section id="HBE82D951544E4A6586AADBD3C9FD1F68"><enum>219.</enum><header>Grants for brownfield site redevelopment</header> 
<subsection id="HFA46D41E58474431B4A8F1944C811982"><enum>(a)</enum><header>In general</header><text>On the application of an eligible recipient, the Secretary may make grants for projects to alleviate or prevent conditions of excessive unemployment, underemployment, blight, and infrastructure deterioration associated with brownfield sites, including projects consisting of—</text> 
<paragraph id="HDAB438FB81DE4E53B9BD3EB2DF295549"><enum>(1)</enum><text>the development of public facilities;</text></paragraph> 
<paragraph id="H553385D24F874147A006D800332FE618"><enum>(2)</enum><text>the development of public services;</text></paragraph> 
<paragraph id="H426D52852C6D4B25A19951AEA2AFF607"><enum>(3)</enum><text>business development (including funding of a revolving loan fund);</text></paragraph> 
<paragraph id="H87C2B1302FA94714A9A79B257EEA368D"><enum>(4)</enum><text>planning;</text></paragraph> 
<paragraph id="H3150F2BE982F4AFF918E60E300098972"><enum>(5)</enum><text>technical assistance;</text></paragraph> 
<paragraph id="H146563EFCFE6445F9F63AE00CC3E6F59"><enum>(6)</enum><text>training; and</text></paragraph> 
<paragraph id="H241BF1AA607E4999BBF3D8587CE97C6"><enum>(7)</enum><text>the purchase of environmental insurance with respect to an activity described in any of paragraphs (1) through (3).</text></paragraph></subsection> 
<subsection id="H1498837726174C330035309CFC2DC08D"><enum>(b)</enum><header>Criteria for grants</header><text>The Secretary may provide a grant for a project under this section only if—</text> 
<paragraph id="HE39B348946284CEEA83E00486CBCF3E4"><enum>(1)</enum><text>the Secretary determines that the project will assist the area where the project is or will be located to meet, directly or indirectly, a special need arising from—</text> 
<subparagraph id="H859A5615B673410FA45C10F800CB93BC"><enum>(A)</enum><text>a high level of unemployment or underemployment, or a high proportion of low-income households;</text></subparagraph> 
<subparagraph id="H3D2DADA91EAC45C2A7E5054924AEDECC"><enum>(B)</enum><text>the existence of blight and infrastructure deterioration;</text></subparagraph> 
<subparagraph id="H3321CEE8EF4844849903A84100027B62"><enum>(C)</enum><text>dislocations resulting from commercial or industrial restructuring;</text></subparagraph> 
<subparagraph id="H202EDB0F98584167B9132F51AF28B600"><enum>(D)</enum><text>outmigration and population loss, as indicated by—</text> 
<clause id="HAC55FAE6F85C4CAA86DF80870C2B779"><enum>(i)</enum> 
<subclause id="H0CC995D779574CBCAEA031DBD17E07E4" display-inline="yes-display-inline"><enum>(I)</enum><text>depletion of human capital (including young, skilled, or educated populations);</text></subclause> 
<subclause id="H1BB712B7897D433F9EB566E95C4CD247"><enum>(II)</enum><text>depletion of financial capital (including firms and investment); or</text></subclause> 
<subclause id="HBAA650FA3A32492885B502D671DDE385"><enum>(III)</enum><text>a shrinking tax base; and</text></subclause></clause> 
<clause id="HAF1BBE9DA6374C148351F7C1AF6C34C2"><enum>(ii)</enum><text>resulting—</text> 
<subclause id="HD72261B2350143EA91834049F85B87F"><enum>(I)</enum><text>fiscal pressure;</text></subclause> 
<subclause id="HC49599C9E44643BC9E9867D07FF364FE"><enum>(II)</enum><text>restricted access to markets; and</text></subclause> 
<subclause id="HB5762CF9DEC94F2B899FADF516AD28B"><enum>(III)</enum><text>constrained local development potential; or</text></subclause></clause></subparagraph> 
<subparagraph id="H124C1682991F4205006B0075B9BFD100"><enum>(E)</enum><text>the closure or realignment of—</text> 
<clause id="HC6052A426AA0418FA49E9361047CDF21"><enum>(i)</enum><text>a military or Department of Energy installation; or</text></clause> 
<clause id="H57EDAD3A3C654A9B995D6150CC1571F0"><enum>(ii)</enum><text>any other Federal facility; and</text></clause></subparagraph></paragraph> 
<paragraph id="HAEF6D75BBEE944CF9D17DDCFFCEBBEE1"><enum>(2)</enum><text>except in the case of a project consisting of planning or technical assistance—</text> 
<subparagraph id="H049FD956BEAF49ED8CB2D87C338C01F7"><enum>(A)</enum><text>the Secretary has approved a comprehensive economic development strategy for the area where the project is or will be located; and</text></subparagraph> 
<subparagraph id="HA58685BB118346FA944B25C100141053"><enum>(B)</enum><text>the project is consistent with the comprehensive economic development strategy.</text></subparagraph></paragraph></subsection> 
<subsection id="H0B3915117DE94575A234A6C3862215CC"><enum>(c)</enum><header>Particular community assistance</header><text>Assistance under this section may include assistance provided for activities identified by a community, the economy of which is injured by the existence of 1 or more brownfield sites, to assist the community in—</text> 
<paragraph id="H0D071F168F7D4F6BBEFA2CA52FB7FB02"><enum>(1)</enum><text>revitalizing affected areas by—</text> 
<subparagraph id="H66D000580E1C4CD79752FFCDCE083B5C"><enum>(A)</enum><text>diversifying the economy of the community; or</text></subparagraph> 
<subparagraph id="HF0A35A533326495A00B56D8487959DD9"><enum>(B)</enum><text>carrying out industrial or commercial (including mixed use) redevelopment, or eco-industrial development, projects on brownfield sites;</text></subparagraph></paragraph> 
<paragraph id="HD21D4153D1774EABA62EA2D92B049D7B"><enum>(2)</enum><text>carrying out development that conserves land by—</text> 
<subparagraph id="H9ADA0CA7104945DDA9434BAC59255899"><enum>(A)</enum><text>reusing existing facilities and infrastructure;</text></subparagraph> 
<subparagraph id="HD9DEA42216534E788409A987C01E7F6E"><enum>(B)</enum><text>reclaiming unused land and abandoned buildings; or</text></subparagraph> 
<subparagraph id="H70D61493BF984015AD5485AB68627BA"><enum>(C)</enum><text>promoting eco-industrial development, and environmentally responsible development, of brownfield sites; or</text></subparagraph></paragraph> 
<paragraph id="H6F97F47CAC0D4EB486842D5FFF07E717"><enum>(3)</enum><text>carrying out a collaborative economic development planning process, developed with broad-based and diverse community participation, that addresses the economic repercussions and opportunities posed by the existence of brownfield sites in an area.</text></paragraph></subsection> 
<subsection id="H08D7862747FD4F4F8C2C638DD395EA39"><enum>(d)</enum><header>Direct expenditure or redistribution by eligible recipient</header> 
<paragraph id="H40027349D5EF478E852C48017D45BED5"><enum>(1)</enum><header>In general</header><text>Subject to paragraph (2), an eligible recipient of a grant under this section may directly expend the grant funds or may redistribute the funds to public and private entities in the form of a grant, loan, loan guarantee, payment to reduce interest on a loan guarantee, or other appropriate assistance.</text></paragraph> 
<paragraph id="H96B40FC6B5F345AD87601C1CA48F6905"><enum>(2)</enum><header>Limitation</header><text>Under paragraph (1), an eligible recipient may not provide any grant to a private for-profit entity.</text></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block> </subsection> 
<subsection id="HB67D30A270F44C52AFCDA9D35C07403F"><enum>(b)</enum><header>Clerical amendment</header><text>The table of contents in section 1(b) of the Public Works and Economic Development Act of 1965 (42 U.S.C. prec. 3121) is amended by adding at the end of the items relating to title II the following:</text>

<toc-entry level="section">Sec. 219. Grants for Brownfield site redevelopment</toc-entry></toc><after-quoted-block>.</after-quoted-block></quoted-block></subsection> 
<subsection id="HB4CC34D6847540D3B14EF7CEBF16992F"><enum>(c)</enum><header>Conforming Repeal of Obsolete Report</header><text>Section 611 of such Act, and the item relating to such section in the table of contents in section 1(b) of such Act, are repealed.</text></subsection></section> 
<section id="H4523987057C0486187CCAEE6A8BE6F02"><enum>6.</enum><header>Authorization of appropriations</header> 
<subsection id="H66818B02C9D3401BBAEA02361C4C5D37"><enum>(a)</enum><header>In general</header><text>Title VII of the Public Works and Economic Development Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/42/3231">42 U.S.C. 3231 et seq.</external-xref>) is amended by adding at the end the following:</text>

<section id="HAD75AF9B630348859BFF7CA503114FD8"><enum>705.</enum><header>Authorization of appropriations for brownfield site redevelopment</header> 
<subsection id="HFEDBD5467CFF450BADD104CBF6567BA0"><enum>(a)</enum><header>In general</header><text>In addition to amounts made available under section 701, there is authorized to be appropriated to carry out section 219 $60,000,000 for each of fiscal years 2006 through 2010, to remain available until expended.</text></subsection> 
<subsection id="HC32AF146BE1F42A08428425B18171E86"><enum>(b)</enum><header>Federal share</header><text>Notwithstanding section 204, subject to section 205, the Federal share of the cost of activities funded with amounts made available under subsection (a) shall be not more than 75 percent.</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection>
